doi: 10.12957/geouerj.2016.15464The objective of this paper is to discuss the advancement of social rights in Brazil, highlighting the right to housing, whose effectiveness does not depend on real estate, but other strategies, among which we highlight the social rent. The experience in the state and city of Rio de Janeiro will be used as the reference of the use of this instrument. The legislation that protects the right to housing will be addressed, as well as its evolution in domestic and international law. There will also be analyzed, some cases arising from the Center for Land and Property Public Defender of Rio de Janeiro, especially after the rains of April 2010, where the social rental policy was widely used among the people who were left homeless. doi: 10.12957/geouerj.2016.15464O objetivo do trabalho é discutir o avanço dos direitos sociais no Brasil, destacando o direito à moradia, cuja efetividade não depende da propriedade imobiliária, mas de outras estratégias, dentre as quais destacamos o aluguel social. A experiência no Estado e Município do Rio de Janeiro será utilizada como referência do uso deste instrumento. A legislação que protege o direito à moradia será abordada, assim como sua evolução no ordenamento jurídico nacional e internacional. A experiência carioca será apresentada com base em alguns casos emblemáticos oriundos da atuação do Núcleo de Terras e Habitação da Defensoria Pública do Rio de Janeiro, especialmente depois das chuvas de abril de 2010, onde a política de aluguel social foi amplamente utilizada entre a população que ficou desabrigada.

There is an ongoing process of increasing urbanization of the world population with socio-spatial polarization in large cities. Such population density increases the competition for urban land, arousing crescent ground rent generation from the central areas, where there is greater availability of urban infrastructure. The outcome of this process has been an extensive growth of these cities, generating costs for the low-income population, forced to take longer trips to get to work centers. It is also represents a cost increment for public administration, responsible for the expansion of urban infrastructure networks. One among the various instruments to face these costs is the urban real estate taxation, which can also fulfill an extra fiscal function, when used to regulate land use. In this article, we aim to analyze urban policy in Brazil regarding the use of the property taxation instrument, arguing its effectiveness in controlling land use. This was an important innovation introduced by the 1988 Federal Constitution and it is associated with private property defense as long as it fulfills its social function. Under these conditions, the main tax levied on real estate assets in Brazil, the Urban Building and Land Tax (IPTU), would be used as an urban policy instrument by foreseeing the possibility of using different rates according to the land's condition (built or not), its destination (residential or commercial), and also predicting progressive rates for properties that do not comply with the social function. Our study takes as reference municipalities with population over 200,000 inhabitants.

Resumo O Brasil esta organizado como uma federacao trina desde que, em 1988, os municipios tornaram-se entes federativos. O fortalecimento institucional do Municipio incluiu a responsabilidade pela execucao das politicas sociais, que eles sao obrigados a co-financiar. Ao longo do tempo, a maior gama de responsabilidades administrativas e financeiras tem indicado os limites da descentralizacao das politicas publicas ja que a maior parte dos municipios nao tem condicoes de atender as expectativas criadas com o seu papel na estrutura federativa. Trata-se de um problema derivado do federalismo simetrico no Brasil, que trata igualmente todos os municipios, sem distingui-los por porte demografico ou funcao na rede urbana. Esse e o contexto em que se estabelece a disputa federativa pela crescente receita que as empresas pagam ao poder publico pela extracao de petroleo. Tal receita deixa de ser percebida como compensacao pelos impactos ambientais e sociais causados pela atividade extrativa e torna-se mais uma transferencia intergovernamental aos entes federativos. Tal situacao tende a torna-los todos mais dependentes desta fonte de receita e, assim, mais sensiveis aos interesses da economia do petroleo, o que diminui o impeto governamental na defesa da politica de substituicao de energia fossil por renovaveis. Abstract Brazil is organized as a federation in three levels including the federal union, states and municipalities since 1988 when municipalities have become federal entities. The institutional strengthening of the municipality included the responsibility for the implementation of social policies which they are required to co-finance. Over time, the larger range of administrative and financial responsibilities has indicated the limits of decentralization of public policies since most municipalities cannot afford to meet the expectations created by its role in the federal structure. It is a problem of the symmetric federalism in Brazil, which treats all municipalities without distinguishing them by population size or function in the urban network. This is the context of the dispute by the increasing federal revenues that companies pay to the government from oil. This income is no longer seen as a compensation for environmental and social impacts caused by extractive activity and becomes an intergovernmental transfer to states and municipalities. This situation tends to make them all more dependent on this source of revenue and thus more vulnerable to the interests of the oil economy, which reduces the government interests to defend the replacement policy of fossil energy by renewable. The municipality in Brazil became a federative entity after the Federal Constitution of 1988, within the context of redemocratisation of the power structures, which included the extension of the citizens rights. In this way, the municipal governments became important actors in these policies, having an effect on the relationships between central and local governments, particularly in matters of tax distribution. The increase in financial autonomy of the municipalities diminished the contributions appropriated by the central government, which faced increasing financial obligations due to the extension of the social rights that were introduced by the current Constitution. These facts led the central government to introduce amendments to the Constitution which included an increased taxation not shared with the state and local governments, as well as a transfer of responsibilities, and a greater financial participation, in the public policies.

Trata-se de um estudo geral do setor de saneamento basico apos a Lei no 11.445/07 que regula o acesso dos servicosde abastecimento de agua, esgotamento sanitario, coleta de residuos solidos e drenagem de aguas pluviaisurbanas. No decorrer do trabalho sao discutidas algumas transformacoes trazidas com a Constituicao de 1988 ea Lei dos Consorcios Publicos. Destaca-se na ultima sessao a apresentacao de um panorama geral da oferta deservicos de saneamento basico no estado do Rio de Janeiro. Palavras-chave: Saneamento Basico. Já foi descrito que o álcool associa-se a distúrbios elétricos cardíacos como prolongamento do intervalo QT. O QT longo, uma alteração incomum entre indivíduos saudáveis (0,0017-2%), pode desencadear taquiarritmias e morte súbita e poderia ser causado diretamente pelo álcool e pela hipomagnesemia desencadeada por ele. MÉTODOS e RESULTADOS: Estudo de associação entre as alterações eletrocardiográficas, clínicas e laboratoriais em alcoolistas ativos comparados a alcoolistas abstinentes há mais de 7 dias e indivíduos não-alcoolistas. Foram avaliados 166 alcoolistas (62 alcoolistas ativos e 104 alcoolistas abstinentes) e 45 não-alcoolistas. Houve maior ocorrência de QT longo entre os alcoolistas ativos do que entre os alcoolistas abstinentes (16% vs. 2% OR 9,81 p = 0,011), enquanto não houve alteração do QT entre os não-alcoolistas. A presença de hipomagnesemia também foi maior entre os alcoolistas ativos (26%) do que entre abstinentes (10% OR 3,11 p = 0,013) e não-alcoolistas (5% OR 6,30 p = 0,022). Os níveis de magnésio sérico mostraram uma relação inversamente proporcional a duração do intervalo QT corrigido entre os alcoolistas ativos (β = - 35,1 ms / p = 0,005). CONCLUSÃO: Houve maior associação de QT longo e hipomagnesemia nos alcoolistas crônicos ativos. O magnésio baixo foi preditor de prolongamento do intervalo QT. Essas alterações poderiam desencadear arritmias fatais, sendo fundamental dar atenção a esta possibilidade diagnóstica, solicitando de rotina eletrocardiograma e dosagem de magnésio sérico no atendimento de pacientes alcoolistas crônicos.

The aim of this article is to reflect on the ill-fated expectations of Brazilian urban policy, much identified with the regulation of urban land use. The present work is based on the premise that urban policy is the dimension of social policy that provides effectiveness to urban planning. Thus, it is fitting that it should be evaluated within a context in which it began to interact with a set of social rights included in the 1988 Constitution. These were the underlying reflections resulting from research, which was conducted through interviews with urban planners who had worked with urban policy in the Municipality of Rio de Janeiro during the 1980s, 1990s and into the 2000s. The main transformations in urban policy and the challenges faced in managing this policy were used as a reference to reflect on the directions taken by Brazilian urban policy.

Resumo: O artigo busca analisar o planejamento urbano, a partir de sua trajetória histórica, apresentando, a cada mudança contextual, os atores que protagonizaram sua elaboração e concretização. Neste sentido, explica as conjunturas que fizeram do médico sanitarista, do arquiteto, do advogado, do empreendedor privado, dos residentes da cidade e do Município atores influentes no planejamento e gestão urbanos. Analisa, ainda, as mudanças do papel do Estado na implementação das políticas públicas, destacando, na experiência brasileira, as conseqüências e perspectivas do reconhecimento constitucional do poder local e o surgimento de arranjos territoriais inovadores que não se limitam à organização federativa e permitem a formulação de planejamentos dirigidos a outras escalas territoriais. Por fim, convida à reflexão sobre os desafios contemporâneos do planejamento urbano diante da insuficiência orçamentária do Estado e da ampliação da atuação do Mercado na execução de políticas urbanas, contrapostos à afirmação da democracia participativa. The article intends to analyze urban planning from its historical trajectory; presenting, to each contextual change, the actors who had carried out its elaboration and concretion. Thus, it explains the conjunctures that made the sanitary doctor, the architect, the lawyer, the privare entrepreneur, the residents of the city, and more recencly the City, influenciai actors in the urban planning and management. It analyzes, social, the changes of the State's role in the public politics implementation, emphasizing, in the Brazilian experience, the consequences and perspectives of the constitutional recognition of the local power and the sprouting of innovative territorial arrangements that are not limited to the federative organization and that allow the formulation of planning directed to other territorial scales. Finally; it invites the reflection the new challenges of the urban planning dueto the State's budgetary insufficiency and to increase of the performance of the Market in the execution of urban policies, opposed to affirmation of the participative democracy. DOI: http://dx.doi.org/10.12957/rdc.2013.9741 Resumo: O objetivo deste artigo e refletir sobre o papel das cidades com populacao superior a 100 mil habitantes na rede urbana brasileira na primeira decada do seculo XXI. Partimos da premissa de que esta em curso uma tendencia de urbanizacao com concentracao da populacao em um numero reduzido de cidades, num contexto de perda de centralidade da Industria. Nesse processo, afirmam-se as metropoles, mas aumenta a relevância de um grupo de cidades de medio porte, parte das quais se tornaram centros regionais e articuladoras do territorio. Estamos chamando esse grupo de “cidades medias nao-metropolitanas”, as cidades com populacao superior a 100 mil habitantes que nao sejam capitais estaduais ou localizadas em regioes metropolitanas. A urbanizacao crescente com maior polarizacao espacial tem sido alimentada pela maior geracao de empregos naquelas cidades, o que torna necessario que sejam implementadas politicas publicas que visem mitigar os efeitos da crise urbana que as metropoles ja experimentam. The urbanization with some spatial polarization has been increased by the employment generation. In this sense, it is necessary to implement public policies to mitigate the effects of the metropolis urban crisis. 10.12957/cdf.2013.9085 O artigo analisa aspectos do impasse da politica urbana brasileira. Por um lado houve um notavel avanco normativo nos ultimos 25 anos, apos a entrada em vigor da Constituicao de 1988, em particular apos a regulamentacao dos novos instrumentos juridicos e urbanisticos pelo Estatuto da Cidade em favor do direito a cidade. Por outro lado, as praticas de politicas publicas urbanas capturadas pelo capital imobiliario se renovaram e vem logrando utilizar a normatividade urbanistica para promover seus interesses atraves da especulacao fundiaria. O resultado e uma distância entre a cidade pretendida pelo plano e a producao da cidade real. Tais reflexoes assumem maior concretude ao serem associadas as praticas em curso, indicando novos desafios a serem enfrentados pela politica urbana. A experiencia de gestao publica da Regiao Metropolitana do Rio de Janeiro e do Municipio do Rio de Janeiro foram utilizados para referir-se as transformacoes recentes no planejamento urbano.
