In recent decades, both academic research and industrial relations practice have been increasingly concerned with whether, and to what extent, transnational forms of labour regulation might constitute a countervailing power to globally operating companies. And although numerous studies have analysed the various instruments and institutions of transnational labour regulation – such as Global Framework Agreements, trade union networks and European or World Works Councils – as yet there has been little in the way of exploration of their dynamics or interconnections. Against this backdrop and based on a comparison of three case studies of multinational companies, we focus on what we consider to be the 'missing link' between the dynamics of social action and the interdependencies of institutions in order to explain how transnational institution building can contribute to the development of transnational labour regulation. Specifically, we investigate how different pathways to transnational labour regulation have been the outcomes of actions taken by actors in a multinational corporation and how, in turn, these developments shaped the dynamics of subsequent action. The study underlines that those pathways can only be properly understood when seen in terms of social actors, their power resources and their willingness and capacities to deploy them. The German dual system of labour relations is at a crossroads. The two cornerstones of the system, collective bargaining at the industry level and codetermination of works councils in companies and establishments, are eroding. Only one third of the workforce is now covered by both institutions. In this situation, trade unions have developed new strategies for revitalisation, including new strategies regarding derogations from collective bargaining agreements, new approaches to organising, and new projects to activate works councils. As a result, the traditional boundaries between union action at the establishment and industry levels, traditionally characterised by a strict separation of roles between works councils and trade unions, are dissolving. The trade unions are now developing active strategies at the establishment level with the aim of strengthening their position in the companies, and strengthening the capacity of works councils to act. At the same time, the importance of works councils as actors in collective bargaining is increasing. This new interplay of actors and levels seems to be an important precondition for the revitalisation of German industrial relations, even if it does not mean that all problems will be solved. This paper is about industrial relation (IR) strategies and practices in multinational companies (MNCs). It is based on a comparison of these practices in subsidiaries of different MNC within one country. We discuss how far differences and commonalities can be explained by national IR institutions, by company structures and cultures or by the agency of IR actors. In doing so, this will also address the broader question of how far the varieties of capitalism affect what MNCs do abroad and if, and in what way, they adapt to local conditions in terms of IRs and union structures. The paper is based on a case study comparison of two of the biggest automotive companies, Volkswagen and Hyundai, and their production locations in Slovakia. Both companies have different institutional backgrounds in their host countries with different patterns of labour relations, they are internationalized on a growing level and they both have foreign operations in identical countries like in Slovakia, which makes it possible to analyse the effects of institutions, strategies and labour agency by a comparison of establishments. There are two main findings exposing a strong interplay of the factors under scrutiny. First, in both companies, the local IR patterns are strongly shaped by the varieties of institutions at the company headquarters, whereas the IR institutions of the host country are adapted to them; and second, agency plays a growing role as the labour shortage improves the power position of the unions. Since the financial crisis at the end of the last decade, Germany is regarded again as a successful coordinated market economy. However, a closer look at labour and working conditions reveals disturbing phenomena like an increase of psychical stress, growing shares of low wage employment or the erosion of collective bargaining or works councils' coverage. Finance capitalism has become the most popular concept among German sociologists to explain why and how industrial relations and working conditions have been put under pressure in the last one or two decades. But how coherent is the finance capitalism story? This question is tackled in the paper, based on literature review and empirical findings. The paper argues that the concept is overexpanded and that, first, financial market capitalism is refractured by agency and actors on different instituitonal levels and that, second, there are other and independent developments influencing industrial relations like globalisation or the deregulation of labour markets that have to be taken into account. This article tackles the question of how labour representatives cope with the implementation of 'Industrie 4.0' in German manufacturing plants. Digitalisation of manufacturing is going along with challenges for employment, work organisation and working conditions. The article analyses one of the main strategies German unions have developed, the project 'Work 2020', which was to raise works councils' awareness of the workplace impact of digitalisation, improve their knowledge of the changes, raise their capacity to respond and, finally, lead to the negotiation of workplace agreements on this issue with employers. The results of the analysis show that a strong interplay between unions and works councils and the activation of works councils by the unions have become indispensable preconditions for coping with the new challenges both of digitalisation and of the ongoing erosion of the German system of labour relations. We investigate codetermination on German supervisory boards of multinational companies and pose two questions. First, under what conditions does board-level representation constitute a power resource for employee representatives? Second, how does board-level representation articulate with European Works Councils? We conclude that factors related to corporate structure – head office location, the level at which supervisory boards are established – play a decisive role in determining the power resources available to employee representatives. Articulation with European Works Councils depends on the adoption of a strategic approach whereby German employee representatives deploy the power resources derived from national codetermination rights at the transnational level, or use the mechanisms of transnational employee representation to compensate where such national power resources are lacking. In the German manufacturing sector, white-collar workers have outpaced blue-collar workers in numbers. Therefore, unions and works councils have launched initiatives to attract, mobilise and organise white-collar workers. This article discusses how both globalisation and corporate governance influence the German coordinated model of employment relations. It outlines recent developments in employment relations in the German automotive and banking industries with a particular focus on skills, staffing and pay systems. It argues that while various changes have taken place in employment relations in both industries, they remain largely within the coordinated framework. Not all the changes are directly associated with globalisation. Rather, an increasing focus on shareholder value in corporate governance has also contributed to these changes. Plant-level derogations from collective bargaining agreements are posing new challenges for works councils. Works councils have to cope with new roles as actors in collective bargaining. The article analyses the changes in the practice of codetermination going alongside derogations. In a nutshell it can be said that works councils, although being in a defensive situation, have shown an astonishing capacity for strengthening their bargaining position by coordinating negotiations with the unions and by organizing support among the employees. Declining union density, the reduction in coverage or informal derogations from collective agreements are signs of erosion of the corporatist German system of collective bargaining. However, new developments can be observed like 'unbound' employers' associations or derogations from collective agreements. These new developments make it necessary to reassess the prospects of collective bargaining. At the first sight they seem to be little more than indicators of erosion or exhaustion, but the in-depth analysis reveals that these developments can be starting points of renewal because they give stimuli to increase the associational power of employers' associations and, even more important for collective bargaining, unions. The European Works Council (EWC) at General Motors Europe is frequently cited as one of the few examples of an efficient body of employee representation at a European level within a multinational company. Despite the increasing threat of social dumping in the enlarged Europe, the EWC was able to agree with management the terms of compulsory European minimum standards for defensive employment and competitiveness pacts, thereby restricting the effects of coercive comparisons between factories located in different countries. The article presents the institution of co-determination in Volkswagen (VW). The case of VW demonstrates that globalization and financialization can be integrated with new regulation of industrial relations and co-determination in decision-making process. The changes and challenges posed by co-determination in VW are discussed.

The article addresses the question whether or not the trend towards the decentralisation of collective bargaining on working time in Germany entails a loss in the binding power of industry-level agreements. To this end, both working-time agreements and practices are examined at the firm or establishment level in the automotive industry. Additionally, the article examines the extent to which workplace micro-level changes are reflected in official statistics.
