This essay revisits some of Canada's constitutional and literary history, taking as its starting point the view that the development of Canadian law and literature has been an ongoing process of national self-contemplation. It explores the disjointed nature of both projects, comparing the Privy Council's leading constitutional cases from the turn of the twentieth century with the writings of the same era's leading Canadian literary figure, Stephen Leacock. It observes that Canada's constitutional jurisprudence has historically been characterized more by its fractured quality than its rational synthesis, while its literary output has been characterized more by incompleteness and diversity than by stylistic or thematic unity. In short, it asks whether we can ever really know Mariposa--whether Canadians are capable of a coherent national discourse, or whether they are, as Robertson Davies put it, 'just too divided in attitudes and feelings and climates and everything else to have a single outlook that would work in a [constitution/novel] of the whole country.' Cet article reexamine l'histoire constitutionnelle et litteraire du Canada en avancant que le developpement du droit et de la litterature au Canada a ete un processus continu d'autocontemplation nationale. L'article explore la nature disjointe des deux projets, comparant les principaux cas constitutionnels du Conseil prive au debut du vingtieme siecle avec les ecrits d'un personnage litteraire canadien important de cette periode--Stephen Leacock. L'article souligne que la jurisprudence constitutionnelle canadienne a ete caracterisee historiquement plus par sa nature divisee que par sa synthese nationale tandis que sa production litteraire a ete caracterisee plus par son incompletude et sa diversite que par son unite stylistique ou thematique. En gros, l'article se demande si on peut vraiment connaitre la Mariposa--si les Canadiens peuvent avoir une discussion nationale coherente ou s'ils sont seulement, comme le declare Robertson Davies, <>.

Landscapes are created by people through their experience and engagement with the world around them and through their activities and movements on the ground. Human groups humanize an environment by mapping themselves onto the landscape using their knowledge of specific landforms and waterways, resources including minerals, plants and animals, and human settlements. Once established, this human imprint transforms the natural landscape into a cultural landscape and establishes a pattern of land use which can persist for generations, if not millennia. The objective of this paper is to examine and compare native perceptions and uses of landscapes using historic maps, established travel and trade routes, and ethnographic data on settlement locations for groups occupying the boreal forest and northwestern Plains of Canada. The data indicate that native perceptions of the landscape are rooted in the landforms and vegetation present in an area as well as the transportation technology available to the group. Although movement and vegetation influence the selection of landmarks on the landscape, mythology and oral traditions describe the origin and spiritual relationships of features on the landscape.
