4. Assessment of container terminals competitiveness in the Brazilian market: a cluster analysis.

Abstract

This article presents an analysis of the competitiveness of Brazilian container port terminals and discusses the implications for the sustainable development of this sector in Brazil in the context of container ship size maximization. A cluster analysis was developed. Thirteen criteria were selected in the analysis taking into consideration both the previous literature and the characteristic of Brazilian ports. The classification shows that the third group of terminals (Santos Brasil, BTP and Paranaguá) has the highest average values in eleven out of the thirteen criteria, standing out mainly in annual capacity, number of plugs, and GDP hinterland. This is the most competitive group with the highest frequency of ship visits. It is also interesting to find that this group of terminals has a limitation regarding the operational draft that limits the port sector when receiving large ships. Considering the expected inclusion of New Panamax-class ships operating on the Brazilian coast, container terminals have restrictions due to the limited operational draft. Conclusions are drawn regarding the potential for implementing strategies and policy interventions. The study represents an application inspired by the current debate in the Brazilian port sector, which presents the country's urgent problem of receiving large capacity ships. [ABSTRACT FROM AUTHOR]

Abstract

From the reading of the Papal Encyclical Laudato Si has aimed to demonstrate that the human relationship with the environment is inseparable assumption of the universal concept of human rights. Therefore, to use as a methodology, the research of the principles of environmental law and dichotomous discussion between anthropocentrism and biocentrism, in order to determine the limits (and actually there) solidarity and fraternity, as rights-guarantees for an effective and essential protection of the ecologically balanced environment and a healthy quality of life for present and future generations. At this point, it has been collate methodology and reference the principles of environmental law, especially the principle of an ecologically balanced environment and sustainable development, beginning the cosmopolitan vision of human rights from the design of multigenerational rights, in order to show the objective of this article, there is real relationship between environmental protection and development and meeting the spiritual being (this is not in the religious sense, but of existential quest for dignified life or abundance) and protection of fundamental rights, regardless of biocentric or anthropocentric view that wants to provide the environmental law. A partir da leitura da Encíclica Papal Laudato Si, este estudo objetiva demonstrar que a relação do humano com o meio ambiente é pressuposto indissociável da concepção universal dos direitos humanos. Para tanto, utiliza-se como metodologia a pesquisa dos princípios do Direito Ambiental e da discussão dicotômica entre antropocentrismo e biocentrismo, com o objetivo de apurar os limites (e se realmente os há) da solidariedade e fraternidade, como direitos-garantias para uma proteção efetiva e primordial do meio ambiente ecologicamente equilibrado e da sadia qualidade de vida para as presentes e as futuras gerações. Nessa perspectiva, tem-se como metodologia cotejar e referenciar os princípios do Direito Ambiental, especialmente o princípio do meio ambiente ecologicamente equilibrado e do desenvolvimento sustentável, principiando a visão cosmopolita dos direitos humanos a partir da concepção de direitos multigeracionais, com o intuito de demonstrar que existe verdadeira relação entre a proteção do meio ambiente e o desenvolvimento e encontro do ser espiritual (este não na acepção religiosa do termo, mas na acepção de busca existencial pela vida digna ou em abundância) e da proteção dos direitos fundamentais, independentemente da visão biocêntrica ou antropocêntrica que se queira fornecer ao Direito Ambiental.

Abstract

The aim is to support the use of appropriate conflict resolution methods recently positivado the Civil Procedure Code 2015 - conciliation, mediation and other forms - as a stage in the judgment of acertamento in discourse theory developed by jusfilósofo Habermas , especially , about his concept of public space and democratic development , where it is exposed to the idea that democracy and conflict resolution are resolved from the discourse or rational narrative speeches , using , therefore, the communicative action as the foundation democratic construction decisions, aiming the efficiency of judicial services., Busca-se fundamentar a utilização dos métodos adequados de solução de conflitos, recentemente positivado no Código de Processo Civil de 2015 – a conciliação, mediação e outras formas – como etapa para o juízo de acertamento, na teoria discursiva desenvolvida pelo jusfilósofo Habermas, especialmente, acerca de seu conceito de espaço público e desenvolvimento democrático, onde é exposta a ideia de que a democracia e as soluções de conflitos se resolvem a partir do discurso ou da narrativa racional dos discursos, utilizandose, para tanto, do agir comunicativo como fundamento da construção democrática das decisões, visando a eficiência da prestação jurisdicional.

16. Strategic alliance in technological development and innovation: Performance evaluation of co-creation between companies and their supply chain

Abstract

Purpose: The Brazilian oil and gas market presents a perspective of growth in the next decades. Considering this scenario, the increasing number of participants in this supply chain is foreseen to supply the demand of goods and services, especially in the technological development area. The paper intends to evaluate the collaborative development capacity and respective measurements of performance on these partnerships established between customer and suppliers, through qualitative research with a sample of Brazilian oil and gas market representative. Design/methodology/approach: This paper intends to verify if the co-creation performance is measured after an implementation, specific in a restricted industry. The methodology consists in a bibliographical research to support the study, and it also had a questionnaire sent to Brazilian companies that take part of the oil and natural gas industry supply chain, to analyze if the results of co-creation activities are measured by this group of companies, to verify its attractiveness to develop the co-creation usage or change the type of partnership with the market. Findings and Originality/value: The misunderstanding of co-creation and technical partnership was noticed. The usage of teams working together from two or more organizations cannot be considered as a co-creation, because the relationship and obligations are different between these two ways of workgroup. But the companies of oil and gas industry, when questioned, were able to distinguish it, avoiding risks of incorrect results motivated by wrong interpretation of the paper content. Research limitations/implications: As related in the paper, eight companies were invited to take part on the questionnaire about co-creation, but only 50% answered it. The research should have a better result of this subject if it had been developed with more answers of Brazilian oil and gas industry companies.
