Abstract

The article analyzes the legal concerns in subprime lending. It reports the increasing residential mortgage foreclosures and the escalation of litigation ancillary to foreclosure proceedings and consumer bankruptcy filings. According to the Bankruptcy Court, a debtor is permitted to avoid foreclosure by developing a plan for curing amounts due and making regular monthly mortgage payments outside the bankruptcy plan. It discusses the opinions of Ohio Federal District Court Judge Christopher A. Boyko and Judge Pat Morgenstern-Clarren related to the issue.
