Abstract

The article examines the effect of peremptory norms of international law on immunity assertions. It explores the different implications of the doctrine of sovereign immunity for international communities. It also assesses the relevant U.S. case law involving foreign sovereign immunity and jus cogens and evaluates how domestic courts address the issue of immunity.
