Non-consensual dissemination of intimate images (NCII) is a growing problem of sexual violence with grave consequences for victims. However, despite recent criminalization and civil and legal sanctions, there is reason to suspect that the majority of NCII cases remain unreported. The reasons for that may be similar to the ones accounting for under-reporting in cases of physical sexual violence and are tied to society’s attitude toward victims. Being a relatively new form of violence, psychological research on perceptions of NCII victims and offenders is scarce. The purpose of the present study was to extend the current knowledge by comparing perceptions toward female and male victims of NCII, while manipulating the victim’s role in producing the intimate material. Drawing on rape research, it was hypothesized that gender stereotypes interact with victims’ sex and behavior to influence the way victims are perceived. Five-hundred and thirty-nine male and female students were presented with a scenario depicting an NCII offense in which the intimate material was either self-generated by the victim (selfies) or stealth-taken by the victim’s ex-intimate partner. Victim and offender sex were also manipulated. The findings indicate a differential treatment toward female and male victims of NCII, depending on their role in the taking of the intimate images. More blaming was attributed toward a female victim whose intimate images were self-taken, in comparison to all other research conditions, and negative feelings toward her were the highest as well. These blame attributions, as well as negative feelings toward female victims, were particularly high on the side of male participants. The findings are interpreted as reflecting perceptions of traditional gender roles and a double standard toward female and male sexual behavior.

While responses to non-consensual intimate image distribution (NCIID) often highlight criminal law remedies, little is known about how young people are choosing to respond to this act and whether they perceive legal intervention as a useful tool. Drawing from interviews with 10 teenagers and survey responses from 81 adult supporters, we provide insight into how young people perceive the supports available to them for responding to NCIID. We find young people may avoid seeking support from both the criminal justice system and adults in general due to fears of adult overreaction, victim blaming and shaming, and self/peer criminalization.

In 2019, the US State of Maryland’s highest court upheld the conviction of a 16-year-old minor for distributing her own ‘child pornography’ when she privately sent a clip of her performing a (completely legal) sexual act to a social media group of which only she and her two best friends were members. Considering that the child porn statute was never meant to prosecute legal and consensual sexting, this criminalization appears to be contra legem in light of the fact that the Court would not have regarded it as an offence if the girl was two years older (which does not make any difference to the legality of the sexual act since the age of sexual consent in Maryland is 16). The Court’s penalization of this act of sexting seems inappositely puritanical especially when it is noted that the convict was a victim of ‘revenge porn’ since one of the two friends leaked the clip in her school in an apparent act of revenge after their friendship ended. This paper analyses both the majority and dissenting opinions of this 2019 judgment to come to the conclusion that the majority ignores the true purport of the US Supreme Court decisions and wrongly invokes the doctrines for interpreting legislative intent to buttress its stance. As Maryland has criminalized acts of ‘revenge porn’, this article’s focus extends to examining how the Court’s failure of factoring in the effect of Maryland’s ‘revenge porn’ statute in discerning the legislative intent of the ‘child porn’ statute has produced an aberration of a statutory interpretation.

As of 2020, legal protections for victims of image-based sexual abuse in the United States remain inadequate. For example, no federal law yet criminalizes the sharing of sexually intimate material without a person’s consent (i.e., nonconsensual porn), and existing state laws are patchy and problematic. Part of the reason for this problem may be that U.S. lawmakers and the general public have yet to grasp that nonconsensual porn is a form of sexual abuse, with many of the same devastating, recurring, and lifelong consequences for victims. This review of psychological research on nonconsensual porn includes frameworks for understating this image-based sexual abuse, correlates and consequences of victimization, victim blame, and the nature of perpetration. Then, we analyze U.S. laws on nonconsensual porn in light of this review and argue for comprehensive legislative solutions.

Beyond ‘scandals’ and the public testimonies of victim-survivors, surprisingly little is known about the nature and extent of the harms of ‘image-based sexual abuse’, a term that includes all non-consensual taking and/or sharing of nude or sexual images. Accordingly, this article examines the findings from the first cross-national qualitative study on this issue, drawing on interviews with 75 victim-survivors of image-based sexual abuse in the UK, Australia and New Zealand. We adopt a feminist phenomenological approach that permits more nuanced and holistic understandings of victim-survivors’ experiences, moving beyond medicalised, trauma-based accounts of harm. Our analysis develops five interconnected accounts of the harms experienced, that we have termed social rupture, constancy, existential threat, isolation and constrained liberty. Our findings shed new light on the nature and significance of the harms of image-based sexual abuse that emphasises the need for more comprehensive and effective responses to these abuses.

Sextortion, a portmanteau of “sexual” and “extortion,” is the threat to distribute intimate, sexual materials unless a victim complies with certain demands. Cyber sextortion is part of a larger continuum of image-based sexual offending in which images are used for harm. Despite the serious nature of this crime, there exists a dearth of empirical knowledge of sextortion. This article employed a qualitative content analysis of media articles and court documents to explore the crimes of 152 cyber sextortion offenders. Characteristics of offenders, victims, demands, and methodology were identified and synthesized to generate a qualitative understanding of offenders who employed cyber sextortion. The results revealed four different themes of offenders based on crime characteristics: minor-focused cyber sextortion offenders, cybercrime cyber sextortion offenders, intimately violent cyber sextortion offenders, and transnational criminal cyber sextortion offenders. The diverse nature of cyber sextortion has implications for crime control policies. Certain offenders are more likely to be apprehended and prosecuted depending on the crime victim and methodology. In addition, there has been a lack of legislative action targeting cyber sextortion, which limits legal recourse available for victims. We discuss the contribution of this work to the broader literature on cyber sextortion and address some of the challenges that this crime presents to the criminal justice system.

Over the last decade, nonconsensual porn (NCP), or the sharing of sexually explicit material without a person’s consent, has become a growing problem with potentially far-reaching adverse consequences for victims. The purpose of this article is to propose and consider a framework for advancing the field’s understanding of NCP within the context of intimate relationships including situating NCP relative to other forms of relational abuse. Specifically, we examined the extent to which NCP in intimate partner relationships was perpetrated using tactics from the Power and Control Wheel through a summative content analysis of U.S. news stories on NCP from 2012 to 2017. This analysis established that NCP has been perpetrated using all eight of the abuse metatactics in the Power and Control Wheel, with the three most common being emotional abuse, coercion and threats, and denial/blame/minimization. Treating NCP in relationships as a potential form of partner violence provides a basis on which to understand the etiology, manifestation, motives, and impact of this form of abuse and informs practitioners’ ability to design prevention efforts and engage a trauma-informed response to survivors.

Many states have criminalized “revenge porn,” an increasingly common form of online sexual abuse. Yet, we know little regarding attitudes toward these laws. Through an original survey of nearly 500 U.S. residents, we find widespread public support for criminalization, but support varies by respondent’s self-identified gender and revenge porn type. Women favor criminalization more than men, but support falls among women and men when the subject created the media, colloquially known as “selfies” or “noodz.” Results suggest that women expressing their sexuality are deemed less deserving of protection, reinforcing feminist legal critiques of criminal law as insufficient to prevent sexual abuse.

Nonconsensual pornography, sometimes referred to as “revenge porn,” refers to the distribution of sexually explicit photographs or videos without the consent of the individual in the image. These images, along with accompanying personal information, are often disseminated by a former romantic or sexual partner with the intent to harm. Websites exist that have a reputation for hosting and promoting revenge porn. However, it is unclear to what extent these websites function for the purpose of explicitly harming victims by providing a victim's personal information. To address this question, a content analysis was performed on 134 photographs from seven different websites that originated within the United States. Descriptions of photos posted, content of victims' personal information included within the post, victim and distributor demographics, and viewers' comments were coded and analyzed. Website layouts and policies were also documented. Key findings were that nearly 92% of victims featured on included websites were women. Moreover, when a reason was given for posting the photo, it was correlated with having a greater number of views, being more likely to allow commenting on photos, and being more likely to include a victim's name. Implications are discussed.

Due to child pornography laws, non-consensual intimate image sharing among youth is subjected to complex legal landscapes in a variety of jurisdictions such as Canada, the United States, the United Kingdom, and Australia. While a growing number of scholars have problematized the use of child pornography charges to respond to these cases, there remains little understanding regarding how the police that enforce these laws conceptualize this issue and how this influences responses to these cases. Drawing from interviews with members of sex crime–related units in police service organizations from across Canada, this article examines how police conceptions of non-consensual intimate image sharing among youth correspond with and/or diverge from legal and critical understandings of this issue. While it is widely understood that online and digitally enabled forms of sexual violence pose unique challenges for police, our research fills a gap in the literature by examining how police themselves understand and respond to these challenges.

This study examines the emotional and mental health effects revenge porn has on female survivors. To date, no other academic studies have exclusively focused on mental health effects in revenge porn cases. In-depth qualitative interviews were conducted between February 2014 and January 2015 with 18 female revenge porn survivors, and inductive analysis revealed participants’ experiences of trust issues, posttraumatic stress disorder (PTSD), anxiety, depression, suicidal thoughts, and several other mental health effects. These findings reveal the seriousness of revenge porn, the devastating impacts it has on survivors’ mental health, and similarities between revenge porn and sexual assault.

Young people's use of technology as a tool for the negotiation of their sexual identities and encounters has increasingly become a focal point in popular and scholarly discussion. Much of this debate centres on the sending of explicit sexual images and/or video (‘selfies’ or ‘sexting’) by mobile phone, email or social media. In Australia and elsewhere, legislative frameworks have arguably over-regulated or criminalised young people's consensual, digital, sexual communications. Equally, the law has failed to respond to the harm that is experienced by victims of non-consensual making and/or distribution of such sexual images. In this paper, we examine the non-consensual creation and distribution of sexual images in the context of harassment, stalking and family or intimate violence. We argue that harmful digital communications are often framed as a problem of user naiveté rather than gender-based violence. Moreover, we argue that current legal and policy approaches fail to adequately capture the social and psychological harm that results from the use of sexual imagery to harass, coerce or blackmail women. We draw on preliminary data from a larger project investigating adult women's experiences of technology-mediated sexual violence and harassment.

The First Amendment Bubble: How Privacy and Paparazzi Threaten a Free Press. Amy Gajda. In her thorough analysis of the evolution of media case law, Tulane University law professor Amy Gajda makes a convincing case that news organizations and journalism programs must forego absolutist positions on the First Amendment, or, she warns, we could face a legislative and judicial backlash so harsh, it will roll back such protections to the pre-Sullivan era.Gajda, a former broadcast journalist, argues that more and more judges are expressing skepticism that quasi-journalists-particularly those who focus on celebrity gossip, revenge porn, and public shaming and humiliation of everyday people-deserve the special treatment the courts have given the press. Meanwhile, faced with intense competition for eyeballs and page clicks, serious journalism organizations find themselves chasing stories that used to be the domain of the tabloids. This has so blurred the lines between the quasi-journalists and mainstream journalists and between entertainment and news that neither the public nor judges seem willing or able to differentiate. Any pushback against quasi-journalists will affect the entire journalism establishment.The only shortcoming in this book was that Gadja underemphasizes the power and pressure of customizable news; the reality is that the eyes of potential newsreaders drift to videos of arrogant cats and men trying on women's bikinis. That forces news organizations to pump out stories that are more visceral than important. It is hard to take the high road in that world.Still, Gadja makes a strong case that journalism organizations need to wake up to a new reality. Professional media ethics codes and media law and ethics classes focus on libel-proofing stories and give short shrift to individual privacy rights and the idea of basic human dignity. As an example, she points to codes and practices that teach students that anything that happens in a public space is up for grabs-that no one can argue privacy rights in public. Through one case after another, Gajda demonstrates a disconnect between the press and the public it reports on and to. Despite people's willingness to share just about anything online, they are increasingly asserting privacy rights in public spaces and on the Internet. …

This article examines the motivations, techniques and potential consequences of the governance of teenage sexting. I examine the over-representation of white, middle-class, heterosexual, female sexters, and abstinence from sexting discourses in the ‘Respect Yourself’ child protection/crime prevention initiative. This campaign, I suggest, exploits slut shaming in an effort to responsibilize teenage girls for preventing the purported harms that may flow from sexting—including humiliation, sexual violations and criminalization—for both themselves and their peers. I examine this responsibilization effort through the lens of critical whiteness, queer, girlhood/young feminist and porn studies’ theorizations of the politics of sexual respectability and sexual subjectification and argue that this campaign simultaneously: reveals anxieties about the decline of the moral authority of the white, middle-class, heterosexual nuclear family; constitutes certain teenage girls’ unintelligibility as sexual subjects; and, undermines teenage girls’ ability to challenge a normative sexual order in which they are often blamed extra/legally for their sexual victimization.

Researchers have accumulated much social scientific knowledge about the scope, distribution, causes, and outcomes of the physical and sexual abuse of female students in North American institutions of higher learning. However, surveys of technology-facilitated stalking and the dissemination of unwanted sexual messages/images in college campus communities are in short supply. The few that have been conducted do not identify key sociological risk factors associated with these two electronic forms of victimization. This paper, then, has two objectives: (1) to examine the influence of two types of negative peer support and (2) to determine if being the target of technology-facilitated stalking and receiving unwanted sexual messages/images are associated with female students’ intimate partner violence and sexual assault experiences. The results confirm that the two variants of negative peer support examined in this study are significant predictors of digital victimization and that such abuse is strongly associated with intimate partner violence and sexual assault.

Often referred to by journalists, policy makers, and the general public as revenge porn, image-based sexual abuse is starting to garner serious legal and social scientific attention. However, theoretical developments have thus far not kept pace with the growing empirical and legal literature on this electronic variant of woman abuse. Further, this problem cannot adequately be explained by gender-blind theories, as there is a strong relationship between gender and women’s risk of being harmed by image-based sexual abuse by current and former intimate male partners. Thus, the main objective of this article is to address this concern by applying male peer support theory.
