Asking about the value of life in the free-market society implies placing it within the biopolitical networks of coordination, production, and regulation of the processes of the species in the triangle of governance in which sovereignty, networks of experts, and capital interact. It is necessary to place the historical development of these elements in the configuration of forms of government through biopolitics without forgetting the place of bare life as an effect and a resistance to those systems of power. This article aims to analyze, from a biopolitical approach and with psychoanalytic concepts, the historical development of the relations between sovereignty and life to glimpse alternative possibilities of affirmation of life in the face of the current regime crisis of governance. Given the crisis of legitimacy in some contemporary states, the need arises to consider solution criteria that are not exclusively based on legality or legality. From a documentary investigation, the concept of exception related to the concept of sovereignty is reviewed, as an alternative to the norm or normal and is proposed as an instrument of democracy that supports state decision-making and the entity empowered to do so, that is, the people. Thus, it is postulated that the concept of exception, as a theoretical construct of Carl Schmitt exposed in his Political Theology, can be an instrument for the adequate exercise of democracy in a State, for which, more than a state of exception, is actually a democratic exception. La filosofía política de Giorgio Agamben gravita en torno a los conceptos de soberanía, excepción, biopolítica y totalitarismo para describir las formas modernas de ejercicio del poder. A partir de estos temas, este artículo realiza un análisis comparativo con Hannah Arendt y Carl Schmitt, quienes representan un referente constitutivo en la propuesta agambeniana, e identifica los puntos de divergencia y convergencia entre ellos. El debate Agamben-Arendt-Schmitt permite comprender las formas de operación del poder soberano en los Estados modernos a través de la intervención en la vida biológica y del uso, que deviene en constante, de instrumentos jurídicos como el estado de excepción. De ello no solo se concluye la vigencia de estos temas que se creían liquidados por la hegemonía del modelo liberal, sino que no hay una tendencia a la desaparición del Estado, en cambio, el poder que ejerce tiende a ensanchar su ámbito de intervención de formas menos visibles y más efectivas.

This article traces a genealogy of sovereignty and exception in the Palestinian refugee camps in Lebanon that highlights their mutual connections and contaminations with the mechanisms of Lebanese state sovereignty from 1948 onward. Drawing together two theoretical approaches emerging from the work of Giorgio Agamben and recent political geographical work on sovereignty, we explore the refugee camps as spaces of exception characterized by hybrid sovereignties. Drawing on original fieldwork, we trace the evolution of the relationship of exception and its mutual links with the production of hybridity in Lebanon's sovereignty from 1948 until today, focusing particularly on the key period from 1968 to 1982 when Palestinian militancy led to a formal recognition of Palestinian autonomy in the camps. Rather than simply undermining Lebanon's sovereignty, the camps' fragmented security and territoriality have instead reshaped Lebanon's state sovereignty in complex ways and forged hybrid spaces for refugee political agency to emerge. El propósito de este artículo es hacer una reconstrucción del concepto de lo político de Carl Schmitt, a partir de la reflexión de sus textos principales y de las críticas que algunos de sus más agudos lectores le han dirigido. La tesis que el texto plantea es que lo político, en Schmitt, equivale a la dictadura. Para demostrar este planteamiento se realiza un análisis de cuatro conceptos centrales en el desarrollo de la concepción del jurista alemán sobre lo político -soberanía, estado de excepción, decisión y enemigo. Análisis que termina por mostrar que dichos conceptos sólo adquieren su contenido explicativo en la figura de la dictadura.This article is an attempt to reconstruct Carl Schmitt's concept of "the political" starting from reflections on his main texts and criticisms that some of his most disparaging readers have directed towards him. The text's thesis is that the concept of "the political" in Schmitt is equal to dictatorship. In order to demonstrate this position the article does an analysis of four central concepts in the development of the German jurist's conceptualization -sovereignty, the state of exception, decision and enemy. This analysis ends by showing that these concepts only acquire their explanatory content in the figure of dictatorship.

Resumen Luego de describir detalladamente el funcionamiento del poder disciplinario, Michel Foucault avanzó con menos precisión en la conceptualización de la biopolítica, de un tipo de regulación de poblaciones que reduce la vida a sus dimensiones biológicas. Retomando, pero también corrigiendo estos desarrollos, Giorgio Agamben marcó una relación estructural entre soberanía y vida, mediadas por el estado de excepción. En este trabajo me interesa remarcar que los conceptos de soberanía y estado de excepción no son aplicables ni siquiera para el nazismo, el único ejemplo histórico analizado por el autor italiano. Abstract After describing in detail the functioning of the disciplinary power, Michel Foucault advanced with less precision in the conceptualization of biopolitics, of a type of population regulation that reduces life to its biological dimensions. Retaking, yet also correcting these developments, Giorgio Agamben marked a structural relationship between sovereignty and life, mediated by the state of exception. In this work I am interested in remarking that the concepts of sovereignty and state of exception are not even applicable to Nazism, the only historical example analyzed by the Italian author. Resumo Despois de descrever em profundidade o funcionamento do poder disciplinar, Michel Foucault avançou com menor detalhe no conceito de biopolitica, isto é, o controle de populações que reduz a vida a suas dimensões biológicas. Nesse sentido, Giorgio Agamben recupera o conceito, mas corrige esses desenvolvimentos, assim ele assinala a relação estrutural entre soberania e vida devida ao estado de exceção. Nesse artigo tento estabelecer que os conceitos de soberania e estado de exceção não são aplicáveis nem mesmo para o nazismo, o único exemplo histórico que o autor italiano analisou. Résumé Après une description détaillée du fonctionnement du pouvoir disciplinaire, Michel Foucault avance avec moins de précision dans la conceptualisation de la biopolitique, d'un type de régulation de population qui réduit la vie à ses dimensions biologiques. Reprenant mais aussi corrigeant ces développements, Giorgio Agamben établit une relation structurelle entre souveraineté et vie, avec pour intermédiaire l'Etat d'exception. Dans ce travail, je voudrais souligner que les concepts de souveraineté et d'état d'exception ne s'appliquent même pas au nazisme, seul exemple historique analysé par l'auteur italien.

La dictadura es un tabú en los regímenes liberal-positivistas. En ellos, el sustantivo dictadura solo es empleado para designar y denostar al enemigo político. Empero, esta vulgarización del término en nada contribuye al estudio de la dictadura como institución genuinamente jurídica. En este trabajo, analizamos la dictadura desde su dimensión jurídica en relación con un tema de actualidad, el COVID-19, y su posible encaje o no dentro del sistema constitucional de 1978 en situaciones de excepcionalidad. Para ello, se parte de la tipología schmittiana y de la diferencia entre dictadura comisaria y dictadura soberana, A ditadura é un tabú nos réximes liberal-positivistas. Neles, o substantivo ditadurasó é empregado para designar e deostar o inimigo político. No entanto, esta vulgarización do termo en nada contribúe ao estudo da ditadura como institución xenuinamente xurídica.Neste traballo, analizamos a ditadura desde a súa dimensión xurídica en relación cun tema de actualidade –o COVID-19– e o seu posible encaixe ou non dentro do sistema constitucional de 1978 en situacións de excepcionalidade. Para iso, pártese da tipoloxía schmittiana e da diferenza entre ditadura comisaria e ditadura soberana, The dictatorship is a taboo in liberal-positivist regimes. In these regimes, the word «dictatorship» is only used to name the political enemy. However, this vulgarization of the word dictatorship does not allow to understand the dictatorship as legal institution. In this paper, we analyze the dictatorship in its legal dimension in relation with COVID-19 pandemic and its possible framing in the Spanish Constitution of 1978 in exceptional situations. This article aims to examine the discussion that Walter Benjamin establishes with Carl Schmitt within the Theses “Über den Begriff der Geschichte” (“On the concept of history”). I will argue that the problem of representation is the hermeneutical key to understand the link between Benjamin’s reformulation of the notions of time and history and his critique of Schmitt’s ideas. Starting from the dispute about the famous notion of “state of exception” (Ausnahmezustand), the paper will trace the elements that can elucidate the scope of this critique. Finally, the conclusions will analyze the implications that arise from the dispute. El presente artículo se propone examinar el debate que Walter Benjamin establece con Carl Schmitt al interior de las Tesis “Über den Begriff der Geschichte” (“Sobre el concepto de historia”). Se buscará sostener que el problema de la representación constituye la clave hermenéutica para comprender el vínculo entre la reformulación benjaminiana de las nociones de tiempo e historia y su crítica a las ideas de Schmitt. Partiendo de la disputa en torno a la célebre noción de “estado de excepción” (Ausnahmezustand), se rastrearán los elementos que puedan dilucidar el alcance de dicha crítica. Finalmente, se analizarán las implicancias que se desprenden de la disputa desarrollada.

This paper is concerned with a concept that has permeated discussions about the corporation in the early 21st century: the “corporate citizen”. The paper uses the liberal understanding of citizenship that involves responsibilities and duties owed to the state on one hand, and the rights guaranteed by the state on the other as its starting point, and applies this dualism to the corporate citizen. Yet the rights and duties applied to corporations are not strictly analogous to the corresponding rights and responsibilities of real flesh and blood citizens. Corporate citizenship implies a set of exceptional powers and privileges that combine to produce homo supra, a paradigmatic “supra-sovereign” subject that is empowered to enjoy sovereign protections and rights far-exceeding those that any ordinary citizen could expect. The paper thus shows how the process of ascribing corporate citizenship has become a key mechanism through which unequal power relations (and attendant privileges of class, gender and race etc.) is guaranteed. El artículo se ocupa del concepto de “ciudadano corporativo”. Utiliza la forma liberal de entender la ciudadanía, la cual, como punto de partida, implica responsabilidades y deberes hacia el Estado, por un lado, y los derechos garantizados por el Estado, por el otro, y aplica esa dualidad al ciudadano corporativo. Sin embargo, los derechos y deberes impuestos a las corporaciones no son estrictamente análogos a los derechos y deberes de los ciudadanos de carne y hueso. La ciudadanía corporativa implica un conjunto de poderes y privilegios excepcionales que se combinan para producir el homo supra, un “supersoberano” paradigmático que es empoderado con amparos y derechos soberanos que exceden con mucho aquéllos que un ciudadano normal podría esperar. Así, el artículo muestra cómo el proceso de asignar la ciudadanía corporativa se ha convertido en un mecanismo por el cual se garantizan relaciones desiguales de poder. One of the fundamental factors in political analysis from modernity had been the intent to overcome the religious elements into the administration of power as consolidation and expression of the liberal form of government, specifically exposed in the figuration of State. However, these contents had been preserved inside the institutions, establishing with this, specific mechanisms for interpretation of society, particularly political power. Thus, the religious contents keep on like a substrate of political concepts inside this liberal tradition. In this arder of ideas, this article pretends to show the functioning of religious factors in construction of the liberal political State in Colombia, particularly how its mutations and internalizations determines surfaces of analysis to the comprehension of power in form of sovereignty. The sovereignty of a state is manifested in constitutional law which assists to suspend individual rights of its citizens under the rhetoric of protecting their rights suspended them. Mexico is no exception to this state logic. However, in this emerging area of legal annulment other modes of being-together implemented by citizens "denationalized" within the meaning of the loss of their rights in their country of origin, indicating new modes of political action arising from the blurring of the rights of modern citizenship. I propose to trace the footsteps of the state of emergency in history by identifying the features that are repeated over time and they survive to continue to endanger the balance between the need for an emergency law and respect for human rights in Mexico. Then I explores some elements of modern representative democracy that explain the fictional staged of governance implementation by the state of emergency. Concluding with the enunciation of some examples of what today we would identify with the emergence of citizen participation practices that emerged in a context of emergency. [ABSTRACT FROM AUTHOR]

Geopolitical “peace-building” relies increasingly on intersections of neoliberal economies of war, violent conflict, and corruption. This article addresses U.S.-led international (post)war aid and development through a spatial examination of Kabul, Afghanistan, examining international worker epistemologies of Afghanistan and “post” conflict aid and development to investigate the spaces of privilege and power associated with political influence, (in)security, and economic and spatial inequities (2006-2008). I draw on recent scholarship in critical feminism, geography, and development studies and the work of Giorgio Agamben regarding the sovereign body and state of exception to demonstrate the spatial disparities and resource inequalities between the “international community” defined as the (un)commonwealth and “local” Afghans. I examine the sovereign status of the (un)commonwealth who manage, assist, or financially profit from international aid and development economies through four interrelated themes: economic and spatial exclusion, (in)security, mobility, and cosmopolitan auxiliary economies. El movimiento de rebeldía zapatista en Chiapas, México se inicia en 1994, logra generar un cambio en la sociedad mexicana al valorar prácticas de liberación indígena. Sin embargo, se instituye un estado de emergencia en territorios zapatistas conforme a leyes que dan amnistía y regulan el vacío jurídico. Ciertos artistas mexicanos como Erick Beltrán, Gabriel Kuri, Abraham Cruzvillegas y Pablo Kubli, aportan reflexiones críticas con obras sustentadas en el contexto de violencia pura del Estado. El marco teórico se constriñe a las teorías de Carl Schmitt, Walter Benjamin, Giorgio Agamben y Achille Mbembe, que contribuyen al entendimiento del estado de excepción que implanta el Estado al modificar la soberanía y los Derechos Humanos. El método utilizado en el artículo corresponde a la recepción de textos literarios. Las piezas artísticas que se integran de Pablo Kubli representan la aportación interdisciplinar de las ciencias sociales y de la práctica del arte, con imágenes, esquemas e intervenciones que son reflexiones argumentativas del entorno de violencia globalizada, y de la resistencia social al paradigma de modificación de la autonomía en regiones intervenidas. Además, se propone un acercamiento comparativo con estados de emergencia de países globalizados conforme a los acontecimientos del 11 de septiembre de 2001 en New York y el 11 de marzo de 2004 en Madrid, entre otros. A partir, de la experiencia mexicana y de países globales, se modifica el término de soberanía por la violencia del Estado sobre territorios cercenados por la permanencia del estado de excepción y restricciones a las garantías constitucionales., The movement of Zapatista rebellion in Chiapas, Mexico began in 1994, succeeding in generating a change in Mexican society by valuing indigenous liberation practices. However, a state of emergency is instituted in Zapatista territories according to laws that grant amnesty and regulate the legal vacuum. Certain Mexican artists such as Erick Beltrán, Gabriel Kuri, Abraham Cruzvillegas and Pablo Kubli, contribute critical reflections with works sustained in the context of pure violence of the State. The theoretical framework is constrained by the theories of Carl Schmitt, Walter Benjamin, Giorgio Agamben and Achille Mbembe, who contribute to the understanding of the state of exception that the State implements by modifying sovereignty and Human Rights. The method used in the article corresponds to the reception of literary texts. The artistic pieces that are integrated by Pablo Kubli represent the interdisciplinary contribution of the social sciences and the practice of art, with images, schemes and interventions that are argumentative reflections of the environment of globalized violence, and of social resistance to the paradigm of modification of autonomy in intervened regions. In addition, a comparative approach with states of emergency of globalized countries is proposed according to the events of September 11, 2001 in New York and March 11, 2004 in Madrid, among others. Starting from the Mexican experience and from global countries, the term of sovereignty is modified by the violence of the State over territories cut off by the permanence of the state of exception and restrictions on constitutional guarantees.

Resumen: La política europea de fronteras ha experimentado numerosos cambios a lo largo de los últimos años, intentando dar diferentes soluciones al fenómeno conocido como crisis migratorias. Y, en virtud de dichas modulaciones, ha mutado también la formación de subjetividades migrantes desde el punto de vista de los poderes que gestionan las fronteras europeas. Así, en función de los mecanismos de control migratorio en sus variantes terrestre y marítima, se ha tratado a los migrantes según principios antropológicos heterogéneos. Ello nos exige comprender el régimen fronterizo europeo en función de las relaciones entre las estrategias tecno-políticas y las figuras de subjetividad que precisan para su legitimidad. Pero a pesar de una supuesta convergencia institucional y estratégica, sorprende que la gestión de las migraciones dé lugar a una pronunciada diversidad en las prácticas gubernamentales, en función de si las fronteras son terrestres o marítimas, y ante ciertos eventos especialmente trágicos asociados a las migraciones globales. Por lo tanto, trazaremos un mapa conceptual destinado a mostrar las diferentes formas de codeterminación entre los mecanismos de poder en la frontera y los procesos de subjetivación asociados a ellos, y así poder identificar los elementos claves que puedan dar lugar a antropología filosófica desde el marco del dispositivo fronterizo integral en el que se ha convertido la Agencia Europea de la Guardia de Fronteras y Costas (Frontex). Abstract: European border politics have gone through numerous changes in recent years as they try to find different solutions to the phenomenon known as the migratory crisis. And as a result of these shifts, the formation of migrant subjectivities has also mutated, as shown in the viewpoint of the powers that manage the European borders. So, in accordance with variations in the mechanisms of migration control at terrestrial and maritime borders, the migrants have been dealt with in accordance with heterogeneous anthropological principles. This means that we must examine the border regime in terms of the relations between the techno-political strategies and the figures of subjectivity which those strategies need to legitimize themselves. But, despite the supposed existence of an institutional and strategic agreement, it is surprising that the management of migration in Europe has led to widely diverse governmental practices, depending on whether the border is a land or maritime one and the impact of some especially tragic events which occur in global migrations. Therefore, we draw a conceptual map of the different modes of codetermination between the mechanisms of power on the borders and the processes of subjectification associated with them, in order to identify the key elements which may lead to a philosophical anthropology, in the framework of the integral frontier mechanism which the European Border and Coast Guard Agency (Frontex) has become. Resumo: A política europeia de fronteiras tem experimentado numerosas mudanças ao longo dos últimos anos, na tentativa de dar diferentes soluções para o fenômeno conhecido como crises migratórias. Por isso, tem mudado também a formação de subjetividades migrantes do ponto de vista dos poderes que administram as fronteiras europeias. Assim, de acordo com os mecanismos de controle migratório em suas variantes terrestre e marítima, os migrantes têm sido tratados segundo princípios antropológicos heterogêneos. Isso nos exige compreender o regime fronteiriço europeu em função das relações entre as estratégias tecnopolíticas e as figuras de subjetividade que precisam para sua legitimidade. Contudo, apesar de uma suposta convergência institucional e estratégica, surpreende que a gestão das migrações torne evidente uma pronunciada diversidade nas práticas governamentais, a depender de se as fronteiras são terrestres ou marítimas e ante certos eventos especialmente trágicos associados às migrações globais. Portanto, traçaremos um mapa conceitual destinado a mostrar as diferentes formas de codeterminação entre os mecanismos de poder na fronteira e os processos de subjetivação associados a eles, e assim poder identificar os elementos-chave que possam dar lugar à antropologia filosófica no âmbito do dispositivo fronteiriço integral no qual a Agência Europeia da Guarda de Fronteiras e Costeira (Frontex) se converteu.

El interés por Carl Schmitt en los primeros años del siglo XXI se hace cada vez más evidente, especialmente en autores que buscan renovar la tradición liberal apelando a los argumentos de este polémico autor. Pese al lugar común que significa Schmitt, su reconocimiento general viene acompañado de una suerte de estigmatización difícil de superar, con la que en ocasiones se le califica de "cómplice" de la tragedia del nazismo. En este artículo se presenta una reflexión en torno a la comprensión que tenía Carl Schmitt sobre el derecho. En dicho análisis se emplea un método hermenéutico de estudio de la primera obra de Schmitt; su tesis de habilitación de 1914. El artículo permite ver que muchos de los elementos de la filosofía política schmittiana en su conjunto, se definen en esta primera obra, la que ideológicamente se ajusta mejor al pensamiento burgués-conservador que a los fundamentos del nazismo. The interest of Carl Schmitt in the first years of XXI century becomes increasingly evident, especially in authors who try to renew the liberal tradition appealing to the arguments of this polemical author. Despite the common place that Schmitt means, his general acknowledgement comes along with a kind of stigmatization difficult to overcome, with which he is sometimes classified as "accomplice" of the Nazism tragedy. In this article a reflexion is presented around the comprehension that Carl Schmitt had about law. In such analysis, a hermeneutic method of study of Schmitt's first work is used: his habilitation thesis in 1914. The article lets us see that many of the elements of the Schmitt's political philosophy in total are defined in this first work, which ideologically fits to the bourgeois-conservator knowledge better than to the Nazism fundamentals. O interesse por Carl Schmitt nos primeiros anos do século XXI está cada vez mais evidente, especialmente entre autores que buscam renovar a tradição liberal apelando aos argumentos deste polemico autor. Apesar do lugar comum em que se encontra Schmitt, seu reconhecimento vem acompanhado de uma espécie de estigmatizarão difícil de superar ao ser tachado como "cúmplice" da tragédia que foi o nazismo. Neste artigo pretendemos apresentar uma reflexão em torno da compreensão que teria Carl Schmitt sobre o direito. Nesta análise aplica-se um método hermenêutico de estudo da primeira obra de Schmitt; a sua tese de habilitação escrita em 1914. O artigo permite visualizar variados elementos da filosofia política schmittiana em seu conteúdo e que são definidas na sua primeira obra, e que ideologicamente se ajusta melhor ao pensamento burgues-conservador, do que ao dos fundamentos nazista.

RESUMEN: El propósito de este artículo es hacer una reconstrucción del concepto de lo político de Carl Schmitt, a partir de la reflexión de sus textos principales y de las críticas que algunos de sus más agudos lectores le han dirigido. La tesis que el texto plantea es que lo político, en Schmitt, equivale a la dictadura. Para demostrar este planteamiento se realiza un análisis de cuatro conceptos centrales en el desarrollo de la concepción del jurista alemán sobre lo político –soberanía, estado de excepción, decisión y enemigo. Análisis que termina por mostrar que dichos conceptos sólo adquieren su contenido explicativo en la figura de la dictadura. ABSTRACT: This article is an attempt to reconstruct Carl Schmitt’s concept of “the political” starting from reflections on his main texts and criticisms that some of his most disparaging readers have directed towards him. The text’s thesis is that the concept of “the political” in Schmitt is equal to dictatorship. In order to demonstrate this position the article does an analysis of four central concepts in the development of the German jurist’s conceptualization —sovereignty, the state of exception, decision and enemy. This analysis ends by showing that these concepts only acquire their explanatory content in the figure of dictatorship.

It is well known that the controversial German theorist Carl Schmitt understood the position of the Sovereign in theologico-political terms: as similar to that of the medieval Prince, charged with the task of preventing and deferring the end of days. An exploration of the links between Schmitt and his acknowledged intellectual mentor Thomas Hobbes reveals that, ultimately, what is at stake in such understandings of the sovereign’s position is the management and control of the risk associated with the possible occurrence of catastrophic events in the future. It is argued here that such a conception of our relationship with time and infinitude has come to dominate the political, economic and even aesthetic landscape of our times. That conception is apocalyptic, authority- based, and catastrophic; it amounts to an unexpected return of religion at the very heart of modernity, on the back of seemingly secular appeals to choice and necessity, following the introduction of war at the centre of the promise of progress.Bien se sabe que el alemán Carl Schmitt interpretó la posición del soberano en términos teológico-políticos: como el príncipe medieval cristiano cuya función consistía en prevenir y deferir el fin. Apuntalando las cercanías entre Schmitt y su mentor intelectual Thomas Hobbes, puede verse que en últimas la posición del decisor soberano es aquí la de quien intenta administrar o controlar el riesgo de la ocurrencia de eventos catastróficos en el futuro. Se argumenta en este ensayo que dicha forma de relacionarse con la temporalidad y el infinito —apocalíptica, autoritativa, y catastrofista— caracteriza tanto a la estética como a la economía y la política de autoridad que predominan en nuestra época. Se trata de un inesperado retorno de lo religioso en el corazón mismo de la modernidad, que anima la radicalización decisionista de los discursos político y económico, y sus presentaciones en la cultura popular tras la introducción de la guerra en el centro de la promesa moderna del progreso.

It also explores the links between the forms of a legal, social, economic, political and cultural state of emergency experienced by immigrants and its value as an interpretative key of the undermining of citizenship suffered by a large number of people in the developed societies., [ES]Partiendo de las contradicciones y crisis de la ciudadanía en las sociedades modernas, tanto las que afectan a la relación entre su lógica universalizadora y los límites territoriales de la validez de los derechos, como las que afectan a la relación entre la lógica del mercado y la lógica de los derechos humanos, este artículo analiza la agudización de dichas contracciones en conexión con el fenómeno de la inmigración y explora los vínculos entre las formas de excepcionalidad jurídica, social, económica, política y cultural que viven los inmigrantes y su valor como clave interpretativa de los procesos de socavamiento de la ciudadanía que sufren amplios sectores de población en las sociedades desarrolladas.
