This paper aims to examine the legal aspects of the “desaposentação” institute and its impact on society. The “desaposentação” is defined as the voluntary act of the insured who seeks reversal of the retirement they have implemented for the granting of a new benefit that is more advantageous in the same or in another pension scheme. The theme, pretty recent, has not yet been pacified by law, nor widely discussed by scholars. The feasibility to regulate this pension branch institute brings about several discussions on this topic, which shows its great complexity. The main objective of this study is to address the issues surrounding the topic, as well as the impact of their possible regulation covering their most relevant characteristics, guiding principles, strengths and weaknesses and positions of the various Courts. El presente artículo trató de analizar los aspectos jurídicos del instituto de salir de júbilo y su repercusión en la sociedad. El salir de júbilo se define como el acto voluntario del asegurado que pretende obtener la revocación de la jubilación por él ya implementada, para la concesión de un nuevo beneficio que le sea más ventajoso, en el mismo o en otro régimen de la seguridad social. El tema, considerablemente reciente, aún no ha sido pacificado por la jurisprudencia, tampoco ampliamente abordado por los doctrinadores. La viabilidad o no de regularse este instituto del ramo previsional causa diversos debates sobre el tema, que se muestra de gran complejidad. El objetivo principal del presente estudio es abordar las problemáticas que envuelven el tema, así como la repercusión de su posible regulación, abarcando sus más relevantes características, principios guía, puntos positivos y negativos y diversos posicionamientos de los Tribunales. O presente artigo buscou analisar os aspectos jurídicos do instituto da desaposentação e sua repercussão na sociedade. A desaposentação é definida como sendo o ato voluntário do segurado que visa obter a reversão da aposentadoria por ele já implementada, para a concessão de um novo benefício que lhe seja mais vantajoso, no mesmo ou em outro regime previdenciário. O tema,consideravelmente recente, ainda não foi pacificado pela jurisprudência,tampouco vastamente abordado pelos doutrinadores. A viabilidade ou não de se regulamentar este instituto do ramo previdenciário causa diversas discussões acerca do tema, que se mostra de grande complexidade. O principal objetivo do presente estudo é abordar as problemáticas que envolvem o tema, bem como a repercussão de sua possível regulamentação, abrangendo suas mais relevantes características, princípios norteadores, pontos positivos e negativos e posicionamentos diversos dos Tribunais.

OBJECTIVES: To develop the Test Your Memory (TYM)-Spanish version (TYM-S), a self-administered cognitive screening test, in a Chilean older sample and to estimate its psychometric properties and diagnostic accuracy.METHODS: The TYM was translated into Spanish and adapted for a Chilean population to develop the TYM-S. Measures of global cognitive impairment and executive dysfunction were administered to 30 controls, 30 dementia patients, and 14 subjects with mild cognitive impairment (MCI). All participants' proxies were interviewed with assessments of dementia severity, functionality in daily living activities, and cognitive change. Convergent validity and internal consistency reliability of the TYM-S were estimated. Cut-off points, sensitivity, and specificity were determined to test its diagnostic capacity for dementia or MCI.RESULTS: Regarding convergent validity, the TYM-S was significantly correlated (p r = 0.902; Addenbrooke's Cognitive Examination-Revised-Chilean version: r = 0.922; Montreal Cognitive Assessment: r = 0.923), executive dysfunction (Frontal Assessment Battery: r = 0.862), dementia severity (Clinical Dementia Rating: r = -0.757), functional capacity (Technology-Activities of Daily Living Questionnaire: r = -0.864; Pfeffer Functional Activities Questionnaire: r = -0.748; Instrumental Activities of Daily Living: r = 0.769), and cognitive change (Alzheimer's Disease 8-Chilean version: r = -0.700) measures. Regarding reliability, Cronbach's α was 0.776. Optimum cut-off scores of 39 and 44 distinguished dementia cases from controls (93.1% sensitivity, 82.2% specificity) and MCI cases from controls (85.7% sensitivity, 69% specificity), respectively. The extent of assistance required in the TYM-S and cognitive impairment was correlated.CONCLUSIONS: The TYM-S is a valid and reliable instrument to assess cognitive impairment, showing good psychometric properties and diagnostic capacity to identify cases of dementia in a Spanish-speaking older cohort. Although its need for assistance may be limiting, its ability to quickly assess several cognitive domains supports widespread clinical use.
