Predmet su ovoga rada radni odnosi i tržište rada u kontekstu fleksigurnosti. U radu se analizira novi vladavinski model, soft law, otvorene metode koordina- cije, europski socijalni model, inkluzivnost, kategorije koje su neraskidivo vezane uz fleksigurnost, radne odnose i tržište rada. Istražena su njihova obilježja i utjecaj na supranacionalnu regulativu, usporednopravna i hrvatska rješenja. Daje se i raščlamba nekih novih instituta tržišta rada (novi oblici uređenja radnog vremena, agencijski rad, mini-jobs). Poseban dio rada čini istraživanje (de)reguliranja tržišta rada, novih modela zapošljavanja, kao i fleksigurnosti i hrvatskoga tržišta rada de lege lata te se daju prijedlozi de lege ferenda., This paper deals with the employment relations and labour market in the context of flexicurity. The authors analyse a new mode of governance, namely soft law, open methods of coordination, European social model, inclusive market, as concepts which are interwoven with flexicurity, employment relations and labour market. The authors take a closer look at the latter concepts’ characteristics and impact on the supranational regulation, while juxtaposing regulations of other legal systems with the Croatian regulation. New forms of employment are analysed too (concerning working time, agency work, mini-jobs). This part of the paper is dedicated to the (de)regulation of the labour market, new models of employment, as well as flexicurity and the Croatian labour market de lege lata, with the proposals de lege ferenda.

This chapter provides a critical review of flexicurity in the context of the Danish labour market. Shortly after flexicurity became a popular concept and a key policy issue in the European Union in the late 1990s, policy makers and labour market experts ‘discovered’ Denmark as a model country regarding flexicurity. Danish flexicurity was perceived as displaying a specific combination of low job security, a high compensation rate for unemployed persons and active labour market policies that could help people to move into new jobs. While the flexibility element of the hybrid termed ‘flexicurity’ is primarily an outcome of regulation determined by employers’ associations and trade unions in the comprehensive Danish collective bargaining system, the security part is mainly rooted in and maintained by the welfare state, not least through the unemployment insurance system. However, public interventions not only secure a basic level of economic and social security but are also geared towards maintaining a supply of labour that consists of persons who are prepared to be employed and work in a flexible labour market. The chapter analyses developments central to flexicurity over the last half century and concludes that the balance between flexibility and security has changed significantly towards more flexibility and less security.

The article deals with the new development regarding the adoption of the European Convention for Human Rights by the European Union. The foundations for this development were laid down in the Lisbon Treaty in 2007 and the 14th Protocol to the European Convention for Human Rights in 2004. Consequently, the EU would also be subject to the jurisdiction of the European Court for Human Rights when human rights are concerned. However, the prolonged negotiation process that started after these two instruments had come into force showed that there are many open issues and that the European Court of Justice is not going to relinquish part of its jurisdiction so easily.
