Several articles of the March 7, 1277 condemnation by the Parisian bishop Stephen Tempier censure an intellectualist conception of the relation of intellect and will. Yet remarkably, thirty years later, John of Pouilly argues that rather than censuring intellectualist stances, these articles endorse them. This paper examines Pouilly's interpretation of these articles against a twofold background: Pouilly's strongly intellectualist theory of free will and Henry of Ghent's voluntarist interpretation of some of the same articles, which is Pouilly's direct target in his discussion of the articles. The paper thus portrays a unique witness of the reception of Tempier's condemnation and provides insight into a sophisticated theory of free will that represents a minority view at the time.

Proponowane w tym rozdziale rozumienie stanowiska Tomasza z Akwinu jako umiarkowanie intelektualistycznego bierze pod uwagę zarówno wcześniejsze jego teksty o wyraźnie intelektualistycznej wymowie (np. De veritate), jak i te późniejsze (Summa theologiae, De malo), które niektórzy badacze traktują jako świadectwo jego zwrotu w stronę woluntaryzmu. W interpretacji przyjętej tu na podstawie przeprowadzonych badań i konfrontacji tekstów źródłowych stanowisko Akwinaty podlega niewątpliwie pewnej ewolucji (np. co do typu przyczynowego oddziaływania intelektu na wolę i odwrotnie), ale zauważalne zmiany nie są radykalne i polegają raczej na innym rozłożeniu akcentów, ewentualnie na bardziej precyzyjnym wyjaśnieniu wzajemnych relacji między intelektem i wolą (tak co do ich współzależności, jak co do ich autonomii w różnych aspektach i fazach ludzkiego działania). Według autora tego rozdziału stanowisko Tomasza z Akwinu w tym zakresie na każdym etapie jego intelektualnego rozwoju jest wyważone, i nawet wtedy, gdy w większym stopniu zdaje się uwzględniać znaczenie woli, pozostaje umiarkowaną wersją intelektualizmu antropologicznego. In this chapter, a proposed understanding of the position of Thomas Aquinas as representative for a moderate anthropological intellectualism takes into consideration both his earlier works (such ad De veritate) and these later (such as Summa theologiae and De malo), which some researchers treat as a proof of his return towards voluntarism. In the interpretation adopted here on the grounds of the performed research and of the confrontation of source texts, Aquinas's position is undoubtedly subject to some evolution (for example, in regard to the types of causal impact of the intellect on the will, and inversely), but this noticeable changes are not very radical and rather they rely on the difference of the emphasis, eventually on a more precise explanation of the complexe mutual relations between intellect and will (in regard to their interdependence as well as in regard to their autonomy in various aspects and phases of human action). According to the author of this chapter, a position of Thomas Aquinas at every stage of his intellectual development is well balanced and remains a moderate version of an anthropological intellectualism, even when seems to take more into account the importance of the will.

Analizy przeprowadzone w tym rozdziale potwierdzają wyraźnie woluntarystyczne stanowisko Henryka z Gandawy w sporze z antropologicznym intelektualizmem, choć nie przesądzają tego, czy jest to woluntaryzm skrajny, czy nie. Kluczowe dla stanowiska Henryka są twierdzenia, które wskazują na prymat woli względem intelektu w trzech wymiarach, tj. w zakresie podstawowej dyspozycji każdej z tych władz, podstawowej czynności tych dyspozycji i podstawowego przedmiotu tych czynności. Podobnie, woluntarystyczny charakter ma teza, że wola jest jedyną władzą człowieka, która jest faktyczną, bezpośrednią i sprawczą przyczyną inicjowania bądź powstrzymywania czynności wszystkich innych ludzkich władz, łącznie z intelektem. Jest też według Henryka władzą samoczynną i autonomiczną względem intelektu, tj. niezdeterminowaną całkowicie przez jego werdykty. Przede wszystkim zaś badania prezentowane w tym rozdziale potwierdzają, że z punktu widzenia Henryka z Gandawy wola jest właściwym podmiotem i rzeczywistą, niemetaforyczną przyczyną ludzkiej wolności: wolnego wyboru, a wraz z nim także etycznych kwalifikacji ludzkich działań. Takie stanowisko czyni go myślicielem reprezentatywnym dla średniowiecznego woluntaryzmu. The analyzes carried out in this chapter confirm an explicitly voluntaristic position of Henry of Ghent in the debate with anthropological intellectualism of 13th century, although they do not determine whether it is extreme voluntarism or not. Key to Henry's position are the statements which indicate the primacy of the will over the intellect in three dimensions, i.e. as to the primary (basic) dispositions of each of these faculties, as to the primary (basic) actions of these dispositions and as to the primary (basic) objects of these actions. Similarly, voluntaristic meaning has the thesis that the will is the only faculty of man which is the actual, immediate and efficient cause of initiating and inhibiting the activities of all other human faculties, including intellect. According to Henry of Ghent, the will is a spontaneous, self-acting faculty, autonomous in the relation to the intellect, i.e. non determined wholly by the intellect's judgments. Above all, the research presented in this chapter confirms that from Henry's point of view the will is the proper subject and real, non-metaphorical cause of human freedom, of free choice and of the ethical qualifications of human actions. Such position makes him a representative thinker of medieval voluntarism.

Celem tej książki jest dostarczenie klucza do zrozumienia pewnych aspektów średniowiecznej fazy w dziejach myślenia o woli, w szczególności dokonującego się w ramach średniowiecznej antropologii procesu pogłębiającej się polaryzacji, którego efektem był spór między antropologicznym intelektualizmem i woluntaryzmem. Zgodnie z zasadniczą tezą tej książki, radykalnie przeciwne stanowiska antropologiczne, tj. intelektualizm i woluntaryzm, nie były dane od początku, czyli już na gruncie starożytnej greckiej antropologii i antropologicznej myśli wczesnego chrześcijaństwa i islamu, lecz kształtowały się stopniowo i dopiero pod koniec XIII wieku przybrały dojrzałą, wyraźnie spolaryzowaną postać (wciąż jeszcze występującą w wariantach dopuszczających stopniowanie, tzn. w wersji umiarkowanej bądź radykalnej). Historyczny i intelektualny kontekst tych rozważań uzasadnia interdyscyplinarne podejście w prowadzonych badaniach, w szczególności włączenie do nich zagadnień wykraczających poza wąsko rozumianą antropologię filozoficzną , takich jak teologiczna kwestia wszechmocy Boga i problem predestynacji. The book aims to provide a key to understanding some aspects of the medieval phase in the history of thinking about the will, especially the process of the deepening polarization within medieval anthropology, resulting in the split between intellectualism and voluntarism. According to the principal thesis of this book, radically opposing anthropological camps - those of intellectualism and voluntarism - were not a given from the outset, i.e. in the ancient Greek and early Christian and Islamic anthropology, but took shape gradually, and only by the end of the 13th century did they assume a mature, clearly polarized form (yet still appearing in options admitting of degrees, i.e. a moderate or radical version). The historical and intellectual context of these considerations validates the interdisciplinary approach of the study, in particular the incorporation of issues from beyond a narrowly conceived philosophical anthropology, such as the theological question of God's omnipotence and the problem of predestination.

The overall goal of the article is to reexamine Hobbes’s concern to respond to the challenges of the republican perspective on the relationship between the liberty of subjects and the political power. If, according to Skinner, republican theorists appealed to sources of classical antiquity, I argue that Hobbes chooses to offer a blend of classical and theological ideas in order to generate a “science” of the political life within the confines of a postlapsarian world dominated by passion and the fear of death. If the image of God is maintained in the Hobbesian politics, it is because Hobbes needed a model of imitation of a stability that the individuals dominated by passions failed too often to have. Hobbes also needed a model of omnipotence and providence to be imitated by the sovereign. This complex relationship between the theological heritage of the past and the novelties inaugurated in political thought by Hobbes’s accent on human passions triggers a series of changes in Hobbes’s understanding of the law of nature and natural right. The article brings to discussion Hobbes’s indebtedness to Lactantius in reading Lucretius’s materialism, Augustine’s model of God as a Creator and the theological controversy between intellectualism and voluntarism when formulating his own anthropological perspective on “natural” and “civil” law and right. L’objectif général de l’article est de réexaminer la préoccupation de Hobbes de répondre aux défis de la perspective républicaine sur la relation entre la liberté des sujets et le pouvoir politique. Si, selon Skinner, les théoriciens républicains utilisent des sources de l’antiquité classique, le choix de Hobbes est de s’orienter vers une synthèse d’idées classiques et théologiques afin de fonder une «science» de la vie politique menée dans le cadre d’un monde postlapsaire dominé par les passions et notamment par la peur de la mort. L’image de Dieu est présente dans la théorie hobbesienne du politique en tant que modèle de stabilité rarement atteinte par les individus sous l’emprise des passions. Un deuxième modèle est celui de la toute-puissance divine, mais destiné plutôt au souverain. Cette relation complexe entre l’héritage théologique et les innovations amenées dans la pensée politique par l’analyse hobessienne des passions humaines donne lieu à des changements dans la conception de la loi de nature et du droit naturel. L’article met en avance des aspects de l’héritage théologique, comme c’est le cas de l’influence de Lactance sur la lecture hobbesienne du matérialisme de Lucrèce, ou l’influence du modèle augustinien du Dieu Créateur et des controverses théologiques entre l’intellectualisme et le volontarisme sur la formulation que Hobbes donne à sa propre vision anthropologique sur la loi et le droit naturels et civils.

La conmemoración, en el año 2017 del cuarto Centenario de la muerte de Francisco Suárez, constituye un motivo cultural que invita a repensar la persistencia de su legado doctrinal jurídico en la Filosofía y la Teoría del Derecho de la actualidad. En este ensayo se analizan su concepción de la ley, a partir de sus elementos constitutivos y de sus implicaciones. Así como las relevantes observaciones de Suárez sobre las características del lenguaje legal. Este trabajo se propone ofrecer un balance de aquellos aspectos de la reflexión de Francisco Suárez sobre el Derecho que pueden implicar mayor interés para la cultura jurídica del presente. Se analiza, con especial atención, el carácter innovador de la concepción jurídica de Suárez con respecto a la tradición medieval y a las doctrinas de su tiempo. Se pueden advertir así rasgos anticipadores del pensamiento de Suárez con respecto a determinadas concepciones filosófico-jurídicas contemporáneas. The commemoration in 2017 of the fourth centenary of the death of Francisco Suárez represents an invitation to rethink the persistence of its legal scholarly legacy within contemporary Legal Theory and Philosophy. This essay analyses its conception of law, based on its constituent elements and their implications, as well as the relevant observations of Suárez on the characteristics of the legal language. This paper intends to offer a balance of those aspects of the reflection of Francisco Suárez on law that may bear more interest for today's legal culture. Special attention is dedicated to the innovative character of the legal conception of Suárez with respect to the medieval tradition and to the doctrines of its time. In this way, we can see the anticipatory features of Suarez's thought in regard to certain contemporary legal-philosophical conceptions.

Autor rozważa w tym artykule niektóre ważniejsze kwestie antropologiczne, takie jak warunki możliwości, przyczyny, zasięg, właściwy podmiot i obszar zastosowań ludzkiej wolności. Stara się uwyraźnić i wyjaśnić tę problematykę w kontekście historycznego sporu między antagonistycznymi stanowiskami określanymi jako woluntaryzm i intelektualizm antropologiczny, które pod koniec XIII wieku stopniowo zyskały dojrzałą postać. Prezentując różne fazy tego sporu i różne - zarówno bardziej radykalne, jak i umiarkowane - warianty zaangażowanych weń przeciwnych stanowisk, autor koncentruje swoją porównawczą i krytyczna analizę na tezach i argumentach dwóch wiodących przedstawicieli nurtu woluntarystycznego i intelektualistycznego w tej epoce - Henryka z Gandawy i Gotfryda z Fontaines. Celem jego dociekań jest odkrycie i objaśnienie zarówno przyczyn rzeczywistych, nieredukowalnych rozbieżności między wspomnianymi stanowiskami co do źródeł, istoty i uzasadnienia ludzkiej wolności (wolny osąd rozumu czy wolny wybór woli), jak i momentów względnej między nimi zbieżności. In this paper the author considers some of the major anthropological issues, such as conditions, causes, dimensions, and the appropriate subject and domain of application of human freedom, and tries to make explicit and to explain these issues in the context of the historical controversy between the antagonistic positions which gradually matured in the late 13th century and can be defined as anthropological voluntarism and anthropological intellectualism. Presenting the different phases of this controversy and the different versions - both radical and moderate - of the opposing positions, the author focuses his comparative and critical analysis of the main claims and arguments of the leading representatives of the voluntarist and intellectualist currents of this time - Henry of Ghent and Godfrey of Fontaines. The aim of his inquiries is to discover and explain both the causes of very real, irreductible discordances between their positions regarding the sources, essence, and justifications of human freedom (free judgment of reason versus free choice of the will) and - eventually - the moments of their relative agreement.

In dieser Arbeit werden vier zwischen 1712 und 1755 entstandene Kritiken von Leibniz’ Optimismus-Lehre der ‚besten aller möglichen Welten‘, wie diese in der Theodizee (1710) vorgestellt wird, dargestellt und kritisch untersucht. Nach der Meinung etlicher Kommentatoren wurde Leibniz’ philosophischer Optimismus erst nach dem Erdbeben von Lissabon 1755 und Voltaires Angriffen zum Ziel gewichtiger Kritiken seitens Philosophen und Theologen. Gegen dieses geläufige Bild zeigt diese Dissertation, dass jene Kritiken sehr bald nach der Veröffentlichung der Theodizee kamen, und dass zentrale Thesen des Leibniz’schen Optimismus schon in der ersten Hälfte des 18. Jh. Gegenstand philosophiegeschichtlich bedeutender Polemiken waren. Es wird gezeigt, dass die Kritik an Leibniz’ Gottesbegriff – der in dieser Arbeit als ‚intellektualistisch‘ bezeichnet wird – eine fundamentale Rolle spielt, und dass ein beträchtlicher Teil des Konflikts zwischen dem Optimismus und dem frühen ‚Gegen-Optimismus‘ durch den Konflikt zwischen Intellektualismus und Voluntarismus erklärt werden kann. This work describes and examines four critical reviews, all of them written between 1712 and 1755, of Leibniz’s theory of optimism or the system of ‘the best of all possible worlds’, as it is presented in the Theodicy (1710). Several commentators state that the first important criticisms of Leibnizian philosophical optimism by philosophers and theologians came only after the Lisbon Earthquake of 1755 and Voltaire’s subsequent attacks. In opposition to this standard picture, this dissertation shows that criticisms emerged very soon after the publication of Theodicy, and that central theses of Leibniz’s optimism were already the target of significant philosophical criticisms in the first half of the eighteenth century. Furthermore, it is demonstrated that the criticism of Leibniz’s concept of God – a concept described here as ‘intellectualist’ – plays a fundamental role, and that a considerable part of the conflict between optimism and early ‘counter-optimism’ can be explained by referring to the conflict between intellectualism and voluntarism.

El presente artículo ofrece un estudio completo de las obras de Francisco de Vitoria con el objetivo de señalar la posición intermedia del autor entre el voluntarismo y el intelectualismo, así como, remarcar la originalidad de su pensamiento. Especialmente, la importancia que tiene Vitoria en la conceptualización del derecho subjetivo y, como consecuencia, en la génesis de lo que posteriormente se conocerían como Derechos Humanos. This article provides a comprehensive study of the works of Francisco de Vitoria in order to indicate the intermediate position of the author between voluntarism and intellectualism, as well as, highlight the originality of his thought. Especially, the importance of Vitoria in the conceptualization of subjective Right and, consequential-ly, in the genesis of what would later be known as Human Rights
