1. Regulatory Fragmentation: An Unexamined Barrier to Species Conservation Under Climate Change

Abstract

Requirements for the protection or restriction of species are based on regulatory classifications such as “native” or “invasive,” which become anachronistic when climate change drives species outside of their historical geographic range. Furthermore, such regulatory classifications are inconsistent across the patchwork of land ownership that species must traverse as they move between jurisdictions or when transported by humans, which obstructs effective regional management. We surveyed the U.S. laws and regulations relevant to species movement and found that the immigration of species to new jurisdictions makes paradoxical existing regulatory language that sets the categories of species deserving protection or removal. Climate change is universal and progressing rapidly, which provides a shrinking window to reconcile regulatory language originally developed for a static environment.

Abstract

The speed and uncertainty of environmental change in the Anthropocene challenge the capacity of coevolving social–ecological–technological systems (SETs) to adapt or transform to these changes. Formal government and legal structures further constrain the adaptive capacity of our SETs. However, new, self-organized forms of adaptive governance are emerging at multiple scales in natural resource-based SETs. Adaptive governance involves the private and public sectors as well as formal and informal institutions, self-organized to fill governance gaps in the traditional roles of states. While new governance forms are emerging, they are not yet doing so rapidly enough to match the pace of environmental change. Furthermore, they do not yet possess the legitimacy or capacity needed to address disparities between the winners and losers from change. These emergent forms of adaptive governance appear to be particularly effective in managing complexity. We explore governance and SETs as coevolving complex systems, focusing on legal systems to understand the potential pathways and obstacles to equitable adaptation. We explore how governments may facilitate the emergence of adaptive governance and promote legitimacy in both the process of governance despite the involvement of nonstate actors, and its adherence to democratic values of equity and justice. To manage the contextual nature of the results of change in complex systems, we propose the establishment of long-term study initiatives for the coproduction of knowledge, to accelerate learning and synergize interactions between science and governance and to foster public science and epistemic communities dedicated to navigating transitions to more just, sustainable, and resilient futures.

Author(s): Camacho, AE; Glicksman, RL | Abstract: In recent years, regulation scholars and policymakers have increasingly turned their attention to the role of inter-governmental organizational design in effective governance. The existing literature on regulatory design has provided important insights into the advantages and disadvantages of alternative structural options. This article synthesizes and builds on that literature by describing a novel framework for characterizing, analyzing, and structuring authority across public institutions. Drawing on examples from a range of jurisdictions, it highlights the value of this framework in identifying the values tradeoffs that should drive policymakers' decisions to choose among competing structural alternatives. The framework is founded on two important points. First, inter-governmental allocations of authority can be structured along three different dimensions. Failing to appreciate the existence of, and differences among, these dimensions can prompt misassessments of the reasons for existing regulatory failures and selection of structural allocations that do not suit the problems intended to be addressed. Second, allocations of authority can, and in many cases should, vary for disparate governmental functions. Differential functional allocations of authority can minimize obstacles to needed structural reforms and tailor inter-governmental relations in ways that best promote chosen regulatory values, such as efficiency, effectiveness, and accountability, as well as how allocational choices may and perhaps should vary depending on the governmental function being performed. Finally, the article suggests how future regulation and governance scholarship can harness this emerging framework to help build a body of empirical evidence upon which policymakers can draw in future regulatory design endeavors.

Abstract

Neutrinoless double-beta ($0\nu\beta\beta$) decay is a hypothesized lepton-number-violating process that offers the only known means of asserting the possible Majorana nature of neutrino mass. The Cryogenic Underground Observatory for Rare Events (CUORE) is an upcoming experiment designed to search for $0\nu\beta\beta$ decay of $^{130}$Te using an array of 988 TeO$_2$ crystal bolometers operated at 10 mK. The detector will contain 206 kg of $^{130}$Te and have an average energy resolution of 5 keV; the projected $0\nu\beta\beta$ decay half-life sensitivity after five years of live time is $1.6\times 10^{26}$ y at $1\sigma$ ($9.5\times10^{25}$ y at the 90% confidence level), which corresponds to an upper limit on the effective Majorana mass in the range 40--100 meV (50--130 meV). Without management strategies that impede harmful invasions and help vulnerable resources adapt, biodi- versity and ecological function will likely decline. However, governing processes are too often insufficiently adaptive, and many resource laws are not designed primarily to facilitate biodiversity or promote ecological health. Many laws are primarily directed at promoting consumptive use; others on promoting historical fidelity; still others on limit- ing human management. Global climate change causes these various conservation goals to be increasingly at odds with each other and with promoting biodiversity. Except in rare circumstances when decline in ecological health is deemed an acceptable trade-­off for historical fidelity, non-­intervention, and/or human consumption or development, natural resources laws must be better adapted to accommodate change not only through adaptive management measures that integrate flexibility into regulatory processes, but also by promoting substantive goals that emphasize ecological health. Abstract

Managed relocation is defined as the movement of species, populations, or genotypes to places outside the areas of their historical distributions to maintain biological diversity or ecosystem functioning with changing climate. It has been claimed that a major extinction event is under way and that climate change is increasing its severity. Projections indicating that climate change may drive substantial losses of biodiversity have compelled some scientists to suggest that traditional management strategies are insufficient. The managed relocation of species is a controversial management response to climate change. Summary 1. Collaborative adaptive management (CAM) is regularly touted as the best way to handle natural resource management in the face of uncertainty, change and conflict. Successful applications of CAM have, however, been elusive in practice. 2. This article examines the Glen Canyon Dam Adaptive Management Program (AMP) in the United States, and other CAM efforts, to illustrate why and how procedural shortcomings may lead to natural resource management failures and reflect on how they may be overcome. 3. Synthesis and applications. To increase the chance of success, CAM efforts should set clear overarching goals and concrete and measurable objectives, employ tools and incentives to facilitate participation and foster collaboration, implement well-defined joint fact-finding protocols to promote shared learning and manage scientific uncertainty, and commit to monitoring and adapting their management regimes over time. Even in complex and contentious resource management contexts, future CAM efforts that integrate these design elements are likely to lead to more effective natural resource management.

Abstract

Managed relocation (MR) has rapidly emerged as a potential intervention strategy in the toolbox of biodiversity management under climate change. Previous authors have suggested that MR (also referred to as assisted colonization, assisted migration, or assisted translocation) could be a last-alternative option after interrogating a linear decision tree. We argue that numerous interacting and value-laden considerations demand a more inclusive strategy for evaluating MR. The pace of modern climate change demands decision making with imperfect information, and tools that elucidate this uncertainty and integrate scientific information and social values are urgently needed. We present a heuristic tool that incorporates both ecological and social criteria in a multidimensional decision-making framework. For visualization purposes, we collapse these criteria into 4 classes that can be depicted in graphical 2-D space. This framework offers a pragmatic approach for summarizing key dimensions of MR: capturing uncertainty in the evaluation criteria, creating transparency in the evaluation process, and recognizing the inherent tradeoffs that different stakeholders bring to evaluation of MR and its alternatives.

Abstract

The Cryogenic Underground Observatory for Rare Events (CUORE) is an experiment to search for neutrinoless double beta decay ($0\nu\beta\beta$) in $^{130}$Te and other rare processes. CUORE is a cryogenic detector composed of 988 TeO$_2$ bolometers for a total mass of about 741 kg. The detector is being constructed at the Laboratori Nazionali del Gran Sasso, Italy, where it will start taking data in 2015. If the target background of 0.01 counts/(keV$\cdot$kg$\cdot$y) will be reached, in five years of data taking CUORE will have an half life sensitivity around $1\times 10^{26}$ y at 90\% C.L. As a first step towards CUORE a smaller experiment CUORE-0, constructed to test and demonstrate the performances expected for CUORE, has been assembled and is running. The detector is a single tower of 52 CUORE-like bolometers that started taking data in spring 2013. Abstract

Though there is much solid evidence that anthropogenic climate change has already had and will increasingly have substantial adverse effects on biota and ecological processes, the chief barrier to effective natural resource governance over the next few decades will likely be the exceptional uncertainty that accompanies attempts to adapt to the effects of climate change on natural systems. Consequently, the effective adaptation of natural resource management to climate change hinges on the development of a regulatory infrastructure that provides public and private actors the capacity to assess and manage uncertainty. This chapter briefly sketches the options originally considered for natural resource governance in the United States, their insufficiency in the key function of managing uncertainty, and how to build a more effective federal system for managing natural resources in preparation for climate change. Uncertainty underscores the value of regulatory experimentation and learning in a largely decentralized and overlapping federal system, and suggests a crucial role for national governments and international institutions of promoting agency learning and inter-jurisdictional information sharing.

Abstract

Neutrinoless double beta decay (0nubb) is one of the most sensitive probes for physics beyond the Standard Model, providing unique information on the nature of neutrinos. In this paper we review the status and outlook for bolometric 0nubb decay searches. We summarize recent advances in background suppression demonstrated using bolometers with simultaneous readout of heat and light signals. We simulate several configurations of a future CUORE-like bolometer array which would utilize these improvements and present the sensitivity reach of a hypothetical next-generation bolometric 0nubb experiment. We demonstrate that a bolometric experiment with the isotope mass of about 1 ton is capable of reaching the sensitivity to the effective Majorana neutrino mass (|mee|) of order 10-20 meV, thus completely exploring the so-called inverted neutrino mass hierarchy region. Abstract

This Article considers how prominent goals of natural resources law and the prevailing model of regulatory decision making combine to limit the capacity of natural resources governance to manage the effects of climate change. The Article explores the implications of continuing to rely on conventionally static and fragmented decision making, passive management, and historical preservation when global climatic shifts are widely expected to lead to rapid changes in ecological systems that are unforeseen, novel, and potentially detrimental to ecological diversity and function. This emphasis of natural resources management on stasis arises from the legal system’s discomfort with integrating and managing uncertainty and change. As an accelerant, climate change makes this rigidity particularly evident and unsustainable. The Article ultimately argues for the need to change both the means and the ends of natural resources law to better deal with change and uncertainty, as well as inform and galvanize public deliberation on natural resource decisions.

Abstract

The R&D activity performed during the last years proved the potential of ZnSe scintillating bolometers to the search for neutrino-less double beta decay, motivating the realization of the first large-mass experiment based on this technology: CUPID-0. The isotopic enrichment in $^{82}$Se, the Zn$^{82}$Se crystals growth, as well as the light detectors production have been accomplished, and the experiment is now in construction at Laboratori Nazionali del Gran Sasso (Italy). In this paper we present the results obtained testing the first three Zn$^{82}$Se crystals operated as scintillating bolometers, and we prove that their performance in terms of energy resolution, background rejection capability and intrinsic radio-purity complies with the requirements of CUPID-0.
