This article is about the victim’s right to prove in criminal proceedings. It studies the victim’s right to prove only in criminal proceedings before the court. However, it does not consider the victim’s ability to prove in court. The aim of the study is to examine the possibilities of victims to prove in criminal proceedings, to identify legal and practical issues for the victim’s right to prove in criminal proceedings, as well as to put forward proposals for solving them. Material and methods used in the preparation of the study include analysis and description of regulatory enactments, court judgments, comparable and logical method. Analysis and description of normative acts and court judgments were used for the creation of the study. The comparative method has been used to compare provisions of regulatory enactments, while the logical method has been used to draw conclusions. Methods of interpretation of legal norms have also been used in the study: grammatical, systemic and teleological method. Keywords: criminal proceedings, the victim, proof

Kriminālprocesa likumā noteiktais tiesiskais regulējums atļauj kriminālprocesā izmantot operatīvās darbības pasākumos iegūtās ziņas par faktiem [3, 127. pants]. Gan mūsdienās pastāvošais noziedzīgo nodarījumu internacionālais raksturs, gan apstāklis, ka noziedzīgie nodarījumi tiek izdarīti tā, ka arvien grūtāk pierādīt noziedzīgā nodarījuma izdarītāja vainu, vienkārši izmantojot parastas kriminālprocesuālas metodes un līdzekļus, ir pamats arvien biežāk kriminālprocesā izmantot operatīvās darbības pasākumos iegūtās ziņas par faktiem. Veicot operatīvās darbības pasākumus, ļoti būtiski tiek ierobežotas to personu cilvēktiesības, attiecībā uz kurām šie pasākumi tiek veikti. Vienlīdz būtisks jautājums, veicot operatīvās darbības pasākumus, ir operatīvās darbības metožu neatklāšana. Abi šie aspekti ir būtiski, kriminālprocesā izmantojot operatīvās darbības pasākumu laikā iegūtās ziņas par faktiem. Šajā publikācijā tiek apskatīti normatīvajos aktos noteiktie priekšnosacījumi, lai operatīvās darbības pasākumos iegūtās ziņas par faktiem varētu izmantot kriminālprocesā, kā arī analizēti problēmjautājumi, kas saistīti ar šo ziņu izmantošanu kriminālprocesā. The Criminal Procedure Law allows the use of information obtained during operative activities in criminal proceedings. The international nature of crime and the difficulty of proving it are the basis for the increasing use of information obtained during operational activities in criminal proceedings. The human rights of the persons in respect of whom these measures are taken are severely restricted in the course of operational activities. An equally important issue in operational activities is the non-disclosure of methods. Both aspects are relevant when using information obtained during operational activities in criminal proceedings. This publication will look at legal preconditions for the use of information obtained during operational activities in criminal proceedings. Problems related to the use of information obtained in operational activities in criminal proceedings will be analysed.

The article discusses the court’s ability to assess information of evidence obtained during operational activities. It addresses only the cases where a person is found guilty of a criminal offence and criminal punishment has been imposed by a court judgment, without considering cases where the punishment has been determined by the public prosecutor when drawing up a penal order. The aim of the study is to examine the possibilities of the court to assess information of evidence about facts obtained in operational activities, to identify legal and practical issues for the court’s ability to assess such information, as well as to propose solutions. Material and methods used in the preparation of the article include analysis and description of regulatory enactments, court judgments, comparative and lo­gical method. These materials and methods help to achieve the goal of the research. Analysing normative acts and court judgments, describing normative acts and court judgments in the article, analysis and description of normative acts and court judgments have been used for the compositon of the research. The comparative method has been used to compare provisions of regulatory enactments, while the logical method has been used to draw conclusions.
