The article is devoted to the essence of opportunistic behavior, forms of its manifestation, consequences and methods of its regulation. Emphasis is placed on the fact that opportunistic behavior is an objective phenomenon and exists both at the level of functioning of the main institutions of the state and at the level of relations between citizens and business entities. Opportunistic behavior is the use of asymmetric information for their own benefit and to the detriment of the interests of counterparties. It is noted that opportunistic behavior has objective prerequisites, namely the intensification of contractual relations, intensification of competition, globalization of undesirable behavior of counterparties. It is emphasized that the structural elements of opportunistic behavior are: divergence of interests of counterparties, intentional actions; counterparty damage, asymmetric information, hidden nature of dishonest behavior. However, it is emphasized that it is always possible to prevent the intensification of opportunistic behavior. Contracts, which are a voluntary agreement between independent economic agents, help to eliminate the possibility of its occurrence. From the point of view of entering the network of formal and informal relations, classical, neoclassical contracts and contract of relations are distinguished. It is noted that in the conditions of opportunistic behavior, economic agents have to make efforts to counteract the unfair behavior of counterparties, which creates transaction costs. Transaction costs can be quite significant and amount to 50% of the contract amount. The conclusion of the theoretical study notes that minimizing the negative manifestations of opportunistic behavior is possible with the use of relative contracts that have a longer relationship between the parties, include formal and informal promises of repeat agreements in the future. Under such conditions, the self-motivation of the contractors to comply with the requirements of the contract appears. In relative contracts, the manifestations of opportunistic behavior are minimal, because the expected benefit from repeated orders exceeds the benefit from the benefits obtained as a result of opportunistic behavior., Статтю присвячено питанням сутності опортуністичної поведінки, формам її прояву, наслідкам та методам її регулювання. Акцентується увага на тому, що опортуністична поведінка є об’єктивним явищем і існує як на рівні функціонування основних інститутів держави, так й на рівні стосунків між громадянами та суб’єктами господарювання. Підкреслюється, що структурними елементами опортуністичної поведінки є: розбіжність інтересів контрагентів, навмисність дій; збиток контрагента, асиметрична інформація, прихований характер недобросовісної поведінки. Усунути можливість її появи допомагають контракти, які уявляють собою добровольчу угоду між самостійними економічними агентами. Відмічається, що в умовах опортуністичної поведінки економічним агентам доводиться докладати зусиль щодо протидії недобросовісної поведінки контрагентів, що формує трансакційні витрати. Мінімізувати негативні прояви опортуністичної поведінки можливо при застосуванні відносних контрактів, які мають більш тривалі взаємини сторін, включають в себе формальні і неформальні обіцянки повторних угод в майбутньому.

Институциональные ограничения, которые влияют на социальноэкономический рост муниципальных образований, кроются в доминировании неформальных правил над действующей нормативной базой. Рассмотрены показатели статистической отчетности, как отражающие конечный результат преобразований и их эффективности. Выявлено, что ресурсозависимая экономика в Республике Башкортостан, в том числе и разработка шихан для производства кальцинированной соды, выдает сильную зависимость новых институтов от старых в российской экономике и определяется как «эффект колеи». Установлено, что потенциал роста в сельском хозяйстве кроется в эффективном использовании земель сельхозназначения поэтому необходимо произвести ревизию заброшенных земельных массивов, разработать экономический механизм возврата пригодных для сельскохозяйственного использования земель в хозяйственный оборот, решить проблему с освоением средств выделенных на рекультивацию. Наблюдается снижение реальных денежных доходов населения РБ, что приводит к возникновению институциональной ловушки когда низкая платежеспособность населения приводит к высокой закредитованности перед финансовыми учреждениями. Рассмотрены системные ошибки в здравоохранении республики такие как низкая заработная плата врачей, нежелание молодых специалистов ехать работать в моногорода и райцентры, перевод всех медучреждений из муниципальной собственности в республиканскую. Выявлены высокие трансакционные издержки в строительной отрасли: издержки сбора и обработки информации, издержки проведения переговоров и принятия решений, издержки контроля, издержки юридической защиты выполнения контракта. Специалисты отмечают что, все это ведет к снижению активности строительных предприятий и уходу в теневой бизнес., Institutional constraints that affect the socio-economic growth of municipalities lie in the dominance of informal rules over the current regulatory framework. The indicators of statistical reporting are considered as reflecting the final result of the transformations and their effectiveness. It is revealed that the resource-dependent economy in the Republic of Bashkortostan, including the development of shihans for the production of soda ash, gives a strong dependence of the new institutes on the old ones in the Russian economy and is defined as the “gauge effect”. It has been established that the growth potential in agriculture lies in the effective use of agricultural land, therefore, it is necessary to re-examine abandoned land massifs, develop an economic mechanism for returning agricultural land to economic use, and solve the problem of development of funds allocated for reclamation. There is a decrease in real monetary incomes of the population of the Republic of Belarus, which leads to the emergence of an institutional trap when the low solvency of the population leads to a high debt burden to financial institutions. Considered systemic errors in the public health of the republic such as low wages of doctors, the reluctance of young specialists to go to work in monotowns and regional centers, the transfer of all medical institutions from municipal to republican property. High transaction costs in the construction industry were revealed: the costs of collecting and processing information, the costs of conducting negotiations and making decisions, the costs of control, and the costs of legal protection of contract implementation. Experts note that all this leads to a decrease in the activity of construction enterprises and care in the shadow business.

The article deals with the costs of checking the counterparty and the legal registration of the transaction (ex ante), as well as the costs of monitoring compliance with the terms of the transaction, preventing opportunism of the counterparty, and legal protection for the enforcement of the terms of the transaction. Examples of cost reduction when working with contractors in two Russian medium-sized companies are considered. В статье рассматриваются издержки проверки контрагента и юридическое оформление сделки (ex ante), а также издержки контроля за соблюдением условий сделки, предотвраще-нием оппортунизма контрагента, и защиты для принудительного исполнения сделки. Рас-сматриваются примеры снижения издержек работы с контрагентами двух российских ком-паний.

Syfte: Studiens syfte är att analysera huruvida korruption i biståndsprocesser bättre kan hanteras via de blockkedjebaserade lösningarna kryptovalutor, smarta kontrakt och tokens, jämfört med traditionellt biståndsgivande. Vidare ämnar studien applicera resultaten från fallstudien på generella avtalsprocesser exponerade mot opportunism, för att analysera huruvida de blockkedjebaserade lösningarna bättre kan hantera transaktionskostnader jämfört med traditionella avtalslösningar. Bakgrund: Informationsasymmetrier, begränsad rationalitet och strategiskt beteende resulterar i tillitsproblematik vid avtalsprocesser, vilket ökar transaktionskostnaderna (Williamson, 1974). Biståndsprocesser är extra exponerade mot opportunistiskt beteende i form av korruption, vilket leder till att en stor del av biståndet försvinner på vägen (Transparency International, 2017). Blockkedjebaserad teknik ger möjligheten att ingå avtal utan tillit till motparten, men lösningen är inte optimal för alla typer av avtal. Det motiverar en analys om huruvida tekniken kan hantera transaktionskostnader i biståndsprocesser bättre än traditionellt biståndsgivande. Genomförande: Studiens primärdata inhämtades via semi-strukturerade intervjuer med två svenska biståndsorganisationer och två experter inom blockkedjetekniken. Utöver intervjuerna genomfördes även en litteraturstudie och den insamlade empirin analyserades utifrån ett transaktionskostnadsperspektiv. Slutsats: Blockkedjebaserade lösningar kan hantera transaktionskostnader bättre än traditionellt biståndsgivande när Greenspans (2015) fem kriterium är uppfyllda. Kontexten, avtalets karaktär och avtalsparternas preferenser är de avgörande faktorerna huruvida kriterierna uppfylls i såväl biståndsgivande som generella avtalsprocesser. En ökad transparens, öppenhet och censurresistens måste värderas högre vid implementering än de medföljande säkerhetsriskerna. Purpose: The purpose of this study is to analyze whether corruption in aid processes better can be managed through the blockchain-based solutions cryptocurrencies, smart contracts and tokens, in comparison to traditional donation of aid. The study also aims to apply the results from the case study to general contractual processes exposed to opportunistic behavior, to analyze whether the blockchain-based solutions better can manage the transaction costs in comparison to traditional contractual solutions. Background: Asymmetric information, bounded rationality and strategic behavior result in trust issues in contractual processes, which increases transaction costs (Williamson, 1974). Aid processes are particularly exposed to opportunistic behavior in form of corruption, which leads to aid disappearing on the way (Transparency International, 2017). Blockchain-based technology enables contractual relationships without trusting the counterpart, but is not an optimal solution for all types of contracts. This provides incentives for a further analysis whether the technology can manage transaction costs in aid processes better than traditional donation of aid. Completion: The study´s primary data was obtained through semi-structed interviews with two Swedish aid organizations and two experts in blockchain technology. A literature review was made and the empirical data was analyzed from a transaction cost perspective. Conclusion: Blockchain-based solutions can manage transaction costs better than the traditional donation of aid when Greenspan´s (2015) five criteria is met. The context, the characteristics of the contract and the preferences of the contracting parties are the decisive factors whether the criteria are met in the aid donation process and in general contractual processes. В статье на примере медицинских учреждений анализируется оппортунистическое поведение агентов (врачей и другого медицинского персонала) и принципалов (работодателей). Оппортунистическое поведение рассматривается в рамках теории трансакционных издержек. При этом трудовой договор, анализируемый в статье, рассмотрен в форме эффективного контракта. Дано авторское определение понятию «эффективный контракт». Рассмотрена специфика трудовых отношений в учреждениях здравоохранения, обращено внимание на основные предпосылки оппортунистического поведения в медицинской среде: вынуждаемая государством, так называемая уравниловка в части стимулирования труда; несовпадение целей (интересов) работодателя (главного врача) и работника (врача и другого медицинского персонала); специфичность имеющихся активов (знания, опыт, умения высококвалифицированных специалистов) и другие. В статье аккумулированы виды трансакционных издержек, одним из которых является оппортунистическое поведение агентов и принципалов. Трансакционные издержки включают любые потери, возникающие вследствие неэффективности совместных решений, планов, заключаемых договоров и созданных структур, неэффективных реакций на изменившиеся условия, неэффективной защиты соглашений. В процессе исследования было осуществлено сравнение уровней трансакционных издержек, вызванных оппортунистическим поведением при обычном трудовом договоре и эффективном контракте. Приведена схема построения системы стимулирования труда медицинских работников на основе эффективного контракта. Главная цель — повышение качества медицинского обслуживания населения — достигается в данном случае через цель предлагаемой методики: максимальное снижение оппортунистического поведения работников и работодателей. Достижение установленных нормативов нагрузки и профессиональных требований к работнику оценивается по совокупности критериев интенсивности, качества и сложности труда, что, по разумению авторов статьи, максимально снижает оппортунизм поведения как работодателя, так и работника., The article analyzes the opportunistic behavior of agents (doctors and other medical personnel) and principals (employers) on the example of medical institutions. Opportunistic behavior is considered within the framework of transaction costs theory. Thus the employment contract analyzed in article is considered in the form of the effective contract. The author defines the concept of «effective contract». The specificity of labor relations in health institutions is examined drawing attention to the basic premise of opportunistic behavior in medical environment: forced by the state, the so-called leveling part of labors stimulation; mismatch of goals (interests) of the employer (Chief Medical Officer) and the employee (doctor and other medical personnel); specificity of existing assets (knowledge, experience, skills of highly qualified specialists) and others. The article accumulated types of transaction costs, one of which is the opportunistic behavior of agents and principals. Transaction costs include any loss arising due to the inefficiencies of cooperative solutions, plans, contracts, and created structures, ineffective responses to changed conditions, ineffective protection agreements. The study compared the levels of transaction costs caused by opportunistic behavior under the normal employment contract and an effective contract. The scheme of construction of the system of stimulation of work of medical workers on the basis of the effective contract is resulted. The main goal — to improve the quality of health care for the population — is achieved in this case through the purpose of the proposed methodology: the maximum reduction in opportunistic behavior of workers and employers. Achievements of the established standards of loading and professional requirements to the worker are estimated by the set of criteria of intensity, quality and complexity of work that, according to understanding of the authors of the article, as much as possible reduces opportunism of behavior of both the employer, and the worker., №3(44) (2018)

A proposta deste estudo foi entender o comportamento oportunista a partir dos conceitos incerteza, racionalidade limitada e especificidade de ativos. Para tal, um modelo teórico foi proposto e testado, em que se operacionalizou a especificidade segundo os ativos dedicados, os ativos físicos e os ativos humanos, em conformidade com os trabalhos Anderson e Schmittlein (1984), Carson, Madhok e Wu (2006) e Skarmeas, Katsikeas e Schlegelmilch (2002), ancorados na teoria dos custos de transação (TCT). O comportamento oportunista foi operacionalizado a partir dos indicadores propostos por Carson, Madhok e Wu (2006). A racionalidade limitada foi estudada na perspectiva de Simon (1957, 1980), e a operacionalização do constructo incerteza se amparou nos trabalhos de Knight (2002), Duncan (1972), Gordon e Narayanan (1984), Milliken (1987) e Milliken (1990). Os dados coletados junto a 111 gestores da indústria de transformação no Brasil, selecionados na base da Federação das Indústrias do Estado de São Paulo (Fiesp), foram submetidos à modelagem por equações estruturais. Os resultados apontam que a racionalidade limitada e a especificidade dos ativos influenciam positivamente o comportamento oportunista dos agentes econômicos, confirmando os argumentos da teoria dos custos de transação, ou seja, quanto maior a especificidade dos ativos, menores as possibilidades de reaproveitamento do investimento, tornando a continuidade do relacionamento valiosa e alvo potencial de ações oportunistas. Os resultados também confirmaram a multidimensionalidade do constructo incerteza, reforçando os argumentos teóricos da perspectiva da incerteza da informação. Tal constatação, aliada às definições de Simon (1957, 1980), possibilitou a operacionalização do constructo racionalidade limitada a partir da incerteza de efeito e da incerteza de resposta, bem como a constatação da importância dessa premissa na explicação da existência dos custos de transação. Nesse sentido, os resultados abrem um leque de possibilidades e contribuem significativamente para o avanço dos estudos empíricos no campo da TCT. The purpose of this study was to understand the opportunistic behavior of the concepts from uncertainty, bounded rationality and asset specificity. A theoretical model was proposed and tested where the specificity was operationalized according to the dedicated, physical and human assets following Anderson and Schmittlein (1984), Carson, Madhok and Wu (2006) and Skarmeas, Katsikeas and Schlegelmilch (2002), anchored in the Transaction Cost Theory (TCT). The opportunistic behavior was operationalized as the indicators proposed by Carson, Madhok and Wu (2006). The bounded rationality has been studied from the perspective of Simon (1957, 1980) and the operationalization of the construct uncertainty in line with Knight (2002), Duncan (1972), Gordon and Narayanan (1984), Milliken (1987) and Milliken (1990). The data was collected from 111 managers in the manufacturing industry in Brazil selected on the basis of Industrial Federation of the São Paulo and submitted to Structural Equation Modeling. The results showed that bounded rationality and asset specificity positively influence the opportunistic behavior of economic agents, confirming the arguments of the theory of transaction costs, meaning that as greater the specificity of the assets less are the investment possibilities of reuse, making continuity valuable relationship and potential target of opportunistic. The results confirmed the multidimensionality of the construct uncertainty, too, reinforcing the theoretical arguments from the perspective of Uncertainty Information. This finding, with Simon (1957, 1980) definitions, enabled the operationalization of the construct bounded rationality from the uncertainty effect and response uncertainty, and the realization of the importance of this premise to explain the existence of transaction costs. In this sense the results allows a range of possibilities and contributes significantly to the advance of empirical studies in the field of TCT. El propósito de este estudio fue conocer el comportamiento oportunista de los conceptos de la incertidumbre, racionalidad limitada y la especificidad de los activos. Con este fin, un modelo teórico propuesto y probado que la especificidad fue puesto en práctica de acuerdo a los activos dedicados, activos físicos y capital humano, de acuerdo con el trabajo Anderson y Schmittlein (1984), Carson, Madhok y Wu (2006) y Skarmeas, Katsikeas y Schlegelmilch (2002), anclado en la teoría de los costes de transacción (TCT). El comportamiento oportunista fue puesto en práctica en los indicadores propuestos por Carson, Madhok y Wu (2006). La racionalidad limitada se ha estudiado desde la perspectiva de Simon (1957, 1980) y la puesta en marcha de la incertidumbre de la construcción se sostiene en la obra de Knight (2002), Duncan (1972), Gordon y Narayanan (1984), Milliken (1987) y Milliken (1990). Los datos recogidos de 111 gerentes de la industria manufacturera en Brasil seleccionados sobre la base de la Federación de Industrias de São Paulo (Fiesp) se presentaron a modelos de ecuaciones estructurales. Los resultados muestran que la racionalidad limitada y la especificidad de los activos influyen positivamente en el comportamiento oportunista de los agentes económicos, lo que confirma los argumentos de la teoría de los costos de transacción, es decir, cuanto mayor sea la especificidad de los activos en las posibilidades de inversión de la reutilización, por lo que la continuidad relación valiosa y blanco potencial de infecciones oportunistas. Los resultados también confirman la multidimensionalidad de la incertidumbre de la construcción, lo que refuerza los argumentos teóricos desde la perspectiva de información sobre la incertidumbre. Este hallazgo, junto con las definiciones de Simon (1957, 1980), ha permitido la puesta en marcha de la racionalidad limitada de construir el efecto de la incertidumbre y la incertidumbre de respuesta, y la realización de la importancia de esta premisa para explicar la existencia de costos de transacción. En este sentido, los resultados se están abriendo un abanico de posibilidades y contribuye significativamente a la promoción de estudios empíricos en el campo de la TCT.

The article analyzes informal economy as a category of the economic science in terms of its content and existing forms from the standpoint of institutional economics. It is substantiated that the institutional approach is a logical step in the analysis of informal economy, which appeared after classical and neoclassical methods. Existing definitions and forms of informal economy are analyzed, complemented and summarized. Important characteristics of informal economy, directly manifesting in its current forms, are distinguished. Ways of improving the effectiveness of government rules are offered.

Цель исследования состоит в объяснении траекторий институциональных изменений. Оно фокусируется на общественных отношениях в собственности и рынка земли в Болгарии в период 1878-2013 гг., реформ в сельском хозяйстве в основном определяющих институциональные изменения. Ретроспективный анализ объясняет факторы, которые влияют на долгосрочные модели поведения человека и прав собственности на рынке земли. Прогноз последней реформы определяет, что не будет изменяться централизованным распределением прав собственности. На операционном уровне процесса, локальные монополии будут поддерживать введение высокого уровня расходов. Модели оппортунистического поведения не будет редкостью на рынке земли. Оппортунизм будет присутствовать в качестве специальных, случайных соответствий между участниками рынка в отношении управления для избегания некоторых видов расходов по сделкам. Большая часть социально-экономических связей, относящихся к земельным, будет устранена. Предложены рекомендации по совершенствованию институциональных изменений, связанных с созданием конкуренции в рамках процесса и интеграции прав собственности через информацию., The aim of this study is to explain the trajectory of institutional change. It focuses in the social relations and property rights of agricultural land marketBulgaria during (1878-2013). The reforms define institutional change. Retrospective analysis explains the factors that influence long-term patterns of human behavior and property rights in the agricultural land market. Forecast: The reforms will not change distribution of property rights. On operational level the local monopolies will support high levels of transaction costs. Opportunistic behavior is a special, incidental cooperation between market participants versus administration. In this way the market participants would avoid some of transaction costs. Most of the socio-economic relationships that are defined from “land” will be stopped forever. Proposals to improve the institutional changes are associated with creation of competition within the process and integration of property rights through information.
