Esta pesquisa objetiva analisar a executividade dos contratos eletrônicos. Utilizando o método dedutivo com revisão doutrinária e análise da jurisprudência do STJ como opção metodológica, parte-se do estudo dos impactos da tecnologia no processo, situando os contratos eletrônicos entre as consequências dos avanços tecnológicos e das relações socioeconômicas contemporâneas. Em seguida, estuda-se o título executivo, cujos requisitos são impostos taxativamente pela lei, para, após, demonstrar-se que não há óbices a que o título exista eletronicamente. Ao final, conclui-se pela executividade do título eletrônico em razão da equiparação da certificação digital à assinatura das testemunhas, conforme posicionamento do STJ. This research aims to analyze the enforceability of electronic contracts. Using the deductive method with doctrinal review and analysis of STJ jurisprudence as a methodological option, it starts with the study of the impacts of technology on the process, placing electronic contracts among the consequences of technological advances and contemporary socioeconomic relations. Then, the executive title, whose requirements are imposed by law, is studied, in order to demonstrate that there are no obstacles for the title to exist electronically. In the end, it is concluded that the electronic title is enforceable due to the equivalence of the digital certification to the signature of the witnesses, according to the position of the STJ.
