Restorative Justice is not a new concept in indigenous spaces, but innovative in the traditional, punitive criminal justice system. Through ethnographic investigations and in-depth qualitative interviews, I explore how judicial concepts are curbed and transformed through a relatively novel Restorative Justice court system. Namely, I investigate how elements of procedural justice, therapeutic justice, and compliance performances aid in understanding how justice is constructed in the Restorative Justice court.

Cet article vise à explorer et questionner les modèles de justice restauratrice et, pour ce faire, à les analyser en recourant au modèle de socialité vindicatoire. Ce modèle est vu ici à titre heuristique, comme un modèle de régulation actif dans les rapports sociaux, uniquement perceptible au niveau de l'action et adapté aux caractéristiques d'une société étatisée, centralisée et organique. Procéder à une telle analyse aide à faire ressortir et à réaffirmer certaines valeurs fondamentales de l'approche restauratrice, valeurs qui, selon plusieurs études empiriques, sont quelquefois édulcorées ou passées sous silence lors de leur mise en application. Poser un regard différent sur l'approche restauratrice et en faire ressortir les facettes vindicatoires conduit au final à interroger la place occupée par la justice restauratrice dans les modes de régulation contemporains. This article aims at exploring and questioning the restorative justice models and analyzing them by using the vindicatory model. This model is seen here as a heuristic tool in the sense of an active model of regulation in social relationships, which is only perceptible at the action level and adapted to the characteristics of a state-controlled, centralized and organic society. This kind of analysis helps to highlight and to reaffirm some fundamental values of the restorative approach, values which, according to several empirical studies, are sometimes watered down or ignored during their application. To put a vindicatory look on the restorative approach finally leads to question the place of restorative justice among the contemporary modes of regulation.

Les travaux communautaires sont de manière générale un travail exécuté sans rémunération par un contrevenant pour le compte de la société. Dans ce mémoire, nous cherchons d’une part à appréhender la perception qu’ont les acteurs de la réalisation des travaux communautaires au Québec et d’autre part à savoir si les acteurs judiciaires (avocats, procureurs et juges) et non judiciaires (intervenants des organismes de justice alternative, délégués à la jeunesse et organismes d’accueil) ainsi que les jeunes contrevenants donnent un sens réparateur aux travaux communautaires. Nous abordons ces questions à partir de deux schèmes : le schème fonctionnel pour comprendre la/les fonction(s) des travaux communautaires et le schème herméneutique afin de saisir la valeur symbolique, le sens qui est donné aux travaux communautaires. Les résultats de cette étude montrent des variations entre les points de vue en fonction des différents groupes et cela autour des trois grands thèmes principaux : la nature des travaux, les objectifs des travaux et les effets de ces derniers. Malgré certaines divergences de points de vue et quelques difficultés dans l’application des travaux, les acteurs sont pour la plupart satisfait de cette mesure., Community work services are usually unpaid work performed by an offender in the interest of the society. In this paper, we seek both to understand the perceptions of actors carrying out the community work services in Quebec and secondly whether legal actors (lawyers, prosecutors and judges) and non-judicial (alternative justice agencies, youth workers and host organizations) and young offenders do give a restorative aspect to community work services. We address these questions using two schemes: the functional scheme to understand the function(s) of community work services and the hermeneutic scheme to capture the symbolic value, the meaning that is given to community work. The results of this study show variations between the points of view of the different groups and that, around three main themes: the nature of community work, community work objectives and effects of the latter. Despite some differences of views and some difficulties in the implementation of the community work services, the actors are mostly satisfied with this measure.

Cet article traite des situations de déprivatisation des conflits, lorsque les gens se tournent vers un tiers, en dehors de la sphère juridico-pénale. Le fait de porter attention à cette étape du processus vise essentiellement à mieux comprendre ce qui conduit les gens à faire appel à ces tiers et les solutions que peut apporter la médiation. Pour ce faire, notre analyse se basera sur les expériences relatées par des médiateurs sociaux et d’autres intervenants travaillant en règlement des conflits., The present article deals with situations of deprivatization of conflicts, when people appeal to a third party, out of the legal penal sphere. By focusing on this specific step of the process, we want to better understand the reasons of such an appeal and the potential solutions brought by using mediation. In order to do so, our analysis will be based on experiences provided by social mediators and other facilitators working in the conflict resolution field.
