Abstract

Over 20 years have passed since Executive Order 12898 put environmental justice (EJ) issues on the policy agenda. Since this time, EJ has technically remained a policy priority at all levels of government. However, despite this apparent commitment to EJ, research has shown over the decades after the passage of the Executive Order, we still see persistent trends in inequality of air pollution exposure by race. This begs the question: are EJ policies actually working to create environmentally just outcomes? This article seeks to evaluate this question by examining the impact of state EJ policies on disproportionate exposure to air pollution, with the goal of understanding what types of state actions, if any, are associated with decreases in pollution inequality. Abstract

Air pollution and climate change were two important environmental issues squarely confronting President George H.W. Bush when he took office. By the end of his term, the first problem had been addressed, the second had been sidestepped. Why the differing outcomes? In seeking an answer this question, we utilize Kingdon's (1995) agenda setting framework. Using documentary evidence found in presidential archives, we find an Administration wrestling with divergent views and approaches as it sought to manage and manipulate the agenda setting process in both instances. Policy solutions to the problem of air pollution could be designed in a manner congruent with Administration preferences. However, the issue of global climate change was too large, complex, and ambiguous given the policy atmosphere of the Bush years, and too new, to be addressed in the ordinary flow of Washington's political work. Abstract

In this paper we examine states' use of local clean air agencies and provide a preliminary assessment of what causes states to devolve air quality policy authority to the local level. Data from a unique comparative state survey shows that states vary widely in the number of local clean air agencies they employ and the amount of authority these agencies have to set standards, monitor air quality, and enforce regulations. Multivariate analyses suggest that second-order devolution is partly driven by a general propensity to decentralize policy authority, but that policy-specific factors relating to the problem and interest group environment affect devolution as well. These findings indicate that local agencies play an important role in U.S. air quality regulation, and that the dynamics of state devolution to local agencies deserve further study. Abstract

Policy directed at managing automobile pollution is complicated by the concern for legitimate means of control over urban populations. Especially in regions where vehicle diversity is extensive, uniform policies of in-use vehicle emissions control are not always effective, but any stratified regulatory effort that concentrates on "weeding out" those vehicles that are the worst offenders can result in an awkward administrative predicament involving public accountability. In California, this challenge is particularly serious since automobile culture is pervasive to the point of being the most significant aspect of the urban experience. The history of automobile pollution control in the state demonstrates that in imposing rules on vehicle owners concerning emissions, regulators have had to tread cautiously on the issue of "driving fights" by invoking a public awareness of risk in order to gain consent to their intrusions on the private spaces of driver-citizens. Disproportionate restrictions o,n older vehicles with malfunctioning or poorly functioning emission control systems could not only challenge the doctrine of fairness and point to a problem of social justice but also raise additional problems concerning individual rights in liberal democratic societies.
