Adopted guidelines reflect a harmonised European approach to a specific scientific issue and should reflect the most recent scientific knowledge. However, whilst EU regulations are mandatory for all member states and EU directives must be followed by national laws in line with the directive, EMA guidelines do not have legal force and alternative approaches may be taken, but these obviously require more justification. This new series of the BJCP, developed in collaboration with the EMA, aims to address this issue by providing an annotated version of some relevant EMA guidelines and regulatory documents by experts. Air transport is an essential component of the tourism industry, and the number, frequency, and capacity of flight connections may influence the level of tourism demand, especially for island destinations. This paper evaluates the influence of air transport on tourism arrivals to selected islands in seven southern European Union countries to determine the nature of the relationship between tourist arrivals and air transport, specifically, whether air transport services generate tourism demand or merely enable touristic flows. The paper uses panel data and applies an econometric model with justifications for endogeneity and dynamic issues. Results show a moderate impact of transport infrastructures on generating additional tourist arrivals; however, the model shows that air transport is a prerequisite to developing tourism demand and is not the only determinant in increasing tourist arrivals. By providing financial resources, conditional to the implementation of the (social) recommendations in the Semester and the principles of the European Pillar of Social Rights, the Recovery and Resilience Facility (RRF) has opened new political and institutional opportunity windows for the multi‐level co‐production of social policies. The article first dives into how the RRF has been translated into national social policies choices, by assessing the alignment of reforms and investments with the Semester social recommendations and their capacity to address the social vulnerabilities identified in the Pillar's Social Scoreboard. Second, it sheds light on the interaction between the European Commission, in charge of assessing and monitoring the RRF, and the national governments, the key actors in setting‐up and implementing the plans. Comparing six case studies (Italy, Germany, Spain, Croatia, Belgium and Austria), the article shows that the RRF has only partially contributed to reinforcing member states' compliance with social Country Specific Recommendations and the role of the Social Pillar in the drafting of National Recovery and Resilience Plans has been very limited. This notwithstanding, the RRF has contributed to fasten‐forward the implementation of welfare reforms and initiatives which would have been remained on the paper, especially for whose countries with limited fiscal capacity. Furthermore, it provides empirical evidence of the collaborative approach between the Commission and the national government, substantiating the claim of the emergence of a new mode of coordinative Europeanization. This paper examines institutional change in father‐specific leave ‐ a centre‐piece of the EU's work‐life balance directive (WLBD) ‐ from the perspective of gradual institutional change. The WLBD, a highly contentious directive, represents a litmus test for the possible impact of the European pillar of social rights (EPSR), on welfare state institutions, which are responsible for the organisation, financing and delivery of social rights in member states. The analysis comprises in‐depth case studies in Denmark, Germany, France and Poland, with different combinations of family and parental leave policies prior to the WLBD. The findings reveal that the EU's directive is leading to convergence in paternity leave, but to divergence in parental leave. Our study is important because it shows that even if EU directives in social policy in principle can lead to upwards social convergence across the EU, when they are relatively weak in terms of precise constraint, for instance, for the level of remuneration for leave, this leads to differentiated integration. This could undermine the very purpose of the EPSR, which seeks to improve social rights for all citizens across the EU. Similar dynamics are likely to be present in other areas at the welfare state‐labor market nexus, such as minimum wages or platform work, where the EU is also developing regulation under the auspices of the EPSR. This paper argues that the EU legislative process should be used for taking all decisions at European level that matter, banning the various backroads of European decision‐making (competence creep) that are currently legal but not legitimate. This is a silver bullet, resolving at once a range of seemingly disparate but intimately connected legitimacy problems across all areas of EU activity, that ultimately result from an incorrectly calibrated state of transnational constitutional democracy at EU level, where certain aspects are over‐constitutionalised while others remain fundamentally under‐constitutionalised. This is therefore the key transversal issue that the Conference on the Future of Europe and its ensuing changes should address. The article focuses on the political aspects of the Action Plan for Capital Markets Union (CMU) as well as legislative proposal related to securitization proposed by the European Commission. Topics discussed include the goal of the proposed CMU which include reduction of fragmentation in the financial market, strengthening crossborder capital, and improvement on the access to finance, the significant of the CMU in the single market considering financial market integration, and the financial market integration in the European Union (EU).

Abstract: This article explores the main determinants of youth unemployment in Europe in the period 2002 to 2014 by estimating panel data models for the 28 Member States of the European Union (EU). Heterogeneity is acknowledged by estimating models for subsamples of countries with “high” and “low” youth unemployment rates. The main results suggest that youth unemployment is more pronounced in countries with poor GDP growth, a low share of construction activity and high public debt. Reduced mobility (owing to homeownership), corruption, reception of a high level of remittances and a lack of possibilities for young people to live outside parental homes are also important factors. Several EU countries import wood pellets from the south-eastern United States. The imported wood pellets are (co-)fired in power plants with the aim of reducing overall greenhouse gas ( GHG) emissions from electricity and meeting EU renewable energy targets. To assess whether GHG emissions are reduced and on what timescale, we construct the GHG balance of wood-pellet electricity. This GHG balance consists of supply chain and combustion GHG emissions, carbon sequestration during biomass growth and avoided GHG emissions through replacing fossil electricity. We investigate wood pellets from four softwood feedstock types: small roundwood, commercial thinnings, harvest residues and mill residues. Per feedstock, the GHG balance of wood-pellet electricity is compared against those of alternative scenarios. Alternative scenarios are combinations of alternative fates of the feedstock materials, such as in-forest decomposition, or the production of paper or wood panels like oriented strand board ( OSB). Alternative scenario composition depends on feedstock type and local demand for this feedstock. Results indicate that the GHG balance of wood-pellet electricity equals that of alternative scenarios within 0-21 years (the GHG parity time), after which wood-pellet electricity has sustained climate benefits. Parity times increase by a maximum of 12 years when varying key variables (emissions associated with paper and panels, soil carbon increase via feedstock decomposition, wood-pellet electricity supply chain emissions) within maximum plausible ranges. Using commercial thinnings, harvest residues or mill residues as feedstock leads to the shortest GHG parity times (0-6 years) and fastest GHG benefits from wood-pellet electricity. We find shorter GHG parity times than previous studies, for we use a novel approach that differentiates feedstocks and considers alternative scenarios based on (combinations of) alternative feedstock fates, rather than on alternative land uses. This paper presents a measure of effective multifactor productivity (MFP) growth for Canada, the U.S., Australia, Japan and selected EU countries. The measure differs from the standard MFP growth as it measures productivity growth in the production of different types of products instead of by industry and it captures the effect of productivity gains in both foreign and domestic upstream industries. The paper finds that the increase in effective MFP is closely associated with the decline in output price and improvement in international competitiveness. Multifactor productivity growth for small, open economies and for the production of manufacturing, investment and export goods is partly attributable to productivity gains in the production of intermediate inputs in foreign countries. This paper considers how competitiveness impacts macroeconomic performance in 11 euro area countries. VAR models are estimated for the individual countries using quarterly data from 1995Q4 to 2013Q4. Besides unit labour costs as a competitiveness measure, the models include GDP, the current account balance and domestic credit. The empirical analyses show that changes in unit labour costs help explain GDP dynamics in the short and medium term in most countries, whereas they have little explanatory power for the current account balance or domestic credit for most countries. Overall, the effects of the unit labour costs vary substantially across the countries in the euro area. The heterogeneity suggests that policy measures aiming to improve economic growth, correct current account imbalances and ensure financial stability need to take country‐specific features into account. This paper examines the impact of a 'no deal' or 'hard' Brexit on the recognition of insolvency proceedings commenced in the UK by the remaining Member States of the European Union (EU) post‐Brexit. The paper considers the framework currently implemented by the Recast European Insolvency Regulation and the possible approaches when it will cease to apply to proceedings commenced post‐Brexit. The paper identifies that there will be no overarching framework in the event that 'no deal' is reached between the UK and the EU for post‐Brexit arrangements, resulting in reliance on individual Member States' domestic laws to determine recognition of insolvency proceedings commenced in the UK. The paper sets out the contrasting approaches of five of the UK's key trading partners in the EU: France, Germany, Ireland, the Netherlands and Spain. The paper concludes that UK insolvency proceedings will not be recognised in a consistent manner in these Member States, which will be detrimental to stakeholders in, and ultimately the economies of, the UK and these Member States. In doing so, the paper underlines the importance of an agreement being reached between the UK and the EU on the recognition of cross‐border insolvency proceedings for the benefit of all parties. The death and disease burden of non‐communicable diseases falls disproportionately on members of lower socioeconomic groups. This paper explores NCD prevention measures introduced through EU consumer law in order to assess the impact these have had on health inequalities. It demonstrates that these interventions often have limited impact, and therefore maintain inequalities. Indeed, when interventions do work, they tend to be more effective with advantaged citizens than disadvantaged citizens, and therefore increase inequalities. From a behavioural research perspective, this paper demonstrates why these interventions – which focus on regulating the consumer information environment – have failed to reduce health inequalities, and analyses the debate on the extent to which behavioural research should act as a core consideration in public health related consumer policy. The paper concludes that, while regulating consumer information is a useful tool for NCD prevention, if information‐based interventions are to reduce health inequalities the EU will need to incorporate greater insights from the way consumers actually behave. Increasing awareness of the potential risks involved in lending to heavily indebted governments focuses attention on credit pricing in the Eurodollar market. This paper utilizes a recent survey of country-by-country risk assessments as perceived by lenders to show that a systematic relationship exists between these assessments and interest rates in the Euromarket. The relationship is derived from an underlying model described in the paper. This paper critically examines the proposal to overcome the judicial definition of fundamental rights by using constitutional amendment procedures. Authors known as "political constitutionalists" have advocated weak‐form judicial review as an alternative to the constitutional practice currently prevailing in liberal democracies. The proposal under consideration here seeks to achieve this alternative by making constitutional amendment as easy as possible, i.e., through minimal constitutional rigidity. The discussion begins by questioning the idea of adopting institutional design as a suitable criterion for rating a judicial review system as "strong" or "weak." Then the alleged relevance of constitutional amendment in the specification of constitutional rights is called into question. Lastly, the paper reaches a double conclusion. On the one hand, minimal constitutional rigidity is not an alternative to prevailing constitutional practice, but a more collaborative version of the same practice; on the other hand, minimal constitutional rigidity only represents a genuine alternative design when it is part of a model ("strong popular sovereignty") aimed at overcoming the current constitutionalist paradigm. This paper focuses on the role played by the Agency for Fundamental Rights in the wake of the euro area crisis. The Agency was created as part of a wider trend towards a broader, more pro-active strategy for the protection of fundamental rights that includes administrative and political rights promotion as a complement to judicial enforcement. In the context of the euro crisis, however, the Agency has not been able to fulfil this role. This paper will analyze the reasons for this missed opportunity, as well as its consequences. It will argue that the sidelining of the Agency in this area is due to the confluence of two factors: on the one hand, the Agency's lack of discretion in setting its own agenda; and, on the other, the predominance of the executive, and resulting resurgence of intergovernmentalism, that have been a feature of post-crisis developments. Ultimately, this paper argues that the sidelining of the Agency in this context is an unfortunate result, given the magnitude of the political debate in this area and the valuable role that the Agency might have played or could still play in informing it. ABSTRACT This article introduces the subject of this special issue and presents the papers that follow. It traces the origins of the label 'transit migration' to discussions of what was called the 'new migration' in the early 1990s. These migrations related to the particular geopolitical context at the end of the Cold War. Though they established the pre-emptive rationale whereby concern is focused as much on potential migration as on actual movement, there have been four substantial changes since then. As the geopolitical context has changed, so has the geographies of migration, with a general shift of attention from east-west to south-north; the technological supports of migration have improved, allowing migrants easier, cheaper access to different routes; the categories of migrant have proliferated and finally similar movements may be observed all over the world though only those in the vicinity of Europe are labelled as 'transit'. This leads us to a critical stance around the term 'transit' that is common to all papers in this special issue. Abstract: Onward migration is a rising issue in migration studies as a consequence of the growing complexity in migration patterns worldwide. This paper analyses historic and economic reasons behind the recent surge of onward migration from Southern European countries and, more specifically, Italy. Using 2014 ORIM data about short‐term onward migration intentions and a logistic regression model, the paper explores factors that select aspirant onward migrants from Italy. The model tests the effects of socio‐demographic and economic factors. The results of the study question the idea of citizenship as the highest level of integration in the host country and suggest that the recent wave of onward migration from Italy is mainly a reactive phenomenon triggered by the economic crisis. Most of all, this study explicitly underlines the role of gender in shaping intentions of short‐term onward migration in Italy. The gender‐sensible approach adopted in the present study shows the important role of women in the decision‐making process of couples: female unemployment significantly increases intentions of onward migration, and the migration is also considered as an opportunity for the spouse and a gain in the economic prospects of the entire family. Abstract: By reflecting on both the exclusionary and the inclusionary role of humanitarian migration and border management in the Central Mediterranean, this paper explores the relationship of humanitarianism with the delocalization of the EU border and with human rights. First, the paper analyses the role of human rights in the institutional humanitarian discourse about migration and border management at the Mediterranean EU border. The paper then analyses the Italian operation Mare Nostrum and, more generally, Italian humanitarianized border management in the Central Mediterranean. In doing this, it shows that humanitarianism contributes to the discursive legitimation and spatial delocalization of exclusionary policies and practices. Moreover, humanitarianism contributes to a symbolically and legally subordinate inclusion of migrants in the European space. While such humanitarian inclusion can be more inclusive than what human rights would require, it is posited as an act of grace rather than an enhancement of human rights. In both its exclusionary and inclusionary dimension, humanitarianism transcends and expands territorial boundaries by outsourcing responsibilities and enhancing delocalized border management. Abstract: Among the factors highlighted by the literature as crucial for the success of cohesion policies in generating satisfaction among citizens, and therefore in acting positively on the constitution of an European identity, this paper emphasizes a particular one, territorial identity. Elaborating on the definition of territorial identity as a local condition in which private interests coincide with public ones, the paper claims that territorial identity plays an important role in a European identity‐building process. In fact, by increasing the probability that local public expenditures match private interests, territorial identity generates a favourable context where the critical factors that hamper the successful programming, design and implementation of cohesion policies can be overcome. Abstract: This paper explores the broader setting of urban and economic development that links ports and cities in Europe and aims at enhancing our understanding of the port‐city interface. A relational view is taken for linking local developments and policies with overarching, more remote spheres of influence and impact, which can be considered both beneficial and critical for the port and the city. In order to illustrate the argument, a framework of three issues is applied to discuss the port‐city interface: first, the role of ports as economic engines of their wider region; second, the cruise ship industry as a market segment that re‐connects port and city; third, semi‐political bodies and institutions that play key roles as intermediaries and knowledge brokers. The finding of the paper shows the relative effectiveness of the 'one size fits all' policy of the European Central Bank. The paper provides strong evidence in favor of this by testing whether the monetary policy effects (footprints) found in inflation uncertainty converge to a common level. These footprints are measured as the fraction of the estimated policy-induced reduction in this uncertainty. The testing was conducted by applying a bootstrap-type test in a regression of the rate of growth of these fractions on their initial values, computed for 16 euro area countries. The economic crisis which has affected the southern EU countries since 2008 set in motion new migration trends. In the case of Portugal, post‐crisis migrations have been in two main directions: northwards to more prosperous European countries, and southwards to former colonies in Africa, notably the oil‐producing state of Angola. Focusing on this latter migration, the paper is structured around two main questions. First, which migration‐theoretic frameworks can be deployed to explain this new North–South migration flow? Relevant concepts include the notion of Portugal as "semi‐periphery" within European and global migration systems; the role of post‐colonial theory, especially ideas about "coloniality" and "Lusotropicalism"; and the function of myth and racialised discourse in constructing this as a high‐skilled migration. The second question is more empirical and relates to the descriptive characteristics of the Portuguese migration to Angola and to the experiences of the migrants and their Angolan co‐workers and employers. Key here is a deconstruction of the notion of "skill" in Portuguese migrants' experiences of employment in Angola. The paper studying the 1995 EU-Turkey Customs Union (CU) delivers a quantitative assessment of trade and GDP per capita effects of the CU on the Turkish economy. Our Synthetic Control Method based analysis reveals, contrary to the results of most studies in the literature, that the CU's effects have been substantial by any standards. In particular, the paper shows that in the absence of the EU-Turkey CU, Turkish exports to the EU and GDP per capita would have been 38 per cent and 13 per cent less, respectively. The 2014 European elections led to a sharp rise in the electoral consensus of parties and independent parliament members perceived as eurosceptic. This paper analyzes the interconnections between distressed economies and the electoral success of hard-line eurosceptic parties. On a panel of 108 elections between 2008 and 2015, the random-effects model shows the relative effect of long- and short-term political trust, economic performance indicators, and institutional variables in determining the rise of hard-line eurosceptic parties. In contrast with previous studies, which have tended to de-emphasize the effect of economic performance in determining the success of eurosceptic forces, the results of this paper detect both a direct and a mediated effect of the economic crisis on the electoral success of hard-line eurosceptic parties. Courts and scholars across jurisdictions increasingly identify personal autonomy as the primary rationale for the right to religious freedom. But there are tensions between autonomy on one hand, and religious belief, practice and proselytism on the other. This paper will focus on two tensions which have unappreciated implications for religious freedom jurisprudence, particularly that of the ECHR. The first tension stems from the resistance of some religious beliefs to revision. The second stems from the manipulative nature of some modes of religious proselytism. This paper argues that, given these tensions, the protection currently offered to religious beliefs, practices and proselytism by the right to religious freedom cannot be justified by reference to the value of autonomy. The paper analyses the determinants of regional disparities in per capita gross domestic product (GDP) and their evolution over time in the enlarged European Union (EU). With reference to the literature it groups EU regions on the basis of three different factors-specialisation, socio-economic features, and innovation. It then analyses regional disparities in per capita GDP (EU-relative and country-relative) across groups over 2004-2011 using both non-parametric tools and traditional regression analysis with spatial effects. The paper finds that EU-wide convergence actually conceals growing divergence across old member regions and within new members. Coming to the factors that lie at the heart of regional disparities, country factors lose importance for newcomers but become more important for older members, notwithstanding longstanding integration. Socio-economic factors and innovation instead become increasingly important for all areas, socio-economic factors lying at the heart of within-country differences and innovation more of those between regions. In the last year, a central issue in regional economic growth debate has been represented by the empirical analysis of Verdoorn's law related to the long-term dynamic relationship between the rate of growth in output and the productivity growth due to increasing returns. Several papers have tested Verdoorn's law on European countries as well as many other world economies. Recently, attempts have been made to provide foundations for a spatial version of the original law specification. The main contributions were dedicated to the inclusion of spatial dependence in the economic model. Surprisingly, in the literature on Verdoom's law the analysis of the spatial heterogeneity is not often considered. The aim of this paper is the regional analysis of the spatial dependence and heterogeneity in Verdoorn's law, identifying spatial regimes that can be interpreted as clusters of productivity growth in European regions at NUTS 2 level. To pursue this objective, an optimization algorithm for the identification of groups is used. This constitutes a modified version of Simulated Annealing. [ABSTRACT FROM AUTHOR]

This article investigates whether the varying prevalence of temporary employment contracts across Economic and Monetary Union (EMU) countries can explain their different unemployment dynamics. Using a database of labour market institutions, dynamic panel regressions are carried out for 11 eurozone countries for 1995-2013. Labour market duality - i.e. the co-existence of permanent and temporary contracts - is found to have a robust and significant effect on unemployment dynamics: a high duality rate increases the response of unemployment to output shocks while decreasing its persistence. A balanced current account in the euro area has disguised sizable imbalances at the country level, exposing the common currency area to severe pressures during the financial crisis. The key contribution of this paper is to evaluate the adjustment process using the New Multi Country Model (NMCM) at the country and sectoral levels. The model suggests that a recovery in wage competitiveness reduces external deficits but has only mildly expansionary effects at the cost of higher net borrowing by households. It also suggests that the impact of an aggregate demand shock in Germany is not enough to lead to a rebound in economic activity and address external imbalances in the rest of the euro area. Finally, the presence of supportive external conditions, while facilitating the implementation of vital reforms, would not necessarily unravel intra-euro-area imbalances. [ABSTRACT FROM AUTHOR]

This paper discusses some new evidence on intra-industry trade (IIT). In particular, we focus on EU trade with Eastern European countries, using trade data at the harmonised commodity description and coding system (HS) eight-digit product level for the period 1988-2010. Our findings include Eastern European countries' rise up the quality ladder, and by contrast, the substantially lower prices of China's exports to EU countries vis-à-vis China's imports from them. Transport infrastructure has represented one of the cornerstones of development and cohesion strategies in the European Union (EU) and elsewhere in the world. However, despite the considerable funds devoted to it, its impact remains controversial. This paper revisits the question of to what extent transport infrastructure endowment - proxied by regional motorways - has contributed to regional growth in the EU between 1990 and 2004. It analyses infrastructure in relationship to other factors which may condition economic growth, such as innovation, migration, and the local 'social filter', taking also into account the geographical component of intervention in transport infrastructure and innovation. The results of the two-way fixed-effect (static) and difference GMM (dynamic) panel data regressions indicate that infrastructure endowment is a relatively poor predictor of economic growth and that regional growth in the EU results from a combination of an adequate 'social filter', good innovation capacity, both in the region and in neighbouring areas, and a region's capacity to attract migrants. The meagre returns of infrastructure endowment on economic growth raise interesting questions about the opportunity costs of further infrastructure investments across most of Western Europe. Este artículo revisa el interrogante de hasta que punto ha contribuido la dotación de infraestructura de transporte - representada por las autopistas regionales - al crecimiento regional en la UE entre 1990 y 2004. Se analiza la infraestructura en relación a otros factores que podrían condicionar el crecimiento económico, como la innovación, la migración, y el 'filtro social' local, teniendo en cuenta asimismo el componente geográfico de la intervención en la infraestructura de transporte y la innovación. Los resultados de las regresiones de datos de panel de efectos fijos (método estático) de doble vía y MGM por diferencias (método dinámico) indican que la dotación de infraestructura es un pobre indicador del crecimiento económico y que el crecimiento regional en la UE tiene su origen en una combinación de un 'filtro social' adecuado, en una buena capacidad innovadora tanto en la región como en áreas vecinas, y en la capacidad de la región de atraer migración. Los escasos retornos para el crecimiento económico de la dotación de infraestructura suscitan cuestiones interesantes sobre los costos de oportunidad de futuras inversiones en infraestructura para la mayoría de Europa Occidental. The paper explores the impact of Europeanization on bureaucratic autonomy in the new EU member states using as a case study the Agricultural Paying Agency in Slovakia. The paper shows that Europeanization had limited sustained impact on the personal autonomy of senior officials; however, it requires and sustains the personal autonomy of an extensive cadre of mid-level and junior civil servants. At the same time, it necessitates and continues to sustain significant change in the way agricultural subsidies are distributed, with a high level of autonomy in implementation and a lower, but still significant, measure of autonomy in policy-making. These conclusions can also generally be supported by evidence from Lithuania and Poland. In addition, the coercive elements of Europeanization interacted with the temporarily high bureaucratic autonomy in Slovakia to ‘open’ non-coercive channels of Europeanization of agricultural subsidies and beyond. This paper presents a new concept – the global roles of currencies. The concept combines the domestic and international (cross-border) use of currencies, and therefore captures the overall importance of different currencies in a globalized economy. The measure of a currency's global role is based on the size and stage of development of the underlying economy, as well as the size and stage of development of its financial markets and the scope of financial instruments available in this currency. The paper applies the concept to 22 currencies of advanced and emerging economies. The results confirm the well-known ranking for the leading currencies – in particular the US dollar and the euro – but give considerably greater weight to currencies of emerging economies than the results obtained from the international debt market, which has so far been used as the basis for measuring the international role of currencies in capital markets. The paper also discusses this established measure in detail, arguing that in view of financial globalization, an indicator based on currency shares in the international debt market alone represents a decreasing share of international financial market activity, as this market excludes government debt, other domestic debt and equities, which are increasingly of interest to international investors. The paper also presents an empirical application of the new global concept to examine cross-border portfolio holdings in debt and equity markets across advanced and emerging economies. It finds that the global role indicator is positively correlated with such holdings and, especially for emerging economies, fares better than the established international debt market indicator. While the harmonisation of insolvency law in the European Union (EU) has been a top priority on the European institutions' agenda in the last decade, it is well known that this endeavour has been slow and has often met resistance from the Member States. The COVID‐19 pandemic revealed that top‐down harmonisation of insolvency (i.e., introduced at EU level) has been temporarily halted. The urgency to control or mitigate the economically and financially destructive effects of the pandemic has, nevertheless, forced European governments to adopt domestic strategies and laws in the area of insolvency. Interestingly, however, such measures show that insolvency and restructuring law responses to the COVID‐19 pandemic, albeit largely uncoordinated, reflect a phenomenon of bottom‐up harmonisation (i.e., introduced by Member States) indicating a convergence towards common approaches. This paper interrogates the insolvency law responses to the COVID‐19 pandemic in six European countries (Denmark, France, Germany, Italy, The Netherlands, the United Kingdom). It uncovers the inadequacy of the EU's harmonisation language, and the limits of harmonisation strategies in insolvency and restructuring law. A wave of privatisation is unfolding in Europe in the wake of the financial crisis, but it has yet to receive serious scholarly attention. This paper examines the case of Ireland, where an austerity strategy and European Union International Monetary Fund bailout conditionality have given impetus to the transfer of public assets to the private sector. Theoretically, the paper explains the roots of the phenomenon with reference to a reformulated concept of 'accumulation by dispossession' whose usefulness lies in emphasising the politico-economic drivers of privatisation, which have been neglected in the mainstream literature. A typology is presented that argues that accumulation by dispossession manifests itself, in practice, through four main processes: (1) private repossession of assets nationalised during the financial crisis; (2) restructuring of state-owned enterprises; (3) commodification of assets and services hitherto located outside the market; and (4) privatised stimulus through public-private partnerships. Research into the mobility of European Union (EU) citizens has contributed to a better understanding of the social effects of European integration. A growing body of literature highlights that naturalised third-country nationals are also making use of their 'freedomof movement'. This paper proposes a typology of 'new EU citizens' who onward migrate between member states. It draws on relevant statistics and qualitative empirical research carried out with Dutch-Somalis, Swedish-Iranians, and German-Nigerians who relocated to the UK. In contrast to research with native-born EU movers, our findings indicate that the majority of naturalised EU citizens onward migrated as a result of the discrimination and racism they experienced in their previous place of residence. In this paper, we conceptualise the interactions of integration and transnationalism as a potential trigger for onward migration. We illustrate how onward migrants are able to complete certain aspects of their integration process in a second member state. Moreover, we show how migrants maintain transnational ties across several destinations and therefore contribute to a broader understanding of transnationalism. [ABSTRACT FROM AUTHOR]

In its White Paper on the Governance of the European Union the European Commission has adopted a narrow concept of governance which focuses almost exclusively on public institutions exercising legislative and executive power (in other words institutions of government ). The article suggests that a theory of multi-level control in the EU would attend to greater variety both in the available governance institutions and the techniques of control. The deployment of an analysis grounded in theories of control suggests that the European Commission is substantially holding to a long-held preference for instruments of government premised on the exercise of hierarchical power. This reform path sits uneasily with revived concerns to render the governance of the EU more democratic. Equally it inhibits the generation of more efficient governance arrangements which place greater dependence on communities, competition, and design as alternative bases of control to hierarchy. Control theory suggests that the assertion of different reform agendas and institutional structures by other actors can check the more wayward (and arguably illegitimate) tendencies within the Commission plan, whilst drawing in alternative bases of control which, when combined, may yield technically superior governance solutions. Through the European Social Fund (ESF) and the Fund for European Aid to the Most Deprived (FEAD), the European Union (EU) acts as a 'material supporter' of national welfare states. Remarkably, the European Social Fund Plus, integrating ESF and FEAD, is presented as the main financial instrument to implement the European Pillar of Social Rights (EPSR). This raises the question of what these levers can do in terms of financial support, especially for Member States with greater social needs. By using the Social Scoreboard indicators that monitor the implementation of the EPSR, we analyse the size and distribution of ESF and FEAD according to Member States' economic capacity, social needs and efforts required to meet the European social goals. We find that the funds benefit relatively more the poorer Member States who also tend to have greater social needs. However, especially for ESF, there are significant deviations from this general pattern. Some countries consistently receive less funding than others with similar levels of social needs, and vice versa. Moreover, if, from the perspective of upward convergence, the budgets are expressed as a percentage of the efforts required to lift all income‐poor citizens to the EU‐wide at‐risk‐of‐poverty threshold, countries who need to make the greatest efforts receive less funding. These outcomes are partly driven by the funds' allocation rules, which give only little importance to the great social discrepancies between countries. Europe has a long history of cartels, but the changes in the scale and geography of collusion in the European market from the post-war decades until the present have not been systematically investigated. Using network analysis methods and an original dataset based on decisions in EU cartel cases, this paper maps the developments in detected collusion in the European market from 1958 to 2008 and tentatively explains these developments. It appears that collusive activities increased during the 1960s and after the mid-1980s and that a long decline in the scale of collusion began in the mid-1990s. Moreover, the geographical spread of collusive activities in Europe increased considerably from 1969 to 1993. To facilitate an explanation of these and other findings, the paper presents a three-dimensional analytical framework that emphasises the importance of anti-cartel regulation, major changes in the business environment and the size of national economies. This paper contributes to a growing body of work on labour market migration to the UK from the new Member States (NMS) of the European Union, particularly the migration of Polish nationals to the UK, drawing attention to the weaknesses of existing data sets which attempt to quantify these migration flows and in particular to map the geographical distribution of migrants. The analysis of Worker Registration Scheme ( WRS) and National Insurance Number ( NINo) allocation data demonstrates that NMS migration has focused on urban and rural locales rather than having a predominantly rural or 'peripheral' area bias. The paper also argues that the discrepancies between WRS and NINo data potentially reveal a 'hidden' geography of self-employment and entrepreneurial activity among NMS migrants which merits further investigation. The European Commission's open consultations of stakeholders are a central mechanism of the attempt to practice participatory governance at the European level and to open the political process to contributions from the societal sphere. This paper analyses the current practice of open consultations as one important operationalisation of participatory governance and as an implementation of Article 11 of the Treaty of the European Union ( TEU). It asks whether consultations can be a means to give voice to the citizens and to increase the legitimacy of European institutions. The paper presents an empirical analysis of the field of participants in the consultations. A main finding is that business and industry organisations dominate the consultative process while the participation of citizens and not-for-profit organisations is generally weak. The paper explores to which extent the consultations can, considering the empirical findings, be seen as a suitable way for direct or representative citizen participation. [ABSTRACT FROM AUTHOR]

Abstract: This article investigates the evolution of job tenure for the time period 2002–2012 using microdata from the European Union Labour Force Survey (EU‐LFS). Overall, the data show a slight increase in average job tenure at the EU level, which can be explained by disproportional lay‐offs of short‐tenured workers during the crisis. When controlling for changes in the demographic composition of the workforce, an underlying negative trend in mean tenure becomes visible. Job tenure evolved very differently across the EU before and during the crisis, highlighting the importance of institutional frameworks, especially employment protection legislation (EPL). Abstract: What is the material context of constitutional order? The purpose of this paper is to offer an answer to that question by sketching a theory of the material constitution. Moving beyond the interwar constitutional theories of Heller and Mortati, the paper outlines the four ordering forces of the material constitution: political unity; a set of institutions; social relations, and fundamental political objectives. These forces constitute the substance and dynamic of constitutional ordering, in internal relation with the formal constitution. Because these ordering forces are multiple, and in tension with one another, there is no single determining factor of constitutional development. Neither is order as such guaranteed. The conflict that characterises the modern human condition might but need not be internalised by the process of constitutional ordering. Abstract: The aim of the paper is to detect, through dynamic panel data techniques, the long‐run macro drivers of citizens’ mood toward European institutions and to support the existence of an inverse relationship both in the short and in the long‐run between trust on one side and the rate of unemployment and the discretionary fiscal policy measures on the other. This is valid in the whole Eurozone and in particular in peripheral countries. This outcome gives support to the conclusion that the process of institutional consolidation should pass through a greater political sensibility toward some specific economic variables. Abstract: First embodied by the European Supervisory Authorities in 2010, agency governance in the financial sector has gained momentum with the creation of the Single Resolution Board (SRB) – an EU agency with considerable competencies in banking prudential policy. Within a short period, backed by the ‘ESMA‐Short Selling case’ judgment, agencies have progressed from supporting the European Commission with their quasi‐rule making, to a more prominent role in the decision‐making process, potentially influencing policy‐makers' agenda. By engaging in a qualitative analysis of legal documents, official texts and relevant scholarship, this research note examines the formal framework and practical aspects of SRB's governance, in order to substantiate whether its establishment presents a ‘qualitative increase’ in financial sector agencification. At the same time, the research note highlights problematic issues arising because of the limitations set by the Meroni doctrine arguing that the Board's wide powers ‘on paper’ may prove challenging to implement in practice.
