El objetivo de este trabajo va a ser diseñar los contenidos de la tríada pueblos indígenas-hábitat-territorio desde una perspectiva decolonial. Estructuraremos el escrito en cuatro momentos: a) donde procederemos a establecer una serie de aclaraciones terminológicas, como territorialidad, recursos naturales, biodiversidad, en el marco de sentido de los pueblos indígenas, y cómo estos mismos términos son asumidos de manera diferente por el derecho occidental; b) donde desarrollaremos un balance crítico de la irrupción de las exigencias indígenas en los acuerdos medioambientales multilaterales, desde la perspectiva de los derechos de los pueblos indígenas; c) donde abordaremos los elementos centrales y polémicos de este excitante diálogo intercultural, como es el de Territorialidad indígena; d) analizaremos la jurisprudencia que ha venido desarrollando los últimos años la Corte y la Comisión Interamericana de Derechos Humanos (IDH), conscientes de que nos encontramos en la antesala de un Derecho Intercultural latente en los informes y sentencias de estas dos instituciones jurídicas. The objective of this study is to design contents for the threefold topic “indigenous peoples-habitat-territory,” from a decolonizing perspective. From this starting point, the study confronts the complicated challenge of intercultural dialogue. The work was structured in four sections: a) Terminological clarifications regarding the subject; what can we understand by territoriality, natural resources and biodiversity within the logical framework of the indigenous peoples, and how these same terms are understood differently by Western law; b) Critical analyses of indigenous claims in the multilateral environmental treaties that have emerged lately, from the perspective of indigenous peoples’ rights; c) Controversial central elements in this exciting intercultural dialogue, such as indigenous territoriality; d) An analysis of the jurisprudence that has been developed by the Inter-American Human Rights Court and Commission, aware that this may be a first advancement toward intercultural law, latent in the different reports and decisions made by these two juridical institutions.
