Abstract

This paper examines what is known about the link between court decisions and changing school discipline practices; proposes a variety of studies to add to knowledge in this area; and contains suggestions on ways that research findings can be used to improve the ongoing legal education of school personnel. The complex nature of some of the Supreme Court education decisions in the late 1960s and early-to-mid 1970s increased the role of legal commentators in exploring and interpreting decisions. The focus on litigation also diverted attention from other educational issues such as exploring the root causes of school unrest. School law materials need to be specialized and tailored to meet the special issues that are common to particular positions. Teachers need to learn the basic principles of school law and learn of the outcomes of controversial cases involving such issues as educational malpractice. Two tables in the appendixes summarize search and seizure and discipline cases in federal courts and state courts of appeal which were decided between 1979 and 1985. (57 references) (MLF)

Abstract

This chapter focuses on 1981 cases involving students. The author notes that litigation involving pupils occurred with greater frequency in the areas of handicapped students, student testing, and church-state separation. The most important cases involving students concerned circuit courts of appeal decisions in the handicapped and testing areas. Fewer cases addressed issues concerning student transportation and discipline. Desegregation litigation continued. Cases in this chapter are organized under the headings of handicapped and exceptional children, public school assignment, tuition and transportation, bilingual-bicultural programs, private and parochial schools, school sports, substantive rights of students, sanctions for student misconduct, testing and placement, and desegregation. Abstract

Chapter 4 of a book on school law, this chapter focuses on 1979 cases involving students. The author notes that in 1979 most unresolved legal issues in this area involved handicapped children. He finds disagreement among the holdings in these cases about the limits of a district's responsibility to provide special services to the handicapped. It is noted that the Supreme Court rendered several significant decisions in 1979 cases dealing with school desegregation. According to the author, decisions in "Dayton II" and "Columbus" made it clear that the Court was not backing away from approving plans involving substantial busing. In other desegregation cases, the Fifth Circuit Court of Appeals continued last year's trend by becoming more like the other circuits in desegregation decisions. Two new patterns in pupil cases are seen: one regarding cases involving both student testing and bilingual-bicultural programming, and one regarding cases involving athletic association and school sports. It is observed that many sex discrimination charges were raised in 1979. Abstract

Litigation having to do with pupils occurred with greater frequency in 1980 than in the past. The greatest increase dealt with the handicapped and with substantive rights of students. Cases involving handicapped students generally focused on parent requests for residential treatment, extended-year programs, and in-class assistance for their children. The defending school systems argued the adequacy of less costly alternatives to the parent requests. Although several cases reached the federal appeals level, substantial disagreement still exists concerning the definition of "appropriate" placement and treatment. In the substantive rights area, courts are increasingly being asked to rule on the propriety of materials printed in student publications and contained in school libraries. In addition, cases involving religious matters increased as fundamentalist groups and persons opposing those groups resorted to the courts. In the desegregation area, the courts have continued the policy of ordering busing and other system-wide remedies to combat the effects of illegal school segregation. Law suits over such diverse topics as the use of sniff dogs in student searches, gay prom dates, 80-mile bus rides, basketball summer camps, and vaccination exclusions were also dealt with. 5. Creating Conditions for Professional Practice in Education.

Abstract

Educators should know the components of the school situation before they enter the profession. To establish a work setting conducive to professional development, the educator must work within the community, the school district organization, the school itself, the teaching program, and professional development activities. These components should form an interrelated network that enhances and motivates all participants in the educational process. School-based programs can use community or local industry resources, emphasizing the integral part played by the school in the community. Those responsible for providing a range of preservice experiences for prospective teachers should help them become aware of the school climate and how to adjust to it. Through field experiences, student teaching experiences, and supportive counseling in the beginning years, the adjustment to the teaching profession can be effectively monitored. The school climate must be a continual factor in stimulating professional growth if teacher burnout is to be avoided. Such methods as rotating assignments, sharing office space, annual goal-setting, constructive evaluation, and a responsible reward structure can be used to increase and continue professional development. Abstract

This third chapter of "The Yearbook of School Law, 1986" summarizes and analyzes state and federal court decisions handed down in 1985 affecting the legal rights of students in elementary and secondary schools. Among the topics examined are public school pupil assignment, tuition, transportation, compulsory attendance, and bilingual and bicultural programs; the public provision of services to students in private or parochial schools; student participation in athletics and other activities; students' civil rights and civil liberties; sanctions for misconduct; student testing and placement; and the desegregation of schools. The chapter notes that first amendment religion cases assumed increasing importance during the year, that school search cases were heard by several state and federal courts, and that, following a recent trend, local districts continue to claim that desegregation standards mandated by court order have been met.
