Objective: the purpose of this document is to support the need to reform the Federal Labor Law in Mexico to provide the protection required to the Elderly Population (PAM by its acronym in Spanish), based on the theoretical position of Bauman (2004) on the fluidity of relationships, which implies the full exercise of their human and social rights, while achieving harmony between the international and domestic legal framework. Methodology: the research is of a theoretical-documentary nature; the proposal is of an analytical-argumentative nature based on the deductive and exegetical method. The first step of the procedure that follows is the identification of the subject under study based on the legal approach, which determines for whom the right to work should be recognized and protected. The next step seeks to draw the PAM in Mexico based on their characteristics, through official statistics, in order to establish the vulnerability that this age generates in relation to other age groups. Subsequently, a review of human rights legislation at three levels -- universal, regional, and domestic -- is carried out to determine which rights are recognized. This opens the door to demonstrate that the right to work is a human and social right enshrined and protected in the three normative spheres; thus, the analysis of the right to work in Mexican legislation is made possible, which produces the inputs to build the arguments of the conclusions. Results: among the results obtained are the lack of harmonization of Mexican labor legislation regarding the protection of the PAM as a worker, which produces a systemic transgression of their fundamental rights. Conclusions: one of the conclusions reached is that the neoliberal orientation of the rule of law in contemporary Mexico has led to the disarticulation between the right to work of PAMs and public institutions, which has resulted in their invisibility, precariousness, and violation. This article is based on a dense research project on the "underworld" of prostitution, from the perspective of fundamental rights and their implementation. It analyzes the relativization of human dignity caused by denying those who work as prostitutes the right to work, as well as their condition of invisibility and social stigma. The analysis of sexual rights encompassed by freedom also highlighted the indissolubility of the "normative amalgam" of law, morality and religion, demonstrating the urgent need to regulate this activity as a means of guaranteeing those who work as prostitutes equal respect and consideration. Resumen Objetivo: describir la problemática de hombres y mujeres trabajadores que al percibir vulnerado su derecho a la salud en el trabajo por sufrir presuntos o declarados ATEL, buscaron apoyo e interpusieron uno o más recursos constitucionales para lograr su restablecimiento efectivo. Materiales y métodos: estudio mixto. Se aplicó encuesta a 189 trabajadores que sufrieron un presunto o reconocido evento de ATEL y que buscaron apoyo en los servicios de extensión solidaria de la Universidad de Antioquia o en organizaciones de derechos humanos en Medellín. La encuesta captó datos sociodemográficos, de seguridad social, laborales, del SGSST, de los antecedentes, ocurrencia y consecuencias de los ATEL y los recursos interpuestos. Para el abordaje cualitativo se realizó: i) una entrevista en profundidad con un médico laboral y abogado independiente y ii) cuatro grupos focales con trabajadores que sufrieron ATEL, sindicalistas, abogados y médicos representantes de ARL, académicos. Resultados: los trabajadores más vulnerables fueron los más afectados en su derecho. Los agentes que integran el SGRL hacen un abordaje fragmentado de la salud y el trabajo que facilita la vulneración del derecho. Los trabajadores que sufren ATEL deben enfrentar barreras económicas, administrativas y de acceso a salud para restituir su derecho. Conclusiones: el trabajo decente y digno es un horizonte hacia el cual se deben apuntar los esfuerzos para que los trabajadores más vulnerados históricamente conquisten y sostengan una vida plena, digna y saludable. Los recursos como la acción de tutela contribuyen a lograr el cumplimiento del derecho a la salud en el trabajo. Abstract Objective: to describe the problems of working men and women who, when perceiving their right to health at work violated due to alleged or declared workplace accidents or illnesses (ATEL for its acronym in Spanish) sought support and filed one or more constitutional resources to achieve their effective restoration. Materials and methods: Mixed study. A survey was applied to 189 workers who suffered an alleged ATEL event and who sought support in the solidarity extension services at Univesidad de Antioquia or in human rights organizations in the city of Medellin. The survey that captured sociodemographic data, social security data, labor data, the Occupational Health and Safety Management System (SGSST for its acronym in Spanish) data of the background, occurrence and consequences of ATELs and legal resources interposed. For the qualitative approach, an in-depth interview was conducted with an occupational physician and an independent lawyer and four focus groups with workers who suffered ATELs, trade unionists, lawyers and doctors representing the Occupational Risk Administrator (ARL for its acronym in Spanish), and academicians. Results: the most vulnerable workers were the most affected in their right. The agents that make up the General System of Occupational Risks (SGRL by its acronym in Spanish) make a fragmented approach to health and work that facilitates the violation of the right. Workers suffering from ATEL must face economic, administrative and access to health barriers to restore their right. Conclusions: Decent and respectable work is a horizon towards which efforts should be aimed so that the most historically vulnerable workers conquer and sustain full, dignified and healthy life. Resources such as guardianship action contribute to the fulfillment of the right to health at work. Resumo Objetivo: descrever a problemática de homens e mulheres trabalhadores que ao perceber vulnerado seu direito à saúde no trabalho por sofrer presuntos ou declarados ATEL, procuraram apoio e interpuseram um ou mais recursos constitucionais para lograr seu restabelecimento efetivo. Materiais e métodos: estudo misto. Aplicou se enquete a 189 trabalhadores que sofreram um presunto ou reconhecido evento de ATEL e que buscaram apoio nos serviços de extensão solidaria da Universidade de Antioquia ou em organizações de diretos humanos em Medellín. A enquete captou dados sócios demográficos, de segurança social, laborais, do SGSST, dos antecedentes, ocorrência e consequências dos ATEL e os recursos interpostos. Para a abordagem qualitativa se realizou: i) uma entrevista em profundidade com um médico laboral e advogado independente e ii) quatro grupos focais com trabalhadores que sofreram ATEL, sindicalistas, advogados e médicos representantes de ARL, acadêmicos. Resultados: os trabalhadores mais vulneráveis foram os mais afetados em seu direito. Os agentes que integram o SGRL fazem uma abordagem fragmentada da saúde e o trabalho que facilita a vulneração do direito. Os trabalhadores que sofrem ATEL devem enfrentar barreiras econômicas, administrativas e de aceso a saúde para restituir seu direito. Conclusões: o trabalho decente e digno é um horizonte para o qual se devem apontar os esforços para que os trabalhadores mais vulnerados historicamente conquistem e sustenham uma vida plena, digna e saudável. It analyzes the phenomenon of clandestine parties during the period of social distancing measures imposed due to the Sars-Cov-2 (COVID-19) pandemic in the years 2020 and 2021, with special attention to the geographic profile of the Federal District. Based on this context, it promotes a reflection on an alleged antinomy and political positions that diametrically oppose, on the one hand, human rights to freedom of movement and assembly, to participate freely in the cultural life of the community and to work, and, on the other, to guarantee of public health and the spirit of solidarity, and on how restrictions on individual freedoms served as a basis both for fears related to biopolitics and the state of exception (manifested with more representation by Giorgio Agamben) and for the more inconsequential liberal individualism and authoritarian, especially in Brazil. Rescues the Party category from Mikhail Bakhtin and Henri Lefebvre, brings examples of parties in the most adverse historical circumstances and seeks to understand the reasons why people ignore health and life risks and relegate solidarity and mourning to a second plan to instead join in clandestine events. From a qualitative sample of news in the most accessed media in the Federal District, it raises the possibility of an excessive, sensationalist or differentiated approach to the subject in relation to other generators of agglomeration. It is wondered what would be (or would have been) the consensual scenario conducive to avoiding or minimizing the phenomenon., Este trabajo analiza el fenómeno de las fiestas clandestinas durante las medidas de distanciamiento social impuestas debido a la pandemia de SARS-Cov-2 (COVID-19) en los años 2020 y 2021, con especial atención al área geográfica del Distrito Federal. Partiendo de este contexto, promueve una reflexión sobre una supuesta antinomia y posiciones políticas que se oponen diametralmente, por un lado, a los derechos humanos a la libertad de circulación y reunión, a participar libremente en la vida cultural de la comunidad y al trabajo y, por otro, a la garantía de la salud pública y al espíritu de solidaridad, y sobre cómo las restricciones a las libertades de carácter individual sirvieron de base tanto para los temores a la biopolítica y al estado de excepción (manifestados de forma más gráfica por Giorgio Agamben) como para el individualismo liberal más inconsecuente y autoritario, especialmente en Brasil. Rescata la categoría Festa de Mijaíl Bajtín y Henri Lefebvre, aporta ejemplos de fiestas en las circunstancias históricas más adversas y trata de entender las razones por las que la gente ignora los riesgos para la salud y la vida y relega la solidaridad y el luto a un segundo plano para, en cambio, socializar en eventos clandestinos. La presente monografía busca resolver en cuatro capítulos el problema que existe frente al ejercicio del derecho a la huelga en los servicios públicos esenciales en Colombia. A partir de esta premisa, se realizó un marco teórico sobre la legislación internacional y su posición dentro del ordenamiento jurídico colombiano; además de una breve explicación sobre el funcionamiento, organigrama y facultades de la Organización Internacional del Trabajo. Con esto, lo que se buscó fue poner en contexto las facultades de este organismo internacional, pero sobre todo la validez de sus decisiones y/o regulaciones en nuestro país. Posteriormente, se contrastó la posición sobre el derecho a la huelga y los servicios públicos esenciales entre ambas regulaciones. En este orden de ideas, esta monografía tocó temas como: la definición de los tratados internacionales, el bloque de constitucionalidad, el derecho a la huelga y los servicios públicos esenciales. Además, se trataron temas como la Organización Internacional del Trabajo, el trámite de ratificación de los tratados internacionales en Colombia, el funcionamiento del ejercicio del derecho a la huelga, así como otros aspectos importantes a la hora de adoptar una posición al respecto del problema planteado en este escrito., This monograph seeks to resolve in four chapters the problem that exists regarding the exercise of the right to strike in essential public services in Colombia. Based on this premise, a theoretical framework on international legislation and its position within the Colombian legal system was developed, in addition to a brief explanation of the functioning, organizational chart and powers of the International Labor Organization. En el artículo se muestra un tipo de violencia sobre el trabajo y sus condiciones de desarrollo que se ejerce a través de la estructura desigual y asimétrica del capitalismo que es controlada por poderes innominados y salvajes, provocando sistemas de sujeción y explotación. Asimismo, desde los conceptos de riqueza y agencia humana y de trabajo vivo, se explicitan algunos dispositivos que hacen que el trabajo asalariado sea el anticipo de otras formas de trabajo más precarias, sumando el derecho al trabajo como una nueva promesa incumplida de la modernidad. Finalmente se denuncia el concepto de derechos humanos oficializado y generalizado que es insuficiente como instrumento de garantía del derecho al trabajo. The article shows a type of violence on work and its conditions of development that is exerted through the unequal and asymmetric structure of capitalism that is controlled by unnamed and savage powers, causing systems of subjection and exploitation. Likewise, from the concepts of wealth and human agency and living work, some devices are made explicit that make wage labor the advance payment of other more precarious forms of work, adding the right to work as a new unfulfilled promise of modernity. Finally, the official and generalized concept of human rights is denounced, which is insufficient as an instrument to guarantee the right to work.

Cuando se piensa en los excombatientes pertenecientes a grupos armados ilegales, se les atribuye una serie de características generales que por lo regular implican un daño en su personalidad y la representación de un riesgo latente (lejano o cercano), se omite la idea de que ellos comparten los mismos derechos cualquier ciudadano, perdiendo la posibilidad de construir una vida desde la legalidad. Un círculo vicioso susceptible de romperse siempre y cuando se proporcionen las oportunidades necesarias para plantear los cambios. Se hace importante entonces, determinar la influencia de las percepciones sobre el proceso de reintegración en la existencia de Oportunidades Laborales para las personas excombatientes del conflicto armado colombianos desmovilizadas entre el 2003 - 2016. Desde una perspectiva crítica de Derechos Humanos y como eje primordial para el logro de una reintegración que garantice el no retorno a la participación de actos ilícitos, se propone el Derecho al Trabajo como la herramienta de Desarrollo Humano desde la cual, las personas pueden lograr autorrealización, automotivación, satisfacción y bienestar social. El documento de garantías en los Derechos Humanos del Sistema Penitenciario y Carcelario en Colombia, busca dar a conocer el estado de sujeción bajo el cual se encuentran las personas privadas de la libertad por la comisión de conductas punibles, no obstante a través de este se establece como las garantías esenciales de derechos humanos y de carácter fundamental se ven vulnerados a diario en dichos establecimientos carcelarios y penitenciarios debido a la falta de políticas públicas frente al tema. Así mismo se busca enunciar que a faltas políticas públicas, son los jueces quien a través del activismo judicial quienes han qué tenido que proteger los derechos fundamentales y esenciales de estas personas por medio de sus decisiones, creando de esta manera derecho debido a la falta de las garantías sociales, políticas y culturales que aún no promueve nuestro Estado. RESUMENEn el presente artículo se buscará determinar la existencia de un diálogo entre cortes del tipo deliberativo, cuyo objetivo es la coordinación de actuaciones para conseguir un mejor curso de acción logrando una actuación eficaz y con menores efectos negativos y la relación de este con la protección de grupos vulnerables previstos en la Constitución ecuatoriana, para este análisis se toma como referencia las acciones extraordinarias de protección resueltas por la Corte Constitucional del Ecuador en el período 2008-2018, específicamente se han considerado cinco procesos en los que se hace referencia y cita de los criterios de la Corte Interamericana de Derechos Humanos emitidos en fallos u opiniones consultivas donde se resolvió a favor de un caso de género o en beneficio de personas pertenecientes a grupos de atención prioritaria. Se identificará, de esta manera en cada caso el precedente o regla jurisprudencial que los jueces constitucionales ecuatorianos dictaron bajo este contexto y que constituirán precedentes jurisprudenciales para su aplicación en el futuro. [spa] La tesis analiza los cambios en el mundo del trabajo que impactaron no sólo en las legislaciones en los países centrales y periféricos, sino también en sus Constituciones materiales. El derecho al trabajo y en condiciones dignas se ve afectado. Ocurre con nuevas formas de contratación y el uso de la fuerza de trabajo. Además, hay una huida en la responsabilidad por los derechos laborales, sea por la contratación de terceras empresas, sea por el retorno a formas de contratación en el marco civil, socavando las fronteras de la relación de empleo. Se analiza el contenido del derecho al trabajo digno y demás implicaciones en su dimensión individual (derecho a acceder a un puesto de trabajo en condiciones de igualdad, de mantenerse en él con protección jurídica y a no ser despedido sin causa) y en su dimensión objetiva, como obligación del Estado a promocionar políticas de empleo. Se analizan las graves violaciones al derecho al trabajo digno, así considerado porque los instrumentos internacionales conectan el derecho al trabajo a un umbral de condiciones mínimas, sin las cuales no es aceptable, por violar la dignidad humana. Entre esas violaciones, el trabajo forzoso. En la última década, aumentó en casi el doble el número de personas atrapadas en esa condición. Eso requiere una mayor protección a las víctimas. El compromiso de los países en erradicar las peores formas de trabajo infantil hasta 2016, tampoco se cumple, lo que señala que hace falta la voluntad política y la solidaridad internacional. El paradigma del garantismo se impone como un freno a la flexibilidad, usada en nombre del aumento del nivel de empleo que, en verdad, amenaza el trabajo digno, con recortes en los derechos, dañando no sólo las condiciones de trabajo y la manutención del empleo, sino también la democracia y la justicia, por provocar el crecimiento de la desigualdad. La tesis refuta la devaluación del derecho al trabajo propuesta incluso por intelectuales. Se refuerza la necesidad del reconocimiento constitucional e internacional como derecho humano y fundamental, para asegurar su máxima protección, dotado de fuerza normativa que establece límites infranqueables a los poderes públicos y privados, poniendo de relieve el contenido del Estado Social y Democrático de Derecho, anclado en la dignidad de la persona humana y en la inclusión social. Se proponen garantías robustas, incluyendo hard law para las grandes empresas trasnacionales por el gran poder que detentan, a través de sanciones supranacionales que incluyen no sólo la reparación, sino también la prevención, con la paralización de la actividad en caso de graves violaciones a la dignidad humana, como los riesgos a la vida y a la salud de los trabajadores., [eng] The thesis analyzes the changes in the labor world impressed not only by legislations in the central and peripheral countries, but also in their interpretations of the Constitutions. The right to the work and in worthy conditions is affected. It happens with new forms of contracting and use of the workforce. In addition, there is an escape in the responsibility for the labor laws, for contracting of third companies, and also for the return to forms of contracting in the civil frame, undermining the borders of the labor relations. The content of the right to the decent work and other implications is analyzed, in its individual and in its objective dimension, as obligation to the State in promoting employment policies. Violations to decent work are analyzed here. The international instruments connect the right to the work to a threshold of minimal conditions, without which it is not acceptable, for violating the human dignity. The forced labor is one example. In the last decade, it increased in almost the double the number of persons caught in this condition. It asks for a major protection to the victims. Also the commitment of the countries in eradicating the worst forms of child labour until 2016 is not fulfilled, which indicates that it is necessary to improve the political will and the international solidarity. The paradigm of the garantismo imposes itself as a brake on the flexibility used in name of the increase of the level of employment but, in effect, threatens the worthy work, with cuts in the rights, damaging not only the conditions of work and the subsistence of the employment, but also damaging democracy and justice, for provoking the growth of the inequality. This thesis refutes the devaluation of the right to work, proposed even by intellectuals. It is necessary to reinforce the need of constitutional and international recognition as a human and fundamental right, to assure maximum protection, endowed with normative force that establishes impassable limits to the public and private power. Thus, emphasizing the content of the Social and Democratic State by the rule of law, anchored in the dignity of the human person and in the social inclusion. Robust guarantees are proposed, including hard law to the transnational companies that often disrespect decent work, across supranational sanctions that include not only the repair, but also the prevention, with the suspension of the activity in case of serious violations to the human dignity, such as the risk to the life and the health of the workers.
