In this article the authors share their experiences about partnership learning and teaching approaches they experienced within the open course Creativity for Learning in Higher Education (#creativeHE), linked to the postgraduate module offered by the Centre for Excellence in Learning and Teaching (CELT) at Manchester Metropolitan University in collaboration with the Creative Academic, London Metropolitan University and colleagues from other institutions in the UK and further field, such as the University of Macedonia in Greece for example. Through reflective narratives from student and staff learners on the course, a facilitator and organiser, insights are gained about their experience and lessons learnt are shared that will inform future iterations of #creativeHE and may also be useful for others who consider opening-up courses in higher education.

Professional achievement is not limited to the well-established professions since professional behaviour is required in a wide range of occupations and voluntary work. This situational variety makes the detailed specification of achievement standards (as some are seeking) extremely – and in most circumstances prohibitively – challenging. Approaches to assessment that are rooted in ideas of scientific measurement (which inflect a lot of assessment in contemporary higher education) are inappropriate to the assessment of professional achievement and need to be replaced by an approach based upon professional judgement. This can be characterised in terms of a shift away from realism and towards relativism in assessment. Two consequences are the need to take a critical perspective regarding the merits of technicalities of assessment that reflect psychometric thinking and, where an overall grade is involved, the need to consider the appropriateness of privileging assessments of academic work over those of professional achievement. The challenges faced in work and volunteering range from the routine to the novel. The professional has to deal with both, often in situations in which a ‘good enough’ solution is the best that can be achieved. The assessor has the task of judging the achievement with respect to the prevailing circumstances. Assessors from workplaces often prefer to make broad judgements of achievement. A key issue is the capacity of assessors to make sound judgements. In some areas of higher education assessors are well-versed in assessing professional achievement: in others there is less expertise in such assessing, and hence there is a strong argument for relevant development work. Assessing professional achievement is demanding on resources. Assessment regimes have to be realistic in terms of what is practicable and what limitations follow regarding what can formally be warranted.

Enrique Martinez appeals from the Labor Commission's order, denying his claim for permanent total disability benefits. We reverse and remand.

Ashley J. Bonser appeals from the issuance of a protective order under Utah's Cohabitant Abuse Act, which is codified at Utah Code Ann. §§ 30-6-1 to -15 (1998 & Supp. 2004). Specifically, Bonser appeals the district court's conclusion that he was a "cohabitant" under the Act and therefore subject to its provisions. We reverse and remand.

This case involves a dispute over the annexation into an improvement district of land owned by Utah's School and Institutional Trust Lands Administration and located in Grand County, Utah. Moab Citizens Alliance and some of its individual members appeal from a judgment and order of dismissal entered by the district court. We affirm.

Appellant Nadine Gillmor (Nadine) appeals from several aspects of the trial court's interpretation of an "Easement And Use Agreement" (the Agreement). Appellees and Cross-Appellants Robin and Ken Macey (the Maceys), individually and as owners of Family Link, L.L.C., and David K. Richards & Co. (Richards Co.), likewise cross-appeal from some of the trial court's interpretations of the Agreement. We affirm in part and reverse in part.

J.W. (Father) appeals from a decision of the juvenile court terminating his parental rights. Father specifically argues that the juvenile court required him to establish paternity under the wrong standard of review, the juvenile court denied his right to counsel and his right to receive notification of the proceedings in violation of the Due Process clause of the Fourteenth Amendment, and the findings of fact were insufficient to justify the termination of his parental rights. We affirm.

Petitioner Forest Meadow Ranch Property Owners Association, L.L.C. appeals the trial court's grant of Respondent Pine Meadow Ranch Home Association's motion for summary judgment. Specifically, Petitioner argues that, as a matter of law, Respondent's lien is unenforceable because (1) the 1971 Covenants, Conditions, and Restrictions (the 1971 CC&Rs), as the basis for the lien, violate Utah's statute of frauds, see Utah Code Ann. § 25-5-1 (1998); (2) the doctrine of descriptio personae applies; (3) the 1971 CC&Rs do not run with the land for want of privity; (4) the beneficiary of a trust may not encumber trust property; (5) the doctrine of uniformity applies; and (6) the lien violates Utah's Wrongful Lien Statute, see Utah Code Ann. §§ 38-9-1 to -7 (2001). We affirm.

George and Gerald Lee sued Miles Langley, Robert Thorpe, and Ranger Insurance Co. for false imprisonment, assault, and negligent or reckless endangerment. The trial court dismissed the false imprisonment claims and the jury found for the defendants on the other claims. The Lees appeal various trial court rulings. We affirm.

Plaintiff 3D Construction and Development, L.L.C. appeals the trial court's grant of Defendants'(1) motion for summary judgment. Specifically, Plaintiff argues that the trial court erred by concluding that the doctrines of judicial estoppel and issue preclusion barred Plaintiff's action. We reverse and remand.

C.F. seeks to appeal the juvenile court's order entered after a permanency hearing under Utah Code section 78-3a-312. The order terminated reunification services and visitation, and required the State to initiate the termination of C.F.'s parental rights. In response to the petition on appeal, the Guardian Ad Litem filed a motion to dismiss for lack of jurisdiction, in which the State concurred. We conclude that we lack jurisdiction, but on a different ground than that asserted by the Guardian Ad Litem and the State.

David J. Allen appeals from the trial court's order quieting title in real property in favor of Thomas K. Hall and Homecomings Financial Network, Inc. We reverse in part and affirm in part.

James P. Allen seeks review of the Workforce Appeals Board's (Board) decision that he is ineligible for Trade Adjustment Assistance for Workers (TAA) under the Trade Act of 1974. See 19 U.S.C.A. § 2296 (1998). We affirm.

This case involves a dispute over a strip of land located in Salt Lake County. The trial court ultimately quieted title to the disputed property in Appellee, concluding that a survey based on the metes and bounds description of a deed controlled over the depiction of a natural monument on a subdivision plat map. We affirm.

Frank Amyx appeals the trial court's award of $885 in attorney fees for his claim under the Unsolicited Commercial and Sexually Explicit Email Act. See Utah Code §§ 13-36-101 to -105 (repealed May 3, 2004) (the Act). Columbia House Holdings, Inc. (Columbia House) cross-appeals, arguing that the award must be reduced. The Act awards costs and "reasonable attorney fees" to successful plaintiffs. Id. § 13-36-105(2)(b). We affirm.

Plaintiff Jason P. Arnell asserts that he is entitled to just compensation from Defendants Salt Lake County Board of Adjustment (the Board) and Salt Lake County (the County)(1) (collectively referred to as the County) under federal takings jurisprudence. Alternatively, Plaintiff argues that he is entitled to rescind his land purchase contract with Defendant Truman G. Madsen (Madsen). The trial court granted summary judgment in favor of all Defendants and denied Plaintiff's motion for summary judgment against Defendants. We reverse and remand the trial court's decision as to the County, and affirm the trial court's decision in favor of Madsen and against Plaintiff.

Appellant Matthew Stephen Shipp appeals a conviction for six counts of aggravated sexual assault, first-degree felonies, in violation of Utah Code Annotated section 76-5-405 (1999). We reverse and remand for a new trial.

Neil Steven Pixton appeals from his conviction for felony drunk driving, in violation of Utah Code section 41-6-44(6) (Supp. 2001). We reverse.
