Society has changed considerably over the past fifty years. Whereas before, most people got married, had several children during the marriage and divorce was still relatively rare, currently, there is much more diversity with different forms of cohabitation. Although this trend is present throughout Europe, there is a large difference in the pace and manner in which the new patterns of society are manifesting themselves there. This article indicates that the same applies to the fiscal recognition of unmarried cohabitants and stepchildren from a married couple and an unmarried couple (‘informal’ stepchildren). In the Netherlands, married and unmarried couples are now treated entirely the same for income, gift, and inheritance tax purposes. This also applies to formal and informal stepchildren. In a European context, the Netherlands is therefore leading the way in recognizing nontraditional cohabitation variants in tax legislation. With this article, the author not only discusses the tax treatment in various European countries but also the possible arguments for (not) equating them. The author hopes to contribute to the discussion of whether extra-marital cohabitation and other related relationships should be treated in the same way for tax purposes as relationships that arise through marriage.

Op 11 december 2020 is de Handreiking vaststellen compensatie ter voorkoming van een belaste schenking bij uitfasering pensioen in eigen beheer (hierna: de Handreiking) gepubliceerd. Het tijdstip van publicatie is enigszins verwonderlijk. De uitfasering van het pensioen in eigen beheer is afgerond in 2019. Het is uitermate bijzonder dat een jaar na de uitfaseringsperiode, maar zelfs drie jaar na het geven meeste adviezen, alsnog een handreiking verschijnt in dit kader. Betekent dit nu dat eerder gegeven adviezen heroverwogen moeten worden?

De centrale vraag van dit tweeluik is of het Vereenvoudigingsrapport, onderdeel van het ambtelijke Bouwstenenproject, daadwerkelijk kan bijdragen aan fiscale complexiteitsreductie. Waar wij in het eerste deel meer algemene oorzaken en gevolgen van fiscale complexiteit hebben geanalyseerd, richt dit tweede deel zich op de opzet en inhoud van het Vereenvoudigingsrapport en de bijbehorende voorstellen in de vorm van fiches. Daarbij zal ook het beleidsinstrumentele gebruik van het belastingstelsel worden onderzocht. Aansluitend bespreken we – naast een aantal algemene remedies tegen complexiteit – ook summier meer structurele oplossingen bespreken om het instrumentalisme terug te dringen om zo tot vereenvoudiging van wet- en regelgeving te komen. Het grote probleem blijft echter de maakbaarheidsideologie. Als deze houding ten opzichte van de belastingwet niet verandert, zo concluderen wij, blijft het water naar de zee dragen.

Het ambtelijke Bouwstenen-project doet tal van voorstellen voor een ‘beter belastingstelsel’. Rapport 11 van dit project is getiteld ‘Vereenvoudiging belastingstelsel.’ Het rapport bevat twee soorten vereenvoudigingsvoorstellen. Enerzijds worden vanuit het perspectief van een doelmatige uitvoering en handhaving van wetgeving door de Belastingdienst voorstellen gedaan die diverse belastingwetten raken. Daarnaast worden voorstellen gedaan om het beleidsinstrumentele gebruik van de belastingwet te verminderen, hetgeen natuurlijk ook leidt tot minder druk op de Belastingdienst. Het rapport doet daarmee opnieuw een oproep om het overmatige beleidsinstrumentele gebruik van de belastingwet op een laag pitje te zetten. Dit instrumentalisme is weliswaar een belangrijke oorzaak van wetgevende complexiteit leidend tot grote uitvoerings- en handhavingsproblemen, maar er zijn ook andere oorzaken. Complexiteit wordt immers ook gevoed door het almaar wassende aantal regels en door regelverfijning. In dit deel [1] analyseren wij enige oorzaken en gevolgen van fiscale complexiteit en het onderliggende fiscaal-juridische spanningsveld

As a result of the 2008 financial crisis government had to make substantial cuts in public expenditures. Austerity measures can be considered to be one of the explanations behind a decreased confidence in the government. Furthermore, several tax-related scandals and leaks (for example the so-called Panama Papers and Paradise papers) got much media coverage. The message often was that multinational corporations are not paying their fair share, compounding Treasury’s condition, and tax authorities are too cosy in their dealings with these multinationals. As a result, trust in government, the tax administration in particular, the (international) tax system and large (multinational) corporations diminished. Many actors see greater transparency of the tax system as critical to rebuilding trust in the international tax system – disclosure providing information evidencing that multinational corporations pay a fair share of taxes. Since the demand for increased transparency regards particularly tax authorities, on the one hand, and large corporations, on the other, two types of trust are distinguished. Institutional trust refers to trust in institutions, such as the tax authorities and social or interpersonal trust is about trust in other (corporate) members of society. Since trustworthiness is a prerequisite of trust, we’ll investigate how transparency can promote trustworthiness of tax authorities and multinationals. The first part this paper offers theoretical considerations on various elements, types, and paradoxes of transparency and trust. Subsequently a brief analysis is made of several recently introduced hard and soft law initiatives which are aimed at greater transparency to promote trustworthiness of tax authorities and multinationals. The second part comprises an exploratory study by the Dutch tax authorities on transparency. This empirical research is focused on the question how the Netherlands Tax and Customs Administration (NTCA) can deal with the increasing demand for transparency towards society. This second part focuses on the subject of transparency in regard to the particular context of tax administration and tax enforcement.

De toeslagenaffaire heeft laten zien hoe door collectief falen van de betrokken instituties vaak kwetsbare burgers zijn vernederd. Hoe fatsoenlijke belastingheffing te waarborgen? Dat vraagt om institutionele veranderingen ten behoeve van betere belastingregelgeving en haar toepassing en ruimte voor professionele deugden.
