Colonial empires establish their system of power based on white male supremacy across all spheres of society. In this process, incarceration systems were -- and can still be -- a key element in the preservation of racial, class, and gender hierarchies. In recent decades, extensive research has sought to expose how the incarceration system enjoys an intimate relationship with structural racism. In addition, the War on Drugs initiative accentuates these effects in Latin-American countries. From 2010 to 2014, the incarceration of women in Brazil increased by 567% (World Prison Brief, 2015). This paper, in applying an interdisciplinary approach, will briefly analyze the role of gender and race in this process and will point out how certain colonial legacies operate in Brazilian justice. This article seeks to understand aspects of the different forms of drug policy and its impact on vulnerable populations, focusing on incarceration in two different contexts, Portugal and Brazil. To this end, it carries out a comparison approach between both the criminal frameworks on drug legislation and official statistics on incarceration, in dialogue with the literature, seeking to find trends that make possible regional inequalities visible. The rights of imprisoned women in Brazil and imprisonment conditions in female prisons are discussed. Research is on the lack of effectiveness of the basic health right of imprisoned women and the deepening of vulnerability of this population within the context of the Covid-19 pandemic. Methodology comprising bibliographical and documental review, coupled to doctrines, legislation, documents and qualified journals is employed. Violations against human and fundamental rights in the prison milieu are recurrent, especially with regard to public health in female prisons. Results show that access to health for vulnerable groups in the prison milieu is wanting, especially with regard to female groups who have their vulnerability inherent to the prison milieu worsened by gender vulnerability. In fact, several specific gender needs are not taken into account, especially the lack of basic sanitary conditions within the context of current pandemic. Research is based on the relevance of the themes, such as the covid-19 pandemic, sanitation, vulnerability, the dignity of the human person, Brazilian prison system, effectiveness of the social basic right to health. The article entitled "State action in the context of public security and justice systems in Brazil in times of neoliberalism and conservatism" aims to analyze the penal selectivity that permeates the State's action in situations of incarceration, discussing the inequalities of class, race/ethnicity and gender historically and socially constructed in the Brazilian reality, showing that, in general, the aforementioned State action has been permeated by structural racism, hierarchical and patriarchal structures and a social control of poverty. Based on a bibliographic and documentary study, the results showed that the retraction of the Social State in the Brazilian reality in times of neoliberalism and conservatism has greatly affected social segments historically marked by poverty, segregation and exploitation, especially from the resurgence of State action through public security and justice systems, which has increased the contingent of incarcerated people, including women, contributing to the deepening of expressions of the social issue, the confrontation of which requires the strengthening of public policies and the promotion of rights to starting from a universalist character. It should also be noted that the private accumulation of capital is related to processes of overvaluation of economic interests, with profound consequences for the working class, especially in times of structural crisis, which has intensified repressive mechanisms. Nowadays, mass incarceration has been presented in Brazil as a mechanism for this repression, based on a penal selectivity that reaffirms historically constructed inequalities, based, above all, on the dimensions of social class, race/ethnicity and gender. This article aims to understand the role of the criminal justice system from the incarceration rates of the past 20 years, interacting economic concept of profit maximization with the criminological discourse of selectivity of the penal system. The discourse transformations in the field of criminal policy, characterized by a constant and strong prosecution, passing "penal welfarism" (correction) the increase in punishment, suffer significant interference from the economic model, in particular modulating the practices of incarceration with private interests, producing a significant increase in incarceration rates, permanent selectivity of action of the penal system and the changes in both the contemporary way of life as the action of the organs and structures of control and criminal justice. This paper addresses the issue of male domination and female incarceration. The work analyzes the mixed prisons -- originally intended for men, but due to an increase in the imprisonment of women, it had to be adapted to receive women offenders: double offending, suffering double or multiple punishments. Our approach, besides the mainly bibliographic references, recurs to empirical evidences obtained from the survey conducted by the Interdisciplinary Working and Study Group on Criminality and Penitentiary, entitled 'A prison within the prison: a vision of female incarceration in the 5th Region Penitentiary in Rio Grande South '. The aim is to assess in which degree the prison stereotypes are reflected in the extramural world, and if this reflexion has influences on the statements of rights, preserving the patriarchal system guarantees only in the theoretical-formal plane, while the everyday sufferings are revealed in the practical and empirical ones.
