Philosophical aspects of law and jurisprudence are investigated from various points of view. This collection represents the analytic approach to legal philosophy. However, this approach is not extreme in the sense that it is limited exclusively to linguistic matters. The concept of norm as a directive of conduct is the central category analyzed in particular essays. The structure of directives as well as their semantic and pragmatic roles are studied. Pragmatic functions of directives are linked with their functioning as speech acts. Moreover, existence and validity of norms are analyzed. The author also touches on general methodological problems of legal theory and philosophy, particularly their relations to social sciences. The collection covers material interesting for philosophers, lawyers and social scientists.

This book studies how the relationship between philosophy, morality, politics, and science was conceived in the Vienna Circle and how this group of philosophers tried to position science as an antidote to totalitarianism and irrationalism. This leads to investigation of the still understudied views of the Vienna Circle on moral philosophy, meta-ethics, and the relationship between philosophy of science and politics. This open access book examines from a variety of perspectives the disappearance of moral content and ethical judgment from the models employed in the formulation of modern economic theory, and some of the papers contain important proposals about how moral judgment could be reintroduced in economic theory. This collection of papers investigates the most recent debates about individualism and holism in the philosophy of social science. The debates revolve mainly around two issues: firstly, whether social phenomena exist sui generis and how they relate to individuals. This is the focus of discussions between ontological individualists and ontological holists. Secondly, to what extent social scientific explanations may and should, focus on individuals and social phenomena respectively. This issue is debated amongst methodological holists and methodological individualists.In social science and philosophy, both issues have been intensively discussed and new versions of the dispute have appeared just as new arguments have been advanced. At present, the individualism/holism debate is extremely lively and this book reflects the major positions and perspectives within the debate. The death of Peter Winch in 1997 sparked a revived interest in his work with this book arguing his work suffered misrepresentation in both recent literature and in contemporary critiques of his writing. Debates in philosophy and sociology about foundational questions of social ontology and methodology often claim to have adequately incorporated and moved beyond Winch's concerns. Re-establishing a Winchian voice, the authors examine how such contentions involve a failure to understand central themes in Winch's writings and that the issues which occupied him in his Idea of a Social Science and its Relation to Philosophy and later papers remain central to social studies. The volume offers a careful reading of the text in alliance with Wittgensteinian insights and alongside a focus on the nature and results of social thought and inquiry. It draws parallels with other movements in the social studies, notably ethnomethodology, to demonstrate how Winch's central claim is both more significant and more difficult to transcend than sociologists and philosophers have hitherto imagined.

This book reconstructs the concept and practice of dialectics as a means of grounding a critical theory of society. At the center of this project is the thesis of phronetic criticism or a form of reason that is able to synthesize human value with objective rationality.This book argues that defects in modern forms of social reason are the result of the powers of social structure and the norms and purposes they embody. Increasingly, modern societies are driven not by substantive values concerning human good but by the technical imperatives of economic management, leading to a cultural condition of nihilism that has eroded dialectical consciousness. The first half of the book demonstrates the various ways that social power erodes and undermines critical-rational forms of consciousness. The second part of the book constructs an alternative basis for critical reason by showing how it requires seeing human value as essentially ontological: that is, constituted by objective forms of sociality that either promote human freedom or pervert our capacities and drive toward pathological forms of life. The rise of a significantly large (and young) Muslim population in the West, possessing no historical tradition of being a minority in a non-Muslim environment, has led to a recurring debate about the integration of Muslims into Western societies and the compatibility of Islam with Western values. The proliferation of Islamic sites to which thousands of Western Muslims turn to request a fatwa, i.e. a religious legal opinion on any issue, hints at the urgency felt by these Muslims to find a way out of this conflictual dialectic, since most of their questions concern precisely how to reconcile Islamic principles with some aspect of modern life in the West. The pervasiveness of these internet fatwas is a striking phenomenon worth of study that can help finding answers to the longstanding debate about the integration of Muslims in the West and in modern societies. raising interesting questions: What do Muslims in Western societies ask these virtual muftis and why? Who are they? What are their desires and concerns? In their asking, are these Muslims seeking integration or separation? Do these questions reflect common clichés about Muslims, as conveyed by some Western media narratives or not? Do they reason as individuals or as members of a religious community? This book presents a scientific study aimed at answering these questions through a statistical and discourse analysis of a large corpus of more than ten thousand fatwa questions extracted from the huge fatwa databases available on the internet.

This book concerns the border area between philosophy and social sciences. To explain the status of social sciences, not only cognitive involvement of theory is necessary, but also ontic. Hence epistemology and ontology need to be combined in meta-reflection on knowledge about society. Hence my proposition is social onto-epistemology.

A trenchant case for a novel philosophical position: that our political thinking is driven less by commitments to freedom or fairness than by an aversion to hierarchy.Niko Kolodny argues that, to a far greater extent than we recognize, our political thinking is driven by a concern to avoid relations of inferiority. In order to make sense of the most familiar ideas in our political thought and discourse—the justification of the state, democracy, and rule of law, as well as objections to paternalism and corruption—we cannot merely appeal to freedom, as libertarians do, or to distributive fairness, as liberals do. We must instead appeal directly to claims against inferiority—to the conviction that no one should stand above or below.The problem of justifying the state, for example, is often billed as the problem of reconciling the state with the freedom of the individual. Yet, Kolodny argues, once we press hard enough on worries about the state's encroachment on the individual, we end up in opposition not to unfreedom but to social hierarchy. To make his case, Kolodny takes inspiration from two recent trends in philosophical thought: on the one hand, the revival of the republican and Kantian traditions, with their focus on domination and dependence; on the other, relational egalitarianism, with its focus on the effects of the distribution of income and wealth on our social relations.The Pecking Order offers a detailed account of relations of inferiority in terms of objectionable asymmetries of power, authority, and regard. Inspired by his lectures on rhetoric and by game theory, this book provides a new interpretation of Adam Smith's system of thought. It highlights its coherence through the identification of three reasoning routines and a meta-reasoning routine throughout his work on languages, rhetoric, moral sentiments, self-command, and the nature and causes of the wealth of nations. The identification of these reasoning routines allows the authors to uncover a hitherto poorly understood deep structure of Smith's work and to explain its main characteristics. How these routines emerged in Smith's early research on the principles of the human mind is also traced. This book offers a new and externalist perspective in ignorance studies. Agnotology, the epistemology of ignorance, and, more generally, ignorance studies have grown to cover and explore different phenomena and subjects of research, from known events in history and sociology of science to the investigation of ordinary reasoning and cognitive processing. Nonetheless, although interested scholars have discussed ignorance phenomena and their impact on cognition, most of them have only adopted an internalist perspective to approach this theme. Meanwhile, even though externalist perspectives on cognition flourished in recent literature, authors have paid little attention to the emerging field of ignorance studies. Ignorance has been generally left out from the inquiries on the extension of cognitive states, cognitive processes, and predictive reasoning. Thus, in this volume, we seek to merge the two growing areas of research and to fill this research gap fruitfully. By addressing the uncomfortable themes that pertain to ignorance and related phenomena through an externalist perspective, this book aims to provide much food for thoughts to cognitive scientists and philosophers alike, enriching the current range and reach of both ignorance studies and externalist approaches to cognition.

This book addresses the topic of'being bound'from a philosophical and a sociological perspective. It examines several ways in which we are bound. We are bound to acknowledge the truth and to follow laws; we are bound to others and to the world. Who we are is partly defined by those bonds, regardless of whether we live up to them – or even of whether we acknowledge them. Puzzling questions arise from the fact that we are bound, such as: How are those bonds binding? Wherein lies their normative character? A venerable philosophical tradition, particularly since Kant, has provided an account of normativity that crucially appeals to such notions as “self-legislation.” But can our normative bonds be properly understood in these essentially first-personal terms? Many argue that our social condition resists any account of those bonds that fails to acknowledge the perspectives of the second and the third person. The first part of the book explores these themes from a historical perspective in the tradition of transcendental philosophy (Kant, Fichte, Hegel, Husserl and Heidegger); it examines the phenomenon of “being bound”, i.e., why and how we are bound. The second part of the book offers a sociological analysis of social bonds that is both historical and systematic. Based on sociological approaches to “solidarity” and “reflexivity”, it explores the way in which the phenomenon of “being bound” manifests through the concept of a “social relation”.

Sociology for Durkheim was by no means a knowledge closed in its specificity. It was rather an open science, permeable to contributions coming from other disciplines. For him, the task of sociology was to study what held societies together, giving place to reflective change and progressive development. This is an epistemological and political model that still retains all its relevance today: an example to be rediscovered against any reductionist conception of the vocation and object of social sciences; an encouragement to see sociology as an indispensable protagonist for an authentic interdisciplinary dialogue in the field of humanities. It is one of the best legacies Durkheim left us, that this book attempts to illustrate.

This open access book engages with the response-ability of science education to Indigenous ways-of-living-with-Nature. Higgins deconstructs the ways in which the structures of science education—its concepts, categories, policies, and practices—contribute to the exclusion (or problematic inclusion) of Indigenous science while also shaping its ability respond. Herein, he undertakes an unsettling homework to address the ways in which settler colonial logics linger and lurk within sedimented and stratified knowledge-practices, turning the gaze back onto science education. This homework critically inhabits culture, theory, ontology, and history as they relate to the multicultural science education debate, a central curricular location that acts as both a potential entry point and problematic gatekeeping device, in order to (re)open the space of responsiveness towards Indigenous ways-of-knowing-in-being.

This book proposes a philosophical exploration of the educational role that media plays in university study practices, with a focus on the practices of lecturing and academic writing. Are the media employed in university study practices mere accessories, or rather constitutive of these practices? While this seems to be a purely theoretical question, its practical implications are wide and concern whether such a thing as a ‘digital university'is possible. The'digital university'has been, for a long time, a theoretical construct. However, in the aftermath of the Covid-19 pandemic, moving the university into the digital realm has become a necessity. The difficulties in transitioning to an online university during the 2020 pandemic showed the increased urgency of the questions explored in this book.The book describes lecturing and academic writing through the lens of a phenomenology of gestures and arrives at a description of the experience of university thinking as expanding the subject's range of experiences about the world and about one's modes of thinking about the world. The media configuration characteristic for university study practices is a movement of rendering inoperative one medium through another medium so that thinking can emerge, a movement called ‘mediatic displacement'. The question of the digital university becomes then a question whether mediatic displacement is possible on a digital screen. Although this is conceivable, digital technologies are still relatively new, and we are not used to playing with them in a profanatory way as the book discusses through the example of videoconferencing and MOOCs. The promise of the digital university seems to remain utopian until we figure out how to enact the techniques of mediatic displacement currently flourishing at the physical university.Both emerging and established researchers will benefit from this book since it offers an alternative way of discussing the possibility of a digital transformation of the university, starting from a phenomenology of gestures and an understanding of thinking as a collective experience of potentiality and profanation at the same time. By combining two perspectives, media-theoretical and educational-philosophical, this book show a new way of understanding what makes a university and, thus, contributes to the emerging debate on the digital university.

Until rather recently, philosophy, when practiced as a way of life, was, for most, a communal enterprise of mutually reinforced personal cultivation. In these times of social isolation, including in academic philosophy itself, it is time, yet again, to revitalize this lost, but vital, intercultural mode of philosophy. This volume characterizes a neglected communal mode of philosophy — the philosophical community — by describing the constellation of metaethical principles (general, axiological, cultural, and dialectical) that cultivates its values. This book is dedicated to a critical analysis of race relations and inequality through the prism of Schutzian social phenomenology, which focuses on the world of intersubjectivity and the complex of meanings that orient the conduct of individuals and groups. The phenomenological approach provides a more intimate look at how the societal imposition of negative racial meanings on racialized persons crucially determines the construction of the minority subjectivity as essential otherness, thus becoming a pivotal support of race-based inequality.

This book explores the role of the university in upholding democratic values for societal change. The chapters advocate for the moral virtue of democratic patriotism: the editors and contributors argue that universities, as institutions of higher learning, can encourage the creation of critical and patriotic citizens. The book suggests that non-violence, tolerance, and peaceful co-existence ought to manifest through pedagogical university actions on the basis of educators'desire to cultivate reflectiveness, criticality, and deliberative inquiry in and through their academic programmes. In a way, universities can respond more positively to the violence on our campuses and in society if public and controversial issues were to be addressed through an education for democratic citizenship and human rights.

Bildung gehört zu den zentralen Begriffen der öffentlichen Debatte über die wünschenswerten Zukünfte von Individuen und Gesellschaft, über die Praxis des Bildungswesens und über Chancengleichheit und Bildungsgerechtigkeit. Gleichzeitig ist der Begriff mit Erwartungen überlastet und seine theoretische Qualität bestenfalls ungeklärt. Zur Prüfung von Status, Funktion und Geltung des Begriffs rekonstruiert der Band zunächst (I) die Tradition des Bildungsdenkens und die seither argumentativ verengte Praxis der Rede von Bildung. Gegen die Dominanz von Emphase, Skepsis und Kritik wird dann (II) demonstriert, dass und wie Bildung im Lebenslauf und im Bildungssystem möglich wird. Abschließend (III) wird kritisch geprüft, ob sich die Rede von Bildung auch als Bildungstheorie ausweisen kann. Redeform und Lebensform von Bildung haben, so das Fazit, zwar lebensweltliche, aber keine theoretische Geltung.

This book develops an argument for a historicist and non-foundationalist notion of rationality based on an interpretation of Wittgenstein of the Philosophical Investigations and On Certainty. The book examines two notions of rationality—a universal versus a constitutive conception – and their significance for educational theory. The former advanced by analytic philosophy of education as a form of conceptual analysis is based on a mistaken reading of Wittgenstein. Analytic philosophy of education used a reading of Wittgenstein's philosophy of language to set up and justify an absolute, universal and ahistorical notion of rationality. By contrast, the book examines the underlying influence of the later Wittgenstein on the historicist turn in philosophy of science as a basis for a non-foundationalist and constitutive notion of rationality which is both historical and cultural, and remains consistent with wider developments in philosophy, hermeneutics and social theory. This book aims to understand the philosophical motivation behind this view, to examine its intellectual underpinnings and to substitute this universal conception of rationality by reference to a Hegelian interpretation of the later Wittgenstein that emphasizes his status as an anti-foundational thinker.

Raphael Sassower examines the concept of hypocrisy for its strategic potential as a means of personal protection and social cohesion. Given the contemporary context of post-truth, the examination of degrees or kinds of hypocrisy moves from the Greek etymology of masks worn on the theater stage to the Hebrew etymology of the color adjustment of chameleons to their environment. Canonical presuppositions about the uniformity of the mind and the relation between intention and behavior that warrant the charge of hypocrisy are critically reconsidered in order to appreciate both inherent inconsistencies in personal conduct and the different contexts where the hypocrisy appears. Sassower considers the limits of analytic moral and political discourses that at times overlook the conditions under which putative hypocritical behavior is existentially required and where compromises yield positive results. When used among friends, the charge of hypocrisy is a useful tool with which to build trust and communities.

This book presents the educational view and practice of the Polish-Jewish doctor, writer and pedagogue Janusz Korczak (Warsaw 1878–Treblinka 1942). In the authors'reconstruction five core elements stand out: respect for every child; participation; justice; dialogue as expression and communication; self-awareness and reflection on the part of the educator.These elements do not constitute a well-rounded theory or philosophy, but are part of many stories of living together with children, in Korczak's case orphans. Korczak, actively involving the children themselves, organized this life in such a way that justice ruled. He is the pedagogue of narrativity and of democratic upbringing. Korczak explored many, and today still challenging ways of participative education.The book shows that besides the now domineering positivist outlook on education, with its technocratic language and stress on output, standards, testing, etc., another language is possible, one that is more practice-based and that teachers will relate to immediately: love for children, a pedagogical ethos, and seeking ways to live together in a just way.

This book inquires into the Capability Approach, a value theory of freedom, which crystalizes the interests of Marx, Welfare Economics, Social Choice, and Ethics. The capability approach has attracted many people as a promising interdisciplinary approach to human well-being and social worlds, finely overarching ethical and economic concerns. It has well challenged essential characteristics of welfare economics, which focuses on the criterion of efficiency with the concept of utility, by explicitly incorporating normative criteria such as agency, well-being and real freedom into positive analysis. However, it has a bit operational and methodological difficulties such that how to estimate an individual capability set which includes potential multi-dimensional functioning vectors. This book proposes that paradox, as a theoretically rich and historically enduring concept, has significant potential for researchers in the field of critical leadership studies. By enriching its general form and infusing it with added complexity and theoretical influence, it is argued that paradox can be legitimately applied as a lens for examining and as a pedagogy for realising new learning possibilities.The book takes paradoxes as formed out of the constitutive practices of discourse rather than as representations of conflict or complexity. This book presents authentic educational experience as the actualization of a potential within a phenomenological field whose axes consist of the somatic, the psychic, and the symbolic, thereby rejecting the one-dimensionality of contemporary education that is primarily mind-oriented. The author insists on the nature of experiencing as coming to be in a living tension between the intuition and the intellect, or the inner and the outer, and calls this a pedagogy of the twice-born.
