Southwestern Energy Co. faces with Arkansas Western Gas Co., its utility for natural gas, and SEECO Inc., its division for exploration operations, a complicated $60-million class-action lawsuit. The lawsuit, which is scheduled to go into trial starting on Sep. 28, 1998, in Fort Smith, AR's Sebastian County Circuit Court, charges that Southwestern Energy was allegedly involved in unjust enrichment, tortuous contractual-relations interference, fraud, civil conspiracy and violation of fair-dealing responsibilities and good faith. Southwestern Energy was accused of allegedly improving its transaction terms with Arkansas Western Gas by underpaying holders of royalty interests, who were contracted to supply Southwestern Energy's SEECO division with natural gas.

Southwestern Energy Co. of Fayetteville, AR, is attributing a loss of $42.1 million for the three months ended June 30, 1998 to an accounting correction. The company, ranked the worst-performing public firm in the state, said the bookkeeping correction is mainly due to the amortization of its oil and gas properties. Southwestern Energy said the write-down was called for since the firm utilizes the full-cost related to its oil and gas properties. The write-down amounted to $66.4 million and led to a decrease in the provision for deferred income taxes of $25.9 million.
