The procedure for the Transfer of Sentenced People (TSP) is a legal mechanism provided for in the Migration Law, with a humanitarian basis, and which aims to allow people definitively convicted in a different State to serve time in the country of their nationality or residence. The question to be answered, however, is: how can such an institute contribute to the protection of imprisoned foreign individuals? The purpose of this article is to investigate the aforementioned instrument of international cooperation, verifying its potential in the light of Transnational Law, to assess the possibility of its use as protection of the human rights of foreigners imprisoned in Brazil and, more specifically, in the State of Amazonas. For that, the deductive method will be used, starting from the bibliographic review of general themes such as Transnational Law, human rights protection and the very concept of the institute "Transfer of Sentenced People", to achieve the answers for the formulated problem. Statistical data collected by the National Penitentiary Department within the state of Amazonas will also be used, in the period from July to December 2019 (last census conducted), as a means of quantitative observation and the origin of foreigners imprisoned in the specified geographical area, given its location in the border region. All of this in order to achieve as a result the feasibility of adopting the measure of Transfer of Sentenced People as an aggregating mechanism both for public regional penitentiary policies, but mainly in the aspect of protecting the human rights of foreign prisoners.
