The article discusses the 2008 decision of the European Court of Justice (ECJ) on intellectual property cases. The ECJ clarified the determination of trademark distinctiveness in the OHIM v. Celltech R&D case. The Appeals Board of the European Patent Office decision shows the difference in European and U.S. patent law on interpretation of claims in the Warner Lambert Co. case. The English Patents Court denied the stay of a patent revocation action in England pending the outcome of the European Patent Office (EPO) proceedings.
