- Abstract
The present research problematizes the legal nature of the metaindividual rights and their possible relation with the Civil Law. The objective is to analyze the influence of the protection of human rights and the constitutional principles that fall on the subject of metaindividual rights. In order to do so, it will deal with cases in which the Judiciary demonstrates a more public view of particular interests, as long as collective interests. The conclusions drawn from the jurisprudential analysis with the classification of fundamental rights are compared. It is hoped to present a reflective and up-to-date overview of the metaindividual rights in Civil Law as individual rights whose judicial protection is done by a more publicistic bias, given the relevance of its protection from the collective point of view in the current stage of development of contemporary society. The method to be used in this research is hypothetic-deductive. To do so, the research takes place in two moments: initially, an analysis of legal literature and, later, an analysis of jurisprudence related to the discussion. [ABSTRACT FROM AUTHOR]
