1. Ideation, Conceptualization, Realization - Discovering the Creative Scope in Software Engineering from the Perspective of Copyright and Patent Law

Abstract

Today, the software industry is regarded as one of the most creative and dynamic industries in the world. New, innovative products are constantly being launched, and known established paths for analogue solutions are being challenged and abandoned. Sheltering software through copyright and patent law has been a major point of contention for the past 40 years. A particular difficulty lies in determining the scope of protection in intellectual property law. While the legal framework is highly standardized through several multinational codes, its practical application differs significantly among the various jurisdictions. Economists and lawyers have tried to make the present protection system more balanced and at the same time more efficient. Unfortunately, these analyses often neglect the technical realities – the practicalities and needs of software developers and right holders. The discourse is frequently limited to one particular closed discipline. This doctoral thesis examines the rapidly changing and complex software development market and discusses some pressing legal issues. The aim is to analyse how computer programs are developed and commercialized nowadays, and to evaluate to what extent copyright and patent law are able to reflect these structures. Based on these conclusions, it is then explored what an optimal protection scope for computer programs could look like in copyright and patent law. In 12 expert interviews, technical in-house specialists were questioned about how software companies work today, how they proceed in developing their programs, how they commercialize them through sales and services, and to what extent they use legal measures to protect their software. The results of these qualitative interviews were then evaluated systematically and legally reintegrated. The main achievement of this thesis is to provide the necessary basic scientific research regarding how the software industry works today and how this might affect copyright and patent law. From a legal perspective, it offers novel insights and points of view on existing doctrines. Further, it acknowledges some prevailing trends in the software industry which have so far been largely unaddressed by copyright and patent law. It also discusses possible approaches to how these problems could be tackled in the future.

Abstract

In clinical practice, the diagnosis of breast lesions is achieved by the triple approach of the specialized surgeon, radiologist and pathologist. The recommended approach to breast lesions should always include a detailed history, along with a thorough clinical examination, mammography and/or ultrasound, as well as preoperative cytodiagnosis. In this context, fine needle aspiration cytology and core needle biopsy are the methods of choice for histological diagnosis. Herein, we aim to explain why these procedures seem to be superior compared to open biopsy and we propose a cytodiagnostic algorithm for breast lesions. [ABSTRACT FROM AUTHOR]

Abstract

Anthropological research and social research in general are facing the restrictions and the new data management procedures established by the new European regulation, established in 2018. Before analyzing the technical merits of what is still possible to do and how to do it in compliance with current regulations, the essay discusses to what extent the concept of data as understood by the GDPR fits the case of our discipline. The essay analyzes the genesis and specificity of anthropological data, mainly ethnographic data, and raises epistemological and procedural issues related to the different nature of data in anthropology and in other disciplines. Recalling various traditions of studies – in philosophy, history, cultural criticism and linguistic – which have deeply discussed the genesis of knowledge, the essay highlights the limitations and risks of an approach that proposes a single management for a multiplicity of variable and non-reducible research circumstances.

Abstract

Heart Failure (HF) affects more than 650,000 Canadians (3.6% of Canadian adults above age 40). Even with recent advances in the diagnosis and treatment of this disease, HF remains among the five most common causes for hospitalization in Canada, with a readmission rate above 30% at the 1-year mark. Despite the significant economic and clinical burden of this disease, there is limited awareness among healthcare providers, healthcare system managers, and governments regarding the current HF epidemic and available therapies. This article reviews the definition of HF and the approach to evaluating a patient with suspected HF, focusing on the different presentations of HF, the clinical significance of ejection fraction, and the usefulness of BNP as a marker of cardiac function.

Abstract

Background: The "Minimalistic Hybrid Approach" (MHA) has been proposed to reduce the invasiveness of chronic total occlusion (CTO) percutaneous coronary intervention (PCI)., Aims: This study aims to assess whether MHA may also reduce the utilization of PCI resources (devices, radiations, and contrast) by comparing it with other conventional algorithms., Methods: We aimed to assess the impact of MHA on device, radiation, and contrast usage during CTO-PCI analyzing data from the Belgian Working Group on CTO (BWG-CTO) registry. Patients were divided, depending on the algorithm used, into two groups: Conventional versus Minimalistic. Primary objectives were procedure performance measures such as device usage (microcatheters and guidewires), radiological parameters, and contrast use. At 1-year follow-up, patients were evaluated for target vessel failure (TVF), defined as a composite of cardiac death, new myocardial infarction, and target vessel revascularization., Results: Overall, we analyzed 821 CTO-PCIs (Conventional n = 650, Minimalistic n = 171). The Minimalistic group demonstrated higher complexity of CTO lesions. After adjusting for propensity score, the Minimalistic group had a significantly lower number of microcatheters used (1.49 ± 0.85 vs. 1.24 ± 0.64, p = 0.026), while the number of guidewires was comparable (4.80 ± 3.29 vs. 4.35 ± 2.94, p = 0.30). Both groups had similar rates of success and procedural complications, as well as comparable procedural and fluoroscopic times and contrast volume used. At the 1-year follow-up, both groups showed comparable rates of TVF (hazard ratio: 0.57; 95% confidence interval: 0.24-1.34, p = 0.195)., Conclusion: The MHA may slightly reduce the number of dedicated devices used during CTO-PCI, without adversely affecting the procedural success or long-term outcome., (© 2024 Wiley Periodicals LLC.)

Abstract

Background: Blockchain and distributed ledger technology is a disruptive force in healthcare. Methods: This article provides a globally relevant, interdisciplinary perspective intended to aid disparate group of actors, participants, and users that represent the diverse stakeholders of an increasingly complex and technologically reliant healthcare system. Domain expertise reinforced by literature published via industry, technical, and academic venues was used to inform these perspectives. Results: Key characteristics of blockchain and distributed ledger technology are highlighted and framed for a readership ranging from healthcare executive to policy makers to researchers. Antecedent application of blockchain in the financial sector is explored followed by the technical, security, and interoperability considerations specific to healthcare. Conclusion: Blockchain remains an emerging technology both fraught with unanticipated challenges and the promise of unrealized potential in healthcare. Abstract

Complex geographical atlases represent geosystems of different hierarchical rank, complexity and diversity, scale and connection. They represent a set of large number of different pieces of information about geospace. Also, they contain systematized, correlative and in the apparent form represented pieces of information about space. The degree of information revealed in the atlas is precisely explained by its content structure and the form of presentation. The quality of atlas depends on the method of visualization of data and the quality of geodata. Cartographic visualization represents cognitive process. The analysis converts geospatial data into knowledge. A complex geographical atlas represents information complex of spatial - temporal coordinated database on geosystems of different complexity and territorial scope. Each geographical atlas defines a concrete geosystem. Systemic organization (structural and contextual) determines its complexity and concreteness. In complex atlases, the attributes of geosystems are modeled and pieces of information are given in systematized, graphically unique form. The atlas can be considered as a database. In composing a database, semantic analysis of data is important. The result of semantic modeling is expressed in structuring of data information, in emphasizing logic connections between phenomena and processes and in defining their classes according to the degree of similarity. Accordingly, the efficiency of research of needed pieces of information in the process of the database use is enabled. An atlas map has a special power to integrate sets of geodata and present information contents in user - friendly and understandable visual and tactile way using its visual ability. Composing an atlas by systemic cartography requires the pieces of information on concrete - defined geosystems of different hierarchical level, the application of scientific methods and making of adequate number of analytical, synthetic and complex maps. The essence of each database is its model. The selection of model - the organization of database is very important.

Abstract

For a couple of years I am very interested in honeybees. On one hand it is fascinating how the bee colony develops and enlarges during the summer and how they prepare for the winter. On the other hand their importance for our ecosystem is enormous and intriguing. As a fact, 80% of our fruits needs bees for pollination. Recently the problem of bee mortality is showing up heaped in the media and it makes the importance of the honeybees even clearer. The personal fascination and the fact of the already existing bee mortality have made me to deal with this topic. Abstract

Introduction: The main objective of all the sagittal compensating mechanisms is to allow a subject to stand and keep an erect position. Materials and methods: The cascade of compensating mechanisms appears progressively with the increasing amount of imbalance of the spine until compensation is no longer possible. The loss of lumbar lordosis can be considered as the initiating event of sagittal imbalance. This loss of the normal lordosis pushes the C7 plumb line forward. Results: The assessment of sagittal balance has to include to be complete: a parameter measuring the global balance of the trunk, either C7 plumb line and sacral plateau, the position of the pelvis rotation by the pelvic tilt, and a description of the position of the lower limbs. Those three parameters have been taken into account by the newly described method called full balance integrated (FBI). This evaluation is easily done on a sagittal full spine standing X-ray from C2 to the pelvis, including the first 10 cm of the femur. Актуальність теми. Запровадження нової моделі ринку електроенергії потребує уточнення прогнозування режимів, включаючи необхідність точного обчислення витрат електроенергії на кожну годину наступної доби, таке планування має відбуватися щодня, 365 днів на рік. Втрати електроенергії, що очікуються на наступну добу залежать від багатьох факторів: прогнозованої величини споживання, графіку покриття та складу блоків, запланованих ремонтів в основній мережі, прогнозу погодних умов, тощо. Тому актуальним є завдання автоматизації процесу планування щогодинних витрат електроенергії на добу вперед. Реалізація цього завдання потребує розробки та впровадження програмного комплексу для обчислення втрат електроенергії у електромережах. Мета та завдання дослідження. Розробка програмного рішення автоматизованого розрахунку прогнозованих втрат активної енергії у енергосистемі використовуючи розрахункову модель енергосистеми, графіки генерації/споживання та ремонтів. Дослідження можливостей програмного комплексу DIgSILENT PowerFactory, розрахунок усталеного режиму методом Ньютона-Рафсона та розробка алгоритму автоматизованого розрахунку прогнозованих втрат. Development of a software solution for the automated calculation of the estimated active energy losses in the grid using the grid model, generation/consumption schedules and repairs. PowerFactory software complex was investigated and described, steady-state calculation by Newton-Raphson method was performed and an algorithm for automated calculation of projected losses was developed. In the master's thesis, the software complex DIgSILENT “PowerFactory” was chosen as the object of study. Abstract

Wire Arc Additive Manufacturing (WAAM) has the possibility to build metallic structures in 3D space. WAAM system is based on welding process to deposit metallic material and on a robot that moves the welding torch to add material at a given position. For large skeleton structures, it was chosen to deposit material point by point. Welding process induces fluctuations.To be fully scalable, two main features must be taken into account. First, monitoring of the process is necessary. Local control on the geometry of the deposition must be used to reach the final shape. Secondly, some deposition strategies must be implemented to manage branch intersections. To reach these two objectives, anadaptive and modular slicer and a process manager have been developed in order to implement this control. It allows us, if an error occurs during the deposition, to change the position of the effector or the process parameters. To obtain the desired geometry, the CAM software have to be able to, (i) do a slicing during the additive process of the part with a variable deposit height in order to take into account variation of the deposition process and (ii) manage the deposition strategy at intersection to output the position of the torch.; La technologie de fabrication additive métal fil permet la fabrication de structures filaires complexes en 3 dimensions. Ce système se base sur l'utilisation d'un procédé de soudage qui va permettre le dépôt de la matière. Ce dernier est embarqué sur un bras robotique qui permettra de déplacer la torche de soudage aux positions désirées. Pour fabriquer de grandes structures filaires, le dépôt s'effectue point par point. L'utilisation d'un procédé de soudage induit des fluctuations sur le dépôt. Pour être adaptable facilement, deux aspects doivent être pris en compte. Premièrement, une instrumentation doit être embarquée. Un contrôle local sur la géométrie déposée doit être utilisé pour atteindre les formes finales désirées. Deuxièmement, certaines stratégies de dépôt doivent êtres implémentées pour piloter notre système dans les intersections de branches. Pour atteindre ces deux objectifs, un slicer adaptatif et modulaire, ainsi qu'un système de supervision et de contrôle du système ont été développés pour permettre l'implémentation du contrôle. Cela permet, si une erreur apparait, de changer la position de notre système de dépôt. Pour obtenir la géométrie désirée, notre système de supervision et de contrôle doit pouvoir : (i) effectuer un slicing de la géométrie à la volée lors de la fabrication avec un pas variable pour pouvoir prendre en compte les variations du procédé de dépôt et (ii) gérer les stratégies de dépôt au niveau des intersections pour décider des paramètres procédés et des trajectoires à employer.

15. The Use of Artificial Neural Networks (ANN) in Food Process Engineering

Abstract

Artificial neural networks (ANN) aim to solve problems of artificial intelligence, by building a system with links that simulate the human brain. This approach includes the learning process by trial and error. The ANN is a system of neurons connected by synaptic connections and divided into incoming neurons, which receive stimulus from the external environment, internal or hidden neurons and output neurons, that communicate with the outside of the system. The ANNs present many advantages, such as good adaptability characteristics, possibility of generalization and high noise tolerance, among others. Neural networks have been successfully used in various areas, for example, business, finance, medicine, and industry, mainly in problems of classification, prediction, pattern recognition and control. In the food industry, food processing, food engineering, food properties or quality control, statistical tools are frequently present, and ANNs can process more efficiently data comprising multiple input and output variables. The objective of this review was to highlight the application of ANN to food processing, and evaluate its range of use and adaptability to different food systems. For that a systematic review was undertaken from the scientific literature and the selection of the information was based on inclusion criteria defined. In complex atlases, the attributes of geosystems are modeled and pieces of information are given in systematized, graphically unique form. The atlas can be considered as a database. In composing a database, semantic analysis of data is important. The result of semantic modeling is expressed in structuring of data information, in emphasizing logic connections between phenomena and processes and in defining their classes according to the degree of similarity. Accordingly, the efficiency of research of needed pieces of information in the process of the database use is enabled. An atlas map has a special power to integrate sets of geodata and present information contents in user - friendly and understandable visual and tactile way using its visual ability. Composing an atlas by systemic cartography requires the pieces of information on concrete - defined geosystems of different hierarchical level, the application of scientific methods and making of adequate number of analytical, synthetic and complex maps. The essence of each database is its model. The selection of model - the organization of database is very important. Kompleksni geografski atlasi predstavljaju geosisteme različitog hijerarhijskog ranga, složenosti i raznovrsnosti, razmernosti i povezanosti. Predstavljaju skup ogromnog broja raznovrsnih informacija o geoprostoru. Sadrže sistematizovane, korelativne i u očiglednoj formi konkretno predstavljene informacija o prostoru. Stepen informisanosti iz atlasa preciziran je njegovom strukturom sadržaja i formom predstavljanja. Kvalitet atlasa zavisi od načina vizuelizacije podataka i kvaliteta geopodataka. Kartografska vizuelizacija predstavlja saznajni proces. Analizom se geoprostorni podatak pretvara u znanje. Kompleksni geografski atlas predstavlja informacioni kompleks prostorno-vremenski koordinirane baze podataka o geosistemima različite složenosti i teritorijalnog obuhvata. Svaki geografski atlas definiše konkretni geosistem. Sistemski organizaciono (strukturno i sadržajno) determiniše njegovu kompleksnost i konkretnost. U kompleksnim atlasima modeluju se svojstva geosistema i daju informacije u sistematizovanom, grafički jednoobraznom obliku. Atlas se može smatrati bazom podataka. Pri sastavljanju baze podataka značajna je semantička analiza podataka. Rezultat semantičkog modelovanja izražava se u strukturalizaciji informacija podataka, u isticanju logičkih veza između pojava i procesa i u definisanju njihovih klasa po stepenu sličnosti. Time se obezbeđuje efikasnost istraživanja traženih informacija u procesu korišćenja bazom podataka. Atlasna karta ima posebnu moć da kroz svoju vizuelnu sposobnost integriše skupove geopodataka i prezentuje informacione sadržaje u korisnički orijentisan i razumljiv vizuelni i taktilni način. Sastavljanje atlasa sistemskim kartografisanjem, zahteva informacije o konkretnim - definisanim, geosistemima različitih hijerarhijskih nivoa, primenu naučnih metoda i konstruisanje adekvatnog broja analitičkih, sintetičkih i kompleksnih karata. Abstract

A Bayesian method for regression under shape restrictions and smoothness conditions is proposed. The support of the prior distribution is included in the set of piecewise linear fonctions. It is shown that the proposed prior can be arbitrarily close to the distribution induced by the addition of a polynomial with random coefficients and a (m−1)-fold integrated Brownian motion. Thanks to the piecewise linear property, it is easy to introduce shape constraints. The regression fonction is estimated by the posterior mode. The posterior mode can be computed by a simulated annealing algorithm. The shape constraint is taken into account thanks to the proposal distribution of the simulated annealing algorithm. Simulations from the posterior distribution are obtained by a Metropolis-Hastings algorithm., On propose une méthode bayésienne de régression sous contraintes de régularité et de forme. On construit une loi a priori qui charge les fonctions linéaires par morceaux. On montre que cette loi a priori peut être arbitrairement proche de la loi induite par l’addition d’un polynôme à coéfficients aléatoires et d’un mouvement brownien intégré m − 1 fois. Ainsi, bien que linéaire par morceaux, la fonction de régression se comporte approximativement comme une fonction de classe Cm−1. La linéarité par morceaux permet d’introduire des contraintes de forme. L’estimateur choisi est le mode a posteriori. Il est calculé à partir d’un algorithme de type recuit simulé dont l’étape de proposition garantit la vérification de la contrainte de forme. Des simulations suivant la loi a posteriori sont obtenues grâce à un algorithme de type Metropolis-Hastings.

Complex geographical atlases represent geosystems of different hierarchical rank, complexity and diversity, scale and connection. They represent a set of large number of different pieces of information about geospace. Also, they contain systematized, correlative and in the apparent form represented pieces of information about space. The degree of information revealed in the atlas is precisely explained by its content structure and the form of presentation. The quality of atlas depends on the method of visualization of data and the quality of geodata. Cartographic visualization represents cognitive process. The analysis converts geospatial data into knowledge. A complex geographical atlas represents information complex of spatial - temporal coordinated database on geosystems of different complexity and territorial scope. Each geographical atlas defines a concrete geosystem. Systemic organization (structural and contextual) determines its complexity and concreteness. Abstract

Background: Reverse transcription followed by real-time PCR is widely used for quantification of specific mRNA, and with the use of double-stranded DNA binding dyes it is becoming a standard for microarray data validation. Despite the kinetic information generated by real-time PCR, most popular analysis methods assume constant amplification efficiency among samples, introducing strong biases when amplification efficiencies are not the same. Results: We present here anew mathematical model based on the classic exponential description of the PCR, but modeling amplification efficiency as a sigmoidal function of the product yield. The model was validated with experimental results and used for the development of a new method for real-time PCR data analysis. This model based method for real-time PCR data analysis showed the best accuracy and precision compared with previous methods when used for quantification of in-silico generated and experimental real-time PCR results. Moreover, the method is suitable for the analyses of samples with similar or dissimilar amplification efficiency. Conclusion: The presented method showed the best accuracy and precision. Abstract

The requirements of modern manufacturing industry caused the increase of implementation of the automated systems. Their main aim is to improve visual inspection and quality control. In the ceramic tiles industry the quality control is performed in real time conditions so that tiles are classified and removed if they have defects in color, dimension or on the surface. The need for defect detecting methods occurred. Image processing methods has already been applied in recognizing defect on images. In that purpose some methods for detecting edges of images are described in this work. These methods were applied on images of ceramic tiles with defect in color and surface.

Abstract

The aim of this paper is to make a theoretical review of the learned helplessness phenomenon in man and, further, to explain its nature. Deficits, ethiology, treatment and prevention, are analysed from the point of view of the attribution theory. Although this theory about helplessness seems fit, many problems are still arise against its approval; in fact, the learned helplessness phenomenon is not actually well known. Furthermore, in order to clarify the intervening processes in such phenomenon, these authors have built an algorithm of it, and it is argued that, from now on, the framework provided by the Psychology of Thinking must be paid more heed, El objetivo de este artículo consiste en efectuar una revisión teórica del fenómeno de la indefensión aprendida en el hombre, y en aclarar la naturaleza del mismo. Los déficits, la etiología, el tratamiento y la prevención de la indefensión aprendida son analizados desde el punto de vista de la teoría de la atribución. Aunque esta teoría parece adecuada, se suscitan aún muchos problemas para su plena aceptación; de hecho, el fenómeno de la indefensión aprendida puede decirse que no está en modo alguno bien comprendido. Por otro lado, y para aclarar el proceso de formación de dicho fenómeno, los autores de este trabajo han construido un algoritmo del mismo, afirmando, además, que es necesario tener más en cuenta, en lo sucesivo, el cuerpo teórico que suministra la Psicología General, y en concreto la Psicología del Pensamiento.

Z technického hlediska mě zajímá otázka obousměrné remediace nových médií a malby a jak jejich vývoj podporuje iluzi a imaginaci. Z ontologického hlediska sleduji mystickou povahu obrazu. Závěrečná výstava je metaforou hybrydního obrazu komponvanou na základě technologických a teoretických zkušeností v malbě. Výsledkem je malá syntetická realita., In my master thesis I realize the set of pictures and painterly objects, which should imitate principles of augmented reality by analogial form. From technical standpoint Im interested in question of bidirectional remediation of new media and painting and how its evolution supports ilussion and imagination. In ontologiacal way im looking for mystical nature of picture. Final exhibition is an metaphor composed in hybryd picture based on technological and theoretical experiences in Painting. The result is little synthetic reality.

The thesis describes the methods of measuring oxygen in blood and basic parts of pulse oximeter. It follows introduction to light absorbancy based on Beer’s law and its usage in pulse oximetry. The thesis also describes different probes and its properties and also algorithms for signal processing. Measuring and evauating on tester SECULIFE and volunteers is part of this thesis.

Ve své praktické diplomové práci realizuji soubor obrazů a malířských objektů, které by měly analogovým zbůsobem imitovat principy augmentované a virtuální reality. Z technického hlediska mě zajímá otázka obousměrné remediace nových médií a malby a jak jejich vývoj podporuje iluzi a imaginaci. Z ontologického hlediska sleduji mystickou povahu obrazu. Závěrečná výstava je metaforou hybrydního obrazu komponvanou na základě technologických a teoretických zkušeností v malbě.
