This paper describes the methodological changes that occurred across cycles of the Canadian Incidence Study of Reported Child Abuse and Neglect (CIS), specifically outlining the rationale for tracking investigations of families with children at risk of maltreatment in the CIS-2008 cycle. This paper also presents analysis of data from the CIS-2008 examining the differences between those investigations focusing on risk of maltreatment and those investigations focusing on an incident of maltreatment. The CIS-2008 uses a multi-stage sampling design. The final sample selection stage involves identifying children for which (a) there was a concern of a specific incident of maltreatment, and (b) there was no specific concern of past maltreatment but the risk of future maltreatment was being assessed. The present analysis included 11,925 investigations based on specific inclusion criteria. Bivariate and multivariate analyses were conducted to better understand maltreatment and risk only investigations in the CIS-2008. Families investigated for alleged maltreatment, compared to those investigated for future risk, were more likely to live in a home that was overcrowded, live with the presence of at least one household hazard, and run out of money for basic necessities. Younger children were more likely to be the subject of a risk investigation. Caregiver alcohol abuse, household hazards, and certain child functioning issues were associated with an increased likelihood in a finding of substantiated maltreatment. Several primary caregiver functioning concerns were associated with the decision to substantiate risk, as well as household hazards and overcrowding. This study represents the first exploration of a national profile of risk only investigations. The analyses provided an opportunity to examine differences in the profile of children and families in risk only investigations and child maltreatment investigations, revealing several important differences.

A series of recent legal and policy developments in Canada have potential to contribute to reconciliation efforts, particularly related to the overrepresentation of Indigenous children in child welfare systems. However, systematic collection, analysis, and synthesis of research knowledge--particularly, research that is locally grounded--on Indigenous child welfare involvement is notably missing from these efforts. With the aim of collating existing research knowledge on this topic, this scoping review of literature includes a broad swath of literature spanning decades (1973-2018) and countries with similar settler colonial histories (Canada, the United States, Australia, and New Zealand). Our search yielded 881 unique research publications. There was an increase in the number of publications over time in all four countries and a trend toward more empirical literature than non-empirical literature. We found that a plurality of publications focused on programs and services (n = 191), and policy or legal (n = 168) themes. While our review highlights a large base of literature on Indigenous child welfare involvement, it also illustrates the limits of the academic literature in representing the knowledge and experience of Indigenous Peoples and the need for more comprehensive synthesis and broader dissemination of the research related to Indigenous child welfare. These limitations restrict the extent to which existing research can inform the meaningful development of Indigenous child welfare policy in Canada. Due to these gaps, we advocate sustained investment in efforts to synthesize diverse sources of knowledge, support for open source publications, and structural support for Indigenous control of knowledge collection and dissemination regarding policy development related to their communities. Indigenous children are overrepresented in child protection systems in the United States and to an even greater degree in Canada. Canada has recently passed federal child welfare legislation, Bill C-92, with the goal of affirming the rights of Indigenous Peoples and establishing guidelines with respect to child and family services for Indigenous children. The aim of this article is to contribute to ongoing discussions about the recently passed Canadian legislation, drawing on lessons learned in the United States context. The Indian Child Welfare Act (ICWA), passed in the United States in 1978, has created a legislative paradigm, which in some cases has been bolstered by statelevel provisions. The ICWA can provide helpful lessons to consider in Canada as the new legislation is implemented and amended over time. Specifically, we examine elements of the ICWA related to accessibility and compliance with the law, along with deeper analysis of state-level statutes related to adoption provisions in light of the phenomenon of transracial adoption of Indigenous children. As reactions to the Canadian federal law have been mixed, this policy analysis may be supportive of conversations regarding its further development, particularly related to funding and enforcement. On a broader level, considerations of Indigenous community jurisdiction over child and family policies within our discussion are relevant to various settler-colonial contexts. [ABSTRACT FROM AUTHOR]

In 2016, Canada was ordered to implement Jordan's Principle by the Canadian Human Rights Tribunal. In response to the order, Canada created the Child First Initiative to provide federal funding for provincial and territorial organizations supporting First Nations children's health, education, and social service needs, including service coordination. In the shifting national landscape of Child First Initiative funding, there is a lack of evidence on how pediatric healthcare services are addressing the serious health and healthcare inequities experienced by many First Nations children. This paper describes the implementation of a Child First Initiative by the First Nations Health Consortium in the Alberta region and research findings that provide insights into the complexity and challenges of advancing First Nations children's health and health equity within the current federal Child First Initiative mandate in this province. This paper highlights the need for transformative pediatric healthcare approaches that expand beyond an individual and demand-driven system and orient towards practices and policies that are sociallyresponsive. Also, this paper highlights that First Nations leaders and Jordan's Principle initiatives play a leading role in the design and delivery of all pediatric healthcare services with First Nations communities, families, and children across Canada. The health and wellness of Indigenous peoples continue to be impacted by the harmful colonization practices enforced by the Government of Canada. While the long-term health impacts of the Indian Residential School (IRS) system are documented, empirical evidence elucidating the relationship between the IRSs and the risk of offspring experiencing other collective childhood traumas, such as the Sixties Scoop (1950-1990) and the inequities within the child welfare system (CWS), is needed. Through an online study, we explored the links between familial (parents/grandparents) IRS attendance and subsequent involvement in the CWS in a non-representative sample of Indigenous adults in Canada born during the Sixties Scoop era. The final sample comprised 433 adults who self-identified as Status First Nation (52.2%), non-Status First Nation (23.6%), and Métis (24.2%). The study found that adults with a parent who attended IRS were more likely to have spent time in foster care or in a group home during the Sixties Scoop era. They were also more likely to have grown up in a household in which someone used alcohol or other drugs, had a mental illness or a previous suicide attempt, had spent time in prison, had lower mean levels of general household stability, and tended to have lower household economic stability. Moreover, the relationship between parental IRS attendance and foster care was explained, in part (i.e., mediated) by a higher childhood household adversity score. These findings highlight that the intergenerational cycles of household risk introduced by the IRS system contribute to the cycles of childhood adversity and increased risk of spending time within the CWS in Canada. This is the first study among Indigenous adults from across Canada to demonstrate quantitatively that being affected by the CWS during the Sixties Scoop era is linked to intergenerational cycles of risk associated with the IRS system. In Canada, as in other industrialized welfare states, definitions of health system sustainability reflect different goals and correspondingly diverse ways of understanding exactly what is to be sustained and how. In this article, we report on results from a survey of documents and groups involved in and/or concerned about sustainability of the healthcare system. We identify four broad narratives of sustainability in Canadian healthcare reform discourse, and explore what these different sustainability narratives tell us about the character and contours of these often-fractious debates. We argue that sustainability itself may not be a paradigm shift, as has been suggested, but a plot device that helps to steer the story in a particular direction, 'black-boxing' certain aspects of context and emphasizing others. The article focuses on the implementation of Jordan's principle, a child first principle used in Canada named in memory of Jordan River Anderson, a child from Norway House Cree Nation in Manitoba. It highlight factor that contribute to judicial disputes between provincial and federal governments over funding of service for children living on-reserve. It also discusses the court case Pictou Landing Band Council and Maurina Beadle v. Canada, related to violation of Jordan's principle.

Abstract: First Nations (Native American) children are greatly overrepresented in the Canadian child welfare system, and disproportionality in the substantiation of maltreatment contributes to this overrepresentation. This study explores the factors driving disproportionality in the substantiation of maltreatment and, more specifically, neglect. Data from the Canadian Incidence Study of Reported Child Abuse and Neglect (2008) are used in multivariate analyses which examine the relationship between the substantiation of maltreatment/neglect and worker assessments of case, child, household, and caregiver characteristics. These case factors fully explain disproportionality in maltreatment substantiation for First Nations and non-Aboriginal children; the disproportionality reflects underlying differences in the case, child, household and caregiver characteristics identified in First Nations and non-Aboriginal investigations. However, case factors do not fully explain disproportionality in substantiation of neglect-only investigations. Further analysis indicates that the weight that workers assigned to caregiver substance abuse, housing problems, and presence of a lone caregiver when substantiating neglect also differed for First Nations and non-Aboriginal children. Discussion of these findings explores possible explanations for these differences, and links to broader discussions around definitions of neglect and the role of substantiation in child welfare decision making processes. Objectives: The overrepresentation of Aboriginal children in child welfare systems in the U.S., Canada, and Australia is well documented, but limited attention has been paid to investigation-stage disproportionality. This paper examines the overrepresentation of First Nations (the largest of three federally recognized Aboriginal groups in Canada) children, focusing on three questions: (1) What is the level/nature of First Nations overrepresentation at the investigation stage? (2) What is known about the source of referrals in child welfare investigations involving First Nations children? (3) What risk factors and child functioning concerns are identified for investigated First Nations children and families? Methods: The First Nations Component of the Canadian Incidence Study of Reported Child Abuse and Neglect (FNCIS-2008) was designed to address limitations in existing Aboriginal child welfare data: it sampled one quarter of the Aboriginally governed child welfare agencies that conduct investigations in Canada, gathered data on over 3,000 investigations involving First Nations children, and incorporated weights designed for analysis of First Nations data. Bivariate analyses are used to compare investigations involving First Nations and non-Aboriginal children. Results: The rate of investigations for First Nations children living in the areas served by sampled agencies was 4.2 times that for non-Aboriginal children; investigation-stage overrepresentation was compounded by each short term case disposition examined. A higher proportion of First Nations than non-Aboriginal investigations involved non-professional referrals, a pattern consistent with disparities in access to alternative services. Workers expressed concerns about multiple caregiver risk factor concerns for more than ½ of investigated First Nations families and, with the exception of “health issues”, identified every caregiver/household risk factor examined in a greater percentage of First Nations than non-Aboriginal households. Conclusions: It would be extremely difficult to reduce First Nations overrepresentation at later decision points without addressing overrepresentation at the investigation-stage. Despite the serious needs of investigated First Nations families, alternatives to traditional child protection responses may be appropriate in many cases. If First Nations overrepresentation is to be reduced, child welfare agencies must be equipped to provide supports needed to help families address factors such as poverty, substance abuse, domestic violence, and lack of social supports. Aboriginal children are currently overrepresented in out-of-home care in Canada; this extends a historical pattern of child removal that began with the residential school system. The overrepresentation of Aboriginal children persists despite legislative and structural changes intended to reduce the number of Aboriginal children in care. Several recent developments suggest potential for improvement in services for Aboriginal children and families in the near future. However, greater information about the structure of Aboriginal child welfare in Canada is needed to support program and policy development. We present a broad overview of the variation in Aboriginal child welfare legislation and standards, service delivery models, and funding formulas across Canadian provinces and territories. The purpose of this paper is to both describe the major findings from the Canadian Incidence Study of Reported Child Abuse and Neglect, 2008 (CIS-2008), and to compare these findings to data reported by Gilbert et al. (2011), who derived their estimates from the US National Child Abuse and Neglect Data System. The CIS-2008 tracked 15,980 maltreatment-related investigations of children under the age of 16 conducted in a representative sample of 112 child welfare organizations across Canada in the fall of 2008. Bivariate analyses were used to explore the differences in service dispositions, age, and referral sources by primary maltreatment category and risk. The Canadian/US comparison reveals that rates of investigated maltreatment are nearly identical. Rates of substantiated maltreatment are also comparable, although slightly higher in Canada when substantiated risk of maltreatment is included in the substantiation category. The variation in substantiation and service response rates across types of investigated maltreatment requires closer analysis and highlights the need for a detailed understanding of each type of maltreatment. The rapid expansion of reports over the last decade in Canada invites discussion of the extent to which a response focused exclusively on child protection is appropriate for all cases and optimal for addressing a broad array of needs. This article challenges the conventional wisdom that health programs have been largely insulated from welfare state retrenchment. Health care entitlements have in fact been transformed and diminished, albeit in more subtle ways. Employing rhetorical discursive constructions about the nature of social rights, and capitalizing on passive policy drift, reformists have succeeded in altering the right to health care away from a set of collective obligations and toward the competing claims of individuals. As a result, public health insurance programs are abandoning universalistic principles in favor of a narrower conception of rights that is consistent with and supportive of increased privatization of health care financing. Discursive constructions aimed at persuading target audiences to change their ideas aid and abet systemic and institutional factors, making policy changes seem both necessary and inevitable. This article examines the conditions under which policy discourses can serve as contributing factors to policy change, even in the absence of changes in institutions and interests. It begins with a discussion of the role of ideas in policy analysis and how they can play a "constitutive role" as frames for policy. Drawing on a distinction between "augmentative" discourses that serve to reinforce an existing policy framework and "transformative discourses" that seek to persuade various publics of the need for significant policy change, four types of policy discourse are defined and a methodology is suggested for identifying these types. Two of these types, "challenging" and "truth-seeking," are hypothesized to be more conducive to the occurrence of significant policy change. Drawing then on case studies of policy change in Canada and Germany respectively, the article shows that a "challenging" discourse emerges in both countries, but leads to significant policy change only in Germany. Based on the comparison of the two cases, it is argued that three factors are relevant to whether a challenging discourse is successful or not: a broad consensus among core policy actors on the nature and gravity of the policy problem; the consistency of the discourse with broadly held normative values; and the persuasiveness of the "social facts" brought to bear in favour of proposed new solutions. A series of papers using data from the Canadian Incidence Study of Reported Child Abuse and Neglect (CIS) explored the influence of clinical and organizational characteristics on the decision to place Aboriginal children in out-of-home placements at the conclusion of child maltreatment investigations. The purpose of this paper is to further explore a consistent finding of the previous analyses: the proportion of investigations involving Aboriginal children at a child welfare agency is associated with placement for all children in that agency. CIS-2008 data were used in the analysis, which allowed for inclusion of previously unavailable organizational and contextual variables. Multi-level statistical models were developed to analyze the influence of clinical and organizational variables on the placement decision. Final models revealed that the proportion of investigations conducted by the child welfare agency involving Aboriginal children was again a key agency-level predictor of the placement decision for any child served by the agency. Specifically, the higher the proportion of investigations of Aboriginal children, the more likely placement was to occur for any child. Further, this analysis demonstrated that structure of governance, an organizational-level variable not available in previous cycles of the CIS, is an important agency-level predictor of out-of-home placement.
