Verification in Pre-trial Proceedings Abstract: This diploma thesis deals with verification as one of the stages of the pre-trial phase of criminal procedings. The purpose of this thesis is to emphasize the most important institutes operating during verification as well as to expose current issues connected with The Criminal procedure Code, where the author share his experience with this stage of criminal proceedings. The first part of the diploma thesis deals with verification itself - its definition, demarcation of the verification within the criminal proceedings, specification of authorities acting in the verification and defining of the fundamental principles. A brief historical overview of the topic is attached as well. Subsequent principal part of the thesis includes a description of the most significant institutes excercised within the verification. Primarily the institutes related to an evidentiary procedure were stressed, especially institutes raising applicaton difficulties in practise. The author communicates his critisizing view on the topic supported by the appropriate arguments. Данная статья посвящена определению разумных сроков уголовного судопроизводства на стадиях возбуждения уголовного дела. Также затронуты проблемные вопросы, которые возникают в связи с несоблюдением разумного срока уголовного судопроизводства на этапе рассмотрения и разрешения сообщения о преступлении. Предметом исследования выступает принцип разумного срока в нормах, регулирующих процессуальные сроки в стадии возбуждения уголовного дела. Целью исследования является комплексный анализ особенностей и проблем реализации принципа разумного срока в нормах, регулирующих процессуальные сроки в стадии возбуждения уголовного дела. Гипотеза исследования заключается в том, что исследуемая сфера правоотношений имеет ряд проблем, которые необходимо разрешить в кратчайшие сроки. В качестве методологической основы исследования выступали такие методы, как анализ, синтез и формально-юридический метод. Результаты работы заключаются в том, что выявлены проблемы исследуемой сферы и предложены возможные направления их преодоления. Полученные результаты могут быть использованы для дальнейшего исследования реализации принципа разумного срока в нормах, регулирующих процессуальные сроки в стадии возбуждения уголовного дела. Проведенный анализ показал, что барьером, который не ускоряет доступ граждан к правосудию и не обеспечивает разумный срок уголовного судопроизводства, выступает то обстоятельство, что незаконные решения об отказе в возбуждении уголовного дела могут отменяться как по требованию прокуроров, так и руководителями органов предварительного следствия без ведома заинтересованных сторон многократно, но это не гарантирует возможности получения судебной защиты в разумный срок. Проведенное исследование позволило установить, что разумный срок уголовного судопроизводства — это такой его срок, который не дает возникнуть противоречию между действиями участников уголовного процесса и требованием общества о своевременном и адекватном реагировании суда на все злоупотребления, допускаемые этими участниками, влекущими за собой увеличение срока уголовного судопроизводства., This article is devoted to the definition of reasonable terms of criminal proceedings at the stages of initiation of criminal proceedings. The problematic issues that arise in connection with the failure to comply with a reasonable period of criminal proceedings at the stage of consideration and resolution of a crime report are also touched upon. The subject of the study is the principle of reasonable time in the rules governing the procedural terms at the stage of initiation of a criminal case. The purpose of the study is a comprehensive analysis of the features and problems of the implementation of the principle of reasonable time in the norms governing the procedural terms at the stage of initiation of a criminal case. The hypothesis of the study is that the area of legal relations under study has a number of problems that need to be resolved as soon as possible. Such methods as analysis, synthesis, and the formal-legal method were used as the methodological basis of the research. The results of the work consist in the fact that the problems of the studied area are identified and possible ways of overcoming them are proposed. The obtained results can be used for further research of the implementation of the principle of reasonable time in the norms governing the procedural terms at the stage of initiation of a criminal case. The analysis showed that the barrier that does not speed up citizens’ access to justice and does not provide a reasonable time for criminal proceedings is the fact that illegal decisions to refuse to initiate criminal proceedings can be canceled both at the request of prosecutors and by the heads of preliminary investigation bodies without the knowledge of the interested parties, but this does not guarantee the possibility of obtaining judicial protection within a reasonable time. The conducted research allowed establishing that a reasonable period of criminal justice is a term that gives rise to contradiction between the actions of the parties to the proceedings and demanding the companies on a timely and adequate response of the court to all abuses these participants, resulting in increased term of the criminal proceedings. Magistrsko diplomsko delo obravnava institut izvedenca v predkazenskem in kazenskem postopku. Ob hitrem razvoju znanosti in tehnološkega napredka se sodniki nemalokrat znajdejo pri presojanju zadev, kjer pravna znanost brez strokovne pomoči izvedenca ne more zagotoviti pravične in utemeljene sodniške odločitve. Pride do trčenja prava in ostalih znanosti. Avtor v začetnem delu naloge predstavi splošne značilnosti izvedenstva v slovenski kazenski zakonodaji in pojasni ureditev izvedenstva v različnih pravnih sistemih. Opiše prednosti in slabosti posamezne ureditve, kar v zaključku poglavja naveže na problematiko ureditve v slovenskem pravnem sistemu s predlaganimi rešitvami za optimizacijo sistema. V nadaljevanju se avtor opredli do vprašanja, kakšne so možnosti odreditve izvedenstva v predkazenskem postopku s strani policije ob sodelovanju preiskovalnega sodnika in državnega tožilca. Osrednji del naloge predstavlja podajanje sodniške dokazne ocene o izvedenskem mnenju. Postavlja se vprašanje, kako naj se in ali se lahko sodnik opredeli do izvedenskega mnenja s področja, o katerem ima pomanjkljivo znanje. Avtor predstavi okvirne napotke in metode, ki naj se jih sodniki držijo pri presoji izvedenskega dela. Zatem sledi predstavitev uporabe strokovnih mnenj s strani obrambe kot instituta za uspešno nasprotovanje dokazu z izvedencem. Obramba se prav tako kot sodnik srečuje s problemom razumevanja zahtevnih znanstvenih področij predmeta izvedenstva in zaradi tega nujno potrebuje pomoč strokovnjaka, s katerim poizkuša vnesti dvom v izvedensko mnenje. Naloga se zaključi s podajo sklepnih misli, ki zaokrožijo predstavljeno vsebino in vsebujejo ideje ter predloge za optimizacijo sistema izvedenstva v slovenskem kazenskopravnem sistemu. This master thesis deals with the role of the court expert in pre-trial and criminal proceedings. With the rapid development of science and technological advances, judges often find themselves dealing with cases where legal science cannot provide a fair and justified judicial decision without the assistance of an expert. As a result, law and other sciences collide. In the first part of the thesis, the author presents the general characteristics of expert opinion in Slovenian criminal law, and explains how it is regulated different legal systems. It describes the advantages and disadvantages of a particular regulation, and in the end of the chapter connects that to the problems of the regulation in the Slovenian legal system. The author also proposes the solutions for system optimisation. In the next part, the author makes clear his position on the possibilities of ordering a pre-trial expert opinion with the assistance of the investigating magistrate and the public prosecutor. The central part of the thesis deals with the presentation of expert assessment. The question that arises is if and to what extent the judges should consider the expert opinion from the field from which they lack knowledge. In regards to that, the author outlines the guidelines and methods that judges should follow when assessing the work of experts. This is then followed by a presentation of the use of expert opinion by the defence as a tool for successfully opposing the evidence with an expert. Both the defence and the judge are faced with the problem of understanding the complex scientific fields of the subject matter and therefore really need the assistance of a court expert when trying to call into question the expert opinion. The thesis concludes with final thoughts that summarise the content that has been presented and contains ideas as well as suggestions for optimising the system of expert opinion in the Slovenian criminal justice system.

Отказ в возбуждении уголовного дела является итоговым решением, принимаемым следователем (дознавателем) на стадии возбуждении дела, которым завершается уголовное судопроизводство в целом. В связи с этим отказ в возбуждении уголовного дела относится к числу основных уголовнопроцессуальных решений, имеет преюдициальное значение для органов уголовного преследования, являясь основанием прекращения будущего уголовного преследования в отношении конкретных лиц по тому же самому подозрению (п. 5 ч. 1 ст. 27 Уголовнопроцессуального кодекса Российской Федерации, п. 6 ч. 1 ст. 27 Уголовнопроцессуального кодекса Республики Таджикистан). В статье осуществляется правовой анализ субъектов, наделенных полномочиями в отказе от уголовного преследования на досудебном производстве уголовного процесса по законодательству Российской Федерации и Республики Таджикистан, исследуется правовая природа, системная взаимосвязь института отказа от уголовного преследования в досудебном производстве с нормами права, регулирующими порядок принятия решения об отказе от осуществления уголовного преследования субъектами, наделенными полномочиями. В настоящий момент институт отказа от уголовного преследования в досудебном производстве в Республике Таджикистан закреплен в ст. 2426 и чч. 1011 ст. 279 Уголовнопроцессуального кодекса Республики Таджикистан, полномочиями на осуществление которого наделены только прокурор, потерпевший, его представитель, а также законные представители, что, несомненно, является дискуссионной темой, требующей дальнейшего уголовнопроцессуального совершенствования, поскольку законодательством Российской Федерации данными правами наделен более широкий круг лиц, который также рассматривается в рамках данной статьи., The refusal to initiate a criminal case is the final decision made by the investigator (interrogator) at the stage of initiating a case, which ends the criminal proceedings as a whole. In this regard, the refusal to initiate a criminal case is one of the main criminal procedural decisions, which is of prejudicial importance to the criminal prosecution bodies, being the basis for terminating the future criminal prosecution of specific individuals on the same suspicion (clause 5 part 1 of Article 27 of the Code of Criminal Procedure of the Russian Federation, clause 6 part 1 of article 27 of the Code of Criminal Procedure of the Republic of Tajikistan The article provides a legal analysis of the entities empowered to refuse criminal prosecution in pretrial criminal proceedings under the legislations of the Russian Federation and the Republic of Tajikistan, examines the legal nature, systemic relationship of the institution of noncriminal prosecution in pretrial proceedings with the rules of law governing decisionmaking on refusal of criminal prosecution by the entities vested with authority. At present, the institution of noncriminal prosecution of pretrial proceedings in the Republic of Tajikistan is enshrined in Art. 2426 of the Code of Criminal Procedure and parts 1011 Art. 279 of the Code of Criminal Procedure of the Republic of Tajikistan, the powers of which are only granted to the prosecutor, the victim, their representative, as well as legal representatives, which is undoubtedly a debatable topic that requires further criminal procedural improvement, since the legislation of the Russian Federation vests a wider circle of people with these rights, which is also addressed in this article., №3(50) (2019)

В статье говорится о способах защиты прав и свобод личности в стадии возбуждения уголовного дела прокурором. Основным средством обеспечения законности выступает прокурорский надзор в досудебном производстве по уголовным делам, а именно проведение прокурором проверок исполнения закона органами предварительного следствия и дознания на этапе возбуждения уголовного дела. Однако отсутствие должной правовой регламентации процедуры осуществления прокурорских проверок исполнения закона препятствует повышению эффективности деятельности прокурора по обеспечению прав личности в уголовном процессе. Автором делается вывод о необходимости внесения изменений по совершенствованию действующего законодательства в целях должного и своевременного реагирования на нарушения прав и свобод личности в досудебных стадиях уголовного процесса органами предварительного расследования.

Gospodarska kriminaliteta v Sloveniji predstavlja pereč problem. Škoda, ki je z njo povzročena, je ogromna. Pojavljajo se vedno nove in kompleksnejše oblike, kar močno otežuje odkrivanje in preprečevanje gospodarske kriminalitete. Zaradi slednjega se je v kazenski zakonodaji pojavila potreba po inkriminaciji specialne oblike goljufije, storjene pri opravljanju gospodarske dejavnosti. Glavni namen inkriminacije kaznivega dejanja poslovne goljufije je bil razcvet goljufivih poslovnih praks in spoznanje, da z obstoječim kaznivim dejanjem goljufije ni mogoče zajeti zakonskih znakov goljufivega namena po sami sklenitvi posla. Kar je pomenilo, da storilec ni deloval z goljufivim namenom in ga ni bilo mogoče inkriminirati. Poslovna goljufija je bila tako pomembna pridobitev, saj je zakonodajalec z določitvijo tega kaznivega dejanja omogočil goljufijo tudi v fazi izvajanja posla. Bistvo poslovne goljufije je, da nastopi med subjekti, ki opravljajo gospodarsko dejavnost. Zato na tem mestu večkrat govorimo tudi o odgovornosti pravne osebe, če je pridobila protipravno korist iz kaznivega dejanja in je bistveno prispevala k storitvi kaznivega dejanja, ki ga je storila fizična oseba. Razlaga kaznivega dejanja poslovne goljufije predstavlja osrednjo tematiko diplomskega dela. Ker kaznivo dejanje poslovne goljufije spada med najpogostejša kazniva dejanja gospodarske kriminalitete, je v prvem poglavju diplomskega dela predstavljena tudi gospodarska kriminaliteta. Z omenjeno problematiko se ukvarja veliko institucij, saj je preprečevanje in odkrivanje tovrstnih kaznivih dejanj osrednjega pomena. Pomembno je, da se dosledno sledi zakonodaji in da se kazenski postopek izvede dosledno in čim hitreje, zato je zadnji del diplomskega dela posvečen samemu poteku kazenskega postopka in opisu vseh njegovih faz. Konec diplomskega dela je opremljen s primerom poslovne goljufije. Prikazan je primer kaznivega dejanja iz prakse. Economic crime in Slovenia represents a pressing problem. The damage caused by economic crime is huge. It always appears in new and more complex forms, which greatly complicates the detection and prevention of economic crime. Because of the latter the criminal law needs to establish special forms of fraud committed in the course of economic activities. The main purpose of incrimination the offense of business fraud is flourishing fraudulent business practices, and recognition that the existing offenses of fraud can not be covered by legal characters as fraudulent intent, after the actual conclusion of business. Which means that the offender has not been acted with fraudulent intent, and it was impossible to incriminate them. It is important to set commercial fraud by the legislature, since the establishment of this crime enables fraud in the implementation phase of business. The essence of business fraud is, that occurs between the entities engaged in economic activities. Regarding this topic there are a lot of discussions about responsibility of legal persons if it is obtained improperly benefit from the offense and has significantly contributed to the offense committed by nonlegal person. The main topic of thesis represents an interpretation about the offense of business fraud. Among other topics the economic crime is described in the first chapter of the thesis since the offense of business fraud is one of the most common economic crime offenses. Many institutions are dealing with these issues since as the prevention and detection of such crimes is crucial. The last part of thesis is dedicated to the progress and the description of all phases of the criminal proceedings because it is important to strictly follow the law and that the criminal proceedings are conducted consistently and as quickly as possible. At the end of thesis the practical example of business fraud is shown. It represents a case of crime in practice.

v anglickém jazyce Efficiency of criminal procedure and adjustment of pre-trial proceedings The purpose of my thesis is to analyse relationship between basic principles of criminal procedure and the purpose of criminal procedure. The reason for my analysis is fact that basic principles are ground of criminal proceedings. They influence all institutes of criminal procedure law and the way how they are applied. The thesis is composed of five chapters. Chapter One is introductory and defines basic terminology used in the thesis: criminal procedure, purpose of criminal proceedings, pre - trial proceedings and other section of criminal proceedings. The chapter is subdivided into four parts. Part One describes term of criminal procedure and it's purpose and explains relationship between criminal proceedings and human rights. Part Two deals with history of criminal procedure codes in the Czech lands. Part Three deals with relevant Czech legislation connected with criminal proceedings and Part Four explains term of sections of criminal procedure and briefly describes individual sections.
