This article will briefly discuss the concept of neuro-rights. These have been outlined, conceptualized, endowed with content or recognized in Spain, the European Union and elsewhere. Let us clarify, however, that we are basically talking about rights that are being discussed and for which protection is being requested, but actions in this sense are more or less recent, both from the legal perspective, as well as from the ethical and neuroscientific perspectives. In this regard, it should be noted that there are developments of a rather normative type and others of a more declarative type (or soft law), which we will discuss later and whose difference will be explained in due course. The introductory elements and background on neuro-rights will be discussed, given the increasingly notable approach to a new dimension not only of fundamental rights, but also of digital rights, among which are rights in the use of neurotechnologies and rights in the use of Artificial Intelligence (AI), addressed by the Spanish Charter of Digital Rights (section 5, articles XXI to XXVI).
