Although it is customary to refer to Rousseau’s thought when dealing with democracy and human rights, it should be remembered - in strict accordance with the lines of Rousseau - that democracy is nothing more than a form of government among other possible forms and human rights is not a concept found in his thought. So, we must raise the question: why is Rousseau remembered when dealing with these issues? My purpose in this paper is to investigate his contribution to these concepts’ formulation process. Thus, by returning to the fundamental concepts of popular sovereignty, government and common good, I shall try to show convergences and tensions between the political participation of the people, government action and regulatory principles applied to all. Thus, I hope to advance the understanding of Rousseau’s contributions to democracy and human rights and about their relationship. Ainda que seja corrente referir-se ao pensamentode Rousseau quando tratamos de democracia e de direitos humanos, importa lembrar – em estrito acordo com o texto de Rousseau - que democracia nada mais é do que uma forma de governo entre outras possíveis e, direitos humanos não é um conceito próprio ao seu pensamento. Então, cabe perguntar: por que Rousseau é sempre lembrado quando tratamos destes temas ? Investigar sua contribuição à elaboração destes dois conceitos será nosso propósito neste texto. Assim, retomando os conceitos fundamentais de soberania do povo, governo e bem comum discutiremos sobre as convergências e as tensões entre a participação política do povo e a ação governamental buscando compreender algumas das contribuições de Rousseau sobre a democracia e os direitos humanos e sobre sua relação.

The remarkable words we find in the introduction of Democracy in America induces the reader to the hope that social equality will arrive by itself, independent of men’s will. However, it seems to us that this introduction should not be read independently from the text that comes just before, neither of other Tocqueville’s books which make us understand: in first place, that there is a binding between social conditions and politics; and, in second place, that this binding implies mutual determination. In this sense, it is very illustrative the analysis by Tocqueville of the industrialization process in North-America and the rural exodus accompanying the industrialization in England and Ireland at beginning of the 19th. In both cases, the author observes that the new industrial system produces, apart of material goods, two inalterably opposed classes in the social and political scene. Based on this analysis, Tocqueville denounces those hard relations holding between the social and political extents. Therefore, in the symposium about Alexis de Tocqueville’s ideas nowadays, which press us to think our time using his ideas, our purpose is to analyze the tension lying under the reciprocal determination between equality of social conditions and political freedom. Next, we envisage a discussion over the issue of political commitments (for state institutions and for citizenship action) in order to construct social conditions warranting freedom and equality as a common right for all citizens. La fuerza de las palabras presentes en la introducción de La Democracia en América predispone al lector a considerar que la igualdad social de condiciones advendrá por si misma, queriendo los hombres o no. No obstante, me parece que esta introducción no debe ser leída independientemente del texto que antecede, ni de las demás obras de Tocqueville que nos hacen comprender, en primer lugar, que hay un vínculo directo entre condiciones sociales y políticas y, en segundo lugar, que este vínculo implica una mutua determinación. En este sentido, es bastante ilustrativo el análisis de Tocqueville sobre los procesos de industrialización norteamericano y de éxodo rural e industrialización en Inglaterra y Irlanda en inicios del siglo XIX. En ambos casos, el autor observa que el nuevo sistema industrial produce, además de bienes materiales, dos clases antagónicas e inalterables que conforman el escenario social y político. Basado en estos análisis, Tocqueville denuncia las relaciones difíciles entre el ámbito social y el político. De esta manera, en la jornada sobre la vigencia del pensamiento de Aléxis de Tocqueville, que nos remite a pensar el presente a partir de sus ideas, nuestro propósito será analizar la tensión en la determinación recíproca existente entre la igualdad de condiciones sociales y la libertad política para, entonces, discutir el compromiso político (de las instituciones del estado y de la acción de los ciudadanos) de construir condiciones sociales que garanticen la libertad y la igualdad como un derecho común a todos los ciudadanos.

A presente pesquisa visa a efetuar uma análise da trajetória do liberalismo e da democracia no Brasil, observando, especificamente, as condutas governamentais dos últimos anos. Para tanto, pretende realizar um estudo das concepções de democracia ao longo da história, desde sua fase antiga, em Atenas, até sua reconfiguração com os influxos do liberalismo na era moderna. Ainda, visa a analisar o liberalismo enquanto teoria política da liberdade, definindo os contornos daquelas que julgamos ser suas balizas principais, como o Estado de Direito, o Constitucionalismo e os Direitos Humanos. Enfim, o foco se volta para a análise do liberalismo e da democracia no Brasil, primeiro, ao longo de suas constituições, e, depois, nos últimos anos, em que se percebeu uma patente redução do processo liberal-democrático no país, em razão de reiterados atos de governo que minaram o ainda frágil Estado Democrático de Direito, por meio de ataques e ameaças às liberdades civis e políticas e às estruturas da democracia representativa. This research aims to carry out an analysis of the trajectory of liberalism and democracy in Brazil, observing, specifically, the governmental behavior and deportment of recent years. To this end, it intends to establish a study on the conceptions of democracy throughout history, from its ancient stage, in Athens, until its reconfiguration with the influxes of liberalism in the modern era. Still, it aims to analyze liberalism as a political theory of freedom, defining the contours of what we believe to be its main goals, such as the Rule of Law, Constitutionalism and Human Rights. Finally, the focus turns to the analysis of liberalism and democracy in Brazil, first, throughout its constitutions, and then, of the late years, in which there has been a notable reduction in the liberal-democratic process in the country, due to reiterated acts of government that undermined the still frangible Democratic Rule of Law, through attacks and threats towards civil and political freedoms and the structures of representative democracy.

O objetivo desta dissertação é verificar, por meio de uma abordagem interdisciplinar, se o conceito de entidade familiar proposto pelo Estatuto da Família (Projeto de Lei no 6.583/2013) é compatível com a democracia brasileira e com os princípios constitucionais e internacionais de Diretos Humanos. Para a realização deste trabalho foi necessário evidenciar e pormenorizar o texto do Projeto de Lei, seus dois Pareceres e os argumentos utilizados pelos Deputados Federais quando da votação do segundo Parecer pela Comissão Especial da Câmara dos Deputados. O estudo foi desenvolvido a partir de averiguações acerca da construção semântica da entidade familiar no Brasil, em um percurso histórico-social a respeito do qual elegemos como significativos quatro marcos, quais sejam: 1) a atuação religiosa do Constituinte de 1987-1988, a qual, em última instância, contribuiu para a redação final do artigo 226 da Constituição Federal de 1988; 2) a interpretação do ordenamento jurídico sob a ótica neoconstitucionalista; 3) a posição de supralegalidade que os tratados internacionais de Direitos Humanos passaram a ocupar no ordenamento jurídico pós-1988, de acordo com o posicionamento majoritário do Supremo Tribunal Federal; e 4) os argumentos prolatados pelos Ministros do Supremo em seus votos quando da decisão acerca da equiparação das uniões homoafetivas às heteroafetivas (ADPF nº 132-RJ e ADI nº 4.277-DF), somados à Resolução nº 175/2013, editada pelo Conselho Nacional de Justiça, que facilitou a conversão das uniões homoafetivas em casamento. Demonstrou-se fundamental também manter um percurso interdisciplinar para refletir acerca da pluralidade de possibilidades construtivas e interpretativas do conceito de entidade familiar identificadas na literatura contemporânea. Esta dissertação ocupou-se ainda da caracterização da democracia brasileira, tendo como marco normativo a Constituição da República Federativa Brasileira de 1988, e adotou como diretrizes teóricas tanto a concepção procedimental de democracia segundo Norberto Bobbio, consubstanciada nas regras do jogo democrático, como a vertente substancial neoconstitucional defendida por Luís Roberto Barroso. Outro importante enfoque foi dado à principiologia constitucional e internacional de Direitos Humanos, a qual, para além da supralegalidade, revelou-se importante para a realização do controle de convencionalidade – sistema de compatibilidade vertical segundo o qual todas as normas infraconstitucionais a serem produzidas no país devem, necessariamente, passar por uma análise de compatibilidade tanto com a Constituição, como pelos tratados de Direitos Humanos, sob pena de padecer de inconstitucionalidade ou de ineficácia, respectivamente. Por fim, na pesquisa analisou-se a semântica da família no Brasil a partir da ponderação de três argumentos centrais que permeiam o discurso dos Deputados Federais e dos Ministros do STF, no que diz respeito às discussões e confrontos entre o Estatuto da Família, a Constituição, os Direitos Humanos e democracia, quais sejam: a família enquanto instituição naturalizada; a primazia da visão de mundo conferida por cristãos evangélicos em detrimento das demais; e o entendimento de que a democracia se realiza apenas com a satisfação da “vontade da maioria”. This thesis aims to verify, by means of an interdisciplinary approach, if the concept of familial entity suggested by the Family Statute (Brazilian Law Project 6,583/2013) maintains compatibility with the Brazilian democracy and with the constitutional and international principles of Human Rights. In order to accomplish this work, it was necessary to evidence the text of the Law Project and its two Opinions, and also to examine in detail the arguments that have been used by the Federal Representatives when voting on the second Opinion at the Special Commission of the House of Representatives. This study was developed through investigations on the semantic construction of familial entity in Brazil, and through a historical and social about which we elected as significant four marks: 1) the religious actions of the Constituent Representatives in 1987-1988 which, ultimately, contributed to the final wording of the Brazilian Federal Constitution’s article 226; 2) the interpretation of the Brazilian legal order through the neo-constitutionalist lenses; 3) the position of supra-legality that the international treaties of Human Rights occupy in the post-1988 Brazilian legal order, according to the positioning of most of the Brazilian Supreme Court members; and 4) the arguments that have been used by the Brazilian Supreme Court members when voting on the equalization of the homo-affective and hetero-affective unions (ADPF 132-RJ and ADI 4.277-DF), in addition to the Resolution 175/2013 edited by the Brazilian National Council of Justice, which facilitates the conversion of homo-affective unions into marriages. Also, the interdisciplinary trajectory was proven fundamental to the reflections on the plurality of constructive and interpretative possibilities of familial entity identified by the contemporary literature. Moreover, this thesis dealt with the characterization of the Brazilian democracy based on the Brazilian Constitution of 1988 as its normative mark, and also on conceptions of democracy by both Norberto Bobbio’s procedural democracy (the rules of the democratic game) and Luís Roberto Barroso’s substantive democracy as theory guidelines for the work. Furthermore, the constitutional and international principiology of Human Rights received a special focus on this thesis, since, in addition to their supra-legal status, they are also essential instruments to the fulfillment of the conventionality control – a system of vertical compatibility according to which all the infra-constitutional legislation to be produced by Brazil must be necessarily and previously submitted to an analysis of compatibility with the Brazilian Constitution and the Human Rights treaties, in order not to suffer from unconstitutionality or inefficiency, respectively. Finally, this research endeavors the analysis of the semantic of family in Brazil based on the consideration of three central arguments that permeate the discourse of the Federal Representatives and the Supreme Court Ministries, concerning the discussion of and confrontations between the Family State, the Brazilian Constitution of 1988, Human Rights and democracy, which are: the family as a naturalized institution; the primacy of the world view conferred by the evangelical Christians over all the others; and the understanding that democracy cannot be fulfilled by the merely satisfaction of the “will of the majority”. Os últimos trinta anos testemunharam um renovado interesse no pensamento cívico-republicano no interior da filosofia política ocidental. As contribuições das ideias republicanas são especialmente evocadas como resposta ao debate entre liberais e comunitários que vem sendo travado nas últimas décadas. A noção de virtude bem reflete o pensamento político de Alexis de Tocqueville que, marcado por uma combinação de ideias republicanas, liberais e comunitárias, tem sido redescoberto e se tornado uma rica fonte de inspiração para estudiosos que se preocupam com o futuro da democracia. A partir de suas observações sobre os Estados Unidos da América do início da década de 1830, Tocqueville elabora sua visão original acerca das condições de possibilidade de uma comunidade política em que igualdade e liberdade tendem à convergência. O Estado democrático, segundo o autor, somente subsiste por meio do esforço de equilíbrio entre esses dois princípios na experiência da cidadania. Tocqueville propõe uma nova ciência política que vi sa orientar os dirigentes da sociedade na tarefa de formar cidadãos capazes de combater as tendências que ameaçam a sobrevivência da democracia. Em sua estratégia para restaurar os costumes dos homens democráticos, Tocqueville começa por acolher uma doutrina moral que preserva a foça motivacional do interesse do indivíduo enquanto amplia sua perspectiva e seus objetivos. O processo de formação da cidadania de Tocqueville avança encorajando que os homens combatam suas tendências individualistas mediante a pa rticipação política e, pela formação de hábitos opostos, adquiram o gosto pela liberdade. Para Tocqueville, as instituições em geral, a religião, e o engajamento político desempenham a função política de forjar cidadãos e engendrar uma cultural política saudável. Se a irresistível marcha da igualdade que caracteriza os novos tempos é natural, a esperança de Tocqueville é a garantia da liberdade através da arte política. The last thirty years have witnessed a renewed interest in the civic -republican thought within Western political philosophy. The contributions of the Republican ideas are especially evoked in response to the debate between liberals and community that has been caught in recent decades. The notion of virtue reflects well the political thought of Alexis de Tocqueville who, marked by a combination of republican, liberal and communitarian ideas, has been rediscovered and become a rich source of inspiration for scholars who care about the future of democracy. From his observations on the United States of the early 1830s America, Tocqueville elaborates his original vision of the conditions of possibility of a political community in which equality and freedom tend to convergence. The democratic state, according to the author, only exists through the effort of balance between these two principles in the experience of citizenship. Tocqueville proposes a new political science that aims to guide the leaders of society in the task of educating citizens able to fight trends that threaten the survival of democracy. In its strategy to restore democratic customs of men, Tocqueville begins by welcoming a moral doctrine that preserves the motivational seal in the interest of the individual while expanding your perspective and your goals. The process of citizenship formation de Tocqueville advances encouraging men to counter their individualistic tendencies through political participation and the formation of opposing habits, acquire the taste for freedom. For Tocqueville, the institutions in general, religion, and political engagement play the political role of forging citizens and engender healthy cultural policy. Mesmo Rousseau tendo afirmado que a democracia é um regime dos deuses e que tal forma de governo é cercada de dificuldades, sobretudo, no que tange a sua conservação, percebemos que Rousseau não é um opositor desse modelo, mas que reconhece e aponta os problemas mais recorrentes do governo democrático. Não obstante, ao desempenhar a função excepcional de legislador na Córsega, quando opera a transição da teoria política a prática, surpreende-nos ao sugerir que aquele país se governe democraticamente. Em vista disso, a presente dissertação tem como objetivo investigar o tema: Democracia e Liberdade a legitimidade do governo, segundo Jean-Jacques Rousseau . Desse modo, investigaremos três pontos que, a meu ver, são cruciais para se compreender o objeto da pesquisa em questão. Primeiro, os fundamentos políticos de sustentação do conceito de soberano, isto é, faremos uma investigação do pacto social e da noção de liberdade; em segundo lugar, examinaremos as dificuldades políticas do governo, ou seja, nosso exame se concentrará em tratar de dois atos; o que estatui e o que institui o governo e destacaremos as tensões na relação entre as vontades particulares e a vontade geral e, por fim, analisaremos a legitimidade da democracia, a saber, faremos uma análise do conceito rousseauísta de democracia, as condições de possibilidade para se instaurar esse modelo de governo e o seu funcionamento na prática a partir da experiência do Projeto de Constituição para a Córsega. A investigação desses três pontos nos permitiu verificar que a legitimidade da democracia depende, principalmente, que esta se configure como uma emanação do soberano ou corpo político legítimo, conduzindo suas ações em conformidade com a vontade geral. Even though Rousseau had stated that democracy is a gods regime and that such form of government is surrounded by difficulties, mainly regarding its conservation, Rousseau notably is not an oppose of this model, but he recognizes and points out the most recurrent problems of the democratic government. Nevertheless, as he carries out the exceptional function of a legislator in Corsica, when he operates the transition between the political theory and the practice, he surprised us suggesting that country should govern itself democratically. With this at sight, the present dissertation aims at investigating the issue: Democracy and Liberty the legitimacy of the government, according to Jean-Jacques Rousseau . In this sense, it will investigate three topics, which are considered essential for the understanding of the object of this research. First, the political fundamentals for the sustaining of the concept of sovereignty, that is, this study will investigate the social pact and the notion of liberty; second, it will examine the political difficulties of the government, or else, it will focus in dealing with two actions: the one which decrees and the one which institutes the government; and this research will highlight the tensions in the relation between the private and the general will, and finally, it will analyze the legitimacy of the democracy, that is, it will analyze the rousseauist concept of democracy, the conditions of possibility to have this model of government established and its practical execution from The Corsican Constitution Project experience. The investigation of these three topics has allowed it to verify that the legitimacy of democracy depends, mainly, on its configuration as the source of the sovereign or of the legitimate body politic, leading its actions accordingly to the general will.
