Abstract

Committees are often integral parts of national and international political systems, be it to increase the efficiency, the expertise or the legitimacy of decision-making. There are consultative and decision-making committees. By their nature, the former have - similar to many NGOs - access to decision-making arenas which enable them to raise their voice, but they lack formal votes. A state of the art review shows that we know a lot about decisionmaking committees, while there is a gap in our knowledge about consultative committees. This is a pity as consultative committees are common in states and internationally. Hence, this paper analyses the influence of consultative committees. The paper develops a sender-receiver model to inquire to which extent and under which conditions consultative committees can influence policies. In the empirical analysis it draws on the example of the Committee of the Regions and the European Economic and Social Committee, as two prominent consultative committees, and analyses their influence on European policies. Based on a comprehensive survey on the influence of both committees across a variety of policy areas conducted in 2010 and 70 semi-structured interviews, it quantitatively and qualitatively test a series of senderreceiver hypotheses. This reveals that consultative committees are not very influential overall, but that they can exert influence under certain scope conditions, especially if they produce high-quality recommendations quickly, whilst the receivers of their recommendations lack administrative capacities and have flexible preferences. Abstract

The European Economic and Social Committee ( EESC) and the Committee of the Regions ( CoR) are two advisory bodies of the European Union involved in a broad array of policy areas. However, little is known about the effects of the two committees on the positions of the other institutions or final policy outcomes. This article investigates to what extent and under what conditions the CoR and the EESC can exert influence. Based on a comprehensive survey conducted in 2010, a series of hypotheses derived from a neo-institutionalism framework are tested. It is found that consultative committees are not very influential overall. Nevertheless, they can exert influence under certain scope conditions, including the speed with which they produce recommendations, the quality of the recommendations and the resonance with the addressees' prior beliefs. Constitutional courts play an increasing role in policymaking and the concepts of comparative politics. Traditionally, research has focused on the Judicialization hypothesis for European courts. This article argues that there is a major research gap regarding justices' preferences, intra- and inter-institutional rules and that it is necessary to move beyond the Judicialization hypothesis to integrate courts in concepts of comparative politics. Abstract

This article discusses two crucial devices for governmental control of the parliamentary agenda in Germany from the point of view of comparative politics. The vote of confidence procedure makes a contested policy an up-or-down proposal by linking it to the continuity of government, whereas the Gesetzgebungsnotstand gives government a last-offer privilege on a bill. The peculiarities of constitutional norms and political practice of the German procedures are singled out vis-à-vis the expectations assumed by internationally applicable standard rational choice models. It turns out the empirical German-style rules of the devices do not meet requirements being considered important for models to work. In contrast to most other parliamentary democracies, the German design makes the two instruments useful only under very special conditions, which explains why the Gesetzgebungsnotstand has never been used so far and the vote of confidence to control the agenda only on one occasion. Abstract

Courts with the right to constitutional review exert considerable power in a political system. However, especially for Kelsenian constitutional courts there are hardly any large-N studies. This is mainly due to a lack of data. For the German Federal Constitutional Court, this gap has been closed by building a novel database, the development of which is depicted in this book. Employing data from this database, the occurrence of separate opinions in general and their different types in particular are analyzed. The book introduces a new, universal theory that reconciles and expands existing explanations. In a second step, the theory is applied to the German Federal Constitutional Court. It can be proven that one factor that has been neglected so far plays a decisive role: The judges' behavior depends on the profession they pursue after their time in office. Moreover, the study shows that - contrary to the common literature - it is not mainly the topic that determines a case's conflict potential but rather the number of issues a decision has to address.
