Digital forensic practitioners will encounter digital traces during their examinations which they must take steps to understand. This may involve trying to attribute an ‘activity’ to a trace (what created it) or determine where it came from (its ‘source’) – Trace-to-Activity/Source interpretation. Alternatively, they may need to determine if an activity has taken place on a system by identifying traces denoting it – Activity-to-Trace interpretation. In both instances, practitioners may need to conduct tests and/or identify research which will help them understand a trace, and compare any results of their testing/research to the traces in their casework. This work describes both the Trace-to-Activity/Source and Activity-to-Trace interpretive journeys, as well as the steps contained in both. In addition, six ‘trace comparison criteria’ are proposed and discussed to help those carrying out a trace comparison, notably: ‘trace location’, ‘trace structure’, ‘trace examination method’, ‘trace metadata’, ‘trace content’, and ‘trace context’. We investigate likelihood ratio models motivated by digital forensics problems involving time‐stamped user‐generated event data from a device or account. Of specific interest are scenarios where the data may have been generated by a single individual (the device/account owner) or by two different individuals (the device/account owner and someone else), such as instances in which an account was hacked or a device was stolen before being associated with a crime. Existing likelihood ratio methods in this context require that a precise time is specified at which the device or account is purported to have changed hands (the changepoint)—this is the known changepoint likelihood ratio model. In this paper, we develop a likelihood ratio model that instead accommodates uncertainty in the changepoint using Bayesian techniques, that is, an unknown changepoint likelihood ratio model. We show that the likelihood ratio in this case can be calculated in closed form as an expression that is straightforward to compute. In experiments with simulated changepoints using real‐world data sets, the results demonstrate that the unknown changepoint model attains comparable performance to the known changepoint model that uses a perfectly specified changepoint, and considerably outperforms the known changepoint model that uses a misspecified changepoint, illustrating the benefit of capturing uncertainty in the changepoint. Ground truth data (GTD) is used by those in the field of digital forensics (DF) for a variety of purposes including to evaluate the functionality of undocumented, new, or emerging technology and services and the digital traces left behind following their usage. Most accepted and reliable trace interpretations must be derived from an examination of relevant GTD, yet despite the importance of it to the DF community, there is little formal guidance available for supporting those who create it, to do so in a way that ensures any data is of good quality, reliable, and therefore usable. In an attempt to address this issue, this work proposes a minimum standard of documentation that must accompany the production of any GTD, particularly when it is intended for use in the process of discovering new knowledge, proposing original interpretations of a digital trace, or determining the functionality of any technology or service. A template structure is discussed and provided in Appendix S1 which sets out a minimum standard for metadata describing any GTD's production process and content. Purpose: This paper aims to identify impediments, discuss impediments and make recommendations for the impediments during the execution of a search and seizure warrant for digital evidence in South African criminal cases. Design/methodology/approach: The discussion of this article, the second article of two, focuses on a literature review of international and local impediments identified in case law and published research literature and how it is approached in various jurisdictions. Findings: This study found that impediments identified and addressed internationally during the execution of a search and seizure warrant for digital evidence are relevant to South African criminal cases and still need to be addressed during the execution of a search and seizure warrant for digital evidence in South African criminal cases. Research limitations/implications: Although searches and seizures for digital evidence are relevant to civil, regulatory and criminal investigations, this study focuses on the search and seizure for digital evidence in criminal matters with an emphasis on the provisions of the Criminal Procedure Act 51 of 1977 and the Cybercrimes Act 19 of 2020. Originality/value: The originality of this paper lies in the procedures followed during the physical search and seizure of digital information during the execution of search and seizure warrants for digital information in South Africa. If the South African Police Service follows the recommended procedures, it will contribute to the success of the South African Police Service, which would result in the improved quality of investigations and successful prosecution of crime in South Africa. Introduction: The Digital Measures Development: Core Measures of Sleep project, led by the Digital Medicine Society (DiMe), emphasizes the importance of sleep as a cornerstone of health and the need for standardized measurements of sleep and its disturbances outside the laboratory. This initiative recognizes the complex relationship between sleep and overall health, addressing it as both a symptom of underlying conditions and a consequence of therapeutic interventions. It aims to fill a crucial gap in healthcare by promoting the development of accessible, nonintrusive, and cost-effective digital tools for sleep assessment, focusing on factors important to patients, caregivers, and clinicians. Methods: A central feature of this project was an expert workshop conducted on April 19th, 2023. The workshop convened stakeholders from diverse backgrounds, including regulatory, payer, industry, academic, and patient groups, to deliberate on the project’s direction. This gathering focused on discussing the challenges and necessities of measuring sleep across various therapeutic areas, aiming to identify broad areas for initial focus while considering the feasibility of generalizing these measures where applicable. The methodological emphasis was on leveraging expert consensus to guide the project’s approach to digital sleep measurement. Results: The workshop resulted in the identification of seven key themes that will direct the DiMe Core Digital Measures of Sleep project and the broader field of sleep research moving forward. These themes underscore the project’s innovative approach to sleep health, highlighting the complexity of omni-therapeutic sleep measurement and identifying potential areas for targeted research and development. The discussions and outcomes of the workshop serve as a roadmap for enhancing digital sleep measurement tools, ensuring they are relevant, accurate, and capable of addressing the nuanced needs of diverse patient populations. Conclusion: The Digital Medicine Society’s Core Measures of Sleep project represents a pivotal effort to advance sleep health through digital innovation. By focusing on the development of standardized, patient-centric, and clinically relevant digital sleep assessment tools, the project addresses a significant need in healthcare. Cybercrime is growing rapidly, and it is increasingly important to use advanced tools to combat it and support investigations. One of the battlefronts is the forensic investigation of mobile devices to analyze their misuse and recover information. Mobile devices present numerous challenges, including a rapidly changing environment, increasing diversity, and integration with the cloud/IoT. Therefore, it is essential to have a secure and reliable toolbox that allows an investigator to thwart, discover, and solve all problems related to mobile forensics while deciphering investigations, whether criminal, civil, corporate, or other. In this work, we propose an original and innovative instantiation of a structure in a forensic toolbox for mobile devices, corresponding to a set of different applications, methods, and best practice information aimed at improving and perfecting the investigative process of a digital investigator. To ensure scientific support for the construction of the toolbox, the Design Science Research (DSR) methodology was applied, which seeks to create new and unique artifacts, drawing on the strength and knowledge of science and context. Objectives The purpose of the study is to comprehensively examine the interpretation of cybersex in the context of marital guilt, while assessing the implications and challenges of bringing such evidence to court. The article aims to navigate the interpretation and legal recognition of cybersex as grounds for divorce. Material and methods The study used methods used in legal science: 1) the dogmatic method, referring to the establishment of current legal regulations governing the rules of electronic evidence, including cybersex evidence, as well as the way they are used in divorce processes and their impact on the permanent and complete breakdown of marital relations; it has a dominant character in the study due to the fact that the authors focus on the analysis of current legal regulations, as well as their practical use and application in other countries (e.g., the USA and Canada). 2) The analytical method was applied with reference to the current state of knowledge in the subject area in the body of legal science. 3) The comparative legal method is of complementary importance and relates to the analysis of legal and organizational solutions to the use of so-called illegal evidence, as well as the difficulties of conducting evidence and regulations in other countries. 4) The historical method is related to the evolution of the development of the rules of evidence in civil litigation in view of the development and spread of the use of modern technological solutions in justice. Results The potential use of cybersex evidence in divorce proceedings in Civil Procedure, while complex, provides an opportunity for legal growth. Conclusions Incorporating cybersex evidence in divorce proceedings brings a set of challenges, especially related to the violation of privacy rights, data protection, and the potential for cybercrime.

Despite concerns having been voiced internationally about the validity and reliability of mobile phone evidence, there remain large gaps in our understanding of how police acquire and process mobile phone data, and the risks associated with this work. This paper fills some of these gaps by drawing upon qualitative data gathered during an ethnographic study of the role of forensic sciences and technologies in British homicide investigations. Specifically, we draw upon case papers, interviews, and observations to illuminate, from the perspective of police and prosecution actors, some of the opportunities, tensions, and risks encountered in accessing and processing mobile phone data during these inquiries. Our findings reveal several risks associated with current practice alongside broader complexities related to legislation, privatisation, and accreditation. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator's broad discretion to assess the evidence. As cybercrimes grow more sophisticated, network and cloud forensics have become vital investigative tools. However, complex legal, ethical, and practical challenges around extraterritorial evidence, privacy rights, volatile data, and specialized skills constrain these processes. This study critically reviews academic literature and industry reports to examine these multifaceted considerations holistically. It aims to aggregate the latest insights around regulations, technical protocols, certification regimes, and international cooperation frameworks shaping network and cloud forensics. The study follows qualitative research methodology, a doctrinal approach used for the analysis of regulation, and grounded theory used for the analysis of related literature. The results reveal gaps around the liability limitations of internet service and cloud providers, ethical bounds for ancillary data collection, and anti-forensic obfuscation techniques. Proposed solutions include accountability in technology design through transparency and oversight. Simplify procedures for cross-border legal assistance requests. The objective of the second protocol is to strengthen cooperation in cybercrime and the collection of electronic evidence of crimes for the purpose of specific criminal investigations or proceedings. The article also presents and analyzes the most important procedural aspects related to the second additional protocol to the Council of Europe Convention on cybercrime regarding enhanced cooperation and the disclosure of electronic evidence. Abstract Background Proper investigation of digital evidence is of prime significance in cyber investigations. From the collection of evidence, its preservation, and its analysis, it is important to maintain its integrity in the legal system due to the involvement of different stakeholders like law enforcement agencies, digital analysts, and the judiciary. This review paper focuses on how blockchain technology can be used to collect evidence efficiently. Main text In the present scenario, the manual logs of the chain of custody are used to ensure that the evidence remains confidential and transparent. It is accompanied by filling out the application forms and maintaining logs within the organization handling the evidence. Hence, it is important to ensure the validity, integrity, and verifiability of evidence as it moves through different hierarchical levels. There are certain issues associated with the current chain of custody, such as evidence loss, theft, tampering, and, even worse, evidence manipulation inside the system. To avoid this situation and to make the process coherent, this review paper aims to highlight the potential use of blockchain technology to preserve chain of custody. Conclusion Although this scientific technology is mainly used to run cryptocurrencies, with careful consideration and application, this could play a key role in supporting and managing the chain of custody. It is a distributed database that keeps track of blocks. These blocks are collection of entries that keep growing continually and are secured from editing and manipulation by retaining the hash of the previous block in the chain. This is a decentralized technology that is not easily compromised in terms of security and therefore has the potential to solve our problem area. A future research agenda needs to be established, which lays the solid foundation for further studies on this evident emerging area.

The proliferation of digital information presents both opportunities and challenges for the field of criminal procedure. Recognizing the growing importance of electronic evidence in criminal investigations, the Commission has taken proactive measures to streamline the process of obtaining such evidence. New rules have been introduced to facilitate the acquisition of electronic evidence by judicial authorities. Among these rules are provisions for the creation of a European Evidence Production Order and a European Preservation Order specifically tailored for electronic evidence in criminal cases. Furthermore, providers of electronic services operating within the European Union are now required to appoint a legal representative, further enhancing the accessibility of electronic evidence for legal proceedings. Despite these advancements, the utilization of digital evidence raises complex legal questions and challenges. This paper critically examines the various implications associated with the use of digital evidence, shedding light on issues such as authenticity, admissibility, and the preservation of digital evidence. By analyzing these aspects in depth, the paper aims to provide insights into the multifaceted nature of digital evidence and its implications for criminal procedure. In addition to addressing legal complexities, the paper also seeks to establish a foundational understanding of digital evidence by providing basic definitions and classifications. The objective of forensic analysis of cloud computing traffic is to identify any suspicious or malicious behavior in network activities within cloud computing settings. This includes examining network connections, data transfer patterns, and data payloads. To effectively analyze cloud computing traffic associated with IoT devices, it is imperative to understand cloud infrastructure and network protocols. The prevalence of IoT devices in cloud environments necessitates efficient forensic analysis techniques to address security incidents. Considering the distinctive attributes of IoT devices and the decentralized nature of cloud environments, this paper investigates the challenges and considerations related to forensic analysis in cloud computing systems incorporating IoT devices. The framework we present includes comprehensive guidelines about data collection, preservation, analysis, and forensic analysis in IoT-based cloud computing systems. As well as providing practical case studies, we demonstrate how our framework works in real-world scenarios involving IoT-based cloud computing. As the complexity of digital forensic work continues to grow, and the demands and pressures placed on practitioners to complete their investigatory commitments remain, methods for conducting effective and efficient work are of paramount importance. To combat examination challenges any investigating team requires two fundamental and linked components; those conducting DF examinations should develop (1) a digital evidence strategy (DES) that outlines an effective investigative approach, and, (2) deploy it using appropriate tools and techniques. While these should be considered as a pair, arguably as tools have become more comprehensive and more akin to "suites," there is a real risk that tools themselves are being considered an "examination strategy," bypassing the need for investigative forethought. Given this concern, through the vehicle of an example deconstructed hypothetical forensic examination process, this work discusses the relationship between DESs and digital forensic tools, and the importance of both. Law enforcement co‐ordination agencies have recently issued position/guidance documents relating to the potential for VR environments (the "Metaverse") to become new environment for criminal activity, and calling for additional work to enhance investigative capability. By reviewing the historic development of VR and comparing it with the appearance of the WWW, the authors propose that the situation is not as dire as the issued documents may suggest, but represents an evolutionary rather than revolutionary step in online experiences. Digital evidence is content that must be protected against access and use by parties who should not have the authority to do so. Some protection parameters for access to digital evidence must be implemented to ensure its integrity and authenticity. Access to digital evidence is not enough to be facilitated only with authorization and authentication mechanisms but must also be facilitated with other aspects of access by users according to their level of authority. One approach is to use the concept of access control. The study of access control to digital evidence is essential. However, studies on this matter are still limited. Among the many access control models, the application of access control based on attribute variations is a concept that can be applied to the context of access to digital evidence. This paper discusses policy design and modeling using attribute-based access control (ABAC) with four attributes: subject, resource, action, and environment. Then, it implements and tests various requests to the system based on attribute variations and possible algorithms. This study supports the security of digital evidence storage systems through access control to the resources it manages using the Policy Statement, Policy Modeling, Policy Implementation, and Policy Validation approaches. The application of the access control design shows that the ABAC concept has been successfully applied as an access control solution for digital evidence stored in digital evidence storage systems. The primary objective is to comprehensively dissect the multifaceted legal intricacies surrounding e-evidence, including its position and significance in Ukraine’s ongoing quest for European integration and its response to the persistent armed conflict. The article extensively examines the intricate complexities of e-evidence, exploring its pivotal role within the broader framework of procedural sources of evidence. It also scrutinises its interaction with traditional forms of evidence, shedding light on the evolving landscape of legal practices in a digital age. The article emphasises the urgent imperative for substantial enhancements in Ukraine’s legal framework governing e-evidence. The existing framework falls short of contemporary standards, posing substantial impediments to effective law enforcement and judicial prosecution in this era of rapid technological advancements. To ensure accountability for past transgressions and to sustain the principles of the rule of law during the post-war era, Ukraine must harmonise its legal system with modern approaches to handling e-evidence. In summary, this article offers a comprehensive and insightful analysis of the intricacies surrounding electronic evidence in the Ukrainian criminal justice system. It addresses critical legal dimensions, acknowledging their importance as Ukraine navigates a path towards integration with European legal standards and grapples with the ramifications of a prolonged armed conflict. After more than ten years of development, the application of blockchain has expanded beyond the financial field to include other sectors such as E-government and the medical field. One of the most renowned blockchain platforms is Hyperledger Fabric, which is widely adopted by existing works for managing digital evidences (D E s). However, these works overlook the distinct differences between D E s and token-transfer transactions and often adopt the full implementation of Hyperledger Fabric, leveraging chaincode to manage the hash of D E s while keeping the original data off-chain to conserve storage resources. This approach poses challenges such as off-chain data loss, reduced data verification efficiency, and increased resource consumption. In this paper, we introduce a lightweight storage mechanism called Blockchain Z h e n g j u Keeper (BZK) that addresses these issues. In BZK, we subtract Hyperledger Fabric by (1) modifying the endorsement policy to reduce the risk of off-chain data loss, (2) simplifying the D E upload-onchain process while keeping the parallel execution, and (3) abandoning chaincode for D E verification to reduce latency. Comprehensive simulation experiments demonstrate the practicality of the proposed mechanism.
