The planning fallacy is at play in projects when optimism bias and/or strategic misrepresentation are present. We examine the cost performance of approximately US$ 6.5 billion worth of social infrastructure projects that were procured in Hong Kong and specifically the differences between their final accounts and the various types of estimates that were prepared prior to construction. We focus on the (honest) planning fallacy and hence aim to determine whether estimates are more optimistic than actual costs. Our data shows that 43% of projects incurred a cost underrun from their contract award. We therefore infer that at best 57% of projects may be explained by the presence of the planning fallacy. Based on our findings, we argue that optimism and pessimism bias coexist. Likewise, the planning fallacy and competing explanations can simultaneously account for cost deviations in social infrastructure projects. We submit that the prevalence of the planning fallacy has been exaggerated and hence provide an explanation as to why this has occurred. We finally suggest there is a need for additional empirical work to test the claim that the planning fallacy is the underlying cause of cost overruns and thus the best “theory” to explain “how projects work.”

Many empirical studies suggest that the realized values of highest-ranked decision alternatives tend to be systematically lower than estimated, causing the decision-maker to experience post-decision disappointment. This systematic overestimation of value has been explained by a systematic bias in the alternatives’ estimated values resulting from, e.g., a behavioural disposition towards overoptimism or even strategic misrepresentation. Nevertheless, even if these estimates are unbiased, the value of the selected alternative is likely to be overestimated due to selection bias. In this paper, we build models for measuring the shares of systematic and selection biases in generating post-decision disappointment, and develop approaches for estimating these models from data which contains the estimated values of all alternatives but the realized values of selected alternatives only. Results obtained from applying these models to real data on 5,610 transportation infrastructure projects suggest that out of the total cost overrun of $2.77 billion, only ca. 24% can be attributed to systematic bias.

This chapter discusses the foundations of intellectual property rights and how computer technology has influenced and changed the traditional issues of property rights. The reader is immersed into a discussion of controversial issues of ownership in a rapidly amalgamating global cultures, languages, beliefs, and values as a result of rapid globalization technologies like telecommunication that is casting a far and wide net that is likely, in the near future, to create one global commons. The controversial issues focused on here include the politics and psychology of ownership and the changing infringement landscape. Another issue of interest in our focus is the intellectual property crime (IPC), activities that involve infringement, counterfeiting, piracy of products and services for profit without permission from the creator, misappropriation, misrepresentation, corruption and bribery, and espionage.

Legal regulation of religious conversion has become one of the central human rights issues worldwide. Numerous countries, especially in South Asia, have enacted laws that prohibit proselytizating on the grounds of force, allurement, and misrepresentation. Critics have consistently relied on freedom of religion to oppose these laws, but courts in these jurisdictions have upheld them on the very grounds of religious freedom. The present Article explains the historical and ideological bases of this counterintuitive approach to religious freedom by focusing on the case of India. It argues that this approach is based on a historically evolving conception of religion associated with modern Hinduism, according to which all religions have an equal claim to spiritual truth. This precept of religious equality has come to constitute the political and judicial approach to religious freedom and religious conversion laws. The Article uses this interpretive insight to renew the normative critique of such laws.

Digital platforms have shaped the ways of navigating and occupying shared housing properties in the private rental market. Online platforms reconfigure the geography of housing searches and allow potential tenants to identify and enquire about shared properties while transcending local and national boundaries. Urban scholarship has viewed these platforms as real-time, fine-grained, big datasets for investigating housing markets. However, limited attention has been given to tenants’ experiences of using online platforms, and the extent to which these platforms facilitate access to housing. Drawing on interviews with tenants [n = 35] in Sydney, this paper explores tenants’ experiences of searching, negotiating and securing shared room housing advertised on digital platforms. The findings highlight that shared housing digital platforms operate on the logic of peer-to-peer interaction between landlords and tenants via user-generated listings. These platforms allow tenants to compare rental prices, locations and characteristics of shared properties through ‘computerised algorithms’. Shared housing tenants, nonetheless, face a series of challenges, especially related to misrepresentation of property conditions, fake profile identity of advertisers, upward pressure on rental prices and high competition for listed properties, all of which influence their housing search and living experiences. Digital platforms emerge as complex socio-technical assemblages that are difficult to regulate as city authorities struggle to formulate effective mechanisms to govern technology-led social change. The paper provides valuable insights into housing informality and tenant exploitation at the platform interface and calls for platform governance.

“In Defence of the Nominalist Ontology of Money” by Geoffrey Ingham (published by the Journal of Post Keynesian Economics in 2021) contends that “Historicising the Money of Account: A Critique of the Nominalist Ontology of Money” (published by the same journal in 2020) is based on misunderstanding, misrepresentation, and imprecisions. The core proposition in “Historicising the Money of Account” is that the money of account, which is generally understood to be a universal attribute of money, is in fact an institution of late medieval and early modern times that has no significant equivalent in today’s world (or in the ancient world, for that matter). This reply is intended to provide further clarification on the historical and ontological specificity of the late medieval institution of the money of account.

No doubt exists that the separation of powers is a fundamental architectural principle in Canadian public law jurisprudence. But what about the idea of a mixed constitution? A simple CanLII search for “mixed constitution” turns up six cases. In five1 of these cases, the search reveals the following phrases: “pre-mix constituted goods,” “the mix constituting the excavated material,” “the Owners’ mixes constitute ‘bread and rolls’,” “the improper mixing constituted a fraudulent misrepresentation,” and “quality control for the asphalt mix constituted.” Clearly baking and aggregate blends figure largely in constituted mixes, but the constitutional jurisprudential sense is largely absent. That said, concerns about pre-mixing, constituted goods, excavating, improper mixing, and quality control do have some salience for the discussion that follows.

The present article is a critical engagement with Aleksei Yurchak’s Everything Was Forever until It Was No More: The Last Soviet Generation. It contends that, as rich as Yurchak’s insights on the language culture of Brezhnev’s Stagnation have proven to be, his account ends up seriously misrepresenting the Stalinist episode in the life of Soviet ideology. This misrepresentation is due, in large part, to the problematic use of post-structuralist models, and particularly of Claude Lefort’s theorization of ideology in the modern era. Through a re-examination of Lefort’s “Outline of the Genesis of Ideology in Modern Societies,” the present article advances an alternative understanding of the discursive “shift” in Soviet ideology. Yurchak has argued that, before being set afloat in the 1950s, Soviet official discourse was held together through the figure of the “external master,” Stalin himself. The master is able to mask what Yurchak terms the “Lefort paradox” of Soviet ideology and which he glosses as the divergence between ideological enunciation and ideological “rule.” Yet Yurchak misreads Lefort’s theory, and specifically the latter’s references to “master” and “rule.” When these terms are restored to their proper theoretical significance, it becomes possible to formulate in a new way the contradictory duality at the heart of Soviet ideology. The article contends, contra Yurchak, that this is not the duality of enunciation and actual exercise of power; but rather the split internal to ideological discourse, between the “rule of reality” and the “reality of the rule.” The “shift” of Soviet ideological discourse begins as a slippage between these two ideological representations, and not as the removal of some anchor external to representation.

BackgroundHealthcare fraud entails great financial and human losses; however, there is no consensus regarding its definition, nor is there an inventory of its manifestations and factors. The objective is to identify the definition, manifestations and factors that influence health insurance fraud (HIF).MethodsA scoping review on health insurance fraud published between 2006 and 2020 was conducted in ACM, EconPapers, PubMed, ScienceDirect, Scopus, Springer and WoS.ResultsSixty-seven studies were included, from which we identified 6 definitions, 22 manifestations (13 by the medical provider, 7 by the beneficiary and, 2 by the insurance company) and 47 factors (6 macroenvironmental, 15 mesoenvironmental, 20 microenvironmental, and 6 combined) associated with health insurance fraud. We recognized the elements of fraud and its dependence on the legal framework and health coverage. From this analysis, we propose the following definition: “Health insurance fraud is an act of deception or intentional misrepresentation to obtain illegal benefits concerning the coverage provided by a health insurance company”. Among the most relevant manifestations perpetuated by the provider are phantom billing, falsification of documents, and overutilization of services; the subscribers are identity fraud, misrepresentation of coverage and alteration of documents; and those perpetrated by the insurance company are false declarations of benefits and falsification of reimbursements. Of the 47 factors, 25 showed an experimental influence, including three in the macroenvironment: culture, regulations, and geography; five in the mesoenvironment: characteristics of provider, management policy, reputation, professional role and auditing; 12 in the microenvironment: sex, race, condition of insurance, language, treatments, chronic disease, future risk of disease, medications, morale, inequity, coinsurance, and the decisions of the claims-adjusters; and five combined factors: the relationships between beneficiary-provider, provider-insurance company, beneficiary-insurance company, managers and guānxi.ConclusionsThe multifactorial nature of HIF and the characteristics of its manifestations depend on its definition; Identifying the influence of the factors will support subsequent attempts to combat HIF.

An official misrepresentation of the law occurs when an official, acting as an agent of the state, represents what is legal or not in an erroneous or misleading way. Should reliance on such misrepresentations excuse one from criminal responsibility? American courts presently recognize two official misrepresentation defenses: Entrapment by Estoppel and Public Authority. However, there is disagreement about what constitutes these defenses and what their limits are. Part of the confusion surrounds why these defenses are justified at all, especially given the general principle ignorantia juris non excusat. We propose an answer to this justification question: these defenses are justified because official misrepresentations preclude knowledge of the illegality of the acts in question. It is not simply that someone on the receiving end did not know; they could not know. We develop this account, linking it to due process and fairness, and then use it to clarify Entrapment by Estoppel and Public Authority and argue both should be subject to important restrictions.

There has been constant resonance of feminine image misrepresentation in most narratives since the (re)invention of video-films in Nigeria, Ghana, and indeed across the African continent. In spite of the binary struggle between the (presumed) chauvinist filmmakers and their feminist counterparts, masculinity always (re)emerges in new forms or topoi to dominate femininity. Consequently, there seems to be a paradigm shift on the (mis)representation of women that reinforces Laura Mulvey’s sexual voyeuristic objectification of the feminine gender as reflected in near-nude costumes as well as sexually larded scenes that are common sights in African films, particularly those from Ghana. Employing the historical-analytic and observation methods, this article examines three selected films: The Maid I Hired (2010), Why Did I Get Married? (2007) and To Love a Prince (2014) by Frank Rajah Arase (FRA), an African filmmaker of Benin (Edo) extraction who largely operates in the Diaspora, to foreground and highlight the voyeuristic imprints in Ghanaian films (Ghallywood), which tend to demean the feminine gender in the context of African culture that hegemonizes the male folk.

Education reforms are rarely successful or free of controversies. However, efforts to STEM-ify public education in the USA by positioning education in STEM fields and training of future workforce as the central purposes of public schooling is proving to be remarkably successful and devoid of contention. This paper explains the success of STEM-ification of public education in the USA by examining these reform efforts from the perspective of depoliticization. With special reference to the implementation of STEM reforms in the state of Georgia, USA, we analyze STEM reforms as a case of network governance to elaborate its features that contribute to its depoliticization. Then, we examine these reforms as a case where we see three concurrent modes of depoliticization—governmental, societal, and discursive. Our analysis presents the depoliticization of STEM reforms in the USA as an example of governance techniques in the current times that legitimize neoliberalism as the dominant political rationality with profound implications for the diminution of democratic space and perpetuation of injustices of misrepresentation in advanced societies. The paper ends with an appeal for repoliticization of STEM reforms and sustained attention to this issue among educators and researchers.

László Krasznahorkai is now the best-known Hungarian writer in the English-speaking world (perhaps in the world, period). But what is the precise nature of the relationship between his Hungarian works and their English translations that have been, on the whole, so well received in Britain and especially the USA? This article takes a very close linguistic look at one his shorter works, ÁllatVanBent, in a version by Ottilie Mulzet, co-recipient with George Szirtes of the translators’ share of the 2015 Man Booker International Prize, which recognized Krasznahorkai for his “achievement in fiction on the world stage.” I argue that Ottilie Mulzet’s translation is in a hybrid English that in some places evidences a misunderstanding of the Hungarian, and in others claims to be a foreignized, “Krasznahorkai-English” that is, however, insufficiently justified by the original. More broadly, the article thus takes issue with the increasingly widely held view that the translator is not merely a co-author but enjoys a kind of authorial autonomy that implies that the translation can be judged without close reference to the original. As Krasznahorkai’s known views on translation suggest the acceptance of this notion, he is therefore, to a degree, complicit in the partial misrepresentation (and hence misconstrual) of his work.

Grzegorz Malec’s “There Is No Darwin’s Greatest Secret”, a review of my book Nullius in Verba: Darwin’s Greatest Secret, takes one extremely minor finding from my book and, despite his best efforts, manages to disconfirm just one of thirty examples of that minor finding. He then takes that one disconfirmed mere minor example and presents it as evidence that he has disconfirmed all the original major findings in my book. By so doing, his deceptive review goes far beyond the counter-academic deviance of mere cherry picking, it is more a case of gross misrepresentation to the point of de facto fact denial amounting to historic revisionist behaviour.

This article examines gift-giving within the Persian empire and its perception in Greek literary sources. Gift-giving in the Greek world was often framed in the language of friendship, and Greek authors subsequently articulated Persian traditions using the language and cultural norms of their intended audience. There were fundamental differences in the concepts of gift-exchange and reciprocity between the Greeks and the Persians. This article will examine Persian traditions of gift-giving followed by Greek traditions of gift-giving, and will argue that the Greek misrepresentation of Persian customs led to numerous misunderstandings in relations between Greek and Persian individuals. The use of Greek descriptive language, rather than more accurate terminology, to describe Persian traditions has hindered our understanding of gift-giving in the Persian empire. In addressing these misconceptions, this article will demonstrate the successful use of gift-giving in the Persian empire and the perils of Greek misrepresentation of foreign customs.

The fight for gender equality in Turkey extends as far as the sports sector of the economy. Although Turkey has recently seen a fast rise in the participation of women in sports, female athletes are still being marginalized for many reasons. The alarming levels of discrimination discourage females from entering into professional sports in Turkey and have inhibited the growth of the female sports sector in Turkey. This research aims to examine the different roles women have to take with emphasis on explaining the relationship between sports and politics in modern Turkey. The present study explores Turkish women's specific constraints and challenges in professional Sports. Qualitative data were generated from semi-structured interviews conducted with 142 female athletes (both amateur and professionals) across different cities in Turkey. The findings of the study indicate that family influence (χ= 4.39 of 5), wage inequality (χ = 4.31 of 5), media misrepresentation (χ = 4.16 of 5), inadequate sports facilities for women (χ = 4.12 of 5) and high levels of sexual harassment (χ = 3.89 of 5) are the constraints that must be addressed to improve the climate for female participation in sports significantly. The study highlights how these physical activities and sports programs play essential roles in increasing awareness of their importance and improving the overall perception of women in sports in Turkey.

Effective ways to measure employee job satisfaction are fraught with problems of scale, misrepresentation, and timeliness. Current methodologies are limited in capturing subjective differences in expectations, needs, and values at work, and they do not lay emphasis on demographic differences, which may impact people's perceptions of job satisfaction. This study proposes an approach to assess job satisfaction by leveraging large-scale social media data. Starting with an initial Twitter dataset of 1.5M posts, we examine two facets of job satisfaction, pay and supervision. By adopting a theory-driven approach, we first build machine learning classifiers to assess perceived job satisfaction with an average AUC of 0.84. We then study demographic differences in perceived job satisfaction by geography, sex, and race in the U.S. For geography, we find that job satisfaction on Twitter exhibits insightful relationships with macroeconomic indicators such as financial wellbeing and unemployment rates. For sex and race, we find that females express greater pay satisfaction but lower supervision satisfaction than males, whereas Whites express the least pay and supervision satisfaction. Unpacking linguistic differences, we find contrasts in different groups' underlying priorities and concerns, e.g., under-represented groups saliently express about basic livelihood, whereas the majority groups saliently express about self-actualization. We discuss the role of frame of reference and the "job satisfaction paradox", conceptualized by organizational psychologists, in explaining our observed differences. We conclude with theoretical and sociotechnical implications of our work for understanding and improving worker wellbeing.

The practical relevance of entrepreneurial fraud has stimulated a wide array of research occurring in disciplinary silos. We take stock of the current state of the entrepreneurial fraud literature by conducting a multidisciplinary systematic literature review and synthesize the findings into a unified framework. Taking an inductive approach, our framework depicts the antecedents, inner workings, and ramifications of entrepreneurial fraud. Doing so, we reveal nuances in the inner workings of entrepreneurial fraud, such as variation in the focus and magnitude of deception used to obtain valuable resources from stakeholders and that fraud can service authentic entrepreneurial activities or nonentrepreneurial personal uses. Accounting for these distinctions reveals that fraud can result in a mixture of positive and negative consequences for perpetrators, victims, and societies.

This article considers the issue of false information, which has been increasingly available on the World Wide Web. This misrepresentation has engendered much distrust in populations, leading to polarized views, anger and fear, which is tearing society apart. How to evaluate information sources for judgement about their reliability and validity is crucial, particularly for impressionable students, who need a fair, unbiased perspective in their learning experiences. The fact that universities have been cracking down on ideas and materials that are unpopular amongst certain sections of society is an issue that must be addressed. Free speech has always been considered necessary for the progression of societies, but is in danger from today’s oppressive culture that cancels those whose views are not accepted.

esearch expThe present research explores how Fatima Bhutto has glorified her father's political image while defending his political actions and challenging his misrepresentation. In her autobiography Songs of blood and sword: A daughter's memoir (2011), Fatima discusses his father's assassination and tries to eliminate the misconceptions connected with his actions. She narrates the heroic actions of her father that he undertook to rescue his father, Zulfikar Ali Bhutto, from the military regime of Zia. The textual analysis has been applied as a research method. Some extra-textual knowledge such as graphic representation, cross and historical references, and narrative strategies of the narrator has also been employed to analyse how a daughter has defended her father's political vulnerable image. Smith and Watson's Autobiographical theories are applied to analyse the auto/biographical features of the narrative. The research explored that Fatima's self-narrative is father centred, and research findings guide that it is an amalgamation of praise and blame. The study concludes that Fatima's narrative is defensive for his father's political portfolio. She resolves whatever reality of her father she comes up with within her investigative self-narrative, her reverence and love for her father will remain unconditional.

Background Numerous groups, such as the tobacco industry, have deliberately altered and misrepresented knowable facts and empirical evidence to promote an agenda, often for monetary benefit, with consequences for environmental and public health. Previous research has explored cases individually, but none have conducted an in-depth comparison between cases. The purpose of this study was to compile a comprehensive list of tactics used by disparate groups and provide a framework for identifying further instances of manufactured doubt. Methods We examined scholarly books, peer-reviewed articles, well-researched journalism pieces, and legal evidence related to five disparate industries and organizations selected for their destructive impacts on environmental and public health (tobacco, coal, and sugar industries, manufacturers of the pesticide Atrazine, and the Marshall Institute, an institute focused on climate change research, and other scientists from the era that associated with those in the Institute). These documents provided evidence for a list of tactics used to generate pro-industry spin and manufacture doubt about conferred harm. We then identified trends among sets of strategies that could explain their differential use or efficacy. Results We recognized 28 unique tactics used to manufacture doubt. Five of these tactics were used by all five organizations, suggesting that they are key features of manufactured doubt. The intended audience influences the strategy used to misinform, and logical fallacies contribute to their efficacy. Conclusions This list of tactics can be used by others to build a case that an industry or group is deliberately manipulating information associated with their actions or products. Improved scientific and rhetorical literacy could be used to render them less effective, depending on the audience targeted, and ultimately allow for the protection of both environmental health and public health more generally.

PurposePublic libraries and public service broadcasters are threatened by political developments in the UK and USA. They are targets in a divisive culture war waged by ideological organisations that disseminate misleading and false information about social and political matters on line, on screen and in print. The purpose of this paper is to alert information professionals to this issue and suggests that, although they should not engage in this war, they must be prepared to use their professional expertise to identify and correct unreliable material. Further, they should cooperate with other true information organisations to expose the fallacious sources that endanger democracy.Design/methodology/approachThe authors analysed material from academic texts and papers, professional journals, serious contemporary journalism, political manifestoes, Internet blogs and items from the BBC sound archive to illustrate the history, size and nature of the problem and to suggest how it might be dealt with. This documentary analysis was based on the belief that information professionals are not the only people examining and concerned about this issue. It therefore included material from a wide range of other disciplines, including psychology, medicine and politics.FindingsThere is evidence that populist movements from the political right dislike information organisations and have historically, through misinformation and misrepresentation, persuaded working class citizens that they are being exploited by an elite. Public libraries and the BBC are highly trusted organisations, but much of the British public goes to sources it trusts least, such as tabloid newspapers, for information on politics and society. Librarians and BBC broadcasters demonstrated their value during the COVID-19 pandemic, but they need to engage with other professional groups to fully understand what is happening and counteract the threats it presents to our democracy.Originality/valueThe paper deals with a significant current issue that needs to be considered urgently by practitioners, academics and policy makers. It includes practical examples and suggestions demonstrating how information workers have and can help their users identify and use trusted and accurate information sources and perhaps be made aware of editorial bias.

A new form of e-governance is proposed based on systems seen in biological life at all scales. This model of e-governance offers the performance of collective superintelligence, equally high ethical quality, and a substantial reduction in resource requirements for government functions. In addition, the problems seen in modern forms of government such as misrepresentation, corruption, lack of expertise, short-term thinking, political squabbling, and popularity contests may be rendered virtually obsolete by this approach. Lastly, this model of government generates a digital ecosystem of intelligent life which mirrors physical citizens, serving to bridge the emotional divide between physical and digital life, while also producing the first form of government able to keep pace with accelerating technological progress.

The paper was conducted to analyze different factors influencing clients’ choice of insurance companies. Insurance is essential for peace of mind, however, clients should be cautious when choosing insurers to avoid future disappointments. Clients should also be aware of fake agents, misrepresentation of information, fraud and coercion by agents and brokers. The main objective of this paper was to identify the factors that drive clients’ preferences in selecting insurance companies, whilst the second objective was to determine the relative importance of these particular factors (advertising, social and behavioral factors). This paper followed a survey design with questionnaires and 185 randomly selected participants from Keetmanshoop Namibia. The results showed that majority of participants chose insurers as a result of agents/broker persuasion, which is similar to what the majority of other researchers found in previous studies. None the less, 87% of participants are satisfied with their current insurers, leaving 13% unsatisfied and intending to switch to other insurers. In addition findings revealed a positive relationship between client’s relative importance of insurance and factors (social, advertising and behavioral factors).

Despite unprecedented global wealth creation, health inequity—the unjust health inequality between classes and groups among and within countries—persists, reviving the relevance of social justice as a lens to understand and as an instrument to intervene in these issues. However, the theoretical aspects and polysemous character of social justice as applied in the field of public health are often assumed rather than explicitly explained. An intersectional justice approach to understanding health inequality, inequity, and injustice might be useful. It argues that preexisting class-, race/ethnicity-, and gender-based health injustice and the socially differentiated impacts of the COVID-19 pandemic are shaped, interconnectedly, by economic maldistribution, cultural misrecognition, and political misrepresentation. Pursuing health justice requires analyses, strategies, and interventions that integrate the economic, cultural, and political spheres of redistribution, recognition, and representation, respectively. Such an intersectional approach to health justice is even more relevant and compelling in light of the COVID-19 pandemic. This article is broadly about class, race/ethnicity, and gender political economy of public health—but with a narrower focus on maldistribution, misrecognition, and misrepresentation, shaping social and health injustices.

This article describes the structure of the trillion-dollar CMBS and CLO markets, and their current distressed states given the ongoing economic effects of the COVID-19 pandemic. It then outlines various disputes that may arise from this distress. For CMBS, these include control and valuation disputes; waterfall disputes; “busted deal” disputes; REIT, “repo” and margin call disputes; fraudulent selling and misrepresentation disputes; and repurchase claims. For CLOs, the potential disputes involve CLO managers, CLO arrangers, CLO investors and trustees, and CLO valuation issues. In each instance the article describes the parties involved, the legal issues that are likely to arise, and—where possible—the applicable law from prior litigation in respect of the same or similar issues. The article concludes that many of these disputes are likely to result in litigation again soon given the ongoing effects of the COVID-19 pandemic and current economic forecasts within the CMBS and CLO markets. TOPICS:CLOs, CDOs, and other structured credit, CMBS and commercial mortgage loans Key Findings • The world is facing a COVID-driven economic slowdown that many believe will expose flaws in the market for commercial mortgage-backed securities (“CMBS”) comparable to those seen in the residential mortgage-backed securities (“RMBS”) market in 2007/2008. • This broad, multi-sector, economic downturn is also likely to severely impact the hundreds of billions of dollars of Collateralized Loan Obligations (“CLOs”) that have been issued in recent years. Wide-ranging, cross-sector defaults are expected for the loans that collateralize CLOs, and extreme loss severity is expected when those defaults occur. • Both CMBS and CLO industry participants, and legal counsel involved or looking to become involved in the industries, should scrutinize potential disputes closely and prepare for potential litigation in the near future.

We respond to Mech (2019) “Do Indigenous American Peoples’ Stories Inform the Study of Dog Domestication” and point out a number of errors and omissions in Mech’s essay. These include: 1) assuming that the behavior of all wild wolves is the same, and can be characterized according only to Mech’s personal experience; 2) assuming that the domestication of wolves took place in only a single location at one time (14,000 yrs BP); 3) misrepresenting the statements and findings of other scholars; 4) assuming that all wolves that have ever encountered humans have experienced persecution; and 5) dismissing all accounts of interactions with wolves by Indigenous Americans. The last of these is particularly egregious and seems to represent a form of neocolonial thinking, in which only accounts and findings by Europeans are considered to be acceptable evidence. Mech’s own work on Ellesmere Island seems to support the idea that wolves can be curious and unthreatening to humans. We suggest that this might be the only actual time Mech interacted with true Canis lupus. In addition, Mech’s statements on wolf attacks and the significance of rabies are shown to be misleading. As a result, Mech’s work, especially his questioning of the validity of Indigenous knowledge, which often provides crucial insights into some aspects of ethnobiological research, represents a critique of methods employed by scholars within the discipline of ethnobiology, whereas, as a wildlife biologist, Mech seems to lack knowledge of the principles of ethnobiology.

This research article is mainly focused on how Samrat Upadhyay has distorted Nepalese Culture and social norms in is novel Buddha’s Orphans. Nepalese culture and society are represented in a biased way from the western perspective. By using oriental stereotypes, the author has represented Nepal and the religious belief of Nepalese people in the wrong way. The characters of this novel like Bokey Ba, Kaki, Raja, Jamuna, and Ganga Da are presented as irrational and badly conservative people who believe in witch doctors, not in the medical doctors. They are presented as impulsive and eccentric. The setting of this novel is represented as exotic, inscrutable, and mysterious. Kathmandu valley and Nepalese people didn’t well describe as the real Kathmandu. As a qualitative research, the researcher has taken the novel as a primary text and the concepts from orientalism, and the Foucauldian notion of representation is used as a tool to interpret the text. The researcher concluded that the novel is the misrepresentation of Nepalese culture and society.

There are a number of literary texts which earn their raison d’etre from the exotic nature or unfamiliar features in the subject matter of the creative work. One of the brilliant and of standing poets of all ages is Robert Browning. Robert Browning (1812-1889) chose a literary genre alien to his powers as a poet, and a topic beyond the range of a man who had little firsthand knowledge of the Levant. Since he had the power to transfer historical stories magically to forever recited and read poems all over the world and through all ages till the recent one. This poet composed a tragic play entitled The return of the Druses (1843). Literary histories tell us that it was a failure on all accounts. One of the logical reasons for this failure was presumably Browning’s ignorance of the culture he wished to depict in this work. This article is an analysis of the play, to which very little attention was paid even by the specialists in Browning studies. The conclusion is that Browning provided for the readers and spectators a rather weak image of the Druses as individuals and as a community. They are shown to be gullible and misguided as a community. Their leadership is shown as cunning, dishonest, and Machiavellian.

The Ebola virus had only been in the United States for 2 months before it became a major national health concern. However, while some citizens panicked about the looming health crisis, others remained calm, offering explanations for why a rapid spread of the virus was unlikely. Examining the distinctions between these different reactions can contribute to a better understanding of the coping strategies citizens use when facing a health crisis. We consider how citizens respond to fear by focusing on whether or not hyperbolic rhetoric was used as a means for processing and managing fear. Approximately 400 tweets and Facebook posts from the Centers for Disease Control and Prevention, the White House, and The Alex Jones Show were examined to make conclusions about how citizens respond to messages from these mediated forums. At the intersection of health communication and critical rhetoric, we advance an operational definition of health hyperbolism derived from public response to opinion leaders. Ultimately, we find that health hyperbolism contains language illustrative of distrust, blame, anger, misrepresentation, conspiracy, and curiosity.

ObjectivesAccurate documentation in the medical record is essential for quality care; extensive documentation is required for reimbursement. At times, these 2 imperatives conflict. We explored the concordance of information documented in the medical record with a gold standard measure.Materials and MethodsWe compared 105 encounter notes to audio recordings covertly collected by unannounced standardized patients from 36 physicians, to identify discrepancies and estimate the reimbursement implications of billing the visit based on the note vs the care actually delivered.ResultsThere were 636 documentation errors, including 181 charted findings that did not take place, and 455 findings that were not charted. Ninety percent of notes contained at least 1 error. In 21 instances, the note justified a higher billing level than the gold standard audio recording, and in 4, it underrepresented the level of service (P = .005), resulting in 40 level 4 notes instead of the 23 justified based on the audio, a 74% inflated misrepresentation.DiscussionWhile one cannot generalize about specific error rates based on a relatively small sample of physicians exclusively within the Department of Veterans Affairs Health System, the magnitude of the findings raise fundamental concerns about the integrity of the current medical record documentation process as an actual representation of care, with implications for determining both quality and resource utilization.ConclusionThe medical record should not be assumed to reflect care delivered. Furthermore, errors of commission—documentation of services not actually provided—may inflate estimates of resource utilization.

PurposeThis paper examines how and why online daters, differentiated by gender, strategically self-present in online dating profiles when pursuing two competing goals: attracting potential daters and avoiding detection as a liar.Design/methodology/approachA survey and a content analysis were employed to test four hypotheses.FindingsThe results revealed that seeking to project an attractive image in online dating was significantly associated with acquisitive self-presentation. The online daters adopted falsification more than any other strategies, and women were more likely than men to embellish their self-presentation, especially their physical appearance.Originality/valueThe findings clarify people's mate selection processes in light of the interpersonal deception theory (IDT) and the information manipulation theory (IMT) as well as take an evolutionary psychological perspective on computer-mediated communication. For practitioners, they provide a more nuanced picture of deceptive communication in online dating and, for online daters, can guide the adaptation of their online behaviors.

Misrepresentation and manipulation in discourse can be weapons of mass deception. As politicians rely on language as their tool of trade, language users may opt for a language game to achieve their political ends. This is, in fact, the objective of the present study that focuses on the manipulation of person deixis in political discourse. The current research paper sheds light on the perception of Arabs and Muslims from a western perspective. More specifically, the speeches of George W. Bush, delivered between March 2003 and June 2004, and related to Iraqi War II, are analyzed within Fairclough's socio-cultural approach to CDA. The results of this study show that the use of political pronouns in G. W Bush's speeches reflects a WE\THEY dichotomy that divides the referents into pro-US and anti-US groups. The selection of pronouns distorts the truth and misrepresents the referents by allocating negative\pejorative words to them and categorizing them as proliferators of weapons of mass destruction. This research analyzes political pronouns in discourse within the framework of CDA and explains how person deixis is used in a language game to deceive public opinion.

Audit experiments examining the responsiveness of public officials have become an increasingly popular tool used by political scientists. While these studies have brought significant insight into how public officials respond to different types of constituents, particularly those from minority and disadvantaged backgrounds, audit studies have also been controversial due to their frequent use of deception. Scholars have justified the use of deception by arguing that the benefits of audit studies ultimately outweigh the costs of deceptive practices. Do all audit experiments require the use of deception? This article reviews audit study designs differing in their amount of deception. It then discusses the organizational and logistical challenges of a UK study design where all letters were solicited from MPs’ actual constituents (so-called confederates) and reflected those constituents’ genuine opinions. We call on researchers to avoid deception, unless necessary, and engage in ethical design innovation of their audit experiments, on ethics review boards to raise the level of justification of needed studies involving fake identities and misrepresentation, and on journal editors and reviewers to require researchers to justify in detail which forms of deception were unavoidable.

PurposeRepresentations of time are commonly used to construct narratives in visualisations of data. However, since time is a value-laden concept, and no representation can provide a full, objective account of “temporal reality”, they are also biased and political: reproducing and reinforcing certain views and values at the expense of alternative ones. This conceptual paper aims to explore expressions of temporal bias and politics in data visualisation, along with possibly mitigating user approaches and design strategies.Design/methodology/approachThis study presents a theoretical framework rooted in a sociotechnical view of representations as biased and political, combined with perspectives from critical literacy, radical literacy and critical design. The framework provides a basis for discussion of various types and effects of temporal bias in visualisation. Empirical examples from previous research and public resources illustrate the arguments.FindingsFour types of political effects of temporal bias in visualisations are presented, expressed as limitation of view, disregard of variation, oppression of social groups and misrepresentation of topic and suggest that appropriate critical and radical literacy approaches require users and designers to critique, contextualise, counter and cross beyond expressions of the same. Supporting critical design strategies involve the inclusion of multiple datasets and representations; broad access to flexible tools; and inclusive participation of marginalised groups.Originality/valueThe paper draws attention to a vital, yet little researched problem of temporal representation in visualisations of data. It offers a pioneering bridging of critical literacy, radical literacy and critical design and emphasises mutual rather than contradictory interests of the empirical sciences and humanities.

This article examines Virginia Woolf’s late short story, ‘The Symbol’, which takes as its focus the problem of writing the mountain landscape. Not only is the mountain vulnerable to misrepresentation in being “elevated” to the function of a literary symbol, for Woolf it is also freighted with the overbearing weight of her father’s mountaineering legacy, both on the slopes and on the written page. Read in the light of the Alpine exploits of her father (Sir Leslie Stephen), this article presents ‘The Symbol’ not as a minor work on the peripheries of the writer’s oeuvre, but as an important vehicle through which Woolf is able to confront not only her ambivalent relationship with her late father and his legacy, but also the ontological complexities of representing the mountain in creative fiction.

Controlled vocabularies used in cultural heritage organizations (galleries, libraries, archives, and museums) are a helpful way to standardize terminology but can also result in misrepresentation or exclusion of systemically marginalized groups. Library of Congress Subject Headings (LCSH) is one example of a widely used yet problematic controlled vocabulary for subject headings. In some cases, systemically marginalized groups are creating controlled vocabularies that better reflect their terminology. When a widely used vocabulary like LCSH and a controlled vocabulary from a marginalized community are both available as linked data, it is possible to incorporate the terminology from the marginalized community as an overlay or replacement for outdated or absent terms from more widely used vocabularies. This paper provides a use case for examining how the Homosaurus, an LGBTQ+ linked data controlled vocabulary, can provide an augmented and updated search experience to mitigate bias within a system that only uses LCSH for subject headings.

Artificial intelligence (AI) techniques are starting to be used in IVF, in particular for selecting which embryos to transfer to the woman. AI has the potential to process complex data sets, to be better at identifying subtle but important patterns, and to be more objective than humans when evaluating embryos. However, a current review of the literature shows much work is still needed before AI can be ethically implemented for this purpose. No randomized controlled trials (RCTs) have been published, and the efficacy studies which exist demonstrate that algorithms can broadly differentiate well between ‘good-’ and ‘poor-’ quality embryos but not necessarily between embryos of similar quality, which is the actual clinical need. Almost universally, the AI models were opaque (‘black-box’) in that at least some part of the process was uninterpretable. This gives rise to a number of epistemic and ethical concerns, including problems with trust, the possibility of using algorithms that generalize poorly to different populations, adverse economic implications for IVF clinics, potential misrepresentation of patient values, broader societal implications, a responsibility gap in the case of poor selection choices and introduction of a more paternalistic decision-making process. Use of interpretable models, which are constrained so that a human can easily understand and explain them, could overcome these concerns. The contribution of AI to IVF is potentially significant, but we recommend that AI models used in this field should be interpretable, and rigorously evaluated with RCTs before implementation. We also recommend long-term follow-up of children born after AI for embryo selection, regulatory oversight for implementation, and public availability of data and code to enable research teams to independently reproduce and validate existing models.

AIMS: Amazon Mechanical Turk (MTurk) provides a crowdsourcing platform for the engagement of potential research participants with data collection instruments. This review (1) provides an introduction to the mechanics and validity of MTurk research; (2) gives examples of MTurk research; and (3) discusses current limitations and best practices in MTurk research. METHODS: We review four use cases of MTurk for research relevant to addictions: 1) the development of novel measures, 2) testing interventions, 3) the collection of longitudinal use data to determine the feasibility of longer-term studies of substance use, and 4) the completion of large batteries of assessments to characterize the relationships between measured constructs. We review concerns with the platform, ways of mitigating these, and important information to include when presenting findings. RESULTS: MTurk has proven to be a useful source of data for behavioral science more broadly, with specific applications to addiction science. However, it is still not appropriate for all use cases, such as population-level inference. To live up to the potential of highly transparent, reproducible science from MTurk, researchers should clearly report inclusion/exclusion criteria, data quality checks and reasons for excluding collected data, how and when data was collected, and both targeted and actual participant compensation. CONCLUSIONS: Although online survey research is not a substitute for random sampling or clinical recruitment, the MTurk community of both participants and researchers has developed multiple tools to promote data quality, fairness, and rigor. Overall, MTurk has provided a useful source of convenience samples despite its limitations and has demonstrated utility in the engagement of relevant groups for addiction science.

A youngster’s response to dental treatment may greatly facilitate or hinder the course and quality of treatment provided. Numerous children tend to experience various clinical levels of anxiety and some will go on to develop as an anxiety disorder. Estimates suggest that approximately 10–25% of the population may experience an anxiety disorder at some time. Without adequate tools to measure the levels of anxiety in children, it is not possible to isolate the problem and give them the early attention they need. Problems which have arisen in using rating scales typically involve difficulties related to reliability, validity, and measurement level. The major drawbacks of the rating system lie in possible undetected bias and misrepresentation of data. The scorer weighs the evidence on which the rating is based on a complex manner which is not easily specified, standardized, or objectified. The present review was carried out to understand the clinical significance of various behavior rating scales practiced over the years in pediatric practice.

The research highlights on the aesthetics of artistic expression in the products of the Islamic photography schools to highlight the most important aesthetic and aesthetic values ​​by analyzing selected models of those products that the Islamic photographer was able to employ the various life data and its multiple vocabulary to create visual spaces that are characterized by balanced symmetry. He distributes his vocabulary and characters and the contents of his photographic art through a visual text that gave special attention to these productions. These products came as a clear, articulated and expressive view of themselves, inspired by their ideas and implications from the social life of Islamic society. The current research aims to reveal the aesthetics of artistic expression in the productions of Islamic photography schools. Therefore, the researcher adopted the analytical descriptive approach in building the research procedures as it is the most scientific method suitable to achieve the objective of the current research. The current research community consists products of Islamic art photography schools in (Iraqi - Mughal in Iran - Timorese school - Ottoman Turkish photography) dating back to middle Ages. Since the research community is very broad, the researcher resorted to selecting an objective sample consisting of (4) models: 1- Baghdad School (Al-Barqa'a Center- The Hajj procession) 2- (zal under Roodbe's balcony) Shahnama Ferdosi 3- Elephant's Hour. The main conclusions are: pictures expressed a symbolic message, reflected the customs and traditions of those times. 2 - Misrepresentation was present by drawing shapes and exaggerating disposing of proportions contrary to the truth. 3 - coordinating the constituent components of the pictures and creating balanced and unified relationships with each other to achieve aesthetic expression. The most important conclusions are: 1- The value of the creative achievement, the aesthetic and artistic inventory, and the power of expression in Islamic art through their expressions of the soul of society, showing the intellectual level of the Muslim artist. 2- The Islamic decoration was used in the products of Islamic schools to exalt the material existence based on the aesthetic shape which represented by the centrality of man.

Purpose The purpose of this paper is to examine whether the political connections of listed firms in China affect how the market reacts to cases of financial misrepresentation investigated by the regulatory authorities. Design/methodology/approach The authors use an event study method and the financial misrepresentation events in China stock markets as research setting and empirically test the association between market reactions to the announcement of financial misrepresentations and the presence of political connections. Findings The results show that on average, there is no significant market reaction to financial misrepresentation for politically connected firms. In contrast, however, there is a significantly negative market reaction for non-connected firms, which suggests that investors do not punish politically connected firms for financial misrepresentation. The authors argue that politically connected companies use the altered financial information to gain legitimacy and obtain benefits from the government. Consistent with the argument, the authors find that in the years after they disclose their financial misrepresentation, firms with political connections are more likely to increase their bank loans than firms without political connections. Originality/value The authors provide a new explanation for the low-earnings quality of politically connected firms.

The Sixth Amendment right to an "impartial jury" should guarantee fundamental fairness that in capital cases may literally be a matter of life and death. For ecological validity, the current study focuses on capital jury questionnaires (CJQs) employed in actual death-penalty cases. Study I examined 248 undergraduates and their responses to death-penalty relevant questions. As an MTurk investigation, Study II consisted of 259 community members potentially eligible for capital trial jury trials. Misrepresentations were operationalized as either denials (concealing their true views) or outright deceptions (dissembling the opposite viewpoint). Both studies found that CJQ items were very susceptible to both types of misrepresentation, irrespective of support-life or support-death views. Nearly 30% of undergraduates openly acknowledged that they would misrepresent close to half their CJQ responses. Overall, community members were much more willing to engage in denials and outright deceptions. The discussion focuses on how CJQs could be improved to promote candor about death-penalty views.

Individuals who experience personal distress face a dilemma when they enter the workplace: should they authentically express their negative emotions when conversing with colleagues, or feign happiness? Across six experiments, using face-to-face interactions, as well as video and scenario-based stimuli, we explore how feigning happiness in the face of personal hardship affects trust among colleagues. We find that individuals who feign happiness in professional contexts are more likely to be hired and are trusted more by others, despite also being perceived as more dishonest. Our results suggest that these trust benefits are unique to professional (rather than personal) contexts, and are driven by perceptions of resilience, rather than conformity to display rules. This research deepens our understanding of emotion regulation, authenticity, and trust by exploring the consequences of feigned happiness in mixed motive settings and by demonstrating that emotional misrepresentation, unlike many other forms of misrepresentation, can increase trust.

We examine the way in which religion is managed in the major library classification schemes and in archival practice and how and why bias and misrepresentation occur. Broad definitions of what is meant by diversity and religious pluralism and why it is a cause for concern precede a discussion of the standard model of interreligious attitudes (exclusivism/inclusivism/pluralism) with particular reference to the philosophy of John Hick. This model is used as a lens through which to evaluate knowledge organization systems (KOSs) for evidence of comparable theoretical positions and to suggest a possible typology of religious KOSs. Archival and library practice are considered, and, despite their very different approaches, found to have some similarities in the way in which traditional societal structures have affected bias and misrepresentation of religious beliefs. There is, nevertheless, evidence of a general move towards a more pluralistic attitude to different faiths.

Este artigo tem por objetivo contribuir para as reflexões em torno da desafiante questão: qual é o futuro da Inspeção do Trabalho enquanto polí­tica pública no Brasil? Após breve reconstituição histórica da institucionalização da Inspeção do Trabalho no Brasil, analisa-se, criticamente, o atual lugar do trabalho na sociedade e na economia brasileiras, à luz das profundas modificações em curso no mundo do trabalho, ditadas pelas novas tecnologias, e principalmente ditadas pelo neoliberalismo sem limites e sem ética. Como fazem outros autores, são analisados os processos determinantes das "metamorfoses" do trabalho e as principais morfologias atuais. Estas incluem mudanças no conceito de trabalho; mudanças na caracterização das pessoas rotuladas como trabalhadores - homens e mulheres; mudanças na localização espacial das pessoas que trabalham; a descaracterização progressiva do tempo roubado e consumido pelo trabalho na vida das pessoas; e, por último, incluem a crescente descaracterização dos entes responsáveis formais e legais pelas atividades laborativas, sejam pessoas ou organizações. Essas profundas mudanças impactam frontalmente sobre a lógica tradicional da Inspeção do Trabalho, e obrigam a que se busquem alternativas e referências para uma nova lógica. É defendida a tese de que, no curto prazo, a lógica do Sistema Único de Saúde - SUS, que tem como estratégia principal a Atenção Básica (Atenção Primária, Estratégia de Saúde da Família), regionalizada e territorializada, poderia servir como estratégia para a conjugação e harmonização de polí­ticas públicas de Inspeção do Trabalho e de Vigilância do Trabalho e da Saúde e Segurança dos Trabalhadores, considerando a elevada cobertura e capilaridade deste Sistema Público no Brasil. Em médio e longo prazos, há desafiadores espaços para se repensar outras abordagens. Vasta bibliografia embasa o presente documento.
