Recent global and regional assessments of the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services (IPBES) show that Nature's Contributions to People (NCP) are under an alarming threat due to the continuing loss of biodiversity. These assessments call for increasing conservation efforts and a more sustainable use of biodiversity to enhance the chances of halting biodiversity loss and reversing current trends. One of the strategies to achieve change is to mainstream biodiversity into sectoral policies. Mainstreaming, a concept that can be traced back to the Brundtland report, promotes the integration of the environment into political, societal, and economic planning and decision-making. Based on the review of key studies undertaken during the regional assessment for Europe and Central Asia, we develop a stepwise approach to analyze the current status of mainstreaming of biodiversity and NCP. The approach can be used both for policy design purposes and diagnostic evaluations. It demonstrates that mainstreaming has the potential to improve the conservation and sustainable use of biodiversity as well as the sustained provision of NCP. However, based on the status of implementation across Europe and Central Asia, we conclude that mainstreaming needs to be pursued and implemented in a stronger and more systematic way. The results of our assessment provide important input to national strategies and policies but also to the ongoing process of the Conference of the Parties to the Convention on Biological Diversity while developing the post-2020 global biodiversity framework.

I januari 2020 avgjorde Högsta domstolen det s.k. Girjasmålet, där rätten att upplåta småviltsjakt och fiske i fjällområdena prövats. Stridigheter om huruvida det är staten eller samebyn som har rätt att göra sådana upplåtelser har pågått i decennier och har inte gått att lösa politiskt. I artikeln analyseras domen och vilka konsekvenser den får; domens längd och komplexitet motiverar en längre rättsfallsanalys. Det konstateras att domen klargör viktiga förhållanden såsom att samiska markrättigheter upparbetats genom urminnes hävd och att ILO:s konvention nr 169 om urfolks rättigheter i delar är bindande även om den inte har ratificerats. Domen innebär att en betydande rättsutveckling skett inom det samerättsliga området.

I artikeln "Samebyars avtalsrätt" gör Eivind Torp bedömningen att den nuvarande rennäringslagen inte ger utrymme för att behandla renskötselrätten eller delar av rätten som ett civilrättsligt avtalsobjekt. Därför menar Torp att samebyarna saknar rättslig befogenhet att ingå avtal som innebär inskränkningar av renskötselrätten. Vi menar att Torp i sin analys av rättsläget bortser från den rättsutveckling som skett i tiden efter 1971 när den nuvarande rennäringslagen infördes. Dessutom är frågan om samebyarnas avtalsrätt mer komplex än vad den aktuella artikeln visar.

Within the generic scope of the Regional Assessments of Biodiversity and Ecosystem Services, the key policy‑relevant questions of the Europe and Central Asia Assessment concern options and opportunities with regard to biodiversity and ecosystem services and their role for human well-being. The assessment examines the opportunities for sectoral policies and policy instruments; managing production, consumption and economic development; and ecological infrastructures and ecological technologies. It explores opportunities to promote food security, economic development and equality while avoiding land and aquatic degradation and conserving cultural landscapes.

I Finland har erkännandet och implementeringen av samiska rättigheter varit komplicerat. Syftet med detta forskningsprojekt är att ge kunskap om förhållanden som finska regeringen efterfrågat, särskilt i förhållande till samers markrättigheter, deltagande/konsultationer och frågan om vem som är same. Forskningen är en internationell och komparativ studie som avser att ge ny kunskap om den senaste tidens rättsutveckling vad gäller urfolks rättigheter inom internationell rätt samt på nationell nivå med en jämförande ansats av några relevanta länder. Forskningsrapporten består av fyra delar. Den första delen fokuserar på folkrättens krav och internationell standard vad gäller urfolks rättigheter och tar främst sikte på samernas rättsliga status. Den andra delen diskuterar problematiken med att definiera vem som är same, i ljuset av internationell rätt och Högsta förvaltningsdomstolens domar i Finland. Denna del innehåller även en beskrivning av bakgrund och skälen till tvisterna gällande definitionen. Den tredje delen behandlar urfolks rättsliga status och rättigheter enligt internationell rätt, med särskilt fokus på principen om urfolks fria och informerade samtycke, liksom tolkningen av artiklarna rörande landrättigheter i ILOs konvention 169. Den fjärde delen innehåller information om och jämförelse av urfolks rättsliga status i ett antal utvalda rättsystem: Norge, Sverige, Aotearoa Nya Zeeland och Kanada samt ett gemensamt kapitel om Latinamerika. Denna del innehåller sammanfattningar av centrala element och rättsliga lösningar i respektive rättssystem, liksom en sammanfattande konklusion gällande lösningar som kan vara till nytta för erkännandet av samiska rättigheter i Finland.

The aim of the paper is to explore, within a multidisciplinary context, in which way the relation between indigenous people and protected nature, such as national parks, are interpreted from the perspective of different theories with a holistic approach: • Is there a consistent theory that can explain the post-modern role of indigenous people within nature and landscape? • In which way can theories within different disciplines be combined in order to do multi-disciplinary research? • Which methods shall be used in order to achieve results? The researchers come from the disciplines of history, political science and law. Our case is the Sámi within the reindeer herding area of Norway, Sweden and Finland. From an historical perspective much of the winning from natural resources around the world is the result of the former colonial systems and Western dominion. In that way, the dynamics of landscapes is part of a global power system that is remote from the indigenous people, who lived in that landscape with their own perceptions of nature and natural resource management at the time when the colonists came to dominate. With the de-colonisation of power relations after the Second World War, the role of indigenous populations within nature has been reinterpreted, acknowledging social as well as cultural aspects of indigenous traditions and customary rights. In the same time the concept of "nature" has shifted to "landscape" and the concept of "wilderness" has changed to the more cultivated and urban notion of "park" for leisure activities (Hägerstrand 1991; Mels 1999; Svensson 2000; Saltzman 2001; Wramner&Nygård 2010). These changes comprise not only biophysical elements of nature, but also human (socio-cultural) elements including land uses and infrastructures, but also aesthetic values such as scenic beauty.
