Abstract

The article presents information on a case Bensley v. Falconstor Software, Inc. of the U.S. District Court, Eastern District of New York, New York in which class action against the defendants was brought by the plaintiffs for violation of Securities Exchange Act. The investor and pension-fund cross-moved for appointment as lead plaintiff and for approval of class counsel. The court ordered accordingly, and the motion for appointment as lead plaintiff was granted.
