The Author investigates the exercise of control prerogative beyond the company’s borders, while reflecting on the limitations imposed by the Workers' Statute to safeguard freedom and human dignity. By reiterating the prohibition of covert and impersonal monitoring, it is noted how the opportunities to verify the fulfillment of work performed outside the premises where surveillance personnel can be deployed are greatly limited. Nevertheless, attempts to expand them through interpretative means are deemed excessively risky in a context where the protection of human dignity and freedom is at stake.

This article focuses on archival collections relating to so-called “tattare” and “zigenare” (roughly translated as “tinkers” and “gypsies”) created by Swedish folklore scholars during the twentieth century, and how these scholars influenced politics and interventions regarding these categories. It addresses questions regarding the production of knowledge about these categories and the contexts, structures and actors that have created the basis for these kinds of collections. Special focus has been placed on works by the folklore scholars Carl-Martin Bergstrand and Carl-Herman Tillhagen, and collections at the Institute for Language and Folklore, Department of Dialectology, Onomastics and Folklore Research and the Nordic Museum. By unfolding the networks of Bergstrand and Tillhagen and following the traces of their work to other archives, the article highlights some of the political and monitoring dimensions of archival practices in relation to minority groups in Sweden.

The need to contain the pandemic in the past year has given a formidable boost to the use of human resources in a smart way. Companies have had the opportunity to employ their employees by derogating from the rules defined in Law 81/2017. The emergency discipline has introduced a simplification that has apparently facilitated the use of remote work performance, leaving the structure of responsibility for companies unchanged. This extraordinary opportunity to experiment with the agile way of working has led companies to use their human resources remotely without a precise risk analysis, without adopting adequate security measures, without regulation on management, disciplinary and control power. Smart working was used as a business continuity tool, but according to Istat, the Italian labor market has experienced a drop in productivity, a drop in efficiency, as well as negative consequences on the interpersonal relationships of workers. The study intends to examine how, during the use of smart working, extensive employer obligations to protect the physical and moral personality of employees persist and the need for an adequate risk assessment that allows the preparation of timely information on the health risks and on the processing of personal data. The need to protect companies, personal data being processed and secret company data in the case of smart working suggests adopting an organizational system that develops new methods of remuneration linked to the achievement of objectives and that allows effective and efficient internal disciplinary control. on the worker and on the activities so as to allow, in the most serious cases, the possible intervention of the police with computer search tools. The final reflections analyze the need / opportunity to organize the use of smart working in a uniform manner within the company, enhancing the potential of smart contracts via blockchain to protect employers' needs for accountability.

• We examined the effect of minority management on the capital structure of companies operating in Japan. • We investigated whether minority management had a nonlinear effect on corporate financing decisions. • We found significant links between minority management and leverage. • We established that minority management has a threshold effect on leverage. • Firms with a high level of minority management tend to achieve their optimal leverage positions. This study evaluates the effect of minority management (MG) on capital structure for a sample of listed Japanese companies over three sectors. We used a dynamic panel, threshold-based model that can control for endogeneity to investigate the linkage between the speed of adjustment of leverage and MG, with the results proving that there is significant linkage between MG and leverage. We also observed that the level of MG has a threshold effect on leverage, such that firms with a high level of MG can reach their optimal leverage faster than those with a low level of MG.
