Abstract

The article discusses the law regarding child custody among divorced parents in Texas. According to the new Texas Family Code, the court may appoint a custodian who must be a suitable, competent adult, or a parent, or an authorized agency, in any suit affecting the parent-child relationship. The Code further states that a parent shall be appointed the custodian of the child unless the court finds that appointment of the parent would not be in the best interest of the child.

Abstract

The article presents a reprint of the article "The Coup de Grâce for Special Issues," by John J. Sampson, which appeared in the 1991 issue of "Saint Mary's Law Journal." It discusses the coup de grâce for special issues in the Texas Department of Human Services (TDHS) versus E. B. case. It provides an overview on the history of special issues from 1913 to 1988. It examines the provision of the rule and its application on the case which involves the termination of parental rights of allegedly abused children.
