By analyzing various sources of law, this paper provides an assessment of the method of automated administrative order that is used in Lithuania, its potential problematic risks, determined due to the chosen legal regulation, as well as the European vision of integrating technology in the implementation of the public functions of the state. After evaluating the provisions of both national law and European Union law, a proposal regarding how to improve the chosen method of incorporating algorithms into the process of adopting certain administrative orders is made.

The Philippines, with the recent discovery of an archaic hominin in Luzon and an extensive ethnolinguistic diversity of more than 100 Indigenous peoples, is crucial to understanding human evolution and population history in Island Southeast Asia. Advances in DNA sequencing technologies enable the rapid generation of genomic data to robustly address questions about origins, relatedness, and population movements. With the increased genetic sampling in the country, especially by international scientists, it is vital to revisit ethical rules and guidelines relevant to conducting research among Indigenous peoples. Our team led fieldwork expeditions between 2019 and February 2020 in Zamboanga and the Sulu Archipelago, a chain of islands connecting the Mindanao and Borneo landmasses. The trips concluded with a collection of 2,149 DNA samples from 104 field sites. We present our fieldwork experience among the mostly sea-oriented Sama-Bajaw and Tausug-speaking communities and propose recommendations to address the ethical challenges of conducting such research. This work contributes toward building an enabling research environment in the Philippines that respects the rights and autonomy of Indigenous peoples, who are the rightful owners of their DNA and all genetic information contained therein.

COVID-19 pandemic in Latvia has activated several types of criminal threats. Their range also included criminal threats to the administration existing in Latvia, which have been explored in detail in this article. The author has highlighted three topical groups of criminal threat in the field of administrative order: 1) threats, expressed as counter-activities against the person, who participates in elimination or termination of illegal commitment driven towards COVID-19 restrictions; 2) threats expressed as violations of the procedure determined for processing of documents in the field of COVID-19 restrictions; 3) threats expressed as violation of special regulations in the field of COVID-19 restrictions. Having paid attention to each separate group, the author has studied not only the case law, but also amendments to the Criminal Law planned and implemented by the legislator, analysing the positive and negative aspects of the amendments. The study revealed that the repressive approach of the state, implemented within the framework of control of the restrictions for spread of the COVID-19, lead to the situation, where not only the need was discussed to recognise the offences not yet deemed as criminally punishable, but where the legislator still considered it necessary to supplement the special part of the Criminal Law with new norms, thus expanding the types of expression of criminal offences.

Straipsnyje analizuojama problematika, susijusi su automatizuoto administracinio nurodymo taikymu. Pirmoje straipsnio dalyje autorė analizuoja automatizuotų administracinių nurodymų sampratą. Antroje straipsnio dalyje kritiškai įvertinamos problemos, kylančios dėl pasirinkto automatizacijos panaudojimo priimant tam tikrus administracinius nurodymus būdo. Trečioje straipsnio dalyje automatizuotų administracinių nurodymų kontekste apžvelgiama Europos Sąjungos vizija dėl technologijų integracijos viešajame sektoriuje. Atitinkamai pateikiama siūlymų, kaip patobulinti automatizuotų administracinių nurodymų priėmimą, kad jis atitiktų Europos Sąjungos viziją bei būtų eliminuojamos esamo reguliavimo lemiamos rizikos. The subject matter of this paper is to analyze issues related to the application of an automated administrative order. The first part of the paper analyzes the concept of automated administrative orders. In the second part of, the author critically evaluates problems arising from the chosen method of using automation when adopting certain administrative orders. The European Union’s vision for technology integration in the public sector in the context of automated administrative instructions is analyzed in the third part of this paper. Accordingly, the author suggests how to improve the current process of adopting automated administrative orders to reflect the vision of the European Union’s regulation and to eliminate the risks posed by the existing regulation. 7. French Cities' Struggle Against Incivilities: from Theory to Practices in Regulating Urban Public Space.

In France, public policies began defining 'incivilities' as a primary topic and target to focus on more than two decades ago. Yet what this term actually means is still somewhat unclear: almost every organization that uses it has its own definition, sometimes its own observatory. Despite, or perhaps because of, its very vagueness, the concept has become widely shared and used, securing itself a place on the agendas of most local security policies, becoming an explicit part of the remits of an increasing number of professionals, from police officers to social workers, including a wide range of municipal agents. The range of situations and behaviors potentially included in the list of 'unruly conduct' is seemingly endless, from groups of teenagers hanging out to homeless people privatizing public places, and from using playgrounds as public toilets to noise, garbage, dog fouling, graffiti, queue-jumping, pushing and shoving, street harassment, insults of all kinds, badly parked cars, and so forth. However, not all of them provoke the same public attention. This article focuses on the way disorders are actually defined, measured, and dealt with in practice. Incivilities are often said to be growing because of increasing powerlessness. Our research proves action is far from being merely correlative to the legal capacity for sanction. 8. Conceptualizing the European multilevel administrative order: capturing variation in the European administrative system.

Acknowledging that both analysts and practitioners face problems of meaningful categorization of social order in general, and the European political-administrative system in particular, this article suggests a conceptual frame through which European administrative order may be understood. Providing such a frame is important, because the catalogue of categories of the European Union (EU) polity developed so far fails to acknowledge its administrative dimension. Given that the ongoing political transformation in the EU implies ever more administrative interaction between political levels in order to coordinate, manage and implement policies, this administrative dimension becomes ever more important. This article thus sets out a threefold agenda: First, it offers a supplementary conceptual frame that takes the ‘administrative dimension’ seriously. It is suggested that the European politico-administrative organism should be conceived as a European multilevel administrative system (MLA) consisting of three dimensions: Institutional independence, integration and cooptation. Second, the article suggests how the MLA approach differs from one of its main conceptual rivals – the multilevel governance approach (MLG). Finally, the article offers some empirical illustrations of the value of the developed MLA approach for our understanding of the contemporary European administrative system. [ABSTRACT FROM PUBLISHER]

Este artículo analiza el recurso o acción contenciosa administrativa especial de amparo de acceso a la información pública, establecida por la L. Nº 19.653, de 1999, desde una perspectiva teórica y dogmática. Luego de analizar los aspectos teóricos de lo contencioso administrativo y el sistema chileno de acciones o recursos especiales contencioso administrativos, los autores se detienen en el estudio de la responsabilización de la Administración y los agentes públicos, todos los cuales proveen el marco para el estudio de la mencionada acción judicial en el contexto del ordenamiento jurídico chileno. Finalmente, basados en estos elementos, los autores presentan un estudio de la acción judicial señalada, cuya finalidad y características la distinguen en el campo de lo contencioso administrativo nacional.This article analyzes the special legal action to seek injunctive relief as to the right of access to government information enacted by the 1999 Act N° 19,653, both from a theoretical and dogmatic viewpoint. After analyzing the theoretical aspects of administrative litigation and the Chilean system of special legal actions pertaining thereof, the authors focus on the issue of government and public agents accountability. These topics provide a framework to understand the aforementioned legal action in the Chilean legal system. Based on this theoretical backdrop, the authors comment on the procedural law issues involved in that legal action whose object and characteristics set it apart in the Chilean system of administrative litigation.

Tujuan penelitian ini adalah untuk mengetahui pelaksanaan manajemen pengelolaan arsip dinamis, kendala-kendala pada saat pelaksanaan manajemen pengelolaan arsip dinamis, dan usaha-usaha yang dilakukan dalam mengatasi hambatan pada pelaksanaan manajemen pengelolaan arsip dinamis di SMK Widya Praja Ungaran. Sumber data pada penelitian ini diperoleh melalui tatap muka langsung dengan informan. Alat yang digunakan yaitu perekam dan kamera. Teknik pengumpulan data dengan cara observasi, wawancara, dan dokumentasi. Metode analisis data menggunakan teknik analisis interaksi meliputi reduksi data, penyajian data, dan menarik kesimpulan. Prosedur penelitiannya terdiri dari tahap pra lapangan, pekerjaan lapangan, dan analisis data. Hasil penelitian menunjukkan bahwa pelaksanaan manajemen pengelolaan arsip dinamis sudah baik, kendala yang dihadapi yaitu hilangnya arsip berupa surat yang diambil oleh guru setempat tanpa melapor dan tidak mengembalikan ke tempat semula, dan usaha yang dilakukan dalam mengatasi kendala yang ada yaitu dengan menanyakan arsip yang hilang pada guru setempat dan membuat peraturan untuk menulis pada buku surat bagi yang akan meminjam arsip, serta mensosialisasikan prosedur peminjaman arsip. The purpose of this study is to investigate the implementation of archive management, the constraints in the implementation of archive management, and efforts were made to overcome barriers to the implementation of archive management in SMK Widya Praja Ungaran. The data source in this study was obtained through face to face with the informant. Tool used is the recorder and camera. Data collection techniques by observation, interviews, and documentation. Methods of data analysis using interaction analysis techniques, include data reduction, data presentation, and draw conclusions. The procedure consists of a pre research field, field work, and data analysis. The results showed that the implementation of archive management has been good, the constraints faced by the loss of archives in the form of a letter which was taken by a local teacher without the report and does not return to its original site, and the work done in overcoming the existing obstacles, namely by asking the missing archive on local teachers and make regulation to write the letter for the book to be borrowed archive, and disseminate lending procedures archive.

12. An Analysis of the Legal Provisions and Legal Legislation on Administrative Orders.

Order provisions, a common part of the current law, can be divided into provisions of judicial order and those of administrative order. The provisions of administrative order can be further divided into inner order actions and external order actions. An examination of the connotation of the administrative order action may lead to the establishment of specific standards, with the help of which the external order actions can clearly be classified into penalty order actions and non-penalty order actions. It is necessary to classify order actions before their nature can be determined. The nature of "ordering for suspension" can be classified from the following three aspects. First," ordering for suspension" with a penalty nature can only be made after legal qualification has been obtained. Secondly, the overall suspension of the party's business shall be classified as penalty order action, while the order to suspend illegal business shall be classified as non-penalty order action. Finally, ordering to suspend non-production and non-business activities is not equal to ordering for suspension of production or business, nor does it have the attributes of administrative penalty. The nature of other order actions can be judged from the punitive features of the administrative penalty. Generally, the structure of legal legislation is composed of three elements: the assumed element, the processing element and the sanctionative element. According to the structure of the" sanctionative element in the order provision, non-penalty order actions are categorized into five types, namely, unconstrained single order structure, constrained single order structure, selecting punishment structure, conditioning punishment structure and punishment structure. Different types of structure reflect different functions of regulation. The current provisions of administrative order have some demerits, such as inaccurate term definition, unreasonable structure choice, and unscientific action establishment. Specifically speaking, the order in some provisions applies to the parties with no relationship of subordination or management, which goes against both the general meaning and specific meaning of "order." Some provisions do not take into account the structure function and applicable cases of the "sanctionative element, which results in the unfair legislation. Some provisions do not distinguish the function of administrative order from that of administrative penalty, and do not take into account the sanction strength of specific administrative orders and administrative penalties. It is necessary to construct a typical model for administrative order to make the administrative legal provisions more unified, normative and scientific. The typical model for administrative order should obey two principles: fully embodying the remedial function of order actions and ensuring the execution of administrative order. In the combined order provisions, administrative orders become the assistant measures of other administrative actions, and are absorbed by other administrative actions in procedures and relief-granting. The provision of "unconstrained single command structure" does not include the legal consequence of failing to perform the administrative order, which greatly weakens its authority and executive effect. Therefore, "the constrained single command structure' should be taken as the typical model of administrative order, that is, administrative order + ' refused to ⋯ ' + sanctions." The key parts of typical model are "administrative order and 'sanctions. The major function of the "sanctions" is ensuring the performance of administrative orders. El presente libro es el resultado de las investigaciones emprendidas en la Facultad de administración de empresas en el desarrollo de sus tres líneas de investigación: Economía, Empresa y Región; Emprenderismo y Gestión Pública. Se trata de estudiar la tensión existente entre mercado y humanismo con la necesidad de generar procesos de transformación de las condiciones económicas de sectores poblacionales menos favorecidos. La intervención en procesos que promuevan el desarrollo económico con niveles de distribución equitativa de la riqueza. La participación y la organización socio-econó-mica juegan un papel importante en la generación de mayo-res niveles de calidad de vida de las personas, las familias y los grupos poblacionales. El grupo de Economía, Empresa y Región, propicia y motiva la formulación y ejecución de proyectos de investigación que permitan adquirir nuevo conocimiento sobre la actividad económica regional que facilite la generación y desarrollo de ideas de negocios exitosas y soluciones a problemáticas territoriales concretas por parte de los futuros profesionales de Ciencias Administrativas y Contables. El segundo capítulo propone una investigación en la misma línea de Economía, Empresa y Región titulado “El Conocimiento, Inductor del Desarrollo Sostenible: Una Experiencia en el Sector Lechero de Boyacá.” de la investigadora Luri Suárez Pineda y Marlén Suárez Pineda, se trata de “un ejercicio de investigación de enfoque cuantitativo, con una lógica de razonamiento inductivo, se aproxima a la cotidianidad de una comunidad de explotación lechera, reconociendo sus prácticas de gestión del conocimiento y de producción sostenible, con el propósito de identificar si existe o no algún relacionamiento entre las dos variables. A través de las técnicas de cuestionario y observación in situ, se toman los datos según dimensiones que emergen de la revisión teórica, para hacer un análisis de tipo racional aplicando el índice de correlación Pearson.” Se evidencia que la variable gestión del conocimiento tiene comportamiento influyente sobre la variable de desarrollo sostenible, y se guardan una relación positiva, lo que permite formular la proposición que a mayor gestión del conocimiento se obtiene mayor uso de prácticas de producción sostenible. Los estilos de vida y comportamiento del consumidor son diferentes, las ideas novedosas juegan un papel fundamental en el desarrollo empresarial.” (García 2017) En el capítulo cuarto, en la línea de Gestión Pública, se presenta la Investigación titulada “Impuesto Departamental al Consumo en Boyacá para el Año 2017 Respecto a Vigencia Fiscal Anterior Frente a la Aplicación de las Leyes 1801, 1816 Y 1819 de 2016” de Elina Ulloa Sáenz, Carlos Andrés Aranda Camacho y Luis Rodrigo Ramírez Ahumada. La investigación aplicada en un grupo de grandes contribuyentes de impuesto al consumo en el Departamento de Boyacá manifiesta una significativa reducción en las ventas del primer trimestre del año 2017, señalan como causa la en-trada en vigencia del Código Nacional de Policía y Convivencia Ciudadana “Para Vivir en Paz”, la Ley 1819 de 2016 o Reforma Tributaria y a la Ley 1816 de 2016 o Ley de Licores. La Secretaría de Hacienda del Departamento con el fin de conocer el impacto social de los sectores comerciales en relación con el pago de los tributos departamentales, desarrolló un estudio de opinión en establecimientos comerciales con el fin de establecer el comportamiento de las ventas de cigarrillos, cervezas, vinos, licores y similares durante el primer trimes-tre del año 2017. Se encontró que para la mayoría de los comerciantes las ventas han disminuido significativamente y que señalan como causa las medidas del Código de Policía o de los Decretos Municipales que regulan las ventas de los mencionados productos. 17. Points to Consider Regarding the Administrative Order on Dismissal of Executives of Money Lenders

Due to the Act revising a part of the Money-Lending Business Control and Regulation Act (Act No.115 of 2006), an administrative order was established in Money Lending Business Act concerning dismissal of executives of money lenders. In this paper, the following three points are discussed with regard to the adequacy of this administrative order : First, whether this system infringes private autonomy ; second, whether this system is necessary in relation to the internal control structure requested of money lenders under laws ; third, whether this system is rational in reference to the objective to break off the relations with antisocial forces. To conclude, this system seems to have the risk of infringing private autonomy, and furthermore, lacks both necessity and rationality. The present revision to the law was implemented with a great deal of fervor, with some parts of the revision not having been sufficiently examined, and supervision over the appropriate enforcement is essential.

2011 m. sausio 1 d., įsigaliojo Administracinių teisės pažeidimų kodekso (toliau – ir ATPK) pakeitimai, įtvirtinantys administracinio nurodymo institutą. Šio instituto įtraukimą į nacionalinę teisės sistemą sąlygojo keletas priežasčių, tai ir siekis bent iš dalies išspręsti nuolat eskaluojamą klausimą, dėl ypatingai didelio teismų darbo krūvio, ir noras pagreitinti administracinių teisės pažeidimų bylų procesą dėl mažiausiai pavojingų veikų, ir galimybė efektyviau surinkti į valstybės biudžetą lėšas, už paskirtas administracines nuobaudas. Straipsniu siekiama išanalizuoti administracinio nurodymo turinį, jo taikymo sąlygas. Atskleidžiami teisinio reguliavimo trūkumai, kurie susidarė įvedus šį institutą, tačiau nepakoregavus, nepapildžius iki tol galiojusio teisinio reguliavimo. Pasitelkiant konkrečias bylas, siekiama nustatyti, ar taikant administracinio nurodymo institutą praktikoje, pasiteisino įstatymų leidėjo, įstatymo iniciatorių ir rengėjų tikslai, ar šis institutas, jo turinys, tinkamai suprastas ir aiškinamas tų subjektų, kuriems pagal kompetenciją priklauso jį taikyti. Pateikiami siūlymai dėl esamo teisinio reguliavimo tobulinimo. The institute of administrative order is applicable in many states when less dangerous administrative violations are made. Until January 1, 2011, all administrative legal offences regadlessof their gravity degree were investigate according a common procedure in Lithuania. Only after the alterations of the Code of Administrative Violations, adopted in November, 18, 2010, came into force and the institute of administrative order was established, the possibility to avoid the long process of investigation and examination in cases when less dangerous violations are made appeared. As a consequence of adoption of this institute, the workload of the courts and other institutions, authorized to investigate and examine administrative violations, was reduced; the costs are saved due to the shortage of the administrative violation case procedures. The essence of administrative order is that it is offered for the person within ten working days from the date the protocol of administrative violation is presented (in cases when the violation is recorded not in the presence of the person suspected in performance of administrative violation – from the date the administrative protocol together with the administrative order are sent) to pay half of the minimal fine (but not less than ten litas), established in one of the articles foreseeing liability for administrative violations in Chapter II of the Code, on voluantary basis. Administrative order may be issued not in all cases, only when all conditions applied to issuance of administrative order are satisfied. Anyhow, when applying this institute in practise a few problems arose: not all subject having competence to apply administrative order are capable to properly identify the monetary amount of administrative order in specific cases, when the sanction of article of the Code, where a particular violation is described, does not foresee minimal fine; it is not clear if a person who violated specific article and paid the fine indicated in the administrative order, is presumed as being punished by administrative liabilty; is it possible to apply administrative order in cases when a specific sanction of the article of the Code foresee the only sanction – the warning; is it possible to apply administrative order in cases when the alternative penalty foreseen in the particular santion is not only a fine or warning; by what means the subject issuing administrative order may receive the information about previous punishments of the person, and the information whether the person has paid the fine prescribed by the administrative order. All those problematic issues are discussed in the article. It is analyzed whether the aims of the legislative subjects and initiators of this norm where reached in practice. The authors of the article present proposals for improvement of legal regulation and solution of the above-mentioned problems.

Teise maailmasõja aegne Saksa okupatsioon on olulisel määral kujundanud Eesti lähiajalugu ja inimeste suhtumist ning arusaama sellesse. Samas on perioodi käsitlemine akadeemilises ajalooteaduses olnud seni äärmiselt tagasihoidlik. Käesolev uurimus analüüsib Saksamaa totalitaarse süsteemi administratiivõiguse käsitust okupeeritud Eesti halduskorralduse näite varal, tuues võrdlusi sündmustega Lätis ja Leedus. Eesti ei osalenud riigina Teises maailmasõjas, kuid sellegi poolest tegutsesid Eestis haldusvõimu taastamisel Saksa sõjaväe- ja tsiviilasutuste kõrval kolm selgelt eristuvat omamaist osapoolt. Jüri Uluotsa ümber kogunenud rahvuslikud poliitringkonnad ja omaalgatuslikult tegevust taastavad kohalikud omavalitsused lähtusid oma tegevuses Eesti Vabariigi seadusandlusest. Kolmanda osapoole moodustasid Hjalmar Mäe ümber koondunud saksasõbralikud tegelased (hilisem nn Eesti Omavalitsus), kes tegutsesid otseselt Saksa võimude usaldusisikutena. Neist kaks, kohalikud omavalitsused ja H. Mäe juhitud Eesti Omavalitsus, kujundati ka formaalselt Saksa tsiviilhalduse täitevvõimu asutusteks. Sõja kestel välja kuulutatud reformid deklareerisid halduskorralduse lihtsustamist ja otsustusprotsessi viimist madalale tasemele. Tegelikkuses toimus riigivõimu edasine tsentraliseerimine ning Eestis toimivat halduskorraldust asuti ühtlustama Reichis kehtiva korraga., The German occupation during the Second World War has had a significant effect in shaping Estonia’s recent history and people’s attitudes towards and understanding of that history. At the same time, the treatment of this period in academic historical research has been extremely modest thus far. This dissertation analyses how Germany’s totalitarian system treated administrative law according to the example of the administrative order in occupied Estonia, with comparisons to events in Latvia and Lithuania. Estonia did not participate as a country in the Second World War, yet three clearly distinct local groups were nevertheless active alongside German military and civilian institutions in restoring administrative authority in Estonia. Nationalist political circles that assembled around Jüri Uluots, and local governments that began functioning again on their own initiative based their actions on legislation of the Republic of Estonia. The third participating group was formed by pro-German figures (the later so called Estonian Self-Administration) who assembled around Hjalmar Mäe and acted directly as the confidants of the German authorities. Two of these groups, the local governments and the Estonian Self-Administration headed by H. Mäe, were also formally formed into institutions of executive power in the German civilian administration. Reforms announced during the war declared the simplification of the administrative order and that the decision-making process was being brought to a lower, more local level. In actual fact, the continued centralisation of state power took place and the authorities set about harmonising the administrative order functioning in Estonia with the order in effect in the Reich.

Concomitantemente, deu-se um deslocamento populacional para essa área em busca das catas de ouro e de terras para o plantio. Nesse movimento, estabeleceu-se o povoado de N. S. da Conceição do Rio Pardo, que em 1775 foi elevado a freguesia. Esse núcleo populacional correspondeu aos limites da Vila de Caconde (SP) que, no início do século XIX, centralizou os bairros rurais surgidos nas suas proximidades. A integração desse espaço ao território paulista foi acelerada pela expansão da agricultura de exportação na região paulista conhecida como quadrilátero da cana. Transformação essa que se dera no final do século XVIII, possibilitada pela economia de abastecimento interno desenvolvida em algumas regiões de São Paulo, a partir do século XVII. O surgimento de práticas agrícolas voltadas ao mercado internacional ocorreu, sobretudo no período pombalino e no governo de Morgado de Mateus. Quando D. José I assumiu o trono de Portugal, uma série de medidas foram tomadas com o objetivo de que o país alcançasse a riqueza de nações como a Inglaterra e a França, fortalecendo também sua presença na América Portuguesa. Nesta última, as políticas que objetivavam esse avanço se deram grandemente em torno do fomento agrícola, que aos poucos começou a surtir efeito, sobretudo nas regiões do Centro-Sul. Foi esse o caso da Capitania de São Paulo que, entre 1760 e 1770, passou a registrar seus primeiros produtos agrícolas para exportação pelo porto de Santos The settlement of Rio Pardo headwaters region, which nowadays corresponds to cities located in the state of São Paulo such as: Caconde, São José do Rio Pardo, São Sebastião da Grama, Mococa Tapiratiba and Divinolândia, started in 1765; this was year when the governor of Sao Paulo, Luis Antonio de Souza Botelho Mourão, the Morgado de Mateus (his noble title), sent a stagecoach in order to find gold in this site and also in order to secure the possession of the region. There was, at the same time, a population shift to this area, which consisted of people in search of gold and land for planting. In this movement, the village of N. S. Conceição do Rio Pardo was established, which, in 1775, became a municipal sub-district. This population center corresponded to the limits of the Caconde Village (SP) which was, during the early nineteenth century, the center of the rural districts which appeared in its vicinities. The integration of this space to the São Paulo state area was accelerated by the expansion of export agriculture in the region of the state of São Paulo which was known as the cane quadrangle. This transformation had occurred in the late eighteenth century, and it was made possible by the development of an economy of domestic supply in some regions of São Paulo, which had begun in the seventeenth century. The emergence of agricultural practices geared to international markets occurred primarily in the pombalino period and during the government of Morgado de Mateus. When D. Joseph I assumed the throne of Portugal, a number of measures were taken so that the country of Portugal would be able to reach the same wealth of nations such as England and France; thus, strengthening its presence in the Portuguese America. In the latter, the policies aimed at advances were largely due to the promotion of agriculture, which gradually began to yield results, especially in South-Central regions

RESUMEN Este artículo analiza, críticamente, algunos vicios de inconstitucionalidad que existen en la regulación legal del principio de la publicidad de los actos administrativos y de los documentos que les sirven de sustento o complemento directo y esencial, luego de la promulgación de la ley N° 19.653, mejor conocida como la "Ley de Probidad", en 1999. Luego de pasar revista al alcance del derecho de acceso a los actos e información administrativa, configurado a partir del principio antedicho, este artículo analiza algunas normas jurídicas posteriores, reglamentarias y legales, que tratan sobre el principio de publicidad administrativa, para establecer una visión general sobre el citado derecho. En este contexto, este artículo también trata acerca de los antecedentes jurídicos (constitucionales, legales, reglamentarios, dogmáticos y jurisprudenciales) que permiten identificar dichos vicios y finalmente formula algunas reflexiones sobre el tema de la publicidad y el secreto administrativoABSTRACT This article critically analyzes some unconstitutional defects that exist in the statutory norms on the principle of publicity of administrative orders and its direct and essential supporting or complementary documents, after the enactment of the 19.653 Act, better known as the "Probity Act", in 1999. After reviewing the scope of the right of access to administrative acts and information, based on the aforesaid principle, this article draws from some subsequent juridical norms both statutory and regulatory which deal with the principle of government publicity, to come up with a general view on the aforementioned right.
