Our unsustainable use of nature is bringing the Earth system and its capacity to recover from global changes beyond the environmental boundaries that supported us as a society. Here, we discuss some urgent challenges that should be addressed for the human species to live with undesirable products resulting from its development : sustainable use of nitrogen, watersheds management for preserving water resources and their quality, environmental impact of plastics, increase of the resilience of marine ecosystems, restoration of the deteriorated marine coastal ecosystems, or the early detection of emergence of diseases. We advocate for the use of Nature based solutions to mitigate environmental problems, and also consider subjective wellbeing issues in the governance of societies for a future healthy planet.

CSIC white paper on Artificial Intelligence, Robotics and Data Science sketches a preliminary roadmap for addressing current R&D challenges associated with automated and autonomous machines. More than 50 research challenges investigated all over Spain by more than 150 experts within CSIC are presented in eight chapters. Chapter One introduces key concepts and tackles the issue of the integration of knowledge (representation), reasoning and learning in the design of artificial entities. Chapter Two analyses challenges associated with the development of theories –and supporting technologies– for modelling the behaviour of autonomous agents. Specifically, it pays attention to the interplay between elements at micro level (individual autonomous agent interactions) with the macro world (the properties we seek in large and complex societies). While Chapter Three discusses the variety of data science applications currently used in all fields of science, paying particular attention to Machine Learning (ML) techniques, Chapter Four presents current development in various areas of robotics. Chapter Five explores the challenges associated with computational cognitive models. Chapter Six pays attention to the ethical, legal, economic and social challenges coming alongside the development of smart systems. Chapter Seven engages with the problem of the environmental sustainability of deploying intelligent systems at large scale. Finally, Chapter Eight deals with the complexity of ensuring the security, safety, resilience and privacy-protection of smart systems against cyber threats.

In six decades of history, AI has become a mature and strategic discipline, successfully embedded in mainstream ICT and powering innumerable online applications and platforms. Several official documents stating specific AI policies have been produced by international organisations ( like the OCDE ), regional bodies ( EU ), several countries ( US, China, Spain, Germany, UK, Sweden, Brazil, Mexico...) as well as major AI-powered firms ( Google, Facebook, Amazon ). These examples demonstrate public interest and awareness of the economic and societal value of AI and the urgency of discussing the ethical, legal, economic and social implications of deploying AI systems on a massive scale. There is widespread agreement about the relevancy of addressing ethical aspects of AI, an urgency to demonstrate AI is used for the common good, and the need for better training, education and regulation to foster responsible research and innovation in AI. This chapter is organised around four main areas : ethics, law, economics and society ( ELES ). These areas shape the development of AI research and innovation, which in turn, influence these four areas of human activity. This interplay opens questions and demands new methods, objectives and ways to design future technologies. This chapter identifies the main impacts and salient challenges in each of these four areas.

[EN] Almost any property or state of things involved in the bioethical debate —as in everyday life and in most sciences— is likely to have fuzzy edges and borderline cases, lacking precise lines of demarcation, as happens in the case of euthanasia, abortion, embryonic research, hybrids, animal experimentation, etc. etc. However, there is a profound discrepancy between a continuous and gradual reality, characterised by nuances and transitions, a reality in grey, and a logic (an analysis and description of it) that is bivalent, between absolute truth and complete falsehood, in black and white or “all-or-nothing” terms. As an alternative to the ‘principle of bivalence’ that permeates the standard approach to reality in general and bioethics in particular, we maintain the ‘principle of gradualism’, which says that everything is a matter of degree and therefore a fuzzy-logic approach is an appropriate theoretical method in bioethics., [ES] Prácticamente cualquier propiedad o estado de cosas implicado en el debate bioético —así como en la vida cotidiana y en la mayoría de las ciencias— posee unos límites difusos y comprende casos fronterizos, sin unas líneas de demarcación precisas, como sucede con la eutanasia, el aborto, la investigación con embriones, los híbridos, la experimentación con animales, etc. Sin embargo, existe una profunda discordancia entre una realidad continua y gradual, caracterizada por los matices y las transiciones, una realidad en grises, y una lógica, un análisis descriptivo de esta realidad, bivalente, cifrado entre la verdad absoluta y la completa falsedad, en términos de “todo-o-nada”, blanco o negro. Como alternativa a este ‘principio de bivalencia’ que caracteriza en general el análisis estándar de la realidad y, en particular, de la bioética, sostenemos el ‘principio de gradualidad’ según el cual todo es cuestión de grado, por lo que un enfoque lógico-gradualista sería el método apropiado para la bioética.

Abordamos el estudio de los derechos humanos desde una dualidad para clasificarlos: derechos de bienestar y derechos de libertad. Los primeros estriban en que nos sea lícito disfrutar de algo de determinadas características. Los derechos de libertad estriban meramente en la simultánea licitud tanto de una conducta propia cuanto de la abstención correspondiente. En virtud de unas reglas de lógica jurídica los unos difieren de los otros tanto en las obligaciones que acarrean para los demás cuanto en las que para uno mismo comporta la titularidad del derecho correspondiente., We go into the study of human rights availing ourselves of a dichotomy, in order to sort them out: welfare rights and freedom rights. The former lie in the holder's licit enjoyment of something or other with certain characteristics. Freedom rights lie in a course of action and abstention thereof being both licit. In virtue of rules of legal logic, the former differ from the latter not only as regards other people's entailed duties but also concerning duties of the holder himself.

[EN] Million people live involved in the chronic circle of the disease and poverty and does not have access to the essential medicines that could alleviate or cure their diseases. The reason is double: the lack of research in diseases of the poorest (forgotten diseases) and the rigid system of pharmaceutical intellectual property (patents). Nevertheless, the right to primary health care and its corollary, the right to essential drugs, constitute the key of the fundamental and primary human right: the right to life. For that reason, the considerations of public health have to prioritize forehead to the logic of the market in the scope of the pharmaceutical investigation, looking for ways that promote the innovation and the companies’ viability along with the drug development and distribution for the greater number of patients., [ES] Millones de personas viven atrapadas en el círculo crónico de la enfermedad y la pobreza y no tienen acceso a los medicamentos esenciales que podrían aliviar o curar sus enfermedades. El motivo es doble: la falta de investigación en enfermedades de pobres (enfermedades olvidadas) y el rígido sistema de propiedad intelectual farmacéutica (patentes). Sin embargo, el derecho a la atención sanitaria primaria y su corolario, el derecho a los medicamentos esenciales, constituyen la piedra angular del derecho humano fundamental y primario: el derecho a la vida. Por ello, han de primarse las consideraciones de salud pública frente a la lógica del mercado en el ámbito de la investigación farmacéutica, buscando fórmulas que estimulen la innovación y la viabilidad empresarial junto con el desarrollo y la distribución de fármacos para el mayor número de enfermos.

Al hablar de Éticas aplicadas, pensamos casi siempre en Bioética y, cuando nos referimos a ésta, tenemos en mente algunas cuestiones de Ética médica. Sin embargo, las éticas especiales van mucho más allá de este marco, tanto por sus objetivos como por los métodos que utilizan; el análisis bioético tampoco se limita a las cuestiones que surgen de la práctica clínica, sino que tienen un amplio registro. De hecho, resulta difícil entender el origen de la Bioética, sus principales objetivos y su actual expansión hacia otros campos y en otros contextos culturales sin tener en cuenta el papel que siempre ha desempeñado la Ética de la investigación. Es más, la metodología y los resultados de la disciplina han estado definidos por el imperativo de proteger los derechos de los agentes, a fin de garantizar su salud y el respeto por las libertades fundamentales, ante los riesgos que pudieran derivarse del uso indebido de los avances científicos y técnicos. Por tanto, el horizonte de la práctica profesional, de los ensayos y de los proyectos de investigación ha de estar dentro del marco normativo, elaborado a lo largo de las últimas décadas a partir de los Derechos Humanos.

Al editar este número de Isegoría dedicado a «La razón jurídica», hemos de evocar las circunstancias que dieron lugar a su elaboración. Recién constituido el Grupo de Estudios Lógico-Jurídicos del CSIC (JuriLog), en abril de 2005, decidió organizar unas Jornadas anuales sobre «La razón jurídica». Las primeras se han celebrado en abril de 2006, con el tema: «La aplicación de la norma jurídica». Para abril de 2007 se prevén las segundas, dedicadas al tema «Globalización jurídica y paradigmas culturales»., El motivo que nos llevaba a escoger, para iniciar nuestra andadura, el citado tema de la aplicación es que uno de los más graves problemas en la ciencia y la filosofía jurídicas es el de entroncar lo normativo y lo fáctico. La norma no sólo ha de tener vigencia, sino también venir desarrollada y, a la postre, cumplida. La reiterada inaplicación de la norma no puede ser irrelevante para su validez, al menos si sucede durante un largo período y se extiende a un ámbito muy grande del ordenamiento jurídico.

[ES] Hay dos tipos de bienes y derechos: de bienestar y de libertad. Los primeros, irrenunciables, acarrean deberes positivos, de dar o hacer. Los derechos de libertad, en cambio, sólo imponen a otros deberes negativos, dejando a su titular libre para ejercerlos o no según quiera. Sostenemos que el derecho a la vida es un derecho de libertad. De ahí se sigue que no es obligatorio aceptar el don de la vida salvo cuando el ordenamiento permite a los progenitores presumir el futuro consentimiento retroactivo del nuevo ser humano por nacer. Cuando las circunstancias hagan irrazonable tal presunción, es ilícita toda acción causal que contribuya a ese nacimiento salvo únicamente la acción voluntaria y libre de la madre de no abortar --por ser ése un derecho suyo. Matizamos nuestra teoría y la articulamos en un enfoque gradualista que da cuenta de la existencia de conflictos jurídicos., [EN] There are two sorts of goods and rights; wellbeing rights and freedom rights. The latter may be renounced by the right-holder and enjoin abstention duties (or negative duties) upon other people. Wellbeing rights impose positive duties on other people and may not be relinquished by the right-holder. We claim that life is a freedom right. Therefore, there is in general no duty to live. The gift of life has to be accepted only insomuch as the presumption of future backwards acceptance by our parents was reasonable. When such is not the case, the new-born is entitled to claim that his right not to live was violated and to demand a compensation from any person, barring his or her mother, having causally contributed to his/her birth. We hedge our theory with several qualifications within the framework of a gradualistic approach to rights and duties.
