Abstract: In accordance with Article 6 of Regulation (EC) No 396/2005, the applicant LTZ Augustenberg submitted a request to the competent national authority in Germany to modify the existing maximum residue levels (MRLs) for the active substance potassium phosphonates in raspberries, blackberries, currants, blueberries, gooseberries and elderberries. The data submitted in support of the request were found to be sufficient to derive MRL proposals for all crops under consideration. Adequate analytical methods for enforcement are available to control the residues of potassium phosphonates in plant matrices under consideration. Based on the risk assessment results, EFSA concluded that the proposed uses of potassium phosphonates on raspberries, blackberries, currants, blueberries, gooseberries and elderberries will not result in a consumer exposure exceeding the toxicological reference values and therefore are unlikely to present a risk to consumers’ health. Abstract: In accordance with Article 6 of Regulation (EC) No 396/2005, the applicant Dienstleistungszentrum Ländlicher Raum submitted a request to the competent national authority in Germany to modify the existing maximum residue level (MRL) for the active substance flonicamid in radishes. Furthermore, in accordance with Article 6 of Regulation (EC) No 396/2005, the applicant ISK Biosciences Europe N.V. submitted a request to the competent national authority in the Netherlands to modify the existing MRLs for the active substance flonicamid in strawberries, cane fruits, other small fruits and berries, lettuces and other salad plants, and pulses (dry beans, lentils, peas, lupins). The data submitted in support of the request were found to be sufficient to derive MRL proposals for strawberries, blackberries, raspberries, other small fruits and berries, radishes, lettuces and other salad plants, and pulses (dry beans, lentils, peas and lupins). Adequate analytical methods for enforcement are available to control the residues of flonicamid on in the commodities under consideration. Based on the risk assessment results, EFSA concluded that the short‐term and long‐term intake of residues resulting from the use of flonicamid according to the reported agricultural practices is unlikely to present a risk to consumer health. Abstract: In accordance with Article 6 of Regulation (EC) No 396/2005, the applicants ADAMA Agriculture Espana S.A., Sapec Agro SAU and LSA (Landesanstalt für Landwirtschaft, Forsten und Gartenbau) submitted requests to the competent national authorities in Spain and Germany, to modify the existing maximum residue levels (MRLs) for the active substance tebuconazole in olives, rice, herbs and herbal infusions (dried). The data submitted in support of the requests were found to be sufficient to derive MRL proposals for all the crops under consideration. Adequate analytical methods for enforcement are available to control the residues of tebuconazole on the commodities under consideration at the validated limit of quantification (LOQ) of 0.02 mg/kg. Based on the risk assessment results, EFSA concluded that the short‐term and long‐term intake of residues resulting from the use of tebuconazole according to the reported agricultural practices is unlikely to present a risk to consumer health. In accordance with Article 6 of Regulation (EC) No 396/2005, the applicants Bayer CropScience Europe and Oxon Italia S.p.A. submitted requests to the competent national authority in Spain and Italy, respectively, to modify the existing maximum residue levels (MRLs) for fosetyl in peach and potato from the intended southern Europe (SEU) uses of fosetyl‐Al. The applicants Adama Agriculture B.V., Fitosanitarios Bajo Riesgo AIE and Almond Board of California submitted each an application to the competent national authority in France to modify the MRLs for fosetyl‐Al in pome fruits, peaches and tree nuts (except coconut) for the intended/authorised uses of the active substance potassium phosphonates. The data submitted in support of the requests were found to be sufficient to derive MRL proposals for all the crops under consideration. Adequate analytical methods for enforcement are available to control the residues of fosetyl‐Al and phosphonic acid in plant matrices under consideration. EFSA concluded that the proposed use of fosetyl‐Al on potatoes and the proposed uses of potassium phosphonates on pome fruits and peaches and the authorised use of potassium phosphonates on tree nuts in the United States are unlikely to result in a consumer exposure exceeding the toxicological reference values for phosphonic acid and fosetyl and therefore are unlikely to pose a risk to consumers’ health. However, the risk assessment is considered to be tentative and has to be updated as soon as the approval of the renewal of fosetyl and the review of existing uses of potassium phosphonates and disodium phosphonate is finalised. In accordance with Article 6 of Regulation (EC) No 396/2005, the evaluating Member States (EMS), the Netherlands and the United Kingdom, received an application from BASF SE to modify the existing maximum residue levels (MRLs) for the active substance fluxapyroxad in several crops in order to accommodate for proposed new uses in Europe and for the import of crops. According to EFSA, the data are sufficient to derive MRL proposals for all the crops assessed, except for citrus fruits other than oranges and grapefruits. Adequate analytical enforcement methods are available to control the residues of fluxapyroxad on the commodities under consideration, but additional validation data on herbal infusion and spices would be desirable. Based on the risk assessment results, EFSA concluded that the proposed uses on various crops of fluxapyroxad and the use authorised in Brazil on oranges and grapefruits for which import of crops has been requested, will not result in a consumer exposure exceeding the toxicological reference values and therefore are unlikely to pose a consumer health risk. In accordance with Article 6 of Regulation (EC) No 396/2005, the applicant Dow AgroSciences Ltd submitted a request to the competent national authority in France and the Netherlands to modify the existing maximum residue levels (MRL) for the active substance spinetoram in several crops. The data submitted in support of the requests were found to be sufficient for making several MRL proposals for the crops under consideration. Adequate analytical methods for enforcement are available to control the residues of spinetoram on the commodities under consideration. Based on the risk assessment results, EFSA concluded that a risk from short-term intake cannot be excluded for escaroles. Therefore, no MRL has been proposed for this use. Furthermore, in a screening step, risk to consumers has been identified for the current use of spinetoram in lettuce. EFSA therefore proposes to lower the current MRL for lettuce to a safe limit. For the remaining crops, the expected short-term exposure is unlikely to present a risk to consumer health. The applicant BASF SE submitted a request to the competent national authority in the Netherlands to evaluate the confirmatory data that were identified for bentazone in the framework of the maximum residue level (MRL) review under Article 12 of Regulation (EC) No 396/2005 as not available. To address the data gaps, a new livestock feeding study and storage stability data for bentazone and 6‐hydroxy bentazone in animal matrices were submitted. To address the data gap for potatoes, adjusted less critical good agricultural practices (GAPs) were reported and supporting residue data were provided. The data gap related to analytical methods in fat and herbal infusions were addressed in the framework of the peer review. The data gap for residue trials on leek has not been addressed. Further confirmation from the applicant/Member States are needed for the clarification of the GAP for herbal infusions. Based on the information submitted in support of the confirmatory data request, the existing EU MRLs for bentazone need to be modified for potato and leek, for swine fat and kidney and for bovine, equine, goat and sheep fat, liver and milk. The consumer risk assessment performed in the MRL review was updated, using new toxicological reference values derived by the peer review. No consumer intake concerns were identified. In accordance with Article 6 of Regulation (EC) No 396/2005, the competent national authority in Belgium prepared a request to modify the existing maximum residue levels (MRLs) for the active substance spirotetramat in Florence fennels and rhubarbs. Furthermore, in accordance with Article 6 of Regulation (EC) No 396/2005, the applicant Bayer SAS submitted a request to the competent national authority in Austria to modify the existing MRLs for spirotetramat in the group of other small fruits and berries, kiwi fruits and garlic. The data submitted in support to both requests were found to be sufficient to derive MRL proposals for all the crops under consideration. Adequate analytical methods are available to enforce the proposed MRLs. Based on the risk assessment results, EFSA concluded that the short‐term and long‐term intake of residues resulting from the use of spirotetramat according to the intended agricultural practices is unlikely to present a risk to consumer health. In accordance with Article 6 of Regulation (EC) No 396/2005, the applicant BASF SE submitted two requests to the competent national authority in Germany. The first one, to modify the existing maximum residue levels (MRL) for the active substance pyraclostrobin in various crops and to set import tolerances for sugar canes and American persimmons; the second one to set import tolerances for pineapples and passion fruits/maracujas. The data submitted in support of the requests were found to be sufficient to derive MRL proposals for mandarins, grapefruits, lemons, limes, passion fruits/maracujas, pineapples, flowering brassica, head cabbages, lamb's lettuce, cresses and other sprouts, land cresses, rucola, red mustards, baby leaf crops, globe artichokes and leeks. For oranges, American persimmons, spinaches and similar leaves and sugar canes, data gaps were identified which precluded the derivation of MRL proposals. The data submitted did not provide evidence that the existing MRLs for crops belonging to the group of lettuces and maize have to be modified to accommodate for the intended uses. For escaroles, no MRL was proposed as the intended use was found to lead to residues for which a potential consumer health risk cannot be excluded. EFSA concluded that the short‐term intake of residues resulting from the uses of pyraclostrobin according to the reported agricultural practices assessed is unlikely to present a risk to consumer health, except for escaroles, where the expected intake was found to exceed the toxicological reference value.
