Background: Social reintegration relies on the support given to prisoners not only during their reentry into society but also throughout their imprisonment. Our goal was to analyze the expectations reported by cisgender and transgender women returning to society and of the justice and social welfare professionals from the Brazilian prison system. Methods: A qualitative analysis using saturation sampling was conducted. The participants were selected through a non-probabilistic sampling technique. Data was collected through semi-structured interviews with professionals involved in the management of the prison system and female former inmates. Interviews were transcribed and analyzed using an open and focused coding process. Textual data was stored, organized, and coded using Atlas software according to emerging themes. Results: The study involved 15 professionals and 13 female former inmates, five of them identified as transgender women. Among the professionals, the age range went from 38 to 65 years old; they reported a work history in their respective fields, from 10 to 35 years, with an equal distribution across genders. As for the female former inmates, their ages ranged from 24 to 42 years old, and the most reported crime was drug trafficking. Their incarceration time varied from 1 to 8 years. Female inmates were vulnerable to abuse and violence, including physical, sexual, and emotional violence. Women in situations of prior vulnerability faced additional challenges during their sentences. Transgender women were even more neglected and discriminated against by the system. Despite the professionals being aware and concerned about vulnerabilities and the need to improve the reintegration process, in general, they were not sensitive to the gender perspective. There were no specific policies able to support social integration for this public. Conclusions: Data showed multifaceted challenges faced by female former inmates within the Brazilian prison system, highlighting the insufficient policies for both cisgender and transgender women. Additionally, the results revealed a lack of sensitivity among professionals regarding gender issues and their particularities in the prison system and social reintegration. This study examines the adult imprisonment outcomes of a cohort of serious and violent juvenile offenders released from Texas state juvenile correctional facilities during their transition from adolescence to early adulthood. We distinguish incarceration in the adult prison system as resulting from a new offense or as the result of a revocation for a technical supervision violation. Of the sample (n = 709), 37% were incarcerated in Texas' adult prison system within two years following their release from state juvenile incarceration—16% were incarcerated for a new offense and 21% were incarcerated for revocation as a result of a technical violation of supervision. Results indicate that race, being a sexual offender, gang affiliate, engaging in violent institutional misconduct as a juvenile ward, being under supervised release, and age at initial juvenile incarceration were determinants of adult incarceration for any reason. Similar determinants of incarceration were found examining incarceration for offenders released under community supervision. Prior placements as a juvenile and gang affiliation were correlated with incarceration for a new offense. Research and policy implications are discussed. [ABSTRACT FROM AUTHOR]

Background: The extraordinary growth in women's incarceration over the past several decades has resulted in calls for expansion of research into their unique needs and experiences, including those related to pregnancy and perinatal care. However, while research into the health outcomes of women who are incarcerated while pregnant has grown, research on women's custodial and perinatal care patterns has remained nearly non-existent. Here, we sought to describe (1) the characteristics of the population of women who came to be incarcerated in a state prison system during pregnancy and (2) the characteristics of women's custodial and perinatal care patterns during and after incarceration. Methods: We conducted a retrospective chart review of the population of women who received perinatal care while incarcerated in the Arkansas state prison system over a 5-year period from June 2014 to May 2019. Electronic medical records and state prison records were merged to form our study population. Data were from 212 women (Mage = 28.4 years; 75.0% non-Latina White) with a singleton pregnancy who received at least one obstetric care visit while incarcerated. Results: Drug-related convictions were the most common crimes leading to women's incarceration while pregnant, and violent crime convictions were rare. Nearly half (43.4%) of women who gave birth in custody did so within 90 days of admission and the great majority (80.4%) released within 1-year of giving birth, including 13.3% who released within 30 days. Discussion: The frequency with which women who became incarcerated while pregnant released from prison either prior to or shortly after giving birth was a striking, novel finding of this study given the implications for perinatal care disruption among a high-risk population and the harms of forced separation from infants within hours of birth. Conclusions: Diversionary programs for pregnant women convicted of crimes, particularly in states without current access, are urgently needed and should be a priority for future policy work. Background: The purpose of this study was to examine how the COVID-19 pandemic changed U.S. prison operations and influenced the daily work of prison staff. Methods: In collaboration with the National Institute of Corrections, we administered a survey to 31 state correctional agencies in April 2021 and conducted five focus groups with 62 correctional staff. Results: Using a framework of bounded rationality, we find that daily operations were strained, particularly in the areas of staffing, implementing public health policy efforts, and sustaining correctional programming. While prison systems and staff were under-prepared to respond to the pandemic, they attempted to address complex problems with the limited resources they had. Conclusions: Results underscore a need in corrections for prioritizing further developments and reviews of collaborative policies and practices for managing crisis situations. Seeking avenues for leveraging technological innovations to improve operations and facilitate enhanced communication are especially warranted. Finally, meaningful reductions in the prison population, changes in physical infrastructure, and expansions of hiring and retention initiatives are critical for positioning prisons to manage future emergencies. Background: Policies for next-of-kin (NOK) notification and disposition of remains surrounding death are unclear across the United States' (US) carceral systems. The goal of this study was to collect data on carceral system policies pertaining to NOK notification and disposition of remains for individuals who are incarcerated. We collected publicly available operational policies for the Federal Bureau of Prisons, Immigration and Customs Enforcement, 50 state prison systems, and the Washington D.C. jail for a total of 53 systems. Results: Approximately 70% of systems had available policies on NOK notification and disposition of remains. Few systems had information on time constraints for NOK notification, notifying parties or designated contacts person, and ultimate disposition of unclaimed remains. Several systems had no accessible policies. Conclusions: Across the US, carceral systems vary in policies for notifying NOK after the death of an incarcerated individual and their processes for the disposition of remains. Carceral and health systems should work towards standardization of policies on communication and disposition of remains after death of an individual who is incarcerated to work towards equity. The opioid crisis is a significant public health issue in North America that began in the 1990s with opioid-related deaths increasing each year. Although studies have been published regarding the incidence of opioid-related deaths in the general population, there is limited information regarding deaths in the prison population. To investigate the impact of the opioid epidemic in this vulnerable population, a retrospective study of all drug-related deaths that occurred in correctional facilities and penitentiaries in Ontario, Canada, between January 2009 and December 2019 was conducted. A total of 90 deaths were attributed to acute drug toxicity and the decedents ranged in age from 18 to 63 years and comprised 81 men and 9 women. The results of this study indicate the number of drug-related fatalities have increased by 375% (from 4 to 19) over the last 11 years. The detection of opioids in drug-related deaths has increased with fentanyl being the most frequently detected drug. Data also indicates the recent emergence of fentanyl-related analogues in this population. The results from this study provide valuable information about drug-related deaths in the Ontario prison system and provide insight into how the opioid crisis and the increased use of fentanyl and its analogues have affected this vulnerable population. Education within prisons is one of the most complex scenarios in the field of education in Spain. Education is conceived in spatial and temporal coordinates that are totally alien to life in prison and often clash with economic or security and order-related contraindications that frustrate the right to education in the twenty-first century. This is an education that cannot be unconnected with digital competition, and one of its aims is to eliminate the "digital divide". On the one hand, it has been analysed by the Spanish and European authorities that there is a need for education to respond to the challenges of today's society, which is characterised by having moved from the analogue era to the digital era. This digital drive is designed to limit social differences. On the other hand, Spanish prison legislation guarantees the right to education, but without forgetting the special circumstances limiting rights in prisons. In Spain, the 1996 regulation does not seem to be able to respond to the existing difficulties, since its wording has become obsolete on this point. In this regard, the Council of Europe recalled different aspects which lead us to question how the right to comprehensive education should be skilfully combined with that of the restrictions specific to the prison environment. The study of these two aspects leads to the conclusion that it is a difficult challenge. Despite interest in the subject, the study of prison gangs has been meagre since the late 1980s. Occasional studies appear, but they tend to focus on only the largest prison systems in the US. This introduction to this special issue, Prison Gangs as Organized Crime, provides an overview of notable literature on the emergence and evolution of prison gangs, their relationships with protection, and their organized criminal activities. Moreover, the articles in this special issue explore important questions: How might we study prison gangs at a large scale? How do prison administrators' responses to prison gangs cause prison gangs to adjust their power structures? How do prison gangs seek to establish protection arrangements? Background: Despite the limitations the carceral environment may impose on mental wellness, mental healthcare is increasingly becoming a carceral endeavor. Over the course of the last several decades, prisons and jails have become the de facto mental healthcare provider for thousands of incarcerated individuals. Furthermore, practices like mandated mental healthcare for supervised individuals further broaden the population experiencing mental healthcare within the criminal legal system at large. This study examines the perspectives of nine individuals who experienced mental healthcare within the carceral state, whether in prison or on parole or probation, with a special focus on how attributes of the carceral state create ideological and functional barriers to effective mental healthcare. Methods: Data for the parent study of this analysis was collected via in-depth, one-on-one interviews of about one hour's length, conducted at six-month intervals over the course of 2 years. These interviews were analyzed using an iterative process of open-coding, thematic code development, and code application to participant interviews. Results: The results showed a common perception of mental healthcare received within the carceral state as serving goals of the prison system, including control and punishment, rather than therapeutic goals of healing and empowerment. This often had negative implications for the quality of the treatment received, including patterns of diagnostic ambiguity, treatment that was ill-fitting to participants' needs, and treatment that was undermined by the new trauma created by the prison environment. The results also highlighted racial disparities prevalent within the carceral system. Despite the barriers created by the subjection of therapeutic practices to carceral goals, participants demonstrated resourcefulness and creativity in engaging with these treatment modalities to reap benefits where possible. Conclusions: Overall, these results highlight the inappropriateness of combining therapeutic and carceral spaces, the need for greater public attention to how carceral mechanisms disadvantage vulnerable populations, and the need for a cultural reconceptualization of mental illness such that it is met not with criminal punishment but appropriate care. One would be hard-pressed to name an edifice that has dominated the academic imagination as thoroughly and exhaustively as Jeremy Bentham's Panopticon. This somewhat monomaniacal fixation on one of Bentham's many penal contraptions is rooted, to no small degree, in Michel Foucault's now voguish theory of power, as expounded upon in his seminal work Discipline and Punish. Foucault's understanding of Bentham's penal thought, particularly the Panopticon, forms one of the key linchpins which his broad historical claims hinge upon. But to what extent does Foucault's representation of Bentham's penal theories, in particular, his views on the prison and the Panopticon, converge with how Bentham himself gave expression to his own penal philosophy? This question is examined in this article by taking a closer look at The Rationale of Punishment, a compilation of a vast mass of Bentham's manuscripts, which were first published in English in 1830. Despite playing a central role in establishing our current racialized prison system, Southern convict leasing has been largely forgotten by American society. The Lone Rock Stockade Project is carrying out excavations at the site of an 1870s convict stockade in order to illuminate the depravity of convict leasing and acknowledge the sacrifices of the convicts who were forced to work without pay in Tennessee's industries. While the project works to identify descendant communities and manage the dangers of COVID-19, the project's public outreach is focused on establishing the site's narrative as dark heritage, rather than industrial triumph, within the local community. Solitary confinement is a widespread practice in US correctional facilities. Long-standing concerns about the physical and mental health effects of solitary confinement have led to litigation, legislation, and community activism resulting in many prison systems introducing policies or implementing legal mandates to reduce or eliminate its use. Yet little is known about the nature and effectiveness of policies that states have adopted to reduce their use of solitary confinement and exactly how various reforms have actually impacted the lives of people living and working in the prisons where these reforms have taken place. Methods: We conducted an embedded case study, analyzing changes in policies and procedures, administrative data, and focus groups and interviews with incarcerated persons and staff, to describe the circumstances that led to changes in solitary confinement policies and practices in the North Dakota Department of Corrections and Rehabilitation (ND DOCR) and the perceived impact of these changes on incarcerated persons and prison staff.. Results: North Dakota's correctional officials and staff members attributed the impetus to change their solitary confinement policies to their participation in a program that directly exposed them to the Norwegian Correctional Service's philosophy, policies, and practices in 2015. The ensuing policy changes made by North Dakota officials were swift and resulted in a 74.28% reduction in the use of solitary confinement between 2016 and 2020. Additionally, placements in any form of restrictive housing decreased markedly for incarcerated persons with serious mental illness. In the two prisons that had solitary confinement units, rule infractions involving violence decreased at one prison overall and it decreased within the units at both prisons that were previously used for solitary confinement. Although fights and assaults between incarcerated people increased in one of the prison's general population units, during the initial months of reforms, these events continued to decline compared to years before reform. Moreover, incarcerated people and staff attributed the rise to a concomitant worsening of conditions in the general population due to overcrowding, idleness, and double bunking. Both incarcerated persons and staff members reported improvements in their health and well-being, enhanced interactions with one another, and less exposure to violence following the reforms. Conclusions: Immersing correctional leaders in the Norwegian Correctional Service' public health and human rights principles motivated and guided the ND DOCR to pursue policy changes to decrease the use of solitary confinement in their prisons. Ensuing reductions in solitary confinement were experienced as beneficial to the health and wellness of incarcerated persons and staff alike. This case-study describes these policy changes and the perspectives of staff and incarcerated persons about the reforms that were undertaken. Findings have implications for stakeholders seeking to reduce their use of solitary confinement and limit its harmful consequences and underscore the need for research to describe and assess the impact of solitary confinement reforms. Background: Correctional institutions nationwide are seeking to mitigate COVID-19-related risks.Objective: To quantify changes to California's prison population since the pandemic began and identify risk factors for COVID-19 infection.Design: For California state prisons (March 1-October 10, 2020), we described residents' demographic characteristics, health status, COVID-19 risk scores, room occupancy, and labor participation. We used Cox proportional hazard models to estimate the association between rates of COVID-19 infection and room occupancy and out-of-room labor, respectively.Participants: Residents of California state prisons.Main Measures: Changes in the incarcerated population's size, composition, housing, and activities. For the risk factor analysis, the exposure variables were room type (cells vs. dormitories) and labor participation (any room occupant participating in the prior 2 weeks) and the outcome variable was incident COVID-19 case rates.Key Results: The incarcerated population decreased 19.1% (119,401 to 96,623) during the study period. On October 10, 2020, 11.5% of residents were aged ≥60, 18.3% had high COVID-19 risk scores, 31.0% participated in out-of-room labor, and 14.8% lived in rooms with ≥10 occupants. Nearly 40% of residents with high COVID-19 risk scores lived in dormitories. In 9 prisons with major outbreaks (6,928 rooms; 21,750 residents), dormitory residents had higher infection rates than cell residents (adjusted hazard ratio [AHR], 2.51 95% CI, 2.25-2.80) and residents of rooms with labor participation had higher rates than residents of other rooms (AHR, 1.56; 95% CI, 1.39-1.74).Conclusion: Despite reductions in room occupancy and mixing, California prisons still house many medically vulnerable residents in risky settings. In the era of mass incarceration, millions of American citizens have been disenfranchised by the social stigma of a felony conviction. Mentorship of formerly incarcerated (FI) students by FI academics—many of whom identify with Convict Criminology (CC)—is slowly forging a pathway out of the social wasteland of past felony convictions. A common goal of CC is to help FI students and academics overcome the social and structural barriers that severely limit their life chances, as well as those of millions of FI citizens in the world's largest prison system. In this article, three FI criminology faculty members focus on the vital importance of mentorship presented through individual autoethnographic writings. We emphasize four prominent narratives or themes: (1) common narratives of the role of mentorship: encouragement, inclusion, and social capital; (2) differing narratives of the role of mentorship; (3) common narratives of the role of mentorship: experiences of mentoring as activism and advocacy; and (4) common narratives of the role of mentorship in reducing professional fragility. We also consider other dynamics that might emerge in the mentor–mentee relationship involving FI individuals, including the complexities of "coming out" as FI and the fragility of FI identity in the academic world. We conclude with recommendations for future research on the role of mentorship for FI individuals and make suggestions for other areas of study for CC, more generally. [ABSTRACT FROM AUTHOR]

The purpose of this study is to investigate the unique prisons of Bolivia. Their main features include the presence of wives and children, self-management of activities within the prison and the opportunity for inmates to take part in various activities. In particular, the general organisation of the prisons and the inmates' experience, especially on an interpersonal level, is described in this study. The obtained data shows that functional and effective experiences of social rehabilitation can be promoted even under extreme conditions and, in some cases, this provides important insights into the prison systems of most developed countries. Background: Prior studies have documented limited use of medications to treat opioid use disorders (OUD) for people incarcerated within state prisons in the United States. Using the framework of the criminal justice OUD service cascade, this study interviewed representatives of prison systems in states most heavily impacted by opioid overdose regarding the provision of medications for OUD (MOUD). Methods: A stratified sampling strategy included states with high indicators of opioid-overdose deaths. Two sampling strata targeted states with: 1) OUD overdose rates significantly higher than the per capita national average; or 2) high absolute number of OUD overdose fatalities. Interviews were completed with representatives from 21 of the 23 (91%) targeted states in 2019, representing 583 prisons across these states. Interviews assessed service provision across the criminal justice OUD service cascade, including OUD screening, withdrawal management, MOUD availability and provision, overdose prevention, re-entry services, barriers, and needs for training and technical assistance. Results: MOUD (buprenorphine, methadone, or naltrexone) was available in at least one prison in approximately 90% of the state prison systems and all three medications were available in at least one prison in 62% of systems. However, MOUD provision was limited to subsets of prisons within these systems: 15% provided buprenorphine, 9% provided methadone, 36% provided naltrexone, and only 7% provided all three. Buprenorphine and methadone were most frequently provided to pregnant women or individuals already receiving these at admission, whereas naltrexone was primarily used at release. Funding was the most frequently cited barrier for all medications. Conclusion: Study findings yield a complex picture of how, when, and to whom MOUD is provided across prisons within prison systems in states most heavily impacted by opioid overdose in the United States and have implications for expanding availability. Prison inspection and monitoring bodies are important safeguards against breaches of human rights. In recent years, prison inspection and monitoring has become a key focus for international human rights standards, particularly through the introduction of the Optional Protocol to the Convention against Torture (OPCAT) and the UN's Standard Minimum Rules for the Treatment of Prisoners, which recognize the need for robust and effective systems of prison oversight. This article contends that European legal standards on inspection and monitoring have not kept pace with international developments. The content of European law concerning domestic-level prison inspection and monitoring is not clear, nor has it been consolidated or examined in depth. Through engaging in comparative analysis with international instruments, this article analyses standards promulgated by Council of Europe and European Union bodies on inspection and monitoring, arguing that they need reform in light of international developments. Taking the opportunity presented by the revision process for the European Prison Rules and associated commentary, the article proposes improvements to European legal frameworks. It welcomes proposals for stronger powers for inspection and monitoring bodies, advocates for a specific instrument on prison inspection and monitoring and calls for more empirical understanding of how such bodies operate in practice. The spread of COVID-19 put prisons across the globe into an emergency state where extraordinary reactions and measures have been taken. Prison governance and management under such circumstances have facilitated the revelation of existing mechanisms of control. Focusing on the experience of frontline officers, this paper explores how the Chinese prison system contained the spread of COVID-19 inside its walls by demanding officers work on 'lockdown shifts', and what we can learn about its governing logic. Multi-sourced data is utilized, including government-issued policies and reports, media reports, blog posts written by prison officers and participant observation as well as semi-structured interviews with frontline prison officers. This study offers a diachronic analysis of pandemic control within the prison system, focusing on key turning points. By examining frontline prison officers' accounts through first- and second-hand data, the study explores the execution of control policies and how they affect individual lives. The study found that prison officers were ordered to fight at the forefront of pandemic control in prisons by working on shifts inside for an extended and indefinite period of time, which proved effective in terminating the spread of the virus, but placed a heavy burden on the personal lives of the officers. The findings also reveal new facets in the mobility and experience of frontline officers. While effective in terms of what the statistics have demonstrated, the Chinese measures have been less effective in adjusting to the needs of frontline staff and acknowledging the personal sacrifices demanded and made in this process. People in prison are particularly vulnerable to infectious disease due to close living conditions and the lack of protective equipment. As a result, public health professionals and prison administrators seek information to guide best practices and policy recommendations during the COVID-19 pandemic. Using latent profile analysis, we sought to characterize Texas prisons on levels of COVID-19 cases and deaths among incarcerated residents, and COVID-19 cases among prison staff. This observational study was a secondary data analysis of publicly available data from the Texas Department of Criminal Justice (TBDJ) collected from March 1, 2020, until July 24, 2020. This project was completed in collaboration with the COVID Prison Project. We identified relevant profiles from the data: a low-outbreak profile, a high-outbreak profile, and a high-death profile. Additionally, current prison population and level of employee staffing predicted membership in the high-outbreak and high-death profiles when compared with the low-outbreak profile. Housing persons at 85% of prison capacity was associated with lower risk of COVID-19 infection and death. Background: COVID-19 has entered United States prison systems at alarming rates. Disparities in social and structural determinants of health disproportionately affect those experiencing incarceration, making them more vulnerable to COVID-19. Additionally, prisons are sites of congregate living, making it impossible to practice social distancing, and most prisons have relied only on incremental measures to reduce risk and spread of COVID-19. To more fully understand the impact that COVID-19 is having on incarcerated populations, it is critical to have systematic data on testing, test positivity, cases, and case fatality. Using data from the COVID Prison Project, we present data on 53 prison systems COVID-19 testing, test positivity, case, and case fatality by state and compare these data with each state's general population. We do this for the early stages of the pandemic, utilizing data through July 15, 2020. Results: Many states are not reporting full information on COVID testing with some also not reporting on case fatality. Among those reporting data, there is a wide variation between testing, test positivity, and case rates within prison systems and as compared to the general population. However, when more tests are deployed more cases are identified with the majority of state prisons having higher case rates than their general population. Conclusions: These findings underscore the need for the implementation and study of COVID-19 mitigation and surveillance strategies to flatten the COVID-19 curve in prisons across the country. Background: Opioid use disorder (OUD) is among the most prevalent medical condition experienced by incarcerated persons, yet medication assisted therapy (MAT) is uncommon. Four jail and prison systems partnered with researchers to document their adoption of MAT for incarcerated individuals with opioid use disorders (OUD) using their established treatment protocols. Employing the EPIS (Exploration, Planning, Implementation, and Sustainment) framework, programs report on systematic efforts to expand screening, treatment and provide linkage to community-based care upon release. Results: All four systems were engaged with implementation of MAT at the outset of the study. Thus, findings focus more on uptake and penetration as part of implementation and sustainment of medication treatment. The prevalence of OUD during any given month ranged from 28 to 65% of the population in the participating facilities. All programs developed consistent approaches to screen individuals at intake and provided care coordination with community treatment providers at the time of release. The proportion of individuals with OUD who received MAT ranged considerably from 9 to 61%. Despite efforts at all four sites to increase utilization of MAT, only one site achieved sustained growth in the proportion of individuals treated over the course of the project. Government leadership, dedicated funding and collaboration with community treatment providers were deemed essential to adoption of MAT during implementation phases. Facilitators for MAT included increases in staffing and staff training; group education on medication assisted therapies; use of data to drive change processes; coordination with other elements of the criminal justice system to expand care; and ongoing contact with individuals post-release to encourage continued treatment. Barriers included lack of funding and space and institutional design; challenges in changing the cultural perception of all approved treatments; excluding or discontinuing treatment based on patient factors, movement or transfer of individuals; and inability to sustain care coordination at the time of release. Conclusions: Adoption of evidence-based medication assisted therapies for OUD in prisons and jails can be accomplished but requires persistent effort to identify and overcome challenges and dedicated funding to sustain programs. Gambling disorder is an addiction that can cause major suffering, and some populations seem to be more vulnerable than others. Offender populations have a remarkably high prevalence of gambling problems and they are also over-represented in a number of diagnoses related to gambling disorder, like substance use disorders and antisocial personality disorder. Yet, there are few studies investigating gambling disorder prevalence and related psychiatric comorbidity in this group. This study aims to investigate the prevalence of, and association between, gambling disorder and other psychiatric diagnoses in a sample of young, male violent offenders. Two hundred and sixty-four male offenders, all serving sentences for violent crimes (recruited between 2010 and 2012) participated in this study and went through comprehensive psychiatric evaluation, including assessment for Diagnostic and Statistical Manual of Mental Disorders 4th Edition criteria. Sixteen percent of the participants met criteria for gambling disorder. Antisocial personality disorder, cannabis, cocaine and anabolic steroids abuse were significantly more common among participants with gambling disorder. The gambling disorder group also showed significantly lower educational attainment. Cocaine abuse and failure to graduate elementary and middle school in expected time were independently associated with gambling disorder in a regression analysis. This study confirms the previously described high prevalence of gambling disorder in offenders. The psychiatric comorbidity was high and the problems had started early, with lower educational attainment in the gambling disorder group. The findings stress the importance of increased awareness of gambling problems among convicted offenders and of gambling research on young people with delinquent behavior. This article traces the evolution of reeducation-through-labor (laojiao) as a form of administrative punishment in China in an effort to identify the critical junctures, events, and actors that have produced significant changes in the practice over time. Focusing most of its attention on the abolition of the RTL system announced in the Third Plenum Decision of 2013 and the subsequent use of a range of alternative institutions to house former RTL detainees, it outlines a shift toward more diverse and differentiated means of addressing both political opposition and social problems in China. In making this claim, the article suggests the emergence of a new approach of authoritarian control over the legal system, one capable of handling a wider assortment of offender-types and therefore better-able to protect CCP hegemony. Jails may serve an important public health function by treating individuals with psychiatric problems. However, scholars debate the service qualities that can best achieve this aim. Some suggest the possibility of comprehensive psychiatric services in jails, while others recommend a narrower focus on basic elements of care (assessments, medication management, and crisis intervention). To date, this debate remains uninformed by service recipients. This qualitative study addresses this gap by illuminating patient-inmate perspectives on jail psychiatric services. Patient-inmate experiences indicate that the jail environment is incongruent with the provision of comprehensive psychiatric services. Thus, program administrators would best serve patient-inmates by strengthening basic services and connections to community-based providers who can provide comprehensive and effective care. This paper will demonstrate how women's labor in the transnational cocaine commodity chain (TCCC) links together the Santa Monica women's prison in Lima, Peru and the illicit cocaine market. Peru is one the fastest-growing economies in Latin America largely due to a neoliberal free market approach to economic development. It has encouraged foreign investment and also has a growing middle class. But a significant portion of the country's population has not benefitted. This has resulted in some women turning to drug smuggling or selling in order to generate an income. Due to war on drug strategies, many of them are caught and sentenced on drug trafficking charges. I argue that the prison and larger criminal justice apparatus benefit financially from the growing number of drug arrests due to the systemic blackmail of incarcerated women. The cocaine sector benefits from the internment of its ex-workers. It is able to recruit new low-level employees and maintain the protection of middle managers. It is in this way that this prison and the illegal drug market are enmeshed together through the labor of subordinate female smugglers and retailers. Throughout the last three decades, almost all Latin American countries witnessed a dramatic growth of their inmate population that is indicative of the rebirth of the prison in the region. This article contextualizes the rebirth of the prison in contemporary Latin America in empirical and theoretical terms. To this end, it offers a discussion of the expansion of Latin American imprisonment, changes in the region's prison regimes and their embeddedness within wider social and economic contexts, as well as of the impact of institutional histories, larger economic and political transformation processes and globally circulating penal ideas and institutional models, all of which contribute to the growing punitiveness of contemporary Latin America states and politics. The present work aims to understand the process of expansion and consolidation of the organized criminal group the Primeiro Comando da Capital (PCC) in São Paulo's prison system over the past 20 years, and the social configuration that has formed as a result of the PCCs monopolization of opportunities of power. To this end, the work of Norbert Elias is utilized to analyze empirical data collected from various sources. The article consists of two lines of analysis. First, the PCC phenomenon is approached from a macro-sociological point of view, focusing on the social, political and administrative problems that are directly or indirectly linked to the PCCs social development. Second, a figurational analysis is used to explore the social dynamics produced from this process. In comparison to the 'pre-PCC' situation, it is shown that the new social configuration produced from the hegemony of the PCC consists of a complexity of interdependencies, including greater functional division and social integration. Given this intensification of mutual dependencies, the social controls on individual behavior have been expanded and centralized. Here, the structure and organization of the PCC, its political dynamics, and individual self-control are central issues. The article concludes by calling into question the view that the most significant effect of the PCCs consolidation has been social pacification of São Paulo's prison system. Fragilities in the power of the PCC are explored, principally the precarious nature of the relationship between the PCC and state authorities, and the extent to which the PCC's authority is imposed. Objectives: This study examines the effect of prison versus community sanctions on recommitment to prison and compares two levels of community supervision, community control (house arrest) and probation, evaluating whether the findings are contingent on the type of matching methods used in the analysis. Methods: Logistic regression was conducted on unmatched and matched samples. Exact, coarsened exact, and radius-matching procedures were used to create a selection on observables design. Matching variables included current offense, demographics, criminal history, supervision violations, and a rich set of Florida Sentencing Guidelines information culled from an official scoring sheet. Florida judges use this instrument to sentence offenders within the framework of the state determinate sentencing system. Results: The results show that with exact matching, there is no effect of imprisonment on recommitment, while the other procedures suggest a specific deterrent effect of imprisonment. All four analysis methods showed that offenders under community control are more likely to reoffend than those under normal probation. Analyses between the matched and unmatched prison observations demonstrate that the matched set of prisoners is composed of offenders who have less extensive criminal records and less serious conviction offenses than unmatched offenders regardless of the matching algorithm. Conclusions: Contrary to a prior analysis of these data, which found a criminogenic effect of prison, a null effect was found using exact matching. Comparing the matching procedures, the more precise the match the less likely there was an effect of prison. However, community control was criminogenic regardless of the matching procedure. Hepatitis C virus (HCV) is the most common blood-borne infection in the USA, though seroprevalence is elevated in certain high-risk groups such as inmates. Correctional facility screening protocols vary from universal testing to opt-in risk-based testing. This project assessed the success of a risk-based HCV screening strategy in the Philadelphia Prison System (PPS) by comparing results from current testing practices during 2011-2012 (Risk-Based Screening Group) to a September 2012 blinded seroprevalence study (Philadelphia Department of Public Health (PDPH) Study Cohort). PPS processed 51,562 inmates in 2011-2012; 2,727 were identified as high-risk and screened for HCV, of whom 57 % tested HCV antibody positive. Twelve percent ( n = 154) of the 1,289 inmates in the PDPH Study Cohort were anti-HCV positive. Inmates ≥30 years of age had higher rates of seropositivity in both groups. Since only 5.3 % of the prison population was included in the Risk-Based Screening Group, an additional 4,877 HCV-positive inmates are projected to have not been identified in 2011-2012. Gaps in case identification exist when risk-based testing is utilized by PPS. A more comprehensive screening model such as opt-out universal testing should be considered to identify HCV-positive inmates. Internationally, the 200 year honeymoon with the prison may be ending. Research showing that imprisonment is ineffective in reducing crime is finally being heeded by some conservative governments committed to cost cutting. But, as this case-study of Victoria, Australia, again highlights, punishment regimes are neither universal nor rational. Bucking the trend, prison numbers in Victoria have increased dramatically over the last decade and are set to rise higher. The lingering lure of the prison here, we argue, is a manifestation of Australia's colonial history in which punitiveness has always competed with pragmatic innovation. Although the research findings are inconclusive, we contend that Electronic Monitoring (EM), while differently fraught, better meets the key objectives of sentencing. Using a counterfactual social science thought experiment in the form of an imagined Cabinet submission, we show how political decision makers might be persuaded to effect a shift from prison to EM if it is framed within the competing visions of Australian national identity. We argue that understanding how social policy decisions are made sharpens the scholarly research agenda and also highlights how the convergence of a unique set of non-rational cultural assumptions can shape major shifts (or near misses) in the history of punishment in a particular society. Objectives: To present and test an opportunity perspective on prison inmate victimization. Methods: Stratified random samples of inmates ( n = 5,640) were selected from Ohio and Kentucky prisons ( n = 46). Bi-level models of the prevalence of assaults and thefts were estimated. Predictors included indicators of inmate routines/guardianship, target antagonism, and target vulnerability at the individual level, and several indicators of guardianship at the facility level. Results: Assaults were more common among inmates with certain routines and characteristics that might have increased their odds of being victimized (e.g., less time spent in recreation; committed violence themselves during incarceration), and higher levels of assaults characterized environments with lower levels of guardianship (e.g., architectural designs with more 'blind spots', larger populations, and less rigorous rule enforcement as perceived by correctional officers). Similar findings emerged for thefts in addition to stronger individual level effects in prisons with weaker guardianship (e.g., ethnic group differences in the risk of theft were greater in facilities with larger populations and less rigorous rule enforcement). Conclusions: The study produced evidence favoring a bi-level opportunity perspective of inmate victimization, with some unique differences in the relevance of particular concepts between prison and non-prison contexts. This paper suggests that although carceral space seems to be sharply demarcated from the outside world, the prison wall is in fact more porous than might be assumed. The paper critiques Goffman's theory of the 'total institution' by deploying a geographical engagement with liminality to theorise prison visiting rooms as spaces in which prisoners come face-to-face with persons and objects which come from and represent their lives on the 'outside'. Drawing on a specific empirical example from recent research into imprisonment in the contemporary Russian prison system, it uses the example of visiting suites designed for long term 'residential' visits to explore the ways in which visiting spaces act as a space of betweenness where a metaphorical threshold-crossing takes place between outside and inside. The paper specifically explores the expression of that betweenness in the materiality of visiting, and in the destabilisation of rules and identities in visiting space. It contests the sense of linear transformation with which liminal spaces have previously been associated, suggesting that rather than spaces of linear transition from one state to another, liminal spaces can constitute a frustratingly repetitive, static or equilibriating form of transformation which is cumulative rather than immediate, and relates this suggestion to the wider study of prison visitation. Since the collapse of the treatment ideology, public opinion has assumed an increasingly central role as a basis for legitimising current crime policy. It is therefore important to be able to capture and describe the public's views on penal sanctions. Assessments of public opinion regarding appropriate sanctioning levels are largely made on the basis of different types of survey. The problems associated with how such surveys should be implemented in order to produce valid results have been discussed at length. The issue of how the results should be presented in order to provide a representative picture of public opinion have more rarely been explicitly problematized however. This article examines the question of how large a proportion, and which segments, of the public are represented in different descriptions of public opinion that can be produced based on survey results. The issue is examined on the basis of a national Swedish postal survey, in which the respondents were asked to state which sanction should be awarded in relation to six crimes described in the form of vignettes. The survey shows that public opinion on appropriate sanctioning levels is very varied. Summarizing public opinion is thus not a straightforward task. Different descriptions that are similarly representative in relation to one another lead to different conclusions as to what public opinion views as appropriate sanctioning levels. Routine references to public opinion are thus quite arbitrary unless those who refer to a certain description of public opinion also justify why this particular description is relevant. Correctional officers maintain control of the institutional environment by utilizing both formal and informal methods. Although research focusing on informal methods of control is sparse, studies have indicated these methods are essential for facilities to operate efficiently. This exploratory descriptive study examined differences in former jail and prison inmate perceptions of nine methods of informal control. A limited number of the participants indicated that officers use these methods to punish or control inmates, and from their perspectives, all methods examined were viewed as being effective means of control, to some extent. The current study connects survey data of inmates and correctional staff in the Dutch prison system in order to describe and explain the impact of staff orientation and staff working conditions on perceived prison circumstances of inmates. Importation and deprivation theory are combined to test an integrated model to explain perceived prison conditions. By surveying staff (N = 1750) and inmates (N = 4673) independently within the same period of time and by afterwards pairing the results on the level of the housing unit (N = 173) using multilevel techniques, it is found that inmates´ perceptions of the prison conditions vary considerably between housing units. It is also found that staff's perceptions of prison conditions show congruency with those of inmates. Another important finding is that in housing units where the orientation of staff towards inmates is relatively supportive, inmates perceive their circumstances as more positive. The paper explores the link between penal ideology and international trial justice from the perspective of sentencing. The argument is based on the premise that the perceived legitimacy of punishment is directly related to effective governance in criminal justice. As such, loss of faith, or lack of moral empathy by individuals and communities with the ideologies, processes and outcomes of punishment compromises the ability of criminal trials to function effectively in maintaining the 'rule of law'. The paper argues that more emphasis should be given explaining the moral foundations that underpin perceptions of 'justice' in sociological accounts of the 'reality' of sentencing, and proposes an analytical framework for conceptualising this. Adopting this approach, the paper draws on examples from national and international criminal justice to illustrate how the hegemony of penal ideology and its implementation compromises the ability of sentencing outcomes to resonate with the trial's 'relevant audience'. The paper then focuses on how penal ideology influences the construction of the factual basis for sentencing in international criminal trials, and considers the consequences of this for the perceived 'legitimacy' of international trial justice. It has long been contended that the criminal justice system extends the influence of patriarchy in society. Feminist and critical criminologists have produced countless examples of the male domination in the criminal justice system. Critics of law and criminal justice point out that the system treats women the same way as does the mainstream society (MacKinnon , ; Smart ). Therefore, criminal justice cannot be expected to remedy injustices legally before they are recognized as injustices socially. Sociological studies in crime and delinquency have also neglected gender issues. By employing the qualititaive research approach of field observation, this study focuses on how practitioners in three criminal courts in Southern Taiwan interact with female defendants. The findings point out that the court system was unbending in treating the observed defendants in a condescending manner, and expedited the trial process to pronounce the defendants' guilt. The study aims to offer explicit and nuanced empirical evidence of how gender complicates courtroom interaction. The article offers the author's insights on the condition of ex-convicts in the society, despite the implementation of prison, rehabilitation, and alternative systems to prepare them for reentry. The author contemplates the experiences of several ex-inmates where one does not know where to be employed, while the other was being haunted by his prison life on his education career. He calls for public attitude and policy change toward crime and punishment and employment assistance for ex-inmates.

Dostoevsky, Mandela, and others have long noted that prisons expose social realities, often hidden, particularly inequality and gaps between policy and practice. Prisons symbolize, mirror, and shape the communities and countries in which they exist. Although prisons informed and were intertwined with many of the defining moments of 1989, in the 20 years since, societies often failed to recognize the important role prison and punishment play in relationship to democracy. By not recognizing that “prison matters” in relationship to democracy, polities (whether in transition to democracy or established democracies) failed to adequately learn “prison lessons.” Starting with a case study of South Africa, this paper considers prisons during apartheid and under democratic governance. This case is connected to other comparative and international examples (including Russia, Brazil, and the USA) to identify five lessons learned and not learned concerning prison and democracy. First, policies and practices of imprisonment reflect social orders, especially structures of inequality and understandings of legitimate power and opposition. Second, countries transitioning to democracy seldom anticipate rising crime and invariably neglect the relevance of prisons. Third, nations do not adequately grapple with the role of prison in the past, especially the nondemocratic past. Fourth, in established and recent democracies, penal populism resulted as politicians defined prison as a solution to a host of social ills, ignoring the consequences of expanded punishment. Fifth, prisons shaped key substantive realities beyond their walls, from leadership to recidivism, scandals, fiscal deficits, and crises of legitimacy. [ABSTRACT FROM AUTHOR]

Most prison systems use quantitative instruments to classify and assign inmates to prison security levels commensurate to their level of risk. Bench and Allen (The Prison Journal 83(4):367-382, ) offer evidence that the assignment to higher security prisons produces elevated levels of misconduct independent of the individual’s propensity to commit misconduct. Chen and Shapiro (American Law and Economics Review, ) demonstrate that assignment to higher security level among inmates with the same classification scores increases post-release recidivism. Underlying both of these claims is the idea that the prison social environment is criminogenic. In this paper we examine the theoretical premises for this claim and present data from the only experiment that has been conducted that randomly assigns inmates to prison security levels and evaluates both prison misconduct and post-release recidivism. The experiment’s results show that inmates with a level III security classification who were randomly assigned to a security level III prison in the California prison system had a hazard rate of returning to prison that was 31% higher than that of their randomly selected counterparts who were assigned to a level I prison. Thus, the offenders’ classification assignments at admission determined their likelihood of returning to prison. There were no differences in the institutional serious misconduct rates of these same prisoners. These results are contradictory to a specific deterrence prediction and more consistent with peer influence and environmental strain theories. These results also raise important policy implications that challenge the way correctional administrators will have to think about the costs and benefits of separating inmates into homogeneous pools based on classification scores. A substantial body of empirical research examines how the huge expansion in incarceration in the United States since the early 1970s has influenced crime. These studies merge the effects of three conceptually distinct paths by which incarceration might reduce crime: general deterrence, specific deterrence and incapacitation. This issue of the Journal focuses specifically on the incapacitation path. This Introduction reviews the individual papers and offers the editors’ judgment as to the plausibility of progress using different research strategies. The author reflects on Angela Davis's critiques on the racism in the prison system and her call for justice and equality in the U.S. He made a comparison on the work of Davis and that of Michael Foucault and adds that the relationship between their work is both perplexed and informative. Furthermore, he said that the humanist vision of Davis calls for a political reconciliation of the country that has been disunited and damaged by the crime and trauma of slavery.

The author reflects on the issue on the prison system and the move of Angela Davis to abolish prisons in the U.S. He said that the growth of the prison system in the United States can be best answered by Davis's abolitionism. Furthermore, he argues that abolitionism will answer their fights for equality and social justice in the 21st century in the U.S. and that abolitionism calls for a change in their racializing democracy into a different democracy.

The aim of this study is to present a construction of the history of the prison system in Taiwan in the context of the intertwined structures of penal discourses and the governmentality of the state. The prison system in Taiwan has been subject to different ruling political regimes, ranging from colonised, authoritarian to liberal-democratic systems between 1895 and the present. The history of imprisonment can be divided into six stages, each of which consists of distinct governmental strategies that shape prominent penal discourses. My purpose was to uncover the exercising power of governmentality, further shaping, guiding and affecting the penal discourses via rationalities and technologies upon which prison administration depends. The Council for the Administration of Criminal Justice and Protection of Juveniles (Raad voor Strafrechtstoepassing en Jeugdbescherming) is an independent advisory, supervisory and judiciary board to the Netherlands Minister of Justice on matters relating to the prison system, the hospital order detention system, the probation system and the youth incarceration system. Members are recruited from a variety of backgrounds, such as magistracy, science, medicine, psychiatry and social work. As a rule, they have a full-time job in society. They are recruited by virtue of their expertise, competence and professional experience in relevant fields. Nowadays, there are about 60 members. The combination of the Council’s three tasks has been criticised. The argument is that the advisory and supervisory tasks of the Council could interfere with the independent and impartial nature of its judicial task. The supposed incompatibility of the three tasks has been one of the arguments of the Minister of Justice in defending his decision to set up an Inspectorate for the whole field of the administration of justice. This Inspectorate would overlap the Council’s supervisory task. So, legislation has been prepared in order to prevent overlap by taking away this task from the Council. The resistance to these plans was an important reason for the Dutch government to ask the Verwey-Jonker Institute to evaluate the performance of the Council. The Council performed very well in this evaluation. Its performance could not, therefore, really be used as an argument for curtailing its tasks. The independent nature of an Inspection Board is open to question, as it is functioning under the responsibility of the Minister of Justice. However, the Minister of Justice has not been convinced by this and other arguments, so there is a big chance that the Council will loose its supervisory task. [ABSTRACT FROM AUTHOR]

Some observers oppose imprisoning nonviolent drug offenders because they view incarceration as costly and such persons as generally benign. The career-criminal literature has established that perpetrators, including drug violators, commit an array of offenses. The current study merges these debates using a sample of 500 arrested adults selected from an urban jail in the western United States. Drug offenders amassed a much more extensive arrest history than other suspects net the effects of age, race, sex, prison history, and arrest onset. This is the second article of the trilogy devoted to the study of the sense of Venezuelan prison institutions. It shows how the research reported in the first article gives way to the central question presented in this paper: What are the conditions of possibility of our discomfort and dissatisfaction with the current situation in the Venezuelan prisons? The reflection on this question progresses by uncovering different ways of understanding the sense of prisons. These serve as hypothetical grounds of the moral intuitions that make the prisons problematical. As the reflection develops, it seems to indicate that what underpins the problematical nature of the prison problem is the same post-modern liberal order which, according to the first article of the trilogy, underpins prison schizophrenia. This poses some theoretical questions, which give way to the third article of the trilogy. Finally, the possibility of an in-depth solution to the Venezuelan prison problem is discussed. The Dutch Prison Service developed a new policy on indoor employment programmes. The development of this policy, the definition of these programmes and the chosen methodology of Individual Employment Counselling is described. Also some examples of good practice are given. We learned a great deal from good practice, from external advisors, from co-operation with partners like employers, probation services, local authorities and from comparable programmes in other European countries. The development of these programmes was supported by changes in the prison service, economic growth in the Netherlands, a new employment policy initiated by the Dutch government, and by sub-financing of the European Social Fund. Future challenges are: better matching of prisoners (their motivations, their capacities and handicaps) with the programmes, further development of co-operation with partners and the implementation of a good monitoring system.
