In place of the adversarial and inquisitive systems, judicial cooperation emerged as a new model of process, which aims to obtain a fair process, in the same time possible, thus guaranteeing effective access to justice for the jurisdictional parties. Although in certain aspects the cooperative process still has some characteristics of the models that preceded it, what differentiates it from the others is the way it is presented, because in it there will be a true working community in which all procedural subjects must contribute to get as close as possible to the real truth and, also, so that the law is properly applied to the concrete case, because only then can we speak of a fair process. In order for the process to achieve the desired result, which is the provision of fair judicial protection and the social pacification of conflicts, it is necessary for the judge to adopt some proactive postures, both in the conduct of the procedure and at the time of the trial, in order to guarantee fundamental rights. Based on these premises, the present work will analyze the cooperative model of process, in order to verify the hypothesis that it is the same appropriate for the legitimation of judicial proactivity, due to the actions of the parties together with the judge. The analysis will be done in the light of the Federal Constitution of 1988 and CPC/2015, having as a starting point the bibliographic research and, for the conclusions that will be presented, we will use the deductive method. Em substituição aos sistemas adversarial e inquisitivo, surgiu a cooperação judicial como um novo modelo de processo, que tem como objetivo a obtenção de um processo justo, no mesmo tempo possível, garantindo, assim, aos jurisdicionados, o efetivo acesso à justiça. Apesar de em certos aspectos o processo cooperativo ainda possuir algumas características dos modelos que o antecederam, o que o diferencia dos demais é a forma como se apresenta, pois nele haverá uma verdadeira comunidade de trabalho em que todos os sujeitos processuais deverão contribuir para que se chegue o mais perto possível da verdade real e, ainda, para que o direito seja aplicado adequadamente ao caso concreto, pois somente assim poderá falar-se em processo justo. Para que o processo consiga ter o resultado almejado, que é a prestação da tutela jurisdicional justa e a pacificação social dos conflitos, é preciso que o juiz adote algumas posturas proativas, tanto na condução do procedimento como no momento do julgamento, a fim de garantir os direitos fundamentais. Com base em tais premissas, no presente trabalho será analisado o modelo cooperativo de processo, a fim de se verificar a hipótese de ser o mesmo apropriado para a legitimação da proatividade jurisdicional, em razão atuação das partes em conjunto com o juiz. A análise será feita à luz da Constituição Federal de 1988 e CPC/2015, tendo como ponto de partida a pesquisa bibliográfica e, para as conclusões que serão apresentadas, utilizaremos o método dedutivo. The first part investigates the impact of the issue over our civil procedure, concluding that such impact was significant (chapter 1), even fomenting the use of a renewed work method, which we named mais-concretismo (chapter 2). The second part seeks to put together a relevant volume of factual and theoretical elements in order to establish the normative regulation of the timing issue, which is the focus of the thesis, also relying on frequent consultations to empirical studies (chapter 3). The second part also emphasizes an alert against the hiperprincipialização phenomenon, which is also present in the Brazilian civil procedure (chapter 4). In the third and conclusive part of the thesis, a position is adopted in connection with the provisions of celerity and reasonable duration of process, both covered in article 5(78) of the Brazilian Constitution (chapter 5). In relation to celerity, the existence of the corresponding principle is confirmed, rejecting the objections that are argued against it. The reasonable duration principle, in turn, is addressed though a double perspective, namely: a) the intra-procedure or individual perspective, within which the principle reveals itself as a blank principle or a destiny-principle , as it is not subject to being balanced in view of other principles; and b) the extra-procedure or collective perspective, within which the principle collides with other principles and is subject to being balanced. Furthermore, the thesis conducts an in depth and concrete analysis of the conflictual dimension of process timing in our country mainly based on precedents from STF and STJ , at the same time indicating parameters and guidelines for the proper resolution of normative conflicts involving timing (chapter 6). Chapter 7 closes by summarizing the main aspects of the thesis. Voltada para o processo civil brasileiro, a presente tese busca abordar a questão da tempestividade processual por ângulos novos, dividindo-se em três partes, todas formadas por dois capítulos. A primeira parte investiga o impacto do tema sobre o nosso processo civil, concluindo que o impacto foi significativo (cap. 1), estimulando até a utilização de um renovado método de trabalho, que denominamos de mais-concretismo (cap. 2). A segunda parte procura coligir um grande volume de elementos fáticos e teóricos para subsidiar o trato normativo da questão da tempestividade, alvo principal da tese, valendo destacar a consulta frequente a estudos empíricos (cap. 3). Frise-se na segunda parte, ainda, o alerta contra o fenômeno da hiperprincipialização, que também no processo civil brasileiro se faz presente (cap. 4). Na terceira e decisiva parte da tese, toma-se posição no tocante às cláusulas da duração razoável do processo e da celeridade, ambas presentes no inciso LXXVIII do art. 5º da Constituição da República (cap. 5). Quanto à celeridade, confirma-se a existência do princípio correspondente, refutando-se as objeções que lhe são feitas. Já o princípio da duração razoável do processo é abordado em uma dupla perspectiva, a saber: a) perspectiva endoprocessual ou individual, na qual aparece como princípio branco ou princípio-destino , sem se sujeitar a ponderações com outros princípios; e b) perspectiva extraprocessual ou coletiva, na qual, aí sim, colide com outros princípios e se sujeita a ponderações. Além disso, mergulha-se de forma concreta na dimensão conflitual da tempestividade do processo em nosso país com apoio principalmente na jurisprudência do STF e do STJ , ao mesmo tempo em que se indicam parâmetros e diretrizes para o adequado deslinde dos conflitos normativos envolvendo a tempestividade (cap. 6). No cap. 7, enfim, tem-se a recapitulação das principais ideias da tese.

If the ultimate goal of the trial is in the judgment, by which the judge says the Jaw (jurisdictio), dispelling legal uncertainty and thus promoting social peace, other acts must also be made for the fulfillment of the mission of judging : these are the judicial administration acts, which are the subject of our study. The French concept includes the acts of judicial organization and the acts of procedural management, which provide, respectively, the proper functioning of the courts and the proper conduct of the proceedings. Despite the importance of the subject, it is little explored by jurists and we see some hesitation concerning the exact definition of the acts of the judge by scholars and in the jurisprudence. This is not desirable, however, because the judicial administration acts are subjected, according to the French law, to a different set of rules, so they are not in principle liable to the same constraints as judgments, and they cannot incur to any appeal. The Jack of ways of contesting, in addition with the adoption of a flexible system, where the head of the court has major powers in the subject, open legitimate questions concerning the respect of major principles governing the trial and the justice. Although Brazilian law does not have the French notion, the administration of Brazilian justice requires, too, the practice of judicial administration acts. The similarities related with the acts of procedural management and the significant differences in the acts of judicial organization justify the comparative method of this study, which proposes to determine the peculiarities and common features of these two legal systems and to identify what each one can learn from the other in a constant goal of development., Si le but final du procès consiste dans le prononcé du jugement, par lequel le juge dit le droit (jurisdictio), dissipant, l'incertitude juridique et promouvant ainsi la paix sociale, d'autres actes doivent également être réalisés pour l'accomplissement de la mission de juger dans des conditions satisfaisantes : ce sont les actes d'administration judiciaire, sujet de notre étude. Le concept français englobe les actes d'organisation juridictionnelle et les actes de gestion procédurale qui visent, respectivement, au bon fonctionnement des juridictions et au bon déroulement de l'instance. Malgré la portée de ce sujet, il reste peu exploré par les juristes et nous avons pu constater des hésitations quant à l'exacte qualification des actes du juge par la doctrine et la jurisprudence. Ceci n'est pas pourtant souhaitable dans la mesure où les actes judiciaires administratifs sont soumis, selon le droit positif français, à un régime différent de celui qui s'applique aux actes liés à l'activité juridictionnelle. En conséquence, ils ne sont pas assujettis en principe aux mêmes contraintes que les jugements et ne sont sujets à aucun recours. L'absence de voies de contestation liée à l'adoption d'un système souple dans un domaine où le chef de juridiction dispose de pouvoirs majeurs ouvre alors des questionnements légitimes sur Je respect des principes majeurs qui gouvernent le procès et la justice. Même si le droit brésilien ne connaît pas ladite notion française, l'administration de la justice brésilienne requiert, elle aussi, l'accomplissement d'actes judiciaires administratifs. Les similitudes pour ce qui concerne les actes de gestion procédurale et les différences significatives dans le domaine de l'organisation juridictionnelle justifient alors la méthode comparative de la présente étude qui vise à déterminer les particularités et les traits communs de ces deux systèmes juridiques et à identifier ce que chacun peut apprendre de l’autre dans un but constant de développement.

Questa tesi si propone di analisare la sentenza parziale di merito dal punto di vista del “formalismo con valori” come un modo per raggiungere una disposizione giudiziaria più veloce nel processo civile brasiliano. Per tanto è stata usata una metodologia di ricerca bibliografica e giurisprudenziale. L'obiettivo specifico del lavoro è dimostrare la possibilità della sentenza parziale di merito sul presupposto di, con sovrapposizione di richieste, uno di loro (o parte) può essere deciso senza dichiarazione conclusiva che manca, tuttavia, l’altra postulazione. Ancora sono stati affrontati due istituti simili nella legge italiana – condanna con riserva – e nella brasiliana – l’anticipazione della tutela. Inoltre il lavoro cerca di dimostrare qual è il ricorso appropriato contro sentenza parziale di merito e anche l’efficacia di quella. Infine questa tesi ha cercato di affrontare il trattamento dell'istituto nel progetto di nuovo Codice di Procedura Civile e proporre una soluzione di lege ferenda per una regolamentazione appropriata di quello. A tese visa à análise do instituto da Sentença Parcial de Mérito na Perspectiva do Formalismo-Valorativo como forma de alcançar uma prestação jurisdicional mais célere no Processo Civil Brasileiro. Para tanto, foi utilizada como metodologia a pesquisa bibliográfica e jurisprudencial. O objetivo específico do trabalho é demonstrar a possibilidade do julgamento parcial do mérito na hipótese de, havendo cumulação de pedidos, um deles (ou parte) poder ser decidido sem necessidade de instrução probatória, de que carece, todavia, a outra postulação. Ainda, foram abordados dois institutos similares no direito italiano – condenação com reserva – e brasileiro – antecipação da tutela. Além disso, busca-se demonstrar qual o recurso cabível contra a sentença parcial de mérito, assim como sua eficácia. Por fim, buscou-se abordar o tratamento do instituto no anteprojeto do novo Código de Processo Civil, propondo uma solução de lege ferenda para a regulamentação adequada do instituto. This thesis aims to analyze the Partial Sentence of Merit from the perspective of Formalism with values as a way to achieve a faster judicial provision in terms of Brazilian Civil Procedure. For that there were the bibliographical and the jurisprudential research as paper´s methodology. The specific objective on this paper is about demonstrating the possibility of partial judgment of merit on the assumption of, with overlapping of requests, one of them (or part) can be decided without conclusive statement that lacks, however, the other nomination. This thesis still addressed two similar institutes in Italian law – condemnation with reservation – and in Brazilian one – tutelage anticipation. In addition, this paper seeks to demonstrate what is the appropriate resource against partial sentence of merit, as well as its effectiveness. Finally, this thesis sought to address the treatment of the institute in the draft of the new code of Civil Procedure and it proposes a solution of lege ferenda for an appropriate regulation of the institute.

Para a consecução dessa finalidade, desenvolve-se a pesquisa partindo-se do estudo das principais tradições jurídicas do mundo ocidental (common law e civil law), cujas características primordiais e traços distintivos são ressaltados, assim como sua importância para a compreensão dos modelos processuais, especialmente os tradicionalmente a elas vinculados: o adversarial e o inquisitivo. Analisa-se, então, a tradição jurídica brasileira. Em seguida, passa-se ao exame individualizado de cada um desses modelos processuais, apresentando-se suas peculiaridades, a forma como neles se estrutura a divisão de tarefas entre juiz e partes na condução formal e material do processo, bem assim as ideologias políticas que com eles mais bem se ajustam. O modelo processual cooperativo, lastreado no princípio da cooperação, é, então, apresentado como um novo modelo, distinto dos dois anteriormente analisados. Sua marca diferenciadora, consistente na organização do processo à forma de uma verdadeira comunidade de trabalho, é realçada, ao tempo em que se demonstra a existência de manifestações tópicas de aplicação desse modelo no direito brasileiro, encontráveis tanto na legislação infraconstitucional como na jurisprudência pátria. O sistema processual civil português, em que o princípio da cooperação é previsto expressamente, também é examinado, tanto sob o ponto de vista doutrinário quanto no que diz respeito às manifestações jurisprudenciais ali encontradas. Com base em tais premissas, torna-se possível, então, a confrontação dos três modelos processuais com a Constituição Federal de 1988. Essa análise é realizada à luz dos fundamentos constitucionais da democracia participativa, da dignidade da pessoa humana, da solidariedade, do devido processo legal, do contraditório e da boa-fé objetiva, de modo a se aferir qual dentre os modelos processuais mais bem se coaduna com o ordenamento constitucional brasileiro.
