The article proposes a present thinking as the possibility of reaching solutions to some social security and labor issues in democratic rule of law using judicial cooperation in the search for effective social law of social security. The current legal constructivism, also called judicial activism in its manifestation of legal instrument to weigh yourself to get and verify the approach of social dialogue for more proactive attitude of the court, in which the actors involved in the conflict are called to have a more active participation on problem situations, requiring them more than mere legal interpretation in philosophical hermeneutics. O Presente artigo propõe um pensar como possibilidade de se chegar a soluções de algumas questões previdenciário-trabalhista no Estado de Democrático de Direito utilizando a cooperação judicial na busca pela efetivação do direito social da seguridade social. O ativismo judicial na sua manifestação de instrumento legal para se pese para chegar e verificar a aproximação da concertação social, por atitudes mais proativas do jurisdicional, em que os atores envolvidos nos conflitos são chamados a ter uma participação mais ativa sobre as situações problemas, requerendo deles mais do que a simples interpretação legal na hermenêutica filosófica.
