Almost 8 years after 1 February 2014, the day when the current Criminal Code entered into force, it seems to be a useful step to analyze how the principles of Romanian criminal law are reflected in this Code. Following the examination, we will find that some of the principles enjoy express consecration, such as the legality of incrimination or the legality of the criminal law sanctions, and others have different applications in the body of the Criminal Code or are deduced from the economy of the criminal provisions. In the present paper we will review the doctrinal conceptions regarding the principles of the criminal law and the way in which they are reflected in the current Criminal Code. The most important normative act, which regulates the matter of establishing, organizing and dissolving societies, is Law No 31/1990. According to Article 1 (1) of the Law No 31/1990, for the purpose of carrying out activities for profit, natural persons and legal persons may associate and form companies with legal personality, in compliance with the provisions of this law. Article 1 (2) of the same law provides that the companies referred to in paragraph (1) based in Romania are Romanian legal entities. Violations of legal norms regulating the establishment, organization, modification and cessation of the activities of societies can be manifested in various forms and may, as the case may be, imply criminal, civil, disciplinary, tax liability etc. Taking into account the fact that the companies have a special importance in the field of business, the Romanian legislature criminalizes certain facts of violation of the norms provided by the Law No 31/1990. According to Article 247 of the Law No 187/2012 for the implementation of the Law No 286/2009, the Criminal Code entered into force on 1 February 2014. The new Criminal Code provides four articles for the regulation of the application of the criminal law in time: Article 3 refers to the principle of the activity of the criminal law, Article 4 regulates the retroactivity of the criminal law of decriminalization, Article 5 is devoted to the application of the most favourable criminal law before the final judgment of the case, Article 6 concerns the application of the most favourable criminal law after the final judgment of the case, and Article 7 is reserved to the application in time of the temporary criminal law. Fraudulent bankruptcy is one of the criminal law's "Cinderellas" because the legislator was highly oscillating with regard to the sanctioning regime, the rules indicting this deed suffered frequent changes of the contents and the seat of the matter was found in the recent years in several legal acts (the Commercial Code, Law no. 31/1990, Law no. 64/1995, Law no. 85/2006 and the 2009 Criminal Code).
