The article discusses the Trademark Act which gives protection to well-known marks in Taiwan. The act states that a trade mark the same as or similar to a well-known mark may be refused registration when use of the mark would dilute the reputation of the well-known mark. Moreover, the Court stresses that a higher degree of similarity must exist between the marks concerned and that a well-known mark must have a reputation established among general consumers when applying the doctrine of dilution.
