The Superior Court of Justice of Madrid has rejected the appeal filed by the company Touring Club Eurovillage S.A. against the dismissal of its request for a reduction in the protection easement in the Special Plan PEU-5 Cala Montjoi, in Roses, Girona. The company argued that its establishment, the Vacation City Cala Montjoi, should be considered urban land and benefit from a protection easement of the maritime-terrestrial public domain. However, the court concluded that the land does not meet the requirements to apply the reduction of the easement. The sentence highlights that in order to apply the exceptional reduction of the easement area, the situation of the land and its urban qualification must be clearly justified.
